Site gDescriptaon The sub~ect property is approximately 2 28 acres in size and relatively flat
Evergreen Road and Mamer Road provide duect access to the site There are no curbs or
sidewalks along the frontage of the site wnth such roads A single-family residence, barn, and
single-wide mobile home used as a temporary on-site contractor's office and workshop are
currently located on the subject property
Surrounding Conditions Evergreen Road adjacent to the site and Broadway Avenue to the
north are designated as Pnncipal Artenals by the County Artenal Road Plan 1Vhssion Avenue to
the north is designated as a Minor Artenal The land lying north of the site is zoned UR-22 and
developed with multi-family housing in the form of a retirement center The other land
surrounding the srte is zoned UR-3 5 and developed for single-farruly homes Urban Residennal-
7(LTR-7) zones developed with housing consistent with such zoning are found southeast of the
site across Evergreen Road Some Urban Residenhal-12 (UR-12) and UR-22 zones improved
with multi-family housi.ng are located a block northwest of the site along Blake Road A
Neighborhood Business (B-1) zone is found a few blocks south of the site, at the northwest
corner of Broadway Avenue and Evergreen Road The County is plammng to widen Evergreen
Road in the area to a 5-lane section in the near future Valley General Hospital and numerous
medical offices are found some distance west of the site between Pines Road and McDonald
Road, along and south of Mission Avenue
Pro,ect I)escriphon The application requests a rezone of 2 8 acres to the UR-22 zone to
allow expansion of the retuement center located immediately to the north The site plan of
record submitted by the applicant on March 30, 1999 shows 2 two-story multi-family buildings
aligned east to west, which would be developed for a total of 48 rehrement/elderly apartments
The site plan also shows six (6) structures labeled as "stall garage", and 2 parlang spaces
designated for handicapped parking The site plan is mtegrated with the existing retuement
center to the north, which is under the same ownership The proposed vanances would allow 6-
foot high sight-obscunng fencing to be extended into the front and flanking street yards of the
current site, wluch would connect to sinular fencing m the front and flankmg street yards of the
existing retirement center to the north The existing structures on the site will be removed to
accommodate the project
The site plan shows a 25-foot wide stnp of Type III landscaping along the Evergreen Road
frontage, and a 35-foot wide stnp of Type III landscaping along the Mamer Road frontage A 5-
foot wide stnp of Type III landscaping is illustrated along the south boundary line of the site,
adjacent to the UR-3 5 zone lying to the south The site plan shows a 6-foot sight-obscunng
fence located 5-10 feet within the front yard of the site along Evergreen Road, and along the
south boundary line of the site The site plan fails to show the 6-foot high fencing outside the
flanking yard setback, but such fencing is illustrated 5-10 feet inside the flanking street yard on a
previous site plan dated February 17, 1999

no presumption in favor of the rezone, 2) the applicant for the rezone must prove that condihons
have substantially changed in the area since the Iast zorung of the property, and 3) the rezone
proposal must bear a substanhal relationship to the public health, safety or welfare Parkridge v
Seattle, 98 `Vn 2d 454, 462, 573 P 2d 359 (1978), and Bjarnson v Katsap County, 78 Wn App

The County Heanng Examiner Ordmance authonzes the Heanrig Exanuner to grant, deny
or grant with such condihons, modifications and restncttons as the Examiner finds necessary to
make a land use application compahble with the Spokane County Generalized Comprehensive
Plan and applicable development regulations See County Resolution No 96-0171, Attachment
"A", paragraphs 7(d) and sechon 11, and RCW 36 70 970 Development regulations include
without limitation the County Zomng Code, the State Envuonmental Policy Act (SEPA) and the
County's Local Environmental Ordmance (chapter 11 10 of the Spokane County Code)
Section 14 402 020 of the Zomng Code authonzes amendments to the Code based on any
one of 6 grounds, without differentiating between zorung text revisions and amendments to the

