The Spokane County Engineering Department has reviewed the above referenced
application. The following "Conditions of Approval" are submitted to the
Spokane County Planning Department for inclusion in the "Findings of Fact,
Conclusions and Order/Decision" should the request be approved.
Prior to release of a building permit or use of property as proposed:
1. Prior to issuance of a building permit or at the request of the County
Engineer in conjunction with a County Road Project/Road Improvement
District, whichever comes first:
2. Applicant shall dedicate 9 feet on X for right of way.
3. Access permits for approaches to the County Road System shall be
obtained from the County Engineer.
4. Applicant shall submit for approval by the Spokane County Engineer
road, drainage and access plans.
5. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, location and
arrangement of parking stalls shall be in accordance with standard
engineering practices. Paving or surfacing as approved by the County
Engineer will be required for any portion of the project which is to
be occupied or traveled by vehicles.
6. The construction of the roadway improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.

7. The County Engineer has designated a Special Minor Arterial Roadway
Section for the improvement of Barker Road which is adjacent to the
proposed development. This will require the addition of asphalt
equaling 32 feet along the frontage of the development. This widening
shall be done in conjunction with the first phase of the proposal. No
Curbing and sidewalk shall be constructed at this time. The applicant
shall execute an RID/CRP Agreement for the curbing and sidewalk.
8. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge construction
and other applicable county standards and/or adopted resolutions
pertaining to Road Standards and Stormwater Management in effect at
the date of construction, unless otherwise approved by the County
Engineer.
9. The applicant shall file a petition for the vacation of the following
street or alley: Valley Way Court.
10. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 95-0498 as amended and are applicable to this proposal.
11. No construction work is to be performed within the existing or
proposed right of way until a permit has been issued by the County
Engineer. Al1 work within the public road right of way is subject to
inspection and approval by the County Engineer.
12. All required construction within the existing or proposed public right
of way is to be completed prior to the release of a building permit or
a bond in an amount estimated by the County Engineer to cover the cost
of construction or improvements shall be filed with the County
Engineer.
13. The County Arterial Road plan identifies Barker Road as a 100 foot
Principal Arterial. The existing right of way width of 60 feet is not
consistent with that specified in The Plan. In order to implement the
Arterial Road Plan it is recommended that in addition to the required
right of way dedication, a strip of property 11 feet in width along
the Barker Road frontage be set aside in reserve. This property may
be acquired by Spokane County at the time when Arterial Improvements
are made to Barker Road.
14. The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside future acquisition. Spokane
County will assume no financial obligation for adjustments or
relocation regarding these utilities. The applicant should check with
the applicable utilities and Spokane County Engineer to determine
whether the applicant or utility is responsible for adjustment or
relocation costs and to make arrangements for any necessary work.
15. The applicant shall grant applicable border easements adjacent to
Spokane County Right of Way per Spokane County Standards.

Dear Scott,
I have been contacted by Dwight I-Iume, a representative for Lou & Beverly Reillo, to perform a
brief trip distribution for the potential Reillo Retirement Center site west of and adjacent to
Barker Road between Sprague Avenue and Appleway. As I understand the project, the proposed
Reillo Retirement Center involves two adjacent parcels, the southern one zoned UR-3.5 which is
currently vacant and northern one zoned UR-7 which has been platted for mobile homes. The
tJR-7 site currently used as a mobile home park will have the mobile homes removed and the plat
vacated for the proposed project. The UR-3.5 parcel for purposes of this trip distribution '
analysis, will be analyzed at it's most intense use under the UR-3.5 zoning criteria, single-family
housing at a rate of 3.5 houses per acre. The UR-7 parcel for purposes of this irip distribution
analysis, will be analyzed under it's present use, a mobile home park. Trip generation I
characteristics for single family housing and for mobile home park as outlined in the Trip
Generation Manual, Sth Edition published by the Institute of Transportation Engineers were used
for this analysis.
Existing land use in the larger Barker Road area is residential and agricultural with other urban
land uses mixed in. Some residential developments are proposed in the area. These include
Riverwalk, Meadovwiew Terrace, Turtle Creek and Morningside Heigbts. Of these, Riverwalk
is being constructed. Of the remaining developments, only Turtle Creek is anticipated to
construct any phases within the next three years which will generate traffic into the Barker Road
Corridor

Under the proposed zoning and uses for the site, about 6 trips in the AM peak hour and about 9
trips in the PM peak hour could be expected to be generated. This is a reduction of 12 trips for
the AM peak hour and 15 trips in the PM peak hour from the potential uses of the two parcels
under existing zoning.
Based upon the trip generation characteristics of the existing site versus the proposed uses aad
site plan of this proposal, the rezoaing the site serves to lessen the impacts to the transportation
system from this site. Therefore, considering land used in the surrounding areas and the
transportation improvements needed, a fair prorata share for this development to contribute to
these improvements is zero.

