1. Land Use Plan: The proposal' is located in the Major Commercial
category of che Comprehensive Plan. The Major Commercial catcgory is
intended to provide- for the opportunity for develonment of commercial
uses, specificaliy community and regional shopping cznters and commercial
uses directly related to major t.hioughways. Highway and arterial strip
commercial.areas will usually be made up of businesses or individual,
parcels clustered along a heavily tTaveled street or highway, each provid.ing
off-str,eet parking.
The proposed zone reclassif carion is generally consistent with, and
implements the Goals, Objecfives, and Decision Guideluies of the Major
Commercia] category of the Comprehensive.Plan. -

2. 'Arterial Road Plan: Sprague Avenuz is, identified by the Spokane
County Arterial Road Plan a.s a Principal Arterial. The County Engineer has
designated a Special Roadway Section staiidard for the improvement QF
Sprague Avenue which will_require additional paving, curb and sidewalk.
The dcdication of 15 feEt of right of way is requested by the County
LngineEr for Sprague Avenue.
C. Sile Characleristics: 1'he site is relarively flat with an existing commercial
building occupying the sauth portion of the property. The north portion of che
site is undeveloped.

The proposa] is within the Urban Irnpact Area (UTA), che Priority Sewer Service
Area (PSSA), and the Aquifer Sensitive Area (ASA) overlay zone.
Summarv
WiLhin the vicinity of the proposal, business and light industrial zoning occur
along the Sprague Avenue commercial corridar, with Urban Residential-3.5
zoning to the north of the corridor. The business corridor north of and adjaccnt to
Sprague Avenue is approximately 650 feet in dzPth and consists primarily of
Regional Business (B-3) and Commuility Business (B-2) zoning.
Regional Business (B-3) zoning is primarily limited to the parcels adjacent to
Sprague Avenue whi.le the less intensive Community Business (B-2) zoning is
found in ttie northern par[ of the zone corridor adjacent ta the residential
- properties. There is precedence for extending Regional Business (B-3) zoning to
include the entire 650 foo.t depth of corricior with azone reclassif cation to
Regional Business (B-3) (ZE-97-85C) in 1985. That zone reclassification

z.one Corridor. Also, furcher west of ihe proposal there have been zane
reclassifications allowing Regional Business (B-3) zoning to extend the entire
depth of the zoning corridor. The proposal generally coniplies with the
development standards of -the Regional Business (B-3) zone, which includes
performance standards such as landscaping and fencing to buffer adjacent uses.
F . Land Use Analysis:
Site: Ketail, warehouse and vacailr.
North: Single fariiily residences.
South: Retail sales.
East: Retail service business, single fianuly residence, and vacanl.
West: Body shop, auto sales, and vacant.
Thie area near the proposal is esCablished with commercial uses to the satith, east,
and west, and residenrial uses to the norch. Much of tl1e, residentially zoned area
to the north is undeveloped with some semi-niral land uses remaining. With
appropriate landscaping and Fencing to mitigace the impacts to $«rraunding uses:
ttie proposa.l is generally campatible with t}ie adjacent residential and comnnerci,,rd
uses.
G . Circulation: Access ta tlle site is pi-ovided by Sprague Avenue with internal
circulauon provided by private driveways.
H. Design: The ~zone reclassi[icacion proposes development of retail sales, retai]
warehouse, and self-service storagz. A retail sales and warehouse structure is
proposed adjacent to Sprague.Avenue with developiiient of 246 self service
scorage units on the-northern porcion of. the site.

INTRt)AUCTIQN
This matter has come before the Hearing Examiner Committee on December lb,
1993. The members of the Committee present are Harry Gibbons, Chairperson,
Verona Sonthern and Lunell Haught.
PROPOSAL
The sponsor, Vince Moore, requests approval of a Zone Reclassification, ZE-42-93,
from Community Business (B-2) and Regional Business ($-3) to Regional Business
(B-3) for rzetail sales, warehouse, self sErvice storage and those uses allowed in the
Regional Business (B-3) zoae.
FINDINGS UF FACT AND CQNCLUSIONS
1. The property is generally located north of and adjacent to Sprague Avenue
approximately 600 feet west of Flora Road in the southeast 1/4 of Section 13,
Township 25 North, Range 44 EWM, Spokane County, Washington.
2. The committee adopts the Planning Departiment Report as a parc of this reeond.
3. The existing land uses in the area are commercial uses within the Sprague Avenue
commercial corridor and low density residential uses to the north of the corridvr.
4. T'he proposed use is compatible with existing uses in the area and the deveiopment
standards Qf the Regional Business (B-3) zone provides adequate buffering and
screening to mitigate impacts to adjacent properties.
5. The Cornprehensive Plan designates this site as Major Commercial. The Major
Commercial category is intended to provide for the opportunity for development of
commercial nses, specifically community and regional shopping centers and those
uses directly related to major throughways. Highway and arterial sorip commercial,
areas will usually be made up of businesses or individual pareels clustered along a
heavily traveled street or highway, each providing off-street parking.
6. The proposed zoning dces irnplement and canform to the Comprehensive Plan and is
consistent with the Goals, Objectives aad Decision Guidelines of the Major ,
Commercial category of the Compreheasive Plan
7. The Arterial Road Plaa designates Sprague Avenue as a Principal Arterial. The
County Engineer has designated a Special Roadway Secdon Standard for Sprague
Avenue which will require the dedication of 15 feet of additional right of way.
8. The existing zoning of the property described in the application is Community
Business (B-2) and Regional Business (B-3), previously established as Agricuttural
(A) and Commercial (C) zoning in 1979 and 1942 and redesignated to Community

