FINDINGS OF FACT AND CONCLUSIONS The Hearing Examiner has reviewed the zone reclassification application and the evidence of record and adopts the following findings of fact and conclusions: A. GENERAL INFORMATION: Applicant: Kyle Kinyon, Allegro Escrow Services, 12817 East Sprague, Spokane, WA 99216 Address: East 12423 Broadway Avenue Location: Generally located north of and adjacent to Broadway Avenue, approximately 550 feet east of Pines Road in the NW '/a of Section 15, Township 25 North, Range 44 EWM, Spokane County, Washington. Legal Description: Tract B of Short Plat No. SP-757-92, Spokane County, Washington. Zooing: Urban Residential-22 (LTR-22) Comprehensive Plan Category: The property is designated in the Urban category of the Spokane County Generalized Comprehensive Plan. The site is within the Priority Sewer Service Area (PSSA) and the Aquifer Sensitive Area (ASA). Environmental Review: A Determination of Nonsignificance was issued by the Division of Building and Planning on September 13, 1996. HE Findings, Conclusions and Decision ZE-32-96 Page 1 ~ A Site Description: The site is 22,712 square feet in size, 128 feet wide and 177 feet deep, and is flat. There is an existing 1,860 square foot, vacant, one-story residence in the center of the lot. Two small accessory structures are also located on the site. The site fronts along the north side of Broadway Avenue, which is classified by the Arterial Road Plan as a Principal Arterial. Surrounding Conditions: The property fronts on a significant east/west arterial corridor and is one block ea.st of Pines Road (State Route 27), a major north/south commercial corridor. A few lots west of the site is a single-family residence converted for use as a dentist office, pursuant to a rezone approved in 1995 (ZE-42-95). Immediately west of such lot is a paved road/easement that provides access to the public utility facility located immediately north of the . site. Older single-family residences are located west and immediately east of the site. An Urban Residential-22 (LTR-22) zone for multifamily housing is located east of the site at the northwest corner of Broadway Avenue and Vercler Road. Urban Residential-22 (iJR-22) zoning can also be found to the southwest across Broadway Avenue. Project Description: The site plan shows the existing residence with a 600 foot addition on the back side, existing accessory structures and landscaping, and seven proposed parking spaces. Minor modifications are planned to improve the appearance of the building. The landscaping will need to be upgraded to comply with the development standards of the Urban Residential-22 (UR-22) zone. Detailed site plan review to determine compliance with applicable regulations and the conditions of approval will be administrative. The applicant testified at the public hearing that the site would be used as office space for Allegro Escrow Services, which is primarily a mail order business. B. ZONE RECLASSIFICA'I'IO1V ANALYSIS: To be approved, the zone reclassification application must comply with the requirements of Washington case law and statute for the approval of rezones, and Spokane County Zorung Section 14 402 020 (1)(2) The follownng findings of fact and conclusions are made 1 The nronosed zone reclassification eenerallv conforms vvith the Suokane Countv, Generalized Comvrehensive Plan The Urban category of the Comprehensive Plan is intended to provide the opporturuty for a "citylike" environment, including a vanety of land uses served by a high level of public faciLties and services The more intensive uses such as light industnal should be located near the heavily traveled streets, wnth the less intensive uses such as residential isolated from the noise and traffic The Urban category indicates that where conflicts may occur between use types, screening and other performance standards may be required to make them compatible The proposed use of the site for a low mtensity business or professional office is consistent vrnth these policies The proposal is served by a high level of public services, vncluding public sewer and water The Urban Residential-22 (IJR-22) zone is an unplementation tool for the lvgh density residential uses contemplated in the Urban category, pnmarily for multiple-family dwellmgs located near major or secondary artenals Offices are permitted in the Urban Residential-22 (IJR-22) zone to provide some of the sernce needs generated by high-intensity uses The zone is also used to provide transition between low or medium density multiple-family housing and low intensity industnal uses The proposal is consistent with this use of the Urban Residential-22 (UR-22) zone to implement the Urban category 2 Conditions in the area in which the property is located have chanQed substantiallv since the vrovertv was last zoned The zoning of the srte was designated Urban Residential-22 (UR-22) under the Zomng Code on January 1, 1991, pursuant to the Program to Implement the Spokane County Zoning Code This zorung took into consideration the previous zorung of the site under the now expired Zoning Ordinance and the Comprehensive Plan adopted in 1981 The Zomng Code was adopted in 1986, and provided for a five year transrtion penod under the Program to Implement between the old zones of the Zomng Ordinance and the new zones of the Zomng Code, for property in the county HE Findings, Conclusions and Decision ZE-32-96 Page 3 ~ - 1 , The neighborhood of the site along Broadway Avenue appears to be in transrtion from single-family uses towards more intensive development, including offices and commercial uses Public sewer has been extended along Pines Road (SR 27) and along portions of Pines in recent years, and the area has become increasingly urbanized 3 The proposed rezone bears a substantial relationship and is not detrimental to the vublic health, safetv and Qeneral welfare The proposal generally conforms to the Comprehensive Plan No opposition was expressed . to the proposal at the pubhc heanng or in the comments from public agencies A tnp distnbution analysis prepared on behalf of the applicant by an enguleenng consultant indicates that the project will not impact Pines Road (SR 27) or the Pines Road (SR-27)/Interstate 90 Interchange e 4 The nronosed zone chanp-e comphes with the vrovisions ofthe State Environmental Pohcv. This trip distribution has been done as a part of the anticipated moving of this business from Sprague & McDonald to Broadway east of Pines. The proposed site which Allegro Escrow is moving to is presently a single lot which would otherwise be used for a single family home. A single family home is presently on this parcel, and this use would otherwise remain if Allegro Escrow was not moving there. Therefore, the present use of the site will generate trips from land use category 210, Single Family Dwelling Units, in the Trip Generation Manual, Sth Edition published by the Institute of Transportation Engineers. This will amount to 1 AM peak hour trip, 1 PM peak hour trip and 10 average daily trips. Most of the business associated with Allegro Escrow is mail order so that his trip generation is very low. Allegro Escrow has five employees and this work force is stable. The newest employee was hired 4'/z years ago. One of these employees lives in the southern Spokane Valley, two in Otis Orchards, one in Coeur d'Alene, and one near Broadway & McDonald. Moving this business from Sprague & McDonald (it's present location) to Broadway east of Pines will not affect the commute patterns of any of the employees with relation to either Pines or I-90, the nearby state facilities. Of the non-employee trips (customers) to this business, Mr. Kinyon estimates that about 12 customers visit this business per day and that none of these trips occur during the peak hours.
