and 5 of the Staff Report The Staff s finding is that the proposed zone reclassificaUon is
generally consistent vvith the Major Commercial and the Urban Categones of the Comprehenssve
Plan Only a small portion of this property is in the Urban Category, and most of it is in the

Section 14 402 020(2) of the Spokane County Code states that amendments to the zoning
map may occur when it is found that "changes in econorrnc, technological, or land use conditions
have occurred to warrant modification " Staff has listed in its Staff Report on pages 1, 2, and 6,
vanous conditions wluch have changed in ttus area smce the property was last zoned Generally,
those findings demonstrate that there has been a gradual change along Pines Road in the vicirufiy
of the proposal from residential to office and commercial uses There have been a number of zone
reclassifications to office and business uses approved Also, Pines Road, wtuch is a State
H'ighway, has seen increases in tra.ffic and umprovements Further, the availability of pubLc

sernces such as sewer, water, and transit sernce to the site demonstrate that the conditions have
changed to the extent that this zone reclassification is warranted
At the heanng on tius matter the applicant testified that more medical and professional
office uses were being estabhshed in the area due to the growth of the nearby hospital complex
Ttus has created a demand for additional professional and medical office uses, and the applicant
seeks to react to this demand by providing more available office space
M. DECISION
Based on the Findings and Conclusions above, the above zone reclassification appLcation
is approved, subject to the conditions of the vanous pubhc agencies identified below
Failure to comply with the conditions of tius approval may result in revocation of this
approval by the Heanng Exarruner This approval does not waive the applicant's obligation to

Backqround; The applicativn #vr the proposed zone reclassifcation was submitted #o the
Division of Building and Planning on December 29, 1998, and received "Caunter Cvmplete"
status on January 8, 1999. A Technical Review Meeting was held on January 28, 1999, where
the applicant was notified tha# the prvposal was "Technicafly Incompl€te." Un March 2, 1999, the
proposal received "Technically Cvmplete°' status.
Staff Analvsis:
Comprehensive Plan: The subject prvperky is Iocated in an area designated as Urban and
Major Gcamrnercial by the 5pokane County CvmpreFrensive Pian. The majvrity of the site is in the
N1ajar Commercia! Categary, but a small portion of the site, lvcated at the southeast comer of the
property, is in the Urban Categary.
The Urban Categary is intended tv provide the oppor#unity for develapment of a"city-Ifke"
environmen# which includes various land uses, intensive residential development, public facili#ies
and services. The more intensive land uses such as light iradustrial and neighborhood
commercial will be lacated near heavily traveled streets, while the least intensive uses will be
is4lated from the nvise and heavy traffic. Urban areas wi11 hawe public water systems, sanstary
sewer systems, s#vrm sewer systems and utility systems such as electrical, telephone, gas, and
cab(e services. Streets wilf be curbed and paved. Stree# lights and sidewalks will be common to
residentiai, public and cornmercial areas.
Althaugh no specifc Goals, Qbjectives ar Decisian Guidelines are prvvRded for business and
medical offces, Sec#ion 1C (Public Fac+lities and Services) of the Uraan Gategory Detailed
Definition states that: Publfc libraries, rnanned fire sta#ions, medlcat facilifies and governmenf
offrces arrd pvst affices may be dispersed fhroughauf Urban areas. Moreover, Goal 1.6 of the
Urban Categary states tha#: "An orderly pat#ern of development should be established between
developed and unde►velaped areas." Objective 1.6.a states that "Utility services sueh as water,
sewer, pvwer, and natural gas should be orderly and propedy coardinated with Land Use
Plannang." Specifically, Decision Guideiine 1.6. states that "Sefore fand use proposals are
approved they should: a) conform to plans, policies, and regulations of County water, sewer,
storm sewer, utility, and speciai service districts; and b} confiorm to County franspartatian pians
and porfcies, c) identify and #ake steps to resvlve signsf€cant adverse impacts upan existing
utilitFes, (i.e., water, sanftary and storm sewer, utility, avaiiable and future energy resources), and
traffic systems."