Business (B 2) and Regional Business (B-3) on January 1, 1991 pursuant ta the
Program to Implement the Spokane County Zoning Code.
9. The pmvisions of RCW 43.21 CMe State Environmental Poucy Aet) have been
complied with and a Detennination af Nansignificance was issued. The Cornmittee,
after independent review, hereby adopts the DNS.
10. The legal requiretnents for public nodce have been fulfilled.
11. The owners of adjacent lands expressed neither approval nor disapproval of the
• proposed use.
12. The applicant has demonstrated that cand.itions have substandally thanged since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified. Specifically, changed conditions include the development of Sprague Avenue
as a commerrcial corridor and the impicmentation of the Spokane County Zoning Code
and the adoption of the Comprehensive Plan.
13. The proposed use will not be detrimental. tn the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing agenCies.
CONDITIONS OR CONTINGENCIES APPLIED TU THIS APPR4VAL
1. All Conditions imposed by the Hearing Examiner Committee shali be binding on the
"Applicant," which term shall include Che owner or owners of the property, heirs,
assigns, and successors-in-interest.
2. The following Condidons of Approval apply to the real propercy described below:
The East 66 feet of the East 1/2, Block 15 of Vera Except Highway and part of Block 16
of Vera described as the North 210 feet of the East 112 feet of the West 212 feet of the
West 1/2 and the West 100 feet of Block 16 of Vera Except Highway. All in Section 13,
Township 25 North, Range 44 EWM, Spokane County, Washington.
SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall cnmply with the Regional IIusiness (B-3) zone as ameaded..
2. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Dinector/designee, may be permitted, including, but not limited to building
location, landscape plans and general aUowable uses of the permitted zone. All
variations must conform to regulations set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintained.
3. Approvai is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building pemuts.
4. A specific laadscape plan, planting schedule and provisions for maintenance
ac.ceptabie to the Planning Director/designee shall be subnritted with a perfoanance
bond for the project prior to release of building permits. Landscaping shall be

installed and maintained so that sight distance at access points is not obscured or
impaired.
5. Direct light frorri any exterior area lighting fixture shall not extend over the property
boundary.
6. The Planning Department shall prepare and record witli the Spokane Gounty
Auditor a Tide Notice noting that the properry in question is subject to a variety of
special conditions imposed as a nesult of apprava.l of a land use acdon. This Title
Norice shall serve as public nadce of the conditions of approval affecting the
property in question. The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Norice shall generally provide as follows:
The parcel of property legally described as [ ] is the subject
of a land use action by a Spokane County Hearing Body or
Administrative Afficial on [ imposing a variety of
special devetopment conditions. File No. [ ] is availabie for
inspection and copying in the Spokane County Planning Department.
7. The Planning Departrnent shall file with the Spokane County Auditor, within the
same time frame as allowed for an appeal from the final disposition, including
lapsing of appeal period, a Title Notice, which shall genemlly provide as follows:
"Prior to the issuance of any building permit for any building or any use on the
property described hezein, the applicant shall be responsible for complying with the
provisions of the Zoning Code for Spokane County, Section 14.706 (Aquifer
Sensitive Area Overlay Zone). The property which is the Subject of this notice is
more particularly described as follows: . . . "
8. A six foot sight obscuring wood fence and 15 feet of Type I landscaping shall be
provided along the property line adjacent ta the single family residence east of the
site until such time as the adjacent property is used commercially.
SPOKANE COUNTY DIVISION OF ENGTNEERING AND ROADS
Prior to issuance of a building permit or at the request of the County Engineer in
conjunction with a County Road project/Road Improvcment District, whichever acaon
comes first:
1. Applicant shall dedicate 15 feet on Sprague Avenue for right-of-way.
Prior to release of a building pemait or use of the property as proposed:

Spokane County Engineer.
3. The applicant shall submit for approval by the Spoka,ne County Engineer road,
drai.nage and access plans.
4. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a derailed combined on-sitr. sewage system plan

and surface water disposal plan for the entire project, or porcion thereof, if the
development is to be phased.
5. A parking plan and aaPfic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the Cotincy Engineer, will be tequiretl for any poXtian of
the project which is to be occupied or traveled by vehicles.
6. To eonstruct the roadway improvements stated herein, the applicant may, with tbe
approval of the County Engineer, join in and be willing to participate in any
petition or resolu'on which purpose is the formation of a Road Improvement
District (RID) for said improvement, pursuant to RCW 36.88, as amended.
Spokane County will not participate in the cost of these improvements. This is
applicable to Sprague Avenue.
7. As aa altemative aiethod of constructing the road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Raad Project
(CRP) to the extent of the required improvemenL Spokane County will not
participAte in the cost of these inlprovements. This is applicable to Sprague
Avenue.
8. The consmuction of the road impravements stated herein shal] be accornplished as
approved by the Spokane County Engineer.
9. The County En,gineer has designated Special Roadway Section standard for the
impmvement of Sprague Avenue, which is adjacent to the proposed development.
This will reyuire the addition of approximately varying amounts of asphalt along the
frontage of the development The construction of curbing and sidewallc must also
be constructed.
10. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and odier applicable
County staUdards andlor adopted resolutions pertain.ing to Road Standards and
Stormwater Management in effect at ihe date of construction, unless otherwise
approved by the County Engineer.
11. Applicant shall construct a paved and delineated approach(es) to meet the existing
pavement on Sprague Avenue.
12. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Comrnissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
13. No construction work shall be perfozmed within the existing or proposed public
right-of-way until a pennit has been issued by the County Engineer. All work
within the public road iight-of-way is subject to inspection and approval by the
County Engineer.
14. AppIicant shaIl sign and record Spokane County Notice to the Public No. 6 which
specifies the following:

The ownar(s) or successor(s) in interest agaroe to auttiorize the CouAty to place their
name(s) on a perition for the fornlation of a Road Improvement District (R.ID) by
the petition rriethod pursuant to Chapter 36.$8 RCW, which petition includes the
owner(s) property, and further not to object, by the signing of a ballot, the
formation of a RID by the resolution method pursuant to Chapter 36.88 RCW,
which resolution includes the owner(s) propecty. If an RID is formed by either rhe
petition or resolution niethoci, as provided for in Chapter 36.8$ RCW, the owncr(s)
or successor(s) further agree:
(a) that the improvement or construction contemplated within the proposed RID is
feasible;
(b) that the benefits to be derived from t6e formatian of the RID by the property
included therein, together with the amount of any County participation,
exceeds the cost and expense of fonnadon of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall reta.in the right, as
authorized under RCW 36.88.090, to object co any assessment on the property as a
result of the improvements called for in conjunction with the formauan of the RID
by either petition or resolution method under Chapter 36.88 RCW.
This requirement applies to Sprague Avenue, from which the subject parcel takes
access.
15. TheTe may exist utilities, either undergxound or overhead, affecang the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable urility
purveyor aDd the Spokane County Engineer to determine whether applicant(s) or
the utility is respansible for adjustment or relocation costs and to make
arrangements for any necessary work.
SPOKANE COUNTY DIVISION UF UTILITIES
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use
of on-site sewer disposal systems is hereby authorized. This authorization is
conditioned on eompliance with all rules and regulations of the Spokane County
Health District and is further conditioned and subject to specific application
approval and issuance of pennits by the Health District
2. The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the fomnation of ULID by petition method pursuant to
RCW 36.94, which petidon includes the owner(s)' property; and further not to
object by the signing of a protest petition againsc the fonmtion of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)'
property. PROVIDED, this condition shall not prohibit the owner(s) ar
successor(s) from objeeting to any assessment(s) on ihe property as a result of
impmvements called for in conjunction wirh the formation of a ULID by either
petition or resolution method under RCW Chapter 36.94.

3. Any water service for this pmject shall be provided in accordance with the
Coordinated Water System Plan far Spokane County, as amended.
4. Each new unit shall be double-plumbed for connection to future areawide collection
systems.
SPOKANE COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall be approved by
the Spokane County Engineer and Spokane Counry Health District prior to the
issuance of any on-site sewage disposal pennit or build.ing pernvt for this project.
2. Sewage disposal methad shall be as authorized by the Director of Utilities, Spokane
Cou nty.
3. Water service shall be coordinated through the Directrn- of Utilities, Spokane
County.
4. Water service shall be by an existing public water supply when approved by the
Regional engineer (Spokane), State Department of Heaith.
5. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
6. Subject to specific application approval aad issuance of pernuts by the health
officer, the use of individual oa site sewage disposal systems may be authorized.
7. Use of private wells and water systems is prohibited.
SPOKANE COUNTY DIVISI()N OF BUILDINGS
1. The applicant shall cantact the Depamnent of Buildings at the earliest possible stage in
order to be informed of code requirements administered/enforced as authorized by the
State Building Code AcL Design/deveiopment concerns include: Addressing, fire
apparatus access roads, fire hydrant/flow, approved water systems, building
accessibiiity, consrruction type, occupancy classification, exiting, exterior wall
protection, afld energy caie regulations. (Note: The Department of Buildings reserves
the right to confinn the actual address at the time of building permit.)
SPOKANE C4UNTY AIR POLLUTIUN CONTRqL AUTHORITY
1. All air pollution regulations must be meL This includes but is not limited to the

2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activiry during certain weather cond.itions. Haul roads
should be meated, and emissions from the tirransfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.

3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept cleaa.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e., construction waste, etc.).