The site is designated in the Urban category of the Comprehensive Plan The Division of
Building and Planrung found that the proposal generally conformed to the policies of the Urban
category and that the project unplements the purpose and intent of the UR-22 zone expressed in
the Zomng Code The Examiner agrees with such analysis and hereby adopts and incorporates
by reference the analysis contained on pages 4-5 of the Staff Report regarding the consistency of
the project with the Comprehensive Plan, as findmgs of fact and conclusions herein.
Area residents expressed concerns regarding the project, including the proposed 2-story
height of the buildings in the project, increased traffic along Mamer Road resulting from
improvements to Evergreen Road and development of the project, particularly dunng the
construction of the project, land use compatibil2ty with single-famlly residences and other
concerns
The record indicates that the residents objecting to the building heights in the project reside
well south of the site along Mamer Road, and would not be impacted that much by the proposed
2-story structure height To rrutigate buildulg height concerns, the Examiner has added a

condition restnchng the height of the westerly building illustrated on the site plan to 30 feet
Thls compares to the maximum buildmg heights allowed in the UR-22 zone and UR-3 5 zone
respectively of 50 feet and 35 feet The easterly building, which fronts along Evergreen Road, is
proposed to be 2 stones Two stones can be accommodated within much less than 50 feet of
height, probably wnthun 35 feet
Setuor housing typically generates much less peak hour traffic than general mulh-housing
There is no evidence that any levels of service on the roads servmg the project would be
sigruficantly impacted by the project County Engineenng conditions require the applicant to
widen Evergreen Road along the frontage of the site, and add curb and sidewalk, in accordance
with a special5-lane artenal road sechon designated for the unprovement of such road The
applicant is also required to widen, and add curb and sidewalk, along the frontage of the site with
Mamer Road The County is already planning to widen Evergreen Road in the area to 5 lanes in
the next few years, and construction traffic associated with such improvement would occur with
or without the project
The project meets the locational cntena for multi-family housmg recommended by both the
Comprehensive Plan and the UR-22 zone It is located along a Pnncipal Artenal and close to
major transportation routes, shoppvng and employment The location is also enhanced by the
proximity of the project to Valley General Hospital and medical offices located to the west
Retirement centers are typically good neighbors in single-family residenhal settmgs The project
is buffered from nearby residences by ample landscaping and sight-obscurmg fencing, and is
reasonably compahble with adjouung land uses The proposal represents an expansion to the
existing retirement center located to the north
The project is conditioned for compliance with the UR-22 zone and other applicable
provisions of the Zorung Code The density (net) of the project slightly exceeds the maximum
density allowed in the UR-22 zone of 22 uruts per acre However, when consolidated wnth the
adjacent property zoned UR-22, the density of the combmed proJ ect is witlun the maximum
density allowed in such zone
The procedural requirements of chapter 43 21 C RCW and chapter 11 10 of the Spokane
County Code have been met The Heanng Examiner concurs with the Deternunation of
Nonsignificance issued by the Division of Building and Planmng No adverse comments were
received from public agencies or area residents that establish sigruficant, probable adverse
environmental impacts, and dictate a need for withdrawal of the environmental determinahon
C Conditions in the area in which the propertv is located have chanized substantiallv since the
nronertv was last zoned
In applying the changed cucumstances test, courts have looked at a vanety of factors,
including changed public opiruon, changes in land use patterns in the area of the rezone proposal,
and changes on the property itself The Zoning Code references changes in "economic,
technological or land use conditions" as factors that will support a rezone Spokane County
Zoning Code Section 14 402 020 (2) Washington courts have not required a"strong" showing
of change The rule is flexible, and each case is to be judged on its own facts Bassanr v County
Commissioners, 70 Wn App 389, 394 (1993) Recent cases have held that changed
circumstances are not required for a rezone if the proposed rezone implements policies of a