commercial uses, specifcally community and regional shopping centers and cvmmercral us+es,
directly reiated tv malor throughways. Highway artd arteriat strip cvmmercial areas wili usually be
made up of businesses on individual parcels clustered aivng a heaVily #raveled street or highway,
each providing off-s#reet parking.
Most commercial development vwill be on relatively flat land and buildings of low prof le. Paved
parking, streets and man-made structures uvill dominate the si#e with few natural features to be
found. Landscaping, screen'tng, lighting, signage and other architectural trea#ment will Qrovide tor
aestheticaliy pleasing dewelopment. hllajor Cornmerciai areas require a fuEl line of public services
and utilities. These include service by ar commitment to sanitary and stflrm sewers, public water

located along State Route-27, a State highway, and will be served by public services including
public water and sewer and is compatible with the surrounding land use.
Goal 6.1 of the Major Commercial category is to "Promote development of commercial land in a
manner which is complimentary and compatible with adjacent land uses and the surrounding
environment.° Objective 6.1.a. states that: "Commercial developments should be buffered to
protect adjacent areas" and Objective 6.1.b. states that: "Provide for aesthetics of development
along County Arterials and State Highways or Freeways.' Specifically: Decision Guideline 6.1.1
states that: "The best means of encouraging compatibility between commercial uses and
adjacent land use categories will be accomplished by considering: a) orientation of the structures
and/or facilities of the proposal to maintain or improve upon the aesthetics and energy efficiency
of all areas affected by the proposal; and b) provision of buffering needs; and c) provision of
landscaping needs." Moreover, Decision Guideline 6.1.3 states that: "Provide for aesthetic
quality of physical development and land use along rights-of-way for Arterials, State Highways
and Freeways within the Urban Impact Area (UTA) of Spokane County as follows: a) The rights-of-
way as described above would be intended to have an aesthetically pleasing view as seen by the
traveling public and adjacent property owners when they are developed with commercial uses. b)
Standards regarding landscaping, signage, storage and architectural treatment should be
developed for uses locating along these rights-of-way.' Review of the site plan of record
indicates that the subject property has adequate off-street parkina :~c:,:, 1:31
public transit route along Pines Road.
This proposal is generally consistent with the Goals, Objectives and Decision Guidelines of the
Urban and Major Commercial Category in that the site will be served by a full line of public
services. Conditions of approval will be included to mitigate traffic impacts and design of the site
will provide for a buffer to adjacent land uses.
Zoning Analysis: The purpose of the B-1 zone is to allow for limited, small scale neighborhood
serving retail and office uses as a means of implementing the Major Commercial, Urban and
Suburban Categories of the Comprehensive Plan by providing local facilities to serve the
everyday needs of the surrounding neighborhood.
VVithin the Urban and Suburban Categories, the intent is that the size, number and location of
these B-1 zones be limited and required to meet neighborhood needs. Any B-1 zoned area in the
Urban and Suburban Category should not be larger than five (5) acres in size with frontage, on a
Collector Arterial or higher arterial road classification not exceeding six hundred (600) feet.
The B-1 Zones within the Major Commercial Category, in addition to serving the everyday needs
of the surrounding neighborhood, are intended to provide land use transition between the Major
Commercial Category and less intense land use categories of the Comprehensive Plan. The
uses allowed in the B-1 Zone are generally less intense than those of the other business zones
and the development standards, associated with compatibility and aesthetics, provide appropriate
land use transition. These B-1 zones should be located within and on the fringes of a Major
Commercial Category. Site access should be provided by a Collector Arterial or higher arterial
road classification. These B-1 Zones would not be subject to the maximum area, the maximum
frontage, or the minimum separation standards that apply to B-1 Zones in the Urban and
Suburban categories. However, since B-1 Zones within the Major Commercial Category will also
function to serve a neighborhood, the location of these B-1 Zones will be a basis for separating
and locating B-1 Zones in the Urban and Suburban categories. General characteristics of all B-1
Zone areas include paved roads and sidewalks, public sewer and water, and a full line of public
services including manned fire protection and public transit accessibility.

Existing zoning in the surrounding area is a mix of Urban Residential-3.5 (UR-3.5), Urban Residential-22 (UR-22), Neighborhood Business (B-1), Community Business (B-2) and Regional
Business (B-3). Moreover, Neighborhood Business (B-1) and Regional Business (B-3) is the
predominant zone found along Pines Road between Mission Avenue and Broadway Avenue.
This proposal is generally consistent with the purpose and intent of the Neighborhood Business
(13-1) zone, compatible with surrounding zoning, and serves to implement the Urban and Major
Commercial Comprehensive Plan categories.
Other land use activities in the general area of the proposal includes the following approved zone
reclassifications: ZE-7-94, from Urban Residential-22 (UR-22) to Community Business (B-2); ZE-
36-94, from Urban Residential-3.5 (UR-3.5), Neighborhood Business (B-1), and Regional
Business (B-3) to Regional Business (B-3); ZE-23-95, from Urban Residential-3.5 (UR-3.5) to
Regional Business (B-3) ZE-28-95, from Urban Residential-3.5 to Urban Residential-22; ZE-44-
95, Urban Residential-3.5 (UR-3.5) to Urban Residential-22 (UR-22); ZE-49-97, from Urban
Residential-3.5 (UR-3.5) and Urban Residential-22 (UR-22) to Regional Business (B-3); and ZE-
61-97, from Urban Residential-3.5 (UR-3.5) and Urban Residential-22 (UR-22) to Urban
Residential-22 (UR-22). These actions can be considered as changed conditions under Section
14.402.020.2 of the Zoning Code.
Site Develoqment Plan Review:
The site plan of record shows four (4) existing building on the site: Two (2) of the buildings are
currently being used as medical and professional/business offices, and the remaining two (2)
buildings are being proposed as offices. The site plan indicates that the structure labeled "Old
Home" will be removed to make room for additional off-street parking. Moreover, the dimensions
of the existing buildings shown on the Site Plan of Record are not the same as those indicated on
the building permit applications. The site plan shows existing Type I landscaping along the east
boundary line of the site, adjacent to the Urban Residential-3.5 zone. The site plan also shows
proposed Type III landscaping along the Pines Road, Maxwell Avenue and Sinto Avenue
frontage.

