Site Description. The site is approximately 49 acres (21,500 square feet) in size and is
relatively flat in topography The property is within the Interim Urban Growth Area (IUGA)
boundanes designated by Spokane County under the Washington State Growth Management Act
Surrounding Conditions: The site is located adJacent to Sullivan Road, which is a six-lane road
with center turn lane designated as a Pnncipal Artenal by the County Artenal Road Plan The
Sullivan Road comdor has been in transition toward stnp commercial development primanly wrthin
the last decade, with rapid and significant commercial development over the past few years The
surrounding neighborhood consists of established and new commercial stnp development with
businesses ranging from fast food restaurants to offices wlth medium density single family
residential development extending east and west beyond the commercial comdor Very few parcels
of land are left vacant and undeveloped Streets are paved with curbs, sidewalks and street lighting
Project Description. The applicant did not submit a site development plan for review, and did not
specify a particular use for the site other than development of general B-3 uses Site plan review is
recommended to be administrative by the Dlvision of Building and Planning, pnor to issuance of a
building permit

C ZONE RECLASSIFICATION ANALXSIS•
Washington case law generally provides that (1) there is no presumption in favor of a rezone,
(2) the applicant foi the rezone must prove that conditions have substantially changed in the area
stnce the last zoning of the property, and (3) the rezone proposal must bear a substantial
relationship to the publlc health, safety or welfare Parkrid.F-'e v Seattle, 98 Wn 2d 454, 462
(1978), Biarnson v Kitsan Countv, 78 Wn App 840 (1995) Case law also indicates that a
county's comprehensive plan provides guidance to the heanng body in making a rezone decision
Spokane County Zoning Code 14 402 020(1)(2), indicates that consistency with the
Comprehensive Plan, detriment to the public welfare and changed circumstances are relevant
considerations when a site-specific rezone is sought The rezone proposal must also comply with
the Spokane County Zoning Code, the State Environmental Policy Act, the County's Local
Environmental Ordinance, and other applicable land use regulations Conditions may be
imposed to assure the consistency of the proposal with applicable regulations
The following findings of fact and conclusions are made

A comprehensive plan provides guidance to the heanng body in making a rezone decision

plan is relevant in determining whether a rezone bears a substantial relationship to the public
welfare Bassani, Wra, at 396-98 Recent cases have held that changed circumstances need not
be demonstrated if the proposed rezone implements policies of a comprehensive plan Biarnson
v Kitsap Countv, 78 Wn App 840, 846 (1995), Save Our Rural Environment v Snohomish
Countv, 99 Wn 2d 363, 370-371 (1983)
The site is designated within the Ma~or Commercial category of the Comprehensive Plan
The Major Commercial (C) category is intended to provide the opportunity for development of
commercial uses, specifically community and regional shopping centers and commercial uses
directly related to major throughways Major Conunercial areas typically require a full line of
public services and utilities, including public sewer The Regional Business (B-3) zoning is
intended to implement the Major Commercial category of the Comprehensive Plan, including
those policies which encourage commercial development along Pnncipal Artenals or tughways
and the establishment of regional-serving commerctal uses Zorung Code 14 628 100
The proposed rezone clearly implements the policies of the Major Commercial category,
since it is located along a pnncipal artenal and B-3 uses are intended for the site The proposal is
located wi±hin the ILJGA boundanes established by the County under the Growth Management
Act, is within the Public Trailsit Benefit Area designated by the Zoning Code, lies on a public
transit route, and will be served by public sewer and other urban services

The Major Commercial category indicates that commercial developments sliould be
bufFered to protect adjacent areas Goal 6 l, Objective 6 1 a The land along Sullivan Road in
lhe area is dominated by commercial uses, including several B-3 and B-2 zones A commercial
strip mall is located north of the site, on land zoned B-3 A dental office, church and new
cominercial strip mall are located west of the site across Sullivan Road Tlle land south of the
site is undeveloped with a vacant storage building, on tand zoned Neighborhood Business (B-1)
A small strip of land lying immediately east of the site is undeveloped and zoned B-1
Further east is a playground associated with a church, on land zoned Urban Residential-3 5
(UR-3 5) No public opposition was expressed to the proposal, although a concern was
expressed regaiding the compatibility of any alcohol sales on the site considering the proximity
of the nearby church aild playground The applicant agreed to not have aleohol sales on the site
unless consented to by the owner of the church property The development standards of the B-3
zone also ensure adequate buffering for the project, in relation to adjacent uses

In applying the changed circumstances test, courts have looked at a vanety of factors,
including changed public opinion, changes zn land use patterns in the area of the rezone proposai,

Zoning Code 14 402 020 (2) Washington courts have not requlred a"strong" showing of
change The nile is flexible, and each case ts to be Judged on its own facts Bassani v Countv

circumstances are not required for a rezone if the proposed rezone implements policies of a

As indicated above, the proposal generally conforms with the Comprehensive Plan
Changes which support the proposed rezone include the extension of public sewer along Sullivan
Road, and increased traffic and commercial activity along Sullivan Road

