Nonsigruficance on November 13, 1998
Site Description: The site is approximately 2 5 acres in size and relatively flat in
topography The property is improved with a residence, a detached accessory building and a
vacant 2-story commercial bullding
Surrounding Conditions. Sprague Avenue and Sullivan Road in the area are designated
as Pnncipal Artenals by the County Artenal Road Plan, and serve as major traffic and
commercial comdors in the Valley area Sprague Avenue east of Sullivan is in the process of
being widened, resurfaced and public sewer lines installed The site is also located south of and
adjacent to the undeveloped nght of way for Main Avemie The land lying northerly of such
nght of way in the viciruty is zoned Urban Residential-3 5(UR-3 5) and developed with single-
family homes on parcels ranging from 1-5 acres in size The land lying west of the south portion
of the slte is zoned B-3 and developed for retail use, while the land lying west of the north
portion of the site is zoned Urban Residential-22 (UR-22) and developed with multi-family
residences The land lying east of the site is zoned B-3 and developed for retail uses The land
lying south of the site across Sprague Avenue ls zoned Light Industnal (I-2) and used for retail
purposes
Project Description• The appllcation proposes to rezone the site to the B-3 zone to allow the
more intensive uses permitted in such zone The site plan of record dated August 27, 1998 illustrates
development of the site for 4 single story warehouses, ranging in size from 5,000 to 5,500 square
feet, and for 2 single story office buildings of approximately 2,500 sguare feet each The applicant
intends to remove the existing structures on the site to facilrtate development

A Approval cntena
In considenng a rezone application, Washington case law generally provides that 1) there is
no presumption in favor of the rezone, 2) the applicant for the rezone must prove that conditions
have substantially changed in the area since the last zorung of the property, and 3) the rezone
proposal must bear a substantial relationship to the public health, safety or welfare Park-ridge v
Seattle, 98 Wn 2d 454, 462, 573 P 2d 359 (1978), and Bjarnson v Krtsap County, 78 Wn App
840, 899 P 2d 1290 (1995)
A comprehensive plan is considered as a general bluepnnt for land use regulation by local
governments Only general conformance with a comprehensive plan is required to approve a
rezone See Citizens for Moaint Vernon v City of Mount Vernon, 133 Wn 2d 861, 873, 947 P 2d
1208 (1997), and Cathcart v Snohomtsh County, 96 Wn 2d 201, 211-12, 634 P 2d 853 (1951)
Where a comprehensive plan conflicts with zorung regulations, zorung regulations will usually
be construed to prevail See Weyerhaeuser v Pierce County, 124 Wn 2d 26, 43 (1994), 873 P 2d
498 (1994)
The County Heanng Examiner Ordinance authonzes the Heanng Examiner to grant, deny
or grant with such condihons, modifications and restnctions as the Examiner finds necessary to
make a rezone application compatible with the Spokane County Generalized Comprehensive
Plan and applicable development regulations See County Resolution No 96-0171, Attachment
"A", paragraphs 7(d) and section 11, and RCW 36 70 970 Development regulatlons include
without limrtation the County Zoning Code, the State Environmental Policy Act (SEPA) and the
County's Local Environmental Ordinance (chapter 11 10 of the Spokane County Code)
Section 14 402 020 of the Zomna Code authonzes amendments to the Code based on any
one of 6 grounds, wrthout dlfferentiating between zoning text revisions and amendments to the
official zoninQ map Zoning Code 14 402 020 (1) authonzes the Code to be amended if it is "
consistent with the Comprehensive Plan and is not detnmental to the public welfare" Zoninc;

are the most relevant local cntena for consideration of the current rezone application

conforms with the Snokane Countv Generalized Comprehensive Plan, bears a substantial
relationshln to and will not be detnmental to the public health safety and eeneral welfare, and
comnlies with the Sookane Countv Zonme Code and other applicable development reaulations
The site is designated within the Ma9or Commercial category of the Comprehensive Plan
Suc11 category is intended to provide the opportunity for development of commercial uses,
specifically communlty and reglonal shopping centers and commercial uses directly related to
major throughways Major Commercial areas typically require a full line of publlc services and
utilities, including public sewer The Major Commercial category indicates that commercial
developments should be buffered or spatially separated to protect adjacent areas Comprehensive
Plan, Sectlon 6, Goal 6 1, Objective 6 1 a and Decision Guideline 6 12
The applicant proposes to rezone the site to the Reglonal Business (B-3) zone The B-3 zone
is intended to implement the MaJor Commercial category of the Comprehensive Plan, including
those policies whlch encourage commercial development along Pnncipal Artenals and the
establishment of regional-serving commercial uses Zoning Code 14 628 100 The proposed
rezone clearly lmplements such pollcies, since it is located along a Pnnclpal Artenal and B-3 uses
are lntended for the site The proposal is also served by a hlgh level of public services and
facilities, including public sewer The proJect srte is included inside the intenm urban growth
area (IUGA) boundanes designated by the County pursuant to the State Growth Management A.ct
No opposition was expressed to the proposal dunng the public heanng process B-3 zoning
is the preciominant zoning in the area along the south side of Sprague Avenue, and B-3 zone uses
are found in the viciruty The development standards of the B-3 zone ensure adequate bufferulg
for the project in relation to adjacent uses The proposal will provide reglonal business servlces
to the growing population in the Spokane Valley The Examiner agrees wlth the Staff Report
that the project is consistent with the Comprehensive Plan, and will serve the public welfare
Detailed site plan review will be required pnor to issuance of a building permit, to assure
the project's consistency with the development standards of the B-3 zone The project has been
conditioned for compliance with such standards
The procedural requirements of chapter 43 21 C RCW and chapter 11 10 of the Spokane
County Code have been met The Heanng Examiner concurs with the Determinahon of
NonSignificance issued by the Division of Building and Planning No adverse comments were
received from the reviewing public agencies As conditioned, the proposal will not have more
than a moderate effect on the quality of the environment