points is not obscured or impaired.
7. The Spokane County Division of Building and Planning shall prepare and record with the
County Auditor a Title Notice stating that the subject property is subject to a variety of
development conditions imposed as a result of approval of a land use action. This Title
Notice shall serve as public notice of the conditions of approval affecting the property in
question. The Title Notice should be recorded within the same time frame as allowed for an
appeal and shall only be released, in full or in part, by the Division of Building and Planning.
The Notice shall generally provide as follows: The parcel of property legally described
as: That portion of Block 2 of Mission View Addition, as recorded in Plat Book T,
page 27, Spokane County Auditors, described as follows: All of lot 6, 7, 8, 9, and 10
together with the South 71.62 feet of Lot 5, except County right-of-way; Situate in the
County of Spokane, State of Washington, is the subject of a land use action by a
Spokane County Hearing Body or Administrative Official on May 19, 1999, imposing a

the site consist of four (4) singie story buildings (two occupied and two vacant) and two (2)
detached garages. There is landscaping along the frontage of the occupied building and some
along the rear boundary line of the site.
Backqround: The application for the proposed zone reclassification was submitted to the
Division of Building and Planning on December 29, 1998, and received "Counter Complete"
status on January 8, 1999. A Technical Review Meeting was held on January 28, 1999, where
the applicant was notified that the proposal was "Technically Incomplete." On March 2, 1999, the
proposal received "Technically Complete" status.
Staff Analysis:
Comprehensive Plan: The subject property is located in an area designated as Urban and
Major Commercial by the Spokane County Comprehensive Plan. The majority of the site is in the
Major Commercial Category, but a small portion of the site, located at the southeast comer of the
property, is in the Urban Category.
The Urban Category is intended to provide the opportunity for development of a"city-like"
environment which includes various land uses, intensive residential development, public facilities
and services. The more intensive land uses such as light industrial and neighborhood
commercial will be located near heavily traveled streets, while the least intensive uses will be
isolated from the noise and heavy traffic. Urban areas will have public water systems, sanitary
sewer systems, storm sewer systems and utility systems such as electrical, telephone, gas, and
cable services. Streets will be curbed and paved. Street lights and sidewalks will be common to
residential, public and commercial areas.
Although no specific Goals, Objectives or Decision Guidelines are provided for business and
medical offices, Section 1 C(Public Facilities and Services) of the Urban Category Detailed
Definition states that: Public libraries, manned fire stations, medical facilities and govemment
offices and post offices may be dispersed throughout Urban areas. Moreover, Goal 1.6 of the
Urban Category states that: "An orderly pattern of development should be established betweer,
developed and undeveloped areas.° Objective 1.6.a states that "Utility services such as water,
sewer, power, and natural gas should be orderly and properiy coordinated with Land Use
Planning." Specifically, Decision Guideline 1.6. states that °Before land use proposals are
approved they should: a) conform to plans, policies, and regulations of County water, sewer,
storm sewer, utility, and special service districts; and b) conform to County transportation plans
and policies; c) identify and take steps to resolve significant adverse impacts upon existing
utilities, (i.e., water, sanitary and storm sewer, utility, available and future energy resources), and
traffic systems.°
The Major Commercial Category is intended to provide the opportunity for development of
commercial uses, specifically community and regional shopping centers and commercial uses,
directly related to major throughways. Highway and arterial strip commercial areas will usually be
made up of businesses on individual parcels clustered along a heavily traveled street or highway,
each providing off-street parking.
Most commercial development will be on relatively flat land and buildings of low profile. Paved
parking, streets and man-made structures will dominate the site with few natural features to be
found. Landscaping, screening, lighting, signage and other architectural treatment will provide for
aesthetically pleasing development. Major Commercial areas require a full line of public services
and utilities. These include service by or commitment to sanitary and storm sewers, public water
systems and underground utilities such as telephone, gas and electricity. The subject property is