As discussed above, the proposal is generally consistent with the Comprehensive Plan
Numerous changed condihons support the pro1ect, mcluding the 1995 rezone of the property
lying north of the srte to the UR-22 zone for development of a retuement center, planned
unprovements to Evergreen Road, the expansion of the medical distnct west of the site, the
recent approval of other rehrement housing in the general area, increased demand for seruor
housing in the Spokane area, and the availabillry of public sewer

required by the County Zoning Code See Zonuig Code 14 622 365 Penmeter fencing is
justified for the project, to provide secunty and to protect semors from mcreased traffic along
Evergreen Road The Examiner does not find the location of sunilar fencing in the front and
flanking yards of the adjacent retLrement center to be a significant factor in favor of the current
vanance The record indicates that such fencing was allowed without a vanance based on an
erroneous interpretation by County Division of Buildmg and Planiung staff that such fencing was
"nonresidential" See Zorung Code 14 810 020 (7)
The Examiner does find the property to be disadvantaged due to the extraordinary amount of
nght of way requested by the County Englneer for the improvement of Evergreen Road, i e 50
feet along the frontage of the site From an aestherics viewpoint, contnuation of the sight-
obstructing fencing in the front yard of the project along the same line as the adjacent retirement
center is desirable Multi-family housing is typically found along Pnncipal artenals lilce
Evergreen Road The proposed vanance otherwise meets the cntena needed for a vanance, as
discussed in the Staff Report on pages 5-7
The proposed sight-obstructing fencing is less justifiable in the flanking street yard, where
the Examiner finds lt more important to preserve the lateral line of sight from the front yards of
residences located along Mamer Road, a Local Access street pnmanly serving single-family
homes Such vanance would be detnmental to the public health, safety and welfare, and is
therefore derued
IV DECISION,
Based on the Findings of Fact and Conclusions above, the above applicahon for a zone
reclassification and the above application for a vanance from sight-obstruchng fencmg height
allowed in the front yard are hereby approved, subJect to the condihons of the vanous public
agencies specified below The application for a vanance from sight-obscunng fencing height
allowed in the flanking street yard is hereby dented The conditions of approval recommended

shall retain the nght, as authonzed under RCW 36 88 090, to object to any assessment(s) on the

either the petition or resolution method under Chapter 36 88 RCW and to appeal to the Supenor
Court the decision of the Board of County Commissioners confirmmg the final assessment roll,

DescriAtion of the Site: The subject property is approximately 2.28 acres in size and relatively
flat. Evergreen Road and Mamer Road provide direct access to the site. There are no curbs and
sidewalks along the frontage of the site. The existing structures on the site consist of a single
family residence, a bam and a single-wide mobile home used as a temporary on-site contractor's

