The area west of the project site is designated Major Commercial The surrounding area within 1000 feet of the project site is classified in five zones to include B-1, B-2, B-3, UR-3 5 and UR-22. Varied land uses including single family dwellings, professional office buildings and a variety of commercial uses are located in the same area. Also, within 250 feet of the site is the intersection of two significant arterial roads, Sullivan Road and Valley Way. Interstate 90 is about 3000 feet north of the project site. Due to this zoning and land use mix and the trend towards commercial development of the vicinity is the project site is deemed to be an area in transition File No ZE-9-00 Staff Report - November 15, 2000 Public Hearing 5 of 8 . + s < The Comprehensive Plan defines "Transition Areas" on page 330 as the fringe areas between two or more Comprehensive Plan land use categories This is an area which can allow developments complying with either of the Land Use Map categories dependent upon the decision makers' site-specific approval It is the intent that the established boundaries between land use categories are accurate and definable on the ground, but the Plan also recognizes that a specific proposal may cross or be adjacent to the boundaries In these instances, depending on the impacts to existing land use categones and the distance a use intrudes into an adjacent category, a Comprehensive Plan amendment may not be required to allow a use that is generically incompatible with the category a site is located in Section D of the detailed definition of the Urban category indicates major commercial users are incompatible with the Urban category The proposed Community Business (B-2) Zone is not intended to implement the Urban category but rather the Major Commercial category However, Objective 1 5 e of the Urban category states, that when a neighborhood experiences pressure for change in character, such change shall be permitted upon appropriate review Based on the data in the first paragraph of this section (Comprehensive Plan) and based on the intent and spirit of the Comprehensive Plan language addressed in the paragraph immediately above the subJect site is located in an area that is in transition Since the rezone site is located in a land use transitional area and considering the type of land uses permitted in the requested B-2 Zone such zone designation appears to be consistent with the transitional area policy in the Comprehensive Plan Wording within the Comprehensive Plan specifically relating to and supporting the improvements on the subject site is as follows• The Major Commercial category is intended to provide the opportunity for development of commercial uses, specifically community and regional shopping centers and commercial uses, directly related to major throughways Certain residential uses, particularly multi-family developments may be compatible through the use of proper screening and performance standards Major Commercial areas feature high-intensity uses Heavy automobile traffic and related congestion may create pollution problems, especially along commercial strip development Arterial strip commercial development will usually be made up of businesses on individual parcels clustered along heavily traveled streets or highways each providing off-street parking. Shopping is not done by walking from one store to another but rather is of a single- purpose nature Most commercial development will be on relatively flat land and buildings will be of a low profile Paved parking, streets and man-made structures will dominate the site with few natural features to be found Landscaping, screening, lighting, signage and other architectural treatment will provide for aesthetically pleasing development. The project site is relatively flat and commercial projects locating there on will provide for landscaping, screening, lighting and signage as required by the County Zoning Code Major commercial areas require a full line of public services and utilities including sanitary and storm sewers, public water systems Underground utilities such as telephone, gas, electricity are also common in commercial areas. These services are available to the proJect site except storm sewers Surface drainage will be accommodated on-site due to the application of surface drainage requirements in the County Stormwater Management Guidelines Goal 6.1 promotes development of commercial land in a manner which is complementary and compatible with adjacent land uses and the surrounding environment. This concept is further supported by Objectives 6 1.a-d and Decision Guidelines 6 1.1-6.1.3 which encourage buffenng, landscaping and structure orientation as a means of assuring compatibility between commercial File No ZE-9-00 Staff Report - November 15, 2000 Public Hearmg 6 of 8 and adjacent land uses Site specific commercial developments will be consistent with these Decisions Guidelines due to the application of County' development and environmental codes which have provisions which require that these issues be adequately addressed Objectives 6 1 c and 6 1 d, and respective Decision Guidelines 6 1 5 and 6 1 6 identify the need to provide adequate off-street parking, circulation patterns and access to public transit Commercial development should conform to plans and regulations of the County water, sewer, utility and special districts Prior to the issuance of any building permit for the site, compliance with the applicable parking standards identified in the Spokane County