C Conditions in fihe area in whlch the property ls located have chaniZed substantiallv since the
pronertv was last zoned
In applying the changed circumstances test, courts have ]ooked at a vanety of factors,
including changed public opuuon, changes m land use pattems in the area of the rezone proposal,
and changes on the property itself Washington courts have not reqwred a"strong" showing of
change The rule is flexible, and each case is to be judged on its own facts Bassani v County
Commissioners, 70 Wn App 389, 394 (1993)
Recent cases hold that changed circumstances are not required for a rezone if the proposed
rezone implements policies of a comprehensive plan See Bjarnson v Kttsap County, 78 Wn
App 840, 846 (1995), Save Our Racral Environment v Snohonttsh Coainty, 99 Wn 2d 363, 370-
371 (1983), and Ticgwell v Kittitas County, 90 Wn App 1, S, footnote 6(1997) As discussed
above, the project generally conforms to the Comprehensive Plan
Changed condrtions supporting the project include improvements to Sullivan Road west of
the site, the planned widening and lmprovement of Sprague Avenue, including the planned
extension of public sewer, the recent rezone of a 67 acre site located approximately 560 feet
west of the site from the B-2 zone to the B-3 zone, other intensive commercial rezone activity
and development in the area, increased populatlon growth in the Valley area, increased traffic
along Sprague Avenue and Sullivan Road, and designation of the site ~vithin the County's IUGA
boundanes
IV DECISION
Based on the Findings of Fact and Conclusions of Law above, the above rezone application
is hereby approved, subJect to the condrtions of the vanous public agencies specified below
Any conditions whlch have been added or significantly revised by the Examiner are italiciZed
Failure to comply with the conditlons of this approval may result in revocatlon of this
approval by the Heanncy Examiner This approval does not waive the appllcant's obligation to
comply with all other requlrements of other agencies withjunsdiction over land de~=elopment
SPOKANE COUNTY DIVISION OF PLANNING
1 All conditions imposed by the Spokane County Heanng Examiner shall be binding on the
"Applicant," which term shall include the developer (s) and owner (s) of the property, and their
hetrs, assic..;ns and successors
2 The proposal shall comply tivith the Regional Buslness (B-3) zone, the Aquifer Sensitive
Area Overlay zone, and other applicable provisions of the Spokane County Zoning Code, as
amended
3 Prior to issuance of a building permit, a specific lighting and slg-ning plan shall be
submitted to the Division of Plannmg for review and approval

4 Direct light from any extenor area lighting fixture shall not extend over the praperty
boundary
5 A specific landscape plan, planting schedute and provisions for maintenance acceptable to
the Director of the Divlsion of Planning/deslgnee shall be subrrutted with a performance bond or
other suitable guarantee for the proJect pnor to release of building permrts Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or unpaired
6 The applicant shall develop the subject property generally in accordance wrthin the srte
plan of record dated August 27, 1998 A detailed site plan shall be submitted pnor to issuance of
a building permit, whlch complies with the conditions of approval, the County Zoning Code and
applicable development regulations Vanations from the approved site plan, when approved by
the Director of the Divlsion of Planning/designee, may be permirted in accordance with Sectlon
14 504 040 of the County Zoning Code All vanations must conform to regulahons set forth in
the Spokane County Zoning Code, and the onglnal intent of the development plans shall be
maintained
7 Any division of the subject property for the purposes of creattng additional lots/parcels
shall be reviewed by the Director of the Division of Planning/designee for compliance wlth the
Spokane County Subdivision Ordinance and all other applicable local, state and federal
ordinances and development regulations, as amended
S The Division of Planning shall prepare and record with the Spokane County Auditor a Title
Notice noting that the property in questton ls subject to a vanety of special conditions imposed as
a result of approval of a land use action The Title Notice shall serve as public notice of the
conditions of approval affecttng the property ln question The Title Nohce should be recorded
within the same time frame as allowed for an appeal and shall only be released, in full or u-i part,
by the Division of Planning The Title Notice shall generally state as follows

