review of the zone reclasstfication apphcation and the entue record, and finding good cause
therefore hereby makes the following findmgs of fact, conclusions of law and decision
I FINDINGS OF FACT
1 The application requests a rezone of 1 04 acres of land from the Urban Residential-3 5(UR- ~
3 5) zone to the Urban Residential-22 (UR-22) zone, for the development of offices
2 The site is located along the west side of Evergreen Road, immediately southwest of the
intersection of Evergreen Road and Boone Avenue, in the NE '/4 of Section 15, Township 25
North, Range 44 EWM, Spokane County, Waslungton
3 The srte is currently referenced as County Assessor's tax parcel no 45151 1212 The
subject properry is legally descnbed as the East 323 feet of Tract 104 of Vera Addition, per plat
recorded at Book "O", Page 30 of Plats, records of Spokane County Audrtor, EXCEPT the
South 182 18 feet, TOGETHER WITH the East 323 Feet of the South Half of Tract 101 of Vera
Addition lying south of the North 310 feet, EXCEPT County Road, Spokane County,
Waslungton

11 The site is approximately 1 04 acres in size and is relatively flat in topography The easterly
portion of the site is improved with a two-story, single-fanuly home and large garage/storage
building, which access Evergreen Road
12 The site plan of record subnutted on May 20, 2002 illustrates conversion of the existing
residence on the site into a professional office building with a 1,800-square foot addition added
to the building in phase I of the development, and a 2,100-square foot addition added to the
building in phase II of the development After completion of phase II, the office budding will
have approximately 6,000 square feet of office space The new additions will be single-story
approximately 16 feet in height, and constructed on the west side of the remodeled residence
13 Required parlung will be installed in the rear yard of the building, with access provided via a
dnveway along the southerly portion of the property connecting to Evergreen Road The
westerly tlurd of the building will mclude drwnage unprovements and landscaping The srte plan
illustrates required penmeter landscaping along all boundanes, except for the east boundary facmg
Evergreen Road The site plan fwls to illustrate the 6-foot high screerung required by the UR-22
zone along the east and south boundanes of the site, adjacent to UR-3 5 zoning
14 Effective January 1, 1991 the zorung of the site was reclassified from the Agncultural zone
of the now expired County Zomng Ordinance to the Urban Residential-3 5(iJR-3 5) zone under
the Program to Implement the Spokane County Zomng Code The srte is also located in the
Aquifer Sensitive Overlay zone and the Public Transit Benefit Area designated by the Zomng
Code
15 The current rezone application environmental checklist, site plan of record and application
fees were submitted on May 20, 2002
16 Effective January 15, 2002, the County implemented a new comprehensive plan ("GMA
Comprehensive Plan'), Capital Facilities Plan, County Urban Growth Area (UGA) boundanes,
and Phase I Development Regulations, all pursuant to the State Growth Management Act
(GMA) The County also repealed the interim development regulations previously adopted by the
County under the State Growth Management Act See County Resolution No 2-0037 Mulor

revisions were made to the Phase I Development Regulations on May 7, 2002 See County
Resolution No 2-0470
17 The Phase I Development Regulations designate the srte and neighbonng land located along
the west side of Evergreen Road in the Mixed Use category of the GMA Comprehensive Plan,
and in the County UGA Such regulations retained the existing zoning of the srte and such
neighbonng properties
18 The Phase I Development Regulations require all zone reclassification applications in the
Mixed Use category to be consistent with the GMA Comprehensive Plan, and lmut such
applications in the Mixed Use category to the Urban Residential-12 (UR-12) Urban Residential-
022 ([JR-22), Neighborhood Business (B-1), Commuruty Business (B-2) and Industnal Park (I-1)
zones
19 The GMA Comprehensive Plan designates Evergreen Road as an Urban Pnncipal Artenal
Such road was recently improved to a 5-lane artenal road section A freeway interchange was
recently constructed at Evergreen Road and Interstate 90 approxunately one-half rrule northeast
of the subject property The recently developed Spokane Valley mall lies northeast of the
mterchange
20 Neighbonng land uses and zorung are accurately listed in the Staff Report In 1999, two (2)
acres of land located between the site and Broadway Avenue to the south was rezoned from the
UR-3 5 zone to the UR-22 zone, for the development of professional, business or medical offices
See Heanng Examiner decision in File No ZE-10-99 In 1998 2 3 acres of land located duectly
north and northwest of the site were rezoned from the UR-3 5 zone to the UR-22 zone, to allow
development of multi-fanuly dwellings and expansion of a retirement facilrty zoned UR-221ocated
directly north of such acreage See Heanng Exanuner decision in File No ZE-26-98
21 The Staff Report accurately analyzes the consistency of the proposal with the GMA
Comprehensive Plan the County Zorung Code and other development regulations The Exarruner
hereby adopts and incorporates such analysis by reference as findings of fact herein The only
development standards of the Zorung Code that the proposal does not meet is the lack of 20 feet
of Type III landscaping along the frontage of the site, and the lack of required screening along the
south and east property lines The conditions of approval will rectify such deficiencies
22 The proposal wnll be provided with a high level of public sernces and facilrties, including
public sewer and water The pertinent purveyors have issued sewer and water concurrency
certificates for the proposal County Engineenng has deferred issuance of such certificate until a
specific office use is defined for the subject property
23 Neighbonng property owners did not comment on the proposal No public agencies
objected to the proposal
24 The proposal has been conditioned for compliance with the development standards of the
UR-22 zone and other applicable provisions of the County Zorung Code, and the