office and workshop. The applicant has indicated that all existing structures will be removed to
accommodate the proposed multifamily buildings and garages.
Backqround: The application for the proposed zone reclassification was submitted to the
Division of Building and Planning on December 31, 1998, and received "Counter Complete"
status on January 15, 1999. A Technical Review Meeting was held on January 20, 1999, where
the applicant was notified that the proposal was "Technically Incomplete." On February 19, 1999,
the proposal received "Technically Complete° status.
Staff Analvsis:
Comprehensive Plan: The subject property is designated as Urban by the Spokane County
Comprehensive Plan. The Urban Category is intended to provide the opportunity for
development of a"city-like" environment which includes various land uses, intensive residential
development, public facilities and services. Since Urban areas will be the most intensely
developed of all the categories, it is primarily a residential Category of single-family, two-family,
multifamily, and condominium buildings along with neighborhood commercial, light industrial, and
public and recreational facilities. Urban areas will have public water systems, sanitary sewer
systems, storm sewer systems and utility systems such as electrical, telephone, gas, and cable
services. Streets will be curbed and paved. Street lights and sidewalks will be common to
residential, public and commercial areas. The subject property is located along Evergreen Road,
a Principal Arterial, and will be served by public services including public water and sewer and is
compatible with the surrounding land use.
Goal 1.1 of the Urban category is to "Encourage a variety of housing types and densities."
Objective 1.1.a. is to: "Promote fill-in within established development area and existing outlying
communities where utilities, arterials, schools and community facilities have already been
established." Specifically: Decision Guideline 1.1.1 states that: "Urban development will be
approved in areas having adequate power supplies, water, sanitary and storm sewers, streets,
and school and fire services provided that such development meets the intent of other Objectives
and Decision Guidelines of this section." Qbjective 1.1.b states that: "Higher-density
developments such as multifamily and mobile home (manufactured homes) parks should be
located with direct or near direct access to the major arterial systems rather than on interior
neighborhood streets. Access to public transportation should also be considered." And Objective
1.1.c states that: "When multifamily dwellings are to be located adjacent to single-family areas,
careful consideration must be given to the density and designs of the multiple family development
so as to ensure protection of the amenities of the single-family area.° Specially, Decision
Guideline 1.1.e states that: °A multifamily dwelling structure exceeding three (3) residential units
or a development of such structures or manufactured homes (except those on single-family lots)
should: a) locate adjacent designated arterials; b) locate near existing or planned transit routes; c)
improved or maintain the consistency of adjacent single-•family area amenities." Review of the site
plan of record indicates that the subject property has adequate off-street parking and has access
to the public transit route along Mission Avenue and Broadway Avenue.
Goal 1.5 of the Urban category is to "Encourage a healthful and pleasing environment in the
County's residential areas." Objective 1.5.a states that: "New residential or multifamily-family
development should be buffered from existing adjacent land uses where adverse effects may
develop." Specifically, Decision Guideline 1.5.1 states tha#: Buffering and/ or landscaping will be
used to mitigate the difference between proposed developments and existing uses." Decision
Guideline 1.5.2 states that: "Landscaping may be required to provide a healthful and pleasing
residential environment." Objective 1.5.f is to "Consider the profile, especially height of the

existing neighborhood when evaluating multifamily developments." Specifically, Decision
Guideline 1.5.7 states that: °Before approving any multifamily housing or manufactured home
development proposals, it should be determined that such development will enhance the
residential character or aesthetics, or will improve residential values of the area."
This proposal is generally consistent with the Goals, Objectives and Decision Guidelines of the
Urban Category in that the site will be served by a full line of pubtic services. Conditions of
approval will be included to mitigate traffic impacts and design of the site will provide for a buffer
to adjacent land uses.
Zoning Code:
The purpose of the Urban Residential-22 (UR-22) zone is to set standards for the orderly
development of residential property in a manner that provides a desirable living environment that
is compatible with surrounding land uses and assures the protection of property values. It is the
intent of the UR-22 zone to be used to add to the variety of housing types and densities, and as
an implementation tool for the Comprehensive Plan Urban Category. The highest density
residential zone, UR-22 is intended primarily for multiple-family dwellings and is usually iocated
adjacent to major or secondary arterials. It is used as a transition between low or medium density
multiple-family uses and intensive commercial or low intensity industrial uses and to provide for
higher density housing in locations close to employment, shopping and major transportation
routes where movements of people can be handled efficiently and with least overall adverse
impact.
Existing zoning in the surrounding area is a mix of Urban Residential-3.5 (UR-3.5), Urban
Residential-7 (UR-7), Urban Residential-12 (UR-12), and Urban Residential-22 (UR-22).
This proposal is generally consistent with the purpose and intent of the Urban Residential-22 (UR-
22) zone, compatible with surrounding zoning, and serves to implement the Urban
Comprehensive Plan category.
Other land use activities in the general area of the proposal includes approved zone
reclassification ZE-7-96, from Urban Residential-3.5 (UR-3.5) to Urban Residential-22 (UR-22)
and ZE-61-97, from Urban Residential-3.5 (UR-3.5) and Urban Residential-22 (UR-22) to Urban
Residential-22 (UR-22); and approved final short plat SP1057-96, SP-1063-96 and SP-1161-97.
These actions can be considered as changed conditions under Section 14.402.020.2 of the
Zoning Code.
Section 14.810.020 (Fences) of the Spokane County Zoning Code states that: "No sight-
obstructing fence more than thirty-six (36) inches in height nor any non-sight-obscuring fence
(cyclone) more than forty-eight (48) inches in height may be erected and/ or maintained within the
required front yard or required flanking street yard of any lot used for residential purposes." The
applicant is requesting a variance to allow construction of a 6-foot sight-obscuring fence in the
front yard setback along Evergreen Road and Mamer Road.
Section 14.404.081 (Intent) of the Zoning Code recognizes that circumstances may exist such
that strict application of the Zoning Code may cause practical difficulties regarding the use of the
property. Upon demonstration to the Hearing Examiner by the property owner of circumstances
which create practical difficulties, the Hearing Examiner may grant a variance from the provisions
of the Zoning Code.