Zoning Code must be demonstrated and internal circulation patterns must be approved by the County Engineer Public transit is available as Spokane Transit Authority bus route 90 serves Sullivan Road and the immediate vicinity of the proJect site During proJect review sewer and water purveyors will be asked to review site development plans to assure that the project conforms to their requirements The proposal is not consistent with Objectives 6 1 f and 6 1 g nor Decision Guideline 6 17 of the Major Commercial category of the Comprehensive Plan These polices encourage the clustering of commercial uses with shared physical facilities such as ingress/egress, parking, signs, buffering and landscaping Aithough the proJect site is located in an area trending to commercial development the proJect site will not be able to share parking, signage, ingress/egress and buffering. The parcel immediately west of the proJect site is a power substation and the commercial land use (Car Toys retaii store) northwest of the project site and fronting on Sullivan Road is developed in a manner where sharing of these features would be very difficult In essence, Valley Way seems to be the only reasonable access to the site precluding any shanng Additionally, the analysis in the second paragraph of the Zoning Analysis Section below regarding unplanned commercialization of Valley Way east of Sullivan Road leads to the conciusion that the project site is inconsistent with the Objective 6.1 f and 6 1 g and Decision Guideline 6 17. It is the intent of Objectives 6 1 i and 6.1 j and Decision Guideline 6.1 13 to encourage commercial development that is in scale with the needs of the County population and existing development. Small scale commercial developments should be located adjacent to residential neighborhoods. The applicants have not provided any information identifying the need for additional community serving commercial development locating off of the Sullivan Road commercial corridor and adjacent to a single family home area Although 5/6ths the project site is located in the Urban category of the Comprehensive Plan, the site is subject to the definition of a transition area provided within the Comprehensive Plan The proposal is generally consistent with the majorlty of the Objectives and Decision Guidelines of the Major Commercial category, assuming any site specific development project complies with all County development and environmental mitigation codes However, the proposal is in conflict with Objectives and Decision Guidelines which encourage commercial clustering for provisions of shared physical facilities However, these policies and recommendations can be satisfied through site design The subject application is consistent with the requirements of County Growth Management Resolution 97-0321 Zoning: The purpose of the B-2 zone is to provide for the establishment of commercial centers which will meet the needs of a community for a wide range of retail and service uses and to implement the Major Commeraal Category of the Comprehensive Plan. The "B-2" zone is intended primarily to accommodate community shopping facilities consisting of varied retail, service and office establishments grouped at one location served by arterials where they can serve a trade area encompassing the several neighborhoods, usually within a distance of approximately one to one and one-half (1-1/2) miles of such zone. Approval of the subJect application will add 1 3/ acres, or a small fraction, to the existing contiguous B-2 Zone The contiguous B-2 Zoning in the vicinity is part of the already well established ribbon of commercial development and commercial zoning on both sides of Sullivan Road from Interstate 90 to Sprague Avenue, a distance of about 4000 feet Commercial clusters are evoiving at the Interstate 90/Broadway Avenue end and the Sprague Avenue end The subject project site is located almost half of the way between Interstate 90 and Sprague Only on the east side of Sullivan Road is commercial development and commercial zoning occurring on 2"d tier parcels not fronting on Sullivan Road However, an analysis of the commerciai zoning in the area shows that the owners of all 2"d tier parcels also own contiguous 1s' tier parcels fronting on Sullivan Road and the commeraal projects thereon are accessed from Sullivan Road Should the subject reclassification be approved and should commercial projects developed thereon have access only to Valley Way such a situation will be setting a precedent for the area. Such occurrence may encourage other 2"d tier ownerships in the vicinity to commercially develop their property thereby allowing unplanned commercial development along Also, the approval of this application may set a precedent that encourages commercial ribboning along Valley Way east of Sullivan Road The variety of services and facilities described above necessary to serve a B-2 Zone are available to the project site except sidewalks do not exist on Valley Way. There is no site specific commercial development proposed by the applicants at this time. However, at such time as it is proposed the applicants or the assigns and successors will be required to comply with all Spokane County development regulations. This report will follow the draft standards for doing traffic distribution letters as put forward by Spokane County Engineering. ~ Project Description The parcels proposed for this rezone are located east of a power sub-station which lies on the northeast corner of Sullivan / Valleyway.