1 The proposal shall comply with the Regional Business (B-3) and the Aquifer Sensitive Area
Overlay (ASA) zones, and applicable provisions of the Spokane County Zoning Code, as amended

1 Sewage disposal method shall be as authonzed by the Director of Utihties, Spokane

2 Water service shall be coordinated through the Director of Utilities, Spokane County
3 Water service shall be by an existing public water supply, when approved by the Regional
Engineer (Spokane), State Department of Health
4 A public sewer system will be made available for the project and individual service will be

I have reviewed the traffic distribution for the Delay/Klante Rezone ZE-003-97 and have found
the information provided to be accurate and complete While I have some personal reservations
as to whether a bank generates more pm peak hour trips than a fast food restaurant w/ drive
through window, the ITE Trip Generation Manual does support the information presented
Therefore, until information to the contrary is found, I would recommend acceptance of the
distribution letter and the information contained therein

I have been contacted by Gregor Klante, a iepresentative for Joe Delay, to perform a brief trip ~disiribution for a rezone on a site on the east side of Sullivan south of Broadway As I
understand the project, the site involves one parcel zoned B-1 (Neighborhood Business) which is
presently vacant A rezone is being sought to change the B-1 zoning to B-3 (Regional Business)
zoning
Based upon the site's location and size, it appears that under existing zoning, its most intense us~e
is "Banks, savings/loan" as defined in the zoning code, which was assumed to include a bank
with drive-in capabilities A banl: with these characteristics could easily locate on a 20,000
square foot site, the size of this parcel Trip generation charactertstics of a Drive-in Bank as
outlined in the Tr rp Gener atron Manual, Sth Edrtron published by the Institute of Transportation
Engineers were used for this analysis of the trip generation characteristics of the site if developed
under eaisting zoning
A site plan has not been submitted wrth this rezone Therefore, the ultimate use of the site has
not been selected Based upon this situation, the site will be examined under the most intense
use for a parcel of this size using a land use which is allowed under B-3 zoning but not allowed
under the B-1 zoning category Tnp generation characteristics of the srte if rezoned to B-3
(Regional Business) are expected to be no more lntense than "Fast Food Restaurant with Drive-

A portion of the trips going to and from the bank will be pass-by trips, since some of the patrons
of the bank will already use Sullivan Road on their way to and from work. As Table 1 shows,
this is estimated to be 50% of the trips to and from the bank. Therefore, for the existing zoning
and potential land uses, this site could generate 218 PM peal: hour trips, 109 of which would be
trips on the transportation system specifically to use the services at this location.
Under the proposed rezone and assuming that a fast food restaurant with a drive through locates
here, the trip generation characteristics of tlle site are shawn in Table 2.

Under the proposed zoning and iliost intense use of the sitc, it is estimated that 182 trips in the
PM peak hour could be expected to be generated. This is a reduction of 36 trips from the
potential uses of the parcel under existing zoning. A portion of the trips going to and from the

potential restaurant will be pass-by trips, since some of the customers of the restaurant will
already use Sullivan Road on their way to and from home As Table 2 shows, this is estimated to
be 50% of the trips to and from the restaurant
~ Based on the direction of traffic presently on Sullivan Road, it will anticipated that about 60% of
~ the trips generated to this site in the PM peak llour could be expected to come from the north,
' with the majorlty of them passing through the Sullivanll-90 inteichange This is expected to be,~

the case whether the zoning remains at B-1 or changes to B-3
The uses for this site are unknown at this time and some uses, if the rezone occurs could be point
destination uses, as allowed under the B-3 Regional Business zoning category Therefore, many
of these trips will use the Sullivan/I-90 interchange However, based upon thc analysis
presented, the most intense use of the site under the proposed zoning which is not also allowed
undei the existing zoning will generate less traffic than that allowed under the existing zoning
Therefore, based upon the tiip generation and trip distribution charactenstics of the existing site

1. Land Use Plan: The property is located withln the Maior Commercial
category of the Comprehensive Plan, the Pnonty Sewer Service Area
(PSSA) and the Intenm Urban Growth Area (IUGA)
The purpose of the Major Commercial category is to provide the
opportunity for the development of commercial uses, specifically
commuruty and regional shopping centers and commercial uses directly
related to major throughways Major Commercial areas feature high-
intensity uses and will be composed of three different types of commercial
development shopping centers, lughway and arterial commerclal strlps
and freeway commercial
The proposal can be identified as a commercial development associated
vvnth an artenal commercial stnp The consumer goods offered in strip
development frequently differ from those found in shopping centers
Typical businesses found along a commercial corridor often include new
and used car sales, fast food establishments, bars and fruitlproduce stands
Charactenstics of artenal stnp commercial areas include businesses
located on individual parcels clustered along heavily traveled streets or
highways, each providing off-street parking Shopping is not done by
walking from one store to another, but rather a single purpose nature The
heavy automobile traffic and related congestion may create pollution
problems, especially along commercial stnp developments
Most commercial development will be on relatively flat land and buildings
of a low profile Paved parlcing, streets and man-made structures will
dominate the site, wlth few natural features to be found Landscaping,
screening, lighting, signage and other architectural treatment will provide
for aesthetically pleasing development Major Commercial areas require a
fiill line of public services and utilities These include service by or
commitment to sanitary and storm sewers, public water systems and
underground utilrties such as telephone, gas, and electncity
The proposal is generally consistent with and implements the Goals,
Objectives and Decision Guidelines of the Vlajor Commercial category of
the Comprehensive Plan