In order for a variance request to receive approvai, compliance with Section 14.404.082 (1-3) of
the Zoning Code must be demonstrated by the applicant. Any variance from the terms of the
Zoning Code shall be subject to those conditions specifically identified in Section 14.404.082 (1 a
&b). Analysis of the proposal with regards to Section 14.4.04.082 (1 a& b) is as follows:
Response to 14.404.082(1 a): The applicant has stated that because of the need for security,
noise reduction, privacy and consistency in design, it is essential that the proposed fence be
similar in height, construction and alignment with the existing fence and wall of the adjacent
multifamily retirement center and would minimize the difficulty in constructing the proposal without
the use of a variance.
Response to 14.404.082(1 b): The applicant has responded to question D on the Variance
Burden of Proof form by stating that the proposed variance will not be harmful to the public
welfare nor injurious to the property or improvements within the vicinity of the property.
The following analysis of Section 14.404.082(2 & 3), while not to be considered as sole
substantiation, shall be considered in the granting of a variance:
Response to 14.404.082(2a): Strict application of the Zoning Code standards does create an
unreasonable burden in light of the unique environment and physical characteristics of the subject
property and the adjacent multifamily retirement center.
Response to 14.404.082(2b): Relaxation of fence limitation within the required front yard will not
allow a more environmentally sensitive, energy conserving design or result in the adaptive reuse
of a historic property.
Response to 14.404.082(2c): A broader public or community need or interest will be served by
granting the variance as opposed to denying the application.
Response to 14.404.082(3a): The granting of the variance will not be based upon a precedent
established by illegal or non-conforming circumstances.
Response to 14.404.082(3b): No precedent will be established which will adversely affect the
zoning concept for the existing neighborhood or the County as a whole.
Response to 14.404.082(3c): Granting of the variance will not be based on lack of economic
return.

. Summary: The requested variance from the fence standards of Section 14.810.020 of the
Spokane County Zoning Code is based on special circumstances applicable to the subject
property and the adjacent multifamily retirement center. Therefore, strict application of the Zoning
Code fence standards will create an unreasonable burden on the applicant. The Division of
Building and Planning recommends approval of the variance.
Site Develonment Plan Review:
The site plan of record shows two (2), two-story multifamily buildings, which will consist of a total
of 48 retiremenU elderly apartment-like units. The site plan also shows six (6) structures labeled
as "Stall Garage" and finro (2) spaces designated for handicapped parking. The site plan shows a
25-foot wide strip of Type III landscaping along the site's Evergreen Road frontage and 35-foot
wide strip of Type III landscaping along site's Mamer Road frontage. In addition, the site plan
shows a 5-foot wide strip of Type III landscaping along the south boundary line of the site,
adjacent to the Urban Residential-3.5 (UR-3.5) zone. The site plan shows a proposed six (6) foot
sight-obscuring fence along the site's Evergreen and Mamer Road frontage and along the
southern boundary line of the site.