Thank you for the opportunity to respond to the above referenced rezone. The
Washington State Department of Transportation (WSDOT) has the following comments:
The Barker Road/I-90 interchange currently does not have the capacity for increased traffic
that developments in this area will add. The existing capacity has been exhausted by large
amounts of development in the area. As a result, a developer funded traffic signal system
has been proposed to create additional capacity at the interchange and protect the
operational integrity of the roadway. In order for all development to be treated in a fair
and equitable manner, the applicant will need to participate in a pro-rata share of this traffic
signal systern being installed at the Barker Road/I-90 interchange. We ask that this be
placed as a condition of approval on this rezone.

SW '/4 of Section 17, Township 25 N., Range 45 E.W.M., Spokane County,
Washington.
Proposal: Zone reclassification from Urban Residential-3.5 (UR-3.5) and Urban
Residential-7 (UR-7) to Urban Residential-22 (UR-22) for a 110 unit retirement
center.
History: Aportion of the site was previously platted as Southern's Mobile Park
Addition, PE-931-75. If the proposal is approved the eYisting right of way within
the subdivision (Valleyway Avenue) will need to be vacated prior to development.
II. SITE INFOR1l~IATI0N
A. Site Size: Approximately 7.7 acres.
B. Comprehensive Plan
1. Land Use Plan: The proposal is located within the Urban category of the
Comprehensive Plan. The Urban category is intended to provide the
opportunity for development of a"citylike" environment which includes
various land uses, intensive residential development and public facilities
and services. Access to public transportation should also be considered.

Response: The proposal is within an existing development area where
utilities, arterials, schools and community facilities have already been
established.

access to the major arterial systems rather than on interior neighborhood

Response: The site is located adjacent to Barker Road. Barker Road is
identified on the Spokane County Arterial Road Plan as a Principal
Arterial. The site is also located approximately 200 feet south of
Appleway Avenue which is also identified as a Principal Arterial.
There are two bus stops located within 200 feet of the site.

careful cvnsideration mu.st be given to the density and designs of the
multiple firmily development so as to en.sirre protection of the amenities of
the single family area.
Response: The site plan for the proposal illustrates a proposed
building heibht of one story, to a maximum of 25 feet, which together

with required setbacks and landscaping will provide a buffer to
adjacent single-family uses. The low traffic volumes usually associated
with assisted living facilities also help to mitigate potential impacts to
adjacent single-family uses.
2. Arterial Road Plan: The site is located adjacent to Barker Road. The
Spokane County Arterial Road Plan Map identifies Barker Road as a
Principal Arterial. In order- to implement the plan, the Spokane County
Division of Engineering has requested nine feet of dedication alor.g Barker
Road. In addition to the required dedication, the Spokane County
Engineer is also requesting that a strip of property eleven feet in width
along Barker Road be set aside as a future acquisition area.
C. Site Characteristics: The site is generally flat and contains a number of
residences along with open areas of pasture. There are two existing homes -
located on Barker Road and seventeen manufactured homes located along
Valleyway Avenue. All homes are currently occupied. Residences on the site
will be removed prior to development. Vegetation on the site consists of
residential landscaping together with native vegetation and weeds.
D. Zoning Analysis: The zoning in the area of the proposal is a mix of Urban
Residential-3.5 (UR-3.5), Urban Residential-7 (UR-7) and Regional Business
(B-3) with UR-3.5 being the predominant zone. The proposed tJrban
Residential-22 (UR-22) zone reclassification is generally consistent with the
purpose and intent of the Urban Residential-22 (UR-22) zone as stated in
Section 14.622.100 of the Spokane County ZoninQ Code and is suPported by
being adjacent to a principal arterial and by having full range of public services
available.

Residential-7 (UR-7) established in 1991, previously classified as
Residential Mobile Home zone (RIVIH) (ZE-7-75).
North: Regional Business (B-3) established in 1991, previously
classified as Commercial (C) (ZE-129-77) and Urban
Residential-7 (UR-7) established in 1991, previously classified as
Residential Vlobile Home zone (RMH) (ZE-12-70).
South: Urban Residential-3.5 (UR-3.5) established in 1991, previously
classifed as Agricultural (A) (ZE-376-58).
East: Urban Residential-3.5 (UR-3.5) established in 1991, previously
classified as Aericultural (A) (ZE-34-62) and Agricultural
Suburban (AS) (ZE-490-59).
West: Urban Residential-3.5 (UR-3.5) established in 1991, previously
classified as A~ricultural (A) (ZE-376-58) and A~ricultural
Suburban (AS) (ZE-20-63).
E. Land Use Analysis: Land uses within the vicinity of the proposal consist of
single family residences; a manufactured home park, a post office, two churches,
vacant land and commercial uses along Appleway Avenue.