recommendations of the commenting public agencies As conditioned, the project will be
reasonably compatible with, and not have a sigruficant negative impact on, neighbonng land uses
25 No public agencies objected to the Deternunation of Nonsigmficance (DNS) issued for the
proposal by the County Division of Planrung
26 Changed conditions have occurred smce the zorung of the srte was re-designated to the
UR-3 5 zone on January 1, 1991, pursuant to the Program to Implement the Spokane County
Zorung Code Ttus includes the availability of public sewer in the area, recent road improvements
to Evergreen Road and its interchange with I-90 recent rezones to the UR-22 along the west side
of Evergreen Road near or adjacent to the site increased residential growth in the area, and
increased traffic in the area
Based on the above findings of fact, the Heanng Examiner enters the follovving

1 The proposed rezone, as conditioned, conforms to the GMA Comprehensive Plan
2 The proposed rezone, as modified and conditioned, bears a substantial relationshup, and vvill
not be detrunental, to the pubhc health, safety or welfare
3 A change in econorrnc, technological, or land use conditions has occurred to warrant the
proposed rezone as modified and conditioned A substantial change of circumstances has
occuned in the area since the srte was last zoned
4 The procedural requirements of the State Environmental Policy Act and the County's Local
Environmental Ordinance have been met The proposal, as conditioned and modified, will not
have a sigruficant, probable adverse impact on the environment
5 The proposed rezone as conditioned, complies vvith the UR-22 zone, the County Zorung
Code and other applicable development regulations
6 The proposed rezone, as conditioned, meets the cntena established by Waslungton case law
for approving a rezone, and the cntena established in paragraphs 14 402 020 (1)(2) of the County
Zorung Code for amending the County official zorung map
7 Approval of the land use application is appropnate under section 11 of the County Heanng
Examuier Ordinance adopted by County Resolution No 96-0171

Based on the above Findings of Fact and Conclusions of Law, the application for a rezone
to the Urban Residential-22 (UR-22) zone, for the development of offices, is hereby approved,
subject to the conditions of approval of the public agencies stated below

Any condrtions of such agencies that have been added or significantly revised by the Heanng
Exanuner are italicrzed
Failure to comply with the conditions of tlus approval may result in revocation of tlus
approval by the Heanng Examiner Tius approval does not walve the applicant's obligation to
comply with all other requuements of other agencies with junsdiction

1 All conditions imposed by the Heanng Exa.miner shall be binding on the "Apphcant," which
term shall include the owner and developer of the property, heus, assigns and successors

5 The proposal shall be developed in substantial conformance to the srte plan of record
submitted on May 20, 2002, subJect to compliance with conditions of approval and development
regulations The Duector of the Division of Planrung/designee may adnurustratively approve
rrnnor revisions to the site plan, as provided in Section 14 504 040 of the County Zorung Code, as
amended All other revisions shall be subrrutted to the Heanng Exanuner at a public heanng
through a change of conditions appLcation
6 Approval is required from the Director of the Division of Plammng/designee of a specific
lighting and sigrung plan for the descnbed property pnor to the release of any building pernut
7 Direct light from any extenor area lighting fixture shall not extend over the property
boundary
8 A specific landscape plan, planting schedule and provisions for the maintenance acceptable
to the Director of the Division of Planning/designee shall be subrrntted with a performance bond
or other surtable guarantee for the project pnor to release of any building pernuts Landscaping
shall be installed and maintained so that sight distance at access points is not obscured or
impwred