5. To construct the roadway improvements stated herein, the applicant may, with the approvai of
the County Engineer, Join in and be willing to participate in any petition or resolution which
purpose is the formation of a Road Improvement District (Rl D) for said improvement pursuant to
RCW 36.88, as amended. Spokane County will not participate in the cost of these
improvements. This provision is appl+cable to Evergreen Road.
6. As an alternative method of constructing the road improvements stated herein, the applicant
may, with the approval of the County Engineer, accomplish the road improvements stated
herein by joining and participating in a County Road Project (CRP) to the extent of the required
improvement. Spokane County will not participate in the cost of these improvements. This
provision is applicable to Evergreen Road.
7. The construction of the roadway improvements stated here+n shall be accomplished as

The following conditions are relevant to proposed ProJect
• Harvesting of timber creates silvicuitural debris. Consisient with State po(icies and regulations, altematives to
buming should be examined. The preferred attemate dispasal methods in the following order are; slash
production minimization, slash uU1ization, non-buming disposal arld sitviwftural buming. If buming is ttte only
reasonab(e disposal method then it must be done in accordance with a!( applicable regutaGons, and condude-d
in a manner that minimizes smoke related nuisances and air poqution impacts.
• Washington State Regulafion 173-400-110 requires that a Notice oi Consiruct;on and APpliczbon for Approval
be submitted to and approved by our Agency prior to the coristruetion, instaflation or establishment of an air
pollution source. tt is posslble that the fo(Iowing air pollution sources may be pfesent at the proposed
facility: .
~ One or more fossil fuei (natural gas, Propane, butane, diesel, fuel oil, or waste oil) or wood
burning heat sourees. Natural gaslpropane/butane burning boilers, heating units, or hot

~ One or more fossil fuel (natura) gas, propane, butane, dlesel, fuel oi1, or waste oil) or wood
burning heat sources. Natural gas/propane/butane buming boilers, heating units, or hot
water heaters, or combinations thereof, with a total heat input of 4,000,000 Btuslhr are
required to apply for a Notice of Construction. Other units are required to apply for a NOC
when the total heat input excesds 400,000 Btuslhr. ln addition, additional requirements
such as controls for Nitrogen Oxide emissions (NOx) and source testing may be required
depending upon the size of the unit.
~ One or more Stand by Generators. SCAPCA requires 2 Natice of Construction for all Stand
by Generators that are rated greater ihan or equal to 500 mechanica{ horsepower (375
Kilowatts).
• There are numerous businesses that are aitowed in a commercial and industriai zoning that are air
pollution sources. Before any business is established at the site, SCAPCA should be contacted to
determine if a Notice of Construction is required. A copy of this ietter should be qiven to each new
tenant.
• AlI air pollution regufations must be met.
• Air pollution regulations require that dust emissions dunng demolition, consttuction and excavation projects be
controlled. This may require the use of water sprays, tarps, sprinklers or suspension of activity during cerain
weather conditions. Haul roads shoulct be treated and emissions from the transfer of earthen material must be
contro(led as we11 as emissions from all other construction related activities.
• SCAPCA strongly recommends that all traveled surfaces (i.e. ingress, egress, parking areas, access roads)
should be paved and kept clean to ml'nimize emissions.
• Measures must be taken to avoid the deposiiion of dirt and mud from unpaved suriaces onto paved surfaces. lf
tracking or spills occur on paved surfaces, measures must be taken immediately to cfean these surfiaces.
• SCAPCA Regulation I, Article 1V may require registration with this agency depending upon the type of business
that may be established at the site. An approved Noiice of Construction suffices to meet this requirement.
• SCAPCA Regulation I, Article V1, and SCAPCA Regulation I!, AR;cle IV, address air pollution em;ssion
standards. All emission standards must be met
• Debris generated as a resuit of this project must be d►sposed of by means other than burning (i.e. construction
waste, vegetative waste etc.).
• An asbestos sUrvey must be done by an AHERA certif,ed inspector prior to demolition oc renova[ion of
building(s), to determine if asbestos-containing material is present at the site. Demo(ttion and renovation
projects must comply w'rth the requirements of CFR 40, Part 61, Subpart M, SCAPCA Regu(ation 1, Article 1X &
Article X Section 10.09, and Washington State Reguiations (WAC 296-62, -65, & -155). Notice of lntent to
Perform Asbestos Removal and/or Demolition forms are available at the SCAPCA office. Asbestos-containing
material must be removed in accordance with Federal, State, Local regulations and disposed of at a licensed
facility. .
• Depending upon the type of business or equipment established on site, some objectionable odors may result
from this project. SCAPCA's regulations state that effective conirol apparatus and measures must be used to
reduce odors to a minimum.
• All solid fuel burning devices (fireplaces wood stoves, pellet stoves, etc...) must comply with local, state, and
federal rules and reculations. Firep4ace emission standards go into effect January 1, 1997, New firep(aces
must be tested and labeled in accordance with proceduses and criteria specifed in the UBC Standzrd 31-2.