The Division recommends that these two separate parcels be aggregated to

Other Site Plan Considerations:
The site plan submitted for review by the Hearing Examiner is general in
nature. Detailed review to determine compliance with all Code
regulations and conditions of approval is recommended to be
administrative and to occur at the Building Permit stage.
G. Circulation: The proposal will be accessed from Barker Road. Internal
circulation will be provided by private driveways.

H. Drainage: A drainage plan will be required. This plan must be reviewed and
approved by the County Engineer's Division prior to development.
1. Power Transmission Lines/Other Known Easements: None illustrated. Any
required or recorded easements will be disclosed during the building permit
process.
J. Water Supply: The proposal is planned to be served by the Consolidated
Irrigation District.
K. Servage Disposal: The project will be served by a public sewer system. Plans
and specifications are to be reviewed and approved by the Spokane County
Utilities Division prior to issuance of building permit. L. School: The proposal is in the Central Valley School District. No comments
were received by the school district.
M. Fire Protection: The proposal is within Fire District No. 1. The Fire District
and the Division of Buildings Department (Fire Marshall) are required to
approve fire protection provisions prior to the issuance of building permits. N. Cultural Resources/Critical Areas: None have been identified.
III. ENVIRONMENTAL REVIEW:
An Environmental Checklist was submitted by the sponsor and was reviewed by
the Division of Building and Planning. "I`he review considered the specifics of the
proposal, other available information, County ordinances, other regulations and
laws, possible standard Conditions of Approval, the Generalized Comprehensive
Plan, and other County policies and guidelines. The Division has determined that
"No probable significant adverse impacts" would result from the proposal being
developed and has issued a Determination of Nonsic4nificance ("DNS").
The "DNS" was circulated to 14 other agencies of jurisdiction and other
. agencies/departments affected by the fiiture development for review and
comment. The "DNS" comment period ended Januarv 20. 1997 and was
advertised 15 calendar days before said date in the newspaper, by letter to
adjacent property owners within 400 feet of the proposal, and by notice on a sign
posted on the proposal site. The Hearing Examiner may consider additional
environmental related testimony at the public hearing.
IV. BUILDING AND PLANNING DIVISION SUMMARY
The proposed zone reclassification from Urban Residential-3.5 (UR-3.5) and
Urban Residential-7 (UR-7) to Urban Residential-22 (UR-22) is generally
consistent with the Goals, Objectives, and Decision Guidelines of Urban categor_y
of the Comprehensive Plan and generally complies with the development
standards of the proposed Urban Residential-22 (UR-22) zone. Landscaping and
screening requirements tobether with the proposed building height of 25 feet will

. mitigate irnpacts to adjacent uses. The Division of Buil.ding and Pla.nning
recomrnends appraval as conditioned.

The Spokane County Arr Pollufion Contro! Authority (SCAPCA) was formed under the authority of the 1967 Clean Air Act of
Washrngton (RCW) Thaf Act requrred counties, like Spokane County, to acbvate local alr pollutron control agencies. To meet
the requiremenfs of fhat Act, SCAPCA adopted regulations to control the emrssions of air contaminants from sources writhin
Spokane County.
Portions of Spokane County fail to meet federal health standards for parficulate emrssions (dust and smoke) and carbon
monoxide Numerous strategies have beAn rmplemented to reduce arr pollution emissrons so that we can improve air quality
and meet healfh standards.
Following is a list of concernslrssues thaf, af a m►nimum, nesd to be addressed for propos2d projects Additional comments
may result after more detailed information of the project is supplied. SCAPCA encourages proponsnts to contact therr offlces
at 1109 West College, Spokane, WA 99201 for additional information.
The following conditions are relevant to proposed project.
' Harvesting of timber creates silvicultural debris. This debris must be removed by methods other than
burning to the greatest extent possible. If burning is the only desired disposat method then it must be done
in accordance with all applicable regulations, and conducted in a manner that minimizes smoke related
nuisances and air pollution impacts.
* All air pollution regulations must be met.
* Air pollution regulations require that dust emissions during demolition, construction and
excavation projects be controlled This may require the use of water sprays, tarps, sprinklers or
suspension of activity during certain weather conditions. Haul roads should be treated and
emissions from the transfer of earthen material must be controlled as well as emissions from all
other construction related activities.
* SCAPCA strongly recommends that all traveled surfaces (i,e. ingress. egress, parking areas,
access roads) should be paved and kept clean to minimize emissions.

* Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto
paved surfaces. If tracking or spilis occur on paved surfaces. measures must be taken
immediately to clean these surfaces.
* SCAPCA Regulation I, Article IV may require registration with this agency depending upon the
type of business that may be established at the site. An approved Notice ofi Construction
suffices to meet this requirement. -
* SCAPCA Regulation I, Article VI, and SCAPCA Regulation II, Article IV, address air pollution
emission standards. All emission standards must be met.
* Debris generated as a result of this project must be disposed of by means other than burning
(i.e. construction waste, vegetative waste etc.).
* Demolition and renovation projects must comply with the requirements of CFR 40, Part 61, Subpart M and SCAPCA Regulation I, Article IX. Intent to Demolish forms are zvailable at the
SCAPCA office.
* All solid fuel burning devices (fireplaces wood stoves, pellet stoves, etc must comply with
local, state, and federal rules and regulations. Fireplace emission standards go into effect
January 1, 1997. New fireplaces must be tested and labeled in accordance with procedures
and criteria specified in the UBC Standard 31-2.

The following comments are in regards to the SEPA Checklist that was submitted for this zone
reclassification:
Page 3. 1 Earth h. The applicant states that the 208 storm pond system will be used -
to help reduce or control erosion that may occur on site. Stormwater disposal sYstem i.e.
infiltration areas, drywells, detention ponds, etc. do not function properly when they are filled
with fine soil from on site erosion. The applicant needs to be aware that the purpose and
function of stormwater disposal systems does not include erosion control. The applicant will
need to proposa4 can not impact any public stormwater facilities.
It appears that the proposed site is relatively flat, therefore we assume that any erosion and
sedimentation that does occur will be related to the construction practices. We recommend
the site have a construction entrance pad to reduce sediment reaching Barker Road at the
point of ingress/egress. We also recommend the site have a designated washout spot for
concrete trucks and equipment to help protect Stormwater disposal areas against premature
damage.

The Spokane County Engineering Department has reviewed the above referenced
application. The following "Conditions of Approval" are submitted to the
Spokane County Planning Department for inclusion in the "Findings of F'act,
Conclusions and Order/Decision" should the request be approved.
Prior to release of a building permit or use of property as proposed:
1. Prior to issuance of a building permit or at the request of the County
Engineer in conjunction with a County Road Project/Road Improvement

3. Access permits for approaches to the County Road System shall be
obtained from the County EngineeY.

arrangement of parking stalls shall be in Gccordance with standard
engineering practices. Paving or surfacing as approved by the County

be occupied or traveled by vehicles.
6. The construction of the roadway improvements stated herein shall be
accomplishzd as approved by the Spokane Count-y Engineer.

7. The County Engineer has designated a Special Minor Prterial Roadway
Section for the improvement of Barker Road which is adjacent to the
proposed development. This will require the addition of asphalt
equaling 32 feet along the frontage of the development. This widening
shall be done in conjunction with the first phase of the proposal. No
Curbing and sidewalk shall be constructed at this time. The applicant
shall execute an RID/CRP Agreement for the curbing and sidewalk.
8. All required improvements shall conform to the current State of
washington Standard Specifications for Road and Bridge construction
and other applicable county standards and/or adopted resolutions
pertaining to Road Standards and Stormwater Management in effect at
the date of construction, unless otherwise approved by the County
Engineer.
9. The applicant shall file a petition for the vacation of the following
street or alley: Va11ey Way Court.
10. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 95-0498 as amended and are applicable to this proposal.
11. No construction work is to be periormed within the existing or
proposed right of way until a permit has been issued by the County
Engineer. All work within the public road right of way is subject to
inspection and approval by the County Engineer.
12. All required construction within the existing or proposed publi-c right
of way is to be completed prior to the release of a building permit or
a bond in an amount estimated by the County Engineer to cover the cost
of construction or improvements shall be filed with the County
Engineer.
13. The County Arterial Road plan identifies Barker Road as a 100 foot
Principal Arterial. The existing right of way width of 60 feet is not
consistent with that specified in The Plan. In order to implement the
Arterial Road Plan it is recommendad that in addition to the required
right of way dedication, a strip of progerty 11 feet in width along
the Barker Road frontage be set aside in reserve. This property may
be acquired by Spokane County at the time when Arterial Improvements
are made to Barker Road.
14. The applicant should be advised that there may exist utilities either
underground or overhead affecting the applicants property, including
property to be dedicated or set aside future acquisition. Spokane
County will assume no financial obligation for adjustments or
relocation regarding these utilities. The applicant should check with
the applicable utilities and Spo'{ane County Engineer to determine
whether the applican-L. or utility is responsible for adjustm2nL or
relocation casts and to make arrancements ior any necessGry woYk.
15. The applicanc shall grant applicable border easzments adjacent to
Spokane County Right of Way per Snokane County Standards.