side of Sullivan Road A six foot tall cyclone fence runs along a portion of the
east property line
D Neighborhood Characteristics The subJect property lies wnthin the Sullivan
Road commercial corndor and the corridor has been in transrtion toward strip
commercial development pnmanly within the last decade The surrounding
neighborhood consists of established and new commercial stnp development
with businesses ranging from fast food restaurants to offices with medium
density single family residential development extending east and west beyond
the commercial corridor Very few parcels of land are left vacant and
undeveloped Streets are paved with curbs, sidewalks and street lighting The
proposal is consistent with development trends of the surrounding
neighborhood
E. Zoning Analysis The purpose of the Regional Business (B-3) zone is to
provide for the location of a wide range of retail and service activities and this
zone will implement the Major Commercial category of the Comprehensive
Plan The uses within this zone wtll often require large areas for customer
parking, retail services, some outside activities, display and other commercial
activrties The businesses locating wrthin these areas will often draw customers
from the County at a large and other outlying areas rather from a limited trade
area Further it is intended that the Regional Business (B-3) zone to implement

specifics of the proposal, other available information, County ordinances, other
regulations and laws, possible standard Conditions of Approval, the Generalized
Comprehensive Plan, and other County policies and guidelines The Division of
Building and Planning has determined that "No probable sigruficant adverse
impacts" would result from the proposal being developed and has issued a
Determination of Non Sienificance ("DNS")
The "DNS" was circulated to 14 other agencies ofjurisdiciion and other
agencies/divisions affected by the future development for review and comment
The "DNS" comment penod ended June 2, 1997 and was advertised 15 calendar
days before said date in the newspaper, by letter to adjacent property owners
within 400 feet of the proposal, and by notice on a sign posted on the proposal

contamination of groundwater This soil would be classified as a Type IV
f) Geologically, the soils are Glaciofluvial deposits These geological structures generally yield moderate
to very large amounts of water Data from wells in the area referenced in section 1 f shows they are
from 81' to 457' deep and have static water levels varying from 42' to 120' below the surface The Vera
Water and Power has indicated that it can supply domestic use water for the proJect upon completion
of agreements with the proponent

Dear Pat,
I have been contacted by Gregor Klante, a representative for Joe Delay, to perform a brief trip
distrlbution for a rezone on a site on the east side of Sullivan south of Broadway As I
understand the project, the srte involves one parcel zoned 13-1 (Neighborhood Business) which is
presently vacant A rezone is being sought to change the 13-1 zoning to B-3 (Regional Business)
zoning
Based upon the site's location and size, it appears that under existing zoning, its most intense use
is "Banks, savings/loan" as defined in the zoning code, which was assumed to include a bank
with drive-in capabilities A bank with these characteristics could easily locate on a 20,000
square foot site, the size of this parcel Trip generation characteristics of a Drive-in Bank as
outlined ln the Trip Generatcon Manual, Sth Edrtron published by the Institute of Transportation
Engineers were used for this analysis of the trip generation characteristics of the site if developed
under existing zoning
A site plan has not been submitted with this rezone Therefore, the ultimate use of the site has
not been selected Based upon this situation, the site will be examined under the most intense
use for a parcel of this size using a land use which is allowed under B-3 zoning but not allowed
under the B-1 zorung category Trip generation characteristics of the site if rezoned to B- i
(Regional Business) are expected to be no more intense than ` Fast Food Restaurant with Drive-
Thru " Trip generation characteristics of a Fast Food Restaurant with Drive-Thru as outlined in
the Trap Generation Manual, Sth Edrtton published by the Institute of Transportation Engineers
were used for this analysis of the trip generation characteristics of the site if developed under the
proposed B-3 zoning -

Based on the direction of traffic presently on Sullivan Road, it will anticipated that about 60% of
the trips generated to this site in the PM peak hour could be expected to come from the north,
with the majority of them passing through the Sullivan/I-90 interchange This is expected to be
the case whether the zoning remains at B-1 or changes to B-3
The uses for this site are unknown at this time and some uses, if the rezone occurs, could be point
destination uses, as allowed under the 13-3 Regional Business zoning category Therefore, many
of these trips will use the Sullivan/I-90 interchange However based upon the analysis
presented, the most intense use of the site under the proposed zoning which is not also allowed
under the existing zoning will generate less traffic than that allowed under the existing zoning
Therefore, based upon the trip generation and trip distribution characteristics of the existing slte
versus the potential uses of the site if rezoned, the rezoning of the site serves to leave the site
generated trips the same or to lessen the impacts to the transportation system from this site

this is estimated to be 50% of the trips to and from the bank. T'herefore, for the existing zoning
and potential land uses, this site could generate 218 PM peak hour trips, 109 of which would be
trips on the transportation system specifically to use the services at this location.