, Urban Land Policies UL 12 2, UL 12 3 and UL 1g 4 state that Mixed-use areas will include a
variety of high density housing and employment 4o support transi4 service, a full range of retail
goods and services with a with an emphasis on community-serving rather than regional servmg
commercial uses and will prohibit commercial uses that require large land areas with low
employment densities such as warehouses, auto dealerships, etc A professional office building
wili accommodate professional service providers that will meet the professionai service needs of
the surrounding community
Urban Land Policy UL 12 5 states that implementation of Nlixed-use areas should only occur after
the adoption of a subarea plan that involves design professionals, government service providers
business people and community residents A subarea planning program involving the subJect
property and surrounding properties has not been implemented Regardless of Pdicy UL 12 5, the
Mixed Use designation in which the subject property is located was adopted as part of the new
Comprehensive Plan and established without benefit of the subarea planning process Since the
subject property is located in a Mixed Use designation Section il, Zone Reclassification
Applications, of the Phase I Development Regulations states that applications for amendments to
the Spokane County Zoning Map initiated under Section 14 402 100(1) of the Spokane County
Zoning Code shall be limited to reclassifications that are consistent with the Comprehensive Pian
category and associated implementing zone as provided in the table attached to the Regulations
The table identifies the implementing zones for the Mixed-use Category to include the Urban
Residential-22 (UR-22) Zone The existing UR-3 5 Zone is not listed in the table as a zone
implementing the Mixed Use category
Capital Facilities and Utilities Goal CF3 and Policy CF 3 1, taken together specifiy that public
facilities and services must have the capacity to support proposed development at established
Levels of Service and is consistent with public water and sewer system planning Transportation
Goal T2 specifies that transportation system improvements mud be provided concurrent with new
development and consistent with adopted land use and transportation plans The application for
the proposed zone reclassification is consistent with sewer water and transportation concurrency
requirements The water and sewer service providers have certified that adequate water and
sewer services are available to meet the needs of the proposai The Division of Engineering has
stated that Evergreen Road will accommodate the traffic generated by the proposai and that a
Transportation Certificate of Concurrency will be issued at the time buiiding permits are issued
Policy CF 8 1 requires stormwater management systems for new development within the Urban
Growth Area (UGA) The Site Plan of Record identifies proposed stormwater management areas
Additionally, the proposal as conditioned will comply with Spokane County Stormwater
Nlanagement Guidelines In summary, the proposal as conditioned is generally consistent with
the Policies of 4he Mixed Use Transportation and Capital Facilities Chapters of the
Comprehensive Plan
Zoning The purpose of the Urban Residential-22 (UR-22) Zone is to set standards for orderly
development of residential property in a manner that provides a desirable living environment that
is compatible with surrounding land uses and assures the protection of property values It is the
intent of this zone to be used to add to the variety of housing types and densities and as an
implementation tool for the Mixed Use category of the Comprehensive Plan General
characteristics of these areas include paved roads, public sewer and water, accessibility to
schools and libraries, and a fuli line of public services including manned fire protection and public
transit accessibility The highest density residential zone, UR-22, is intended pnmarily for
multifamily dwellings and is usually located adJacent to maJor or secondary arterials It is used as
a transition between low and medium density multiple family uses and intensive commerciai or
low intensity industrial uses and to provide for a higher density housing in locations close to
employment, shopping and maJor transportation routes where movements of people can be
handled efficiently and with the least overall adverse impacts

the Spokane County Gode. 'I'he fees will be based on actual salary costs incurred by Spokane

be billed monthly as accrued. Any billing amaunts due, including any expenses_ incurred in the
callection of an overdue aceount, must be paid prior to the County `s acceptance of the project for
filing. If a project is appr+aved andla►r ~iled with a balance still owing, the unpaid balance shall be
paid within 34 days of t.he invoice date.
2. The undersigned agrees that these fees are due and payable upon receipt of the billing as specified

3. Any inVaices not paid within 30 days of the invaice date will be considered delinquent. If any
vutstanding balarice on the account for this project is nvt paid within 30 days of the invoice date,
no furthear revievws of the project documents will be canducted until the entire account balance is
paid. Any balance on the account for this project not paid within 65 days of the invaiee date may
result in legal action or the initiation of Qther collection procedures, includ', -,-fcrral to a
