1. SUIVIMARY OF PROPOSAL AND DECISION
Proposal: Zone reclassification from the Neighborhood Business (B-1) zone to the Regional
Business (B-3) zone on approximately .33 acres, for those uses allowed in the B-3 zone.
Decision: Approved, subject to conditions.
II. FINDINGS OF FACT AND CONCLUSIONS
The Hearing Examiner has reviewed the zone reclassification application and the
evidence of record, and hereby adopts tlie following findings of fact and conclusions:
A. GENER.A.L INFORNIATION:
Applicant: Bill and Sally Bean, P. O. Box 402, Veradale, WA 99037
Address: 816 and 818 North Pines Road
Location: Generally located east of and adjacent to Pines Road (SR-27), approximately 205
feet north of the intersection of Pines Road and Broadway Avenue in the NW 1/4 of Section 15,
Township 25 North, Range 44 EWM, Spokane County, Washington.
Legal Description: The West 128.43 feet of the North 120 feet of tlle South half of Tract 77,
OPPORTLJNITY, according to the plat recorded in Volume "K" of Plats, Page 20, in Spokane
County, Washington. Except that portion deeded to the State of Washington for SR-27, under
recording Nos. 8312060026 and 8312060027.
Zoning: Neighborhood Business (B-1)
Comprehensive Plan Category: Tlle property is designated in the Major Commercial
category of the Spokane County Generalized Comprehensive Plan. The site is also designated
within the Priority Sewer Service Area, Urban Impact Area and Aquifer Sensitive Area
designated in tlle Plan.
Environmental Revie`v: The Division of Building and Planning issued a Determination
of Nonsignificance on June 13, 1997.

Site Descriptioo: The site is approximately .33 acres (14,400 square feet) in size aild is
relatively flat in topography. Two commercial structures are located on the site, and are
respectively occupied by a dog grooming facility and a non-conforming gun shop. The gun shop
is currently closed and being remodeled. No landscaping is present on site, other than some
shrubbery. Electrical transmission lines and a sidewalk border the west property line along Pines
Road. A chain link fence which varies from approximately four to six feet in height is located
along the other property lines. A portable reader board sign is located on the northwest corner of
the site, adjacent to Pines Road. A row of shrubs and an access easement are located adjacent to
the east property line of the site. Modern Electric has a blanket easement for utilities over the
property. The property is within the Interim Urban Growth Area (IUGA) boundaries designated
by Spokane County under the Washington State Growth Mar,agement Act.
Surrounding Conditions: The site is located along State Route 27 (Pines Road). The
surrounding neighborhood consists primarily of established and new commercial strip
development along Pines Road. Very few parcels of land are left vacant and undeveloped.
Typical land uses within the vicinity of the proposal range from neighborhood to regional
businesses. Streets in the area are paved with curbs, some with sidewalks and street licrhting.
Some properties are landscaped, while others are devoid of vegetation. East and west of the Pines
Road commercial comdor can be found residential areas developed at various densities, ranging
from single-family to multifamily development.
Project Descriptioo: The site development plan for the proposal illustrates the two existing
structures on site. A one-story structure, approximately 15 feet in height, is located on the northeast
corner of the site and has a gross floor area of approximately 960 square feet. The second structure,
located on the southwest portion of the site, is one-story, 20 feet in height and has a gross floor area
of approximately 890 square feet. The structures are respectively occupied by an existing dog
grooming facility and a non-conforming gun shop. Approval of the zone reclassification request is
required in order to recognize the gun shop as a permitted use within the Regional Business (B-3)
zone, since a gun shop is not a permitted use in the B-1 zone. The rear yard setback for the gun shop
is only five feet, while both the existing B-1 zone and the proposed B-3 zone require a 15 foot rear
yard setback. No new construction is proposed at this time; however, the applicant has indicated that
future development of the site is likely. The applicant has requested a waiver from the paving
requirement of the Zoning Code for off-street parking. Parking may also have to be adjusted on the
site to accommodate any new uses located on the property. The Division of Building and Planning
has accepted modifications to required landscaping in accordance with the Zoning Code. The
applicant will need to obtain approval of a Certificate of Exemption prior to issuance of a building
permit so that the parcel can be recognized as a legal lot. The fire district has expressed a concern
regarding fire apparatus access for the site, which may require some redesign of the proposal.

C ZONE RECLASSIFICATION ANALYSIS
Washington case law generally provides that (1) there is no presumption in favor of a rezone,
(2) the applicant for the rezone must prove that conditions have substantially changed in the area
since the last zoning of the property, and (3) the rezone proposal must bear a substantial
relationship to the public health, safety or welfare Parkndize v Seattle, 98 Wn 2d 454 462
(1978) Biarnson v Kltsaa Countv 78 Wn App 840 (1995) Case law also indicates that a
county s comprehensive plan provides guidance to the heanng body in making a rezone decision
Spokane County Zoning Code 14 402 020(1)(2) indicates that consistency with the
Comprehensive Plan, detnment to the public welfare and changed circumstances are relevant
considerations when a site specific rezone is sought The rezone proposal must also comply with
the Spokane County Zoning Code the State Environmental Policy Act, the County s Local
Environmental Ordinance, and other applicable land use regulations Conditions may be
imposed to assure the conslstency of the proposal with applicable regulations
The following findings of fact and conclusions are made