I have no knowtedge of any critical areas on this site.
I consider this application to be technically complete.
My only comment would be that adequate sight distance must be maintained for the drive

Curbing and sidewalk must also be constructed
9 The County Engineer has designated a Local Access Roadway Section for the improvement of
Mamer Road which is adjacent to the proposed development This will require the addition of

10 All required improvements shail conform to the current State of Washington Standard
Specifications for Road and Bridge construction and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer
11 The applicant shall construct a paved and delineated approaches to meet the existing pavement
on Evergreen Road

Spokane Board of County Commissioners resolution 95-0498 as amended and are applicable to

The owner(s) or successor(s) in interest agree that in consideration of Mutual Benefits now or to
be hereafter derived, do for themselves, their heirs, grantees, assigns and successor(s) in
interest hereby request and authorize Spokane County to include the above described property
in a Road Improvement District (RID) and to support the formation of a Road Improvement
District for improvement of the road(s) described below by requesting and authorizing Spokane
County to place their name(s) on a petition for the formation of a Road Improvement District
pursuant to RCW 36 88 050 or by requesting and authorizing Spokane County to cast their
ballot in favor of a RID being formed under the resolution method pursuant to RCW 36 88 030,
and/or by not filing a protest against the formation of a RI D being formed under the alternative
resolution method provided for in RCW 36 88 065 and Chapter 35 43 RCW
If a RID is proposed for improvement of the road(s) described below, said owner(s) and
successor(s)further agree (1) that the improvements or construction contemplated within the
proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID
by the property included therein, together with the amount of any County participation exceeds
the cost and expense of formation of the RID, and (3) that the property within the proposed RID
is sufficiently developed, provided, themselves, their heirs, grantees, assigns and successor(s)
shall retain the right, as authorized under RCW 36 88 090, to object to any assessment(s) on
the property as a resuit of the improvements called for in conjunction with the formation of a RID
by either the petition or resolution method under Chapter 36 88 RCW and to appeal to the
Superior Court the decision of the Board of County Commissioners confirming the final
assessment roll provided further, it is recognized that actual assessments may vary from
assessment estimate so long as they do not exceed a figure equal to the increased true and fair
value improvement(s) add(s) to the property
It is further acknowledged and agreed that at such time as a RID is created or any County Road
Improvement project is authorized by Spokane County, the improvements required shall be at
the sole expense of the owner(s) of property within the RI D or served by the improvements
without any monetary participation by Spokane County
The RID waiver contained in this agreement shall expire after ten (10) years from the date of
execution below This provision is appiicable to Evergreen Road from which the subject parcel
takes access
16 The applicant should be advised that there may exist utilities either underground or overhead
affecting the applicants property, including property to be dedicated or set aside future
acquisition Spokane County will assume no financial obligation for adjustments or relocation
regarding these utilities The appiicant should check with the applicable utilities and Spokane
County Engineer to determine whether the appiicant or utility is responsible for adjustment or
relocation costs and to make arrangements for any necessary work

At the conclusion of the public heanng, I indicated that I would deny the vanance request along
Mamer Road, but approve the rezone to the UR-22 zone and the vanance request alvng
Evergreen Road
The approvals would be subject to the condirions of approval conta.ined in the staff report,
except that the buildtng height for the westerly biulding 1llustrated on the srte plan would be
limmited to 30 feet