Prior to release of a building permit or use of property as proposed
1 Access permits for approaches to the County Road System shall be obtained from the
County Engineer
2 The applicant shal] submit drainage and access plans for approval by the Spokane County

3 The applicant shall submit, for approval by the Spokane County Engineer and the Spokane
Colulty Health Distnct, a detailed combined on-site sewage system plan and surface water
disposal plan for the entire project, or portion thereof if the development is phased

4 A parking plan and traffic circulation plan shall be submitted and approved by the Spokane
County Engineer Tlle design, location and arrangement of parking stalls shall be in accordance
wrth standard engineenng practices Paving or surfacing as approved by the County Engineer
will be required for any portion of the project which ls to be occupied or traveled by vehlcles
5 All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bndge construchon and other applicable county standards and/or
adopted resolutions pertairung to Road Standards and Stormwater Management in effect at the
date of constructlon, unless otherwise approved by the County Engineer
6 Access to Main Avenue shall be prohibited until such time as specifically authonzed by the
Spokane County Engineer
7 Roadway standards, typlcal roadway sections and drainage plan requirements are found ln
Spokane County Resolution 95-0498, as amended, and are applicable to tlus proposal
8 No construction work is to be performed withln the existing or proposed nght of way until

Comprehensive Plan The subject property is located in the MaJor Commercial Category of the
Comprehensive Pfan The Major Commercial Category is intended to provide the opportunity for
development of commercial uses, specifically community and regional shopping centers and
commercial uses, directly related to major throughways Highway and arterial strip commercial areas
will usually be made up of businesses on individual parcels clustered along a heavily traveled street or

another, but rather is of a single-purpose nature
Most commercial development wili be on relatively flat land and building of low profile Paved parking,
streets and man-made structures will dominate the site with few natural features to be found
Landscaping, screening, lighting, signage and other architectural treatment will provide for
aesthetically pleasing development Major Commercial areas require a fuli line of public services and
utilities These include service by or commitment to sanitary and storm sewers, public water systems
and underground utilities such as telephone, gas and electricity The subject property is located on a
Principal Artenal and will be served by public services including public water and sewer
Goal 6 1 of the Major Commercial category is to "Promote development of cornmercial land in a
manner which is complimentary and compatible with adjacent land uses and the surrounding
environment " Specifically Decision Guideline 6 1 1 states that "The best means of encouraging
compatibility between commerciai uses and adjacent land use categones will be accomplished by
considering provision of buffenng needs, and the provision of landscaping needs " The adjoining
areas along the Sprague Avenue commercial corridor are dominated by commercial uses and the
proposed Regional Business (13-3) zone is compatible with adJacent land uses Decision Guideline

and planned public transit facilities and routes " Review of the site plan of record indicates that the
subject property has adequate off-street parking and has direct access to the public transit route along
Sprague Avenue
This proposal is generally consistent with the Goais, ObJectives and Decision Guidelines of the MaJor
Commercial category
Zoning Analysis The purpose and intent of the Regional Business (B-3) zone is to implement the
Major Commercial category of the Comprehensive Pian and to provide for the location of a wide range
of retail and service activities The uses within this zone will often require large areas for customer
parking, retail services, some outside activities, display and other commercial activities General
charactenstics of these areas include paved roads and sidewalks, pubiic sewer and water, and a full
line of public services including manned fire protection and public transit accessibility Chapter
14 628 315 (Minimum Lot Area and Minimum Frontage) of the Spokane County Zoning Code requires
Regional Business (B-3) zones to have frontage on a Pnncipai Arterial or higher classification and this
proposal has direct frontage on Sprague Avenue, which is designated on the Spokane County Arterial
Road Plan as a Pnncipai Arteriai
Existing zoning in the surrounding area is a mix of Urban Residential-3 5(UR-3 5), Urban Residential-
22 (UR-22), Light Industnal (I-2), Community Business (B-2) and Regional Business (B-3) Regional
Business (B-3) is the predominant zoning found along the Sprague Avenue commercial corridor The
properties adjacent to the site are zoned UR-3 5, UR-221 I-2, B-2 and B-3
The proposed zone reclassification from Community Business (B-2) to Regional Business (B-3) is
generally consistent with the purpose and intent of the Regional Business (B-3) zone

The State Environmental Policy Act (SEPA) chapter 43 21C RCW, requires all governmental
agencies to consider the environmental impacts of a proposal before making decistons An
Environmental Impact Statement (EIS) must be prepared for all proposals with probable
significant adverse impacts on the quality of the environment The purpose of this checklist is to
provide information to help you and the agency identify impacts from your proposal (and to
reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide
whether an EIS is required

This environmental checklist asks you to desenbe some basic information about your proposal
Governmental agencies use this checklist to determine whether the environmental impacts of your
proposal are significant, requinng preparatton of an EIS Answer the questions briefly, with the
most precise information known, or grve the best descnption you can