The site is designated withln the Major Commercial category of the Comprehensive Plan
The Major Commercial (C) category is intended to provide the opportunity for development of
commercial uses, specifically community and regional shopping centers and commercial uses
directly related to major throughways MaJor Commercial areas typically require a full line of
public services and utilities, including public sewer The Regional Business (B-3) zorung is
intended to implement the Major Commercial category of the Comprehensive Plan, including
those policies which encourage cornmercial development along Pnncipal Artenals or highways
and the establishment of regional-serving commercial uses Zoning Code 14 628 100 The
proposed rezone clearly implements such policies, since it is located along a state highway and
B-3 uses are intended for the site The proposal is located within the IUGA boundanes
established by the County under the Growth Management Act, is within the Public Transit
Benefit Area designated by the Zoning Code and is served by public sewer and other urban
services
The Major Commercial category indicates that commercial developments should be
buffered to protect adjacent areas Goa16 1, Objective 6 1 a Commercial uses are located south
and west of the site, and a public utility use is located north of the site The proposal is part of a
trend toward the development of B-3 uses along Pines Road The development standards of the
B-3 zone ensure adequate buffenng for the project, in relation to adjacent uses While the
existing gun shop does not meet the rear setback standards of the B-3 zone, no objections were
made to the proposed rezone by adjoining property owners

In applying the changed circumstances test, courts have looked at a vanety of factors,
including changed public opinion, changes in land use patterns in the area of the rezone proposal,
and changes on the property itself The Zoning Code references changes in `economic
technological or land use conditions as factors that will support a rezone Spokane County
Zoning Code 14 402 020 (2) Washington courts have not required a strong showing of
change The rule is flexible, and each case is to be judged on its own facts Bassani v Countv
Commissioners 70 Wn App 389, 394 (1993) Recent cases have held that changed
circumstances are not required for a rezone if the proposed rezone implements policies of a
comprehensive plan Biarnson at 846 Save Our Rural Environment v Snohomish Countv 99

As indicated above, the proposal generally conforms with the Comprehensive Plan
Changes which support the proposed rezone include the growth in business on the property, the
extension of public sewer along Pines Road, and increased traffic and commercial activity along
Pines Road

Act and the Countv s Local Environmental Ordinance
The procedural requirements of chapter 43 21 C RCW and chapter 11 10 of the Spokane
County Code have been met The Heanng Examiner concurs with the Determination of
NonSignificance issued by the Division of Building and Planning No adverse comments were
received from the reviewing public agencies which cannot be resolved through the conditions of
approval As conditioned, the proposal will not have more than a moderate effect on the quality
of the environment
5 The vrooosal as conditioned, complies with the Regional Business (B-3) zone, the
Spokane Countv ZonlnLy Code (SCZC) and anplicable land use regulations
The proposal has been conditioned for compliance with the permitted uses and
development standards of the B 3 zone While the existing gun shop does not meet the minimum
reai yard setback of the zone no additional encroachment on such setback is proposed or would
be allowed Compliance with such standards and other applicable land use regulations will be
ensured through the admmistrative slte plan review process
III DECISION
Based on the Findings and Conclusion above, the above zone reclassification application is
approved subject to the conditions of the vanous public a~encies specified below Any
conditions added or significantly altered by the Heanng Examiner are ctalicized
Failure to comply with the conditions of thus approval may result in revocation of this
approval by the Heanng Examiner This approval does not waive the applicant's obligation to
comply with all other requirements of other agencies with junsdiction over land development
Conditions added or substantially modified by the Heanng Examiner are itnlrcizerl

2 The applicant shall develop the subject property generally in accordance within the concept
presented to the Heanng Examiner Vanations, when approved by the Director of the Division
of Building and Planning/designee, may be permitted, including, but not limited to building
location, landscape plans and general allowable uses of the permitted zone All vanations must
conform to regulations set forth in the Spokane County Zoning Code, and the onginal intent of
the development plans shall be maintained
3 Approval is required by the Director of the Division of Building and Planning/designee of a
specific lighting and signing plan for the descnbed property pnor to the release of any building
permits
4 Direct light from any extenor area lighting fixture shall not extend over the property
boundary
5 A specific landscape plan planting schedule and provisions for maintenance acceptable to
the Director of the Division of Building and Planrung/designee shall be submitted with a
performance bond for the project or other suitable guarantee pnor to release of building perniits
Landscaping shall be installed and maintained so that sight distance at access points is not
obscured or impaired Landscaping shall be provided as per Chapter 14 806 of the Spokane
County Zorung Code, except for the following authonzed modifications
An eleven (11)-foot wlde stnp of Type I landscaping shall be provided within the subject
property and adjacent to the north property line
A five (5)-foot wide stnp of Type I landscaping shall be provided within the subject
property and adjacent to the east property line
6 The Division of Building and Planrung shall prepare and record with the Spokane County
Auditor a Title Notice, noting that the property in question is subJect to a vanety of special
conditions imposed as a result of approval of a land use action This Title Notice shall serve as
public notice of the conditions of approval affecting the property in question The Title Notice
should be recorded within the same time frame as allowed for an appeal and shall only be released,
in full or in part, by the Division of Building and Planning The Title Notice shall generally provide
as follows
