Summarv WiLhin the vicinity of the proposal, business and light industrial zoning occur along the Sprague Avenue commercial corridar, with Urban Residential-3.5 zoning to the north of the corridor. The business corridor north of and adjaccnt to Sprague Avenue is approximately 650 feet in dzPth and consists primarily of Regional Business (B-3) and Commuility Business (B-2) zoning. Regional Business (B-3) zoning is primarily limited to the parcels adjacent to Sprague Avenue whi.le the less intensive Community Business (B-2) zoning is found in ttie northern par[ of the zone corridor adjacent ta the residential - properties. There is precedence for extending Regional Business (B-3) zoning to include the entire 650 foo.t depth of corricior with azone reclassif cation to Regional Business (B-3) (ZE-97-85C) in 1985. The members of the Committee present are Harry Gibbons, Chairperson, Verona Sonthern and Lunell Haught. PROPOSAL The sponsor, Vince Moore, requests approval of a Zone Reclassification, ZE-42-93, from Community Business (B-2) and Regional Business ($-3) to Regional Business (B-3) for rzetail sales, warehouse, self sErvice storage and those uses allowed in the Regional Business (B-3) zoae. FINDINGS UF FACT AND CQNCLUSIONS 1. The property is generally located north of and adjacent to Sprague Avenue approximately 600 feet west of Flora Road in the southeast 1/4 of Section 13, Township 25 North, Range 44 EWM, Spokane County, Washington. 2. The committee adopts the Planning Departiment Report as a parc of this reeond. 3. The existing land uses in the area are commercial uses within the Sprague Avenue commercial corridor and low density residential uses to the north of the corridvr. 4. T'he proposed use is compatible with existing uses in the area and the deveiopment standards Qf the Regional Business (B-3) zone provides adequate buffering and screening to mitigate impacts to adjacent properties. 5. The Cornprehensive Plan designates this site as Major Commercial. The Major Commercial category is intended to provide for the opportunity for development of commercial nses, specifically community and regional shopping centers and those uses directly related to major throughways. Highway and arterial sorip commercial, areas will usually be made up of businesses or individual pareels clustered along a heavily traveled street or highway, each providing off-street parking. 6. The proposed zoning dces irnplement and canform to the Comprehensive Plan and is consistent with the Goals, Objectives aad Decision Guidelines of the Major , Commercial category of the Compreheasive Plan 7. The Arterial Road Plaa designates Sprague Avenue as a Principal Arterial. The County Engineer has designated a Special Roadway Secdon Standard for Sprague Avenue which will require the dedication of 15 feet of additional right of way. 8. The existing zoning of the property described in the application is Community Business (B-2) and Regional Business (B-3), previously established as Agricuttural (A) and Commercial (C) zoning in 1979 and 1942 and redesignated to Community ' HEC Qrder for ZE-42-93 Page 2 Business (B 2) and Regional Business (B-3) on January 1, 1991 pursuant ta the Program to Implement the Spokane County Zoning Code. 9. The applicant has demonstrated that cand.itions have substandally thanged since the original zoning of this area and accordingly, the proposed zone reclassification is justified. Specifically, changed conditions include the development of Sprague Avenue as a commerrcial corridor and the impicmentation of the Spokane County Zoning Code and the adoption of the Comprehensive Plan. 13. The Planning Departrnent shall file with the Spokane County Auditor, within the same time frame as allowed for an appeal from the final disposition, including lapsing of appeal period, a Title Notice, which shall genemlly provide as follows: "Prior to the issuance of any building permit for any building or any use on the property described hezein, the applicant shall be responsible for complying with the provisions of the Zoning Code for Spokane County, Section 14.706 (Aquifer Sensitive Area Overlay Zone). A six foot sight obscuring wood fence and 15 feet of Type I landscaping shall be provided along the property line adjacent ta the single family residence east of the site until such time as the adjacent property is used commercially. SPOKANE COUNTY DIVISION OF ENGTNEERING AND ROADS Prior to issuance of a building permit or at the request of the County Engineer in conjunction with a County Road project/Road Improvcment District, whichever acaon comes first: 1. Applicant shall dedicate 15 feet on Sprague Avenue for right-of-way. Prior to release of a building pemait or use of the property as proposed: 2. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a derailed combined on-sitr. sewage system plan HEC Order far ZE-42-93 Page 4 and surface water disposal plan for the entire project, or porcion thereof, if the development is to be phased. 5. A parking plan and aaPfic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the Cotincy Engineer, will be tequiretl for any poXtian of the project which is to be occupied or traveled by vehicles. 6. To eonstruct the roadway improvements stated herein, the applicant may, with tbe approval of the County Engineer, join in and be willing to participate in any petition or resolu'on which purpose is the formation of a Road Improvement District (RID) for said improvement, pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. This is applicable to Sprague Avenue. 7. As aa altemative aiethod of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Raad Project (CRP) to the extent of the required improvemenL Spokane County will not participAte in the cost of these inlprovements. This is applicable to Sprague Avenue. 8. The consmuction of the road impravements stated herein shal] be accornplished as approved by the Spokane County Engineer. 9. The County En,gineer has designated Special Roadway Section standard for the impmvement of Sprague Avenue, which is adjacent to the proposed development. This will reyuire the addition of approximately varying amounts of asphalt along the frontage of the development The construction of curbing and sidewallc must also be constructed. 10. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction and odier applicable County staUdards andlor adopted resolutions pertain.ing to Road Standards and Stormwater Management in effect at ihe date of construction, unless otherwise approved by the County Engineer. 11. Sewage disposal methad shall be as authorized by the Director of Utilities, Spokane Cou nty. 3. Water service shall be coordinated through the Directrn- of Utilities, Spokane County. 4. Water service shall be by an existing public water supply when approved by the Regional engineer (Spokane), State Department of Heaith. 5. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 6. Subject to specific application approval aad issuance of pernuts by the health officer, the use of individual oa site sewage disposal systems may be authorized. 7. Debris generated as a result of this project must be disposed of by means other than burning (i.e., construction waste, etc.). 6. All solid fuel burning devices (wood stoves, pellet stoves, etc...) must comply with local, state, and federal rules and regulations. 7. Demolition and renovadon projects must comply with the requirements of CFR 40, Part 61, Subpart M and SCAPCA Regulation I, Article IX (asbestos abatement).
