category of the Comprehensive Plan The Major Commercial category is
intended to provide the opportunlry for development of commercial uses,
specifically, commuruty and regional shopping centers and major
throughways Under the detailed defirution of the Major Commercial
category it states "Residential use in Major Commercial areas is not intended
to be a lugh pnonty in tlus category and may be hrruted to pre-existing uses
Certaui residential uses, particularly multi-family developments, may be
compatible through the use of proper screerung and performance
standards" In tlus case the proposal does meet the performance standards
of the proposed Urban Residential-22 (UR-22) zone and can be considered
to be an appropnate use

Items Noticed: Spokane County Comprehensive Plan, Spokane County Zoning Code,
Spokane County Code, Spokane County Resolution Nos 96-0171 and 96-0294
Procedura9 Issue: On May 28, 1996, the Heanng Examiner issued a letter indicating that the
proposal would be approved, subject to conditions and the entry of formal written findings,
conclusions and decision The Heanng Examiner was later advised by Division of Building and
Planrung staff that an error had been made in the staff report as to the actual density of the
proposal The staff report erroneously indicated that the site of the proposal was 1 53 acres and
that the density of the proposal was 13 72 units per acre The hearing notice for the proposal
erroneously indicated the size of the site as 1 53 acres, but-correctly stated the number of
multifamily units in the proposal as 21
The site is actually 79 acres and the density of the proposal is actually 26 67 units per acre
The source of error was ambiguous information provided by the applicant's representative on the
rezone application and the site plan of record The proposed density of 26 67 units per acre is
greater than the density ordinarily allowed in the Urban Residential-22 (UR-22) zone of 22 uruts
per acre However, bonus density can be earned under Chapter 14 820 of the Zoning Code for up
to 27 uruts per acre As discussed in paragraph 5 of Section C below, the proposal meets the
requirements for such bonus density If bonus density was not allowed, the Urban Residential-22
(UR-22) zone would only allow 17 uruts on the site in place of the 21 units requested
Section 14 820 020 of the Zoning Code requires that applications for bonus density be made
on forms provided by the Division of Building and Planning, and that Division staff review and
make a recommendation at the public hearing regarding such request The practice of the

Division of Building and Planning is to have the request for bonus density inserted onto the
rezone application, there is no blank provided on such form for the applicant to fill in to request
bonus density In the present case, there was no notation of the request for bonus density on the
application and there was no recommendation by staff or any discussion at the public hearing
regarding the request for bonus density
Because of the procedural irregulanty, the applicant was asked through his agent if he
would like the opporturuty to have a corrected notice of heanng republished and mailed and the
matter reheard with the bonus density request formally noted The applicant requested that the
request for bonus density be allowed without reheanng The Heanng Examiner notes that the
only testimony at the public heanng indicating any concern with the proposal was the owner of
the adjoining apartment complex, Max Johnston Mr Johnston testified that a visual bamer was
needed between his apartment complex and the site because the proposal was at the maximum
density allowed in the zone, and that the buildings that would be installed on the site would be
prorrvnent He requested that Type III landscaping and a six-foot sight-obscunng fence be
installed along the proposal's west boundary, adjacent to his property
The Hearing Examiner could require the rezone application and request for bonus densrty
reheard, after corrected notice and an amended application However, the Heanng Examiner feels
this would probably be a useless act, since the request for bonus density appears appropnate The
site plan does show the planned configuration of the proposal for 21 units and the relatively small
size of the site is apparent from a visit to the slte The Hearing Examiner has required the
installation of Type III landscaping and the installation of a 6-foot high sight-obscunng bamer
along the west boundary of the site, as requested by Mr Johnston
The error made by the applicant on the application and site plan appears to be inadvertent
The application ambiguously states the area of the site to be "34,307 square feet, 1 53 acres"
The site plan states the size of the site as 1 53 acres, but contains accurate statements from wluch
the correct size of the site can be readily ascertained, such as the percent of building coverage
("32 8% or 10,440 sq ft") and percent of open space ("67 2% or 23,867 sq ft") The Hearing
Exarrnner suggests that the County's rezone application form be revised, or supplemented by
another form, so that there are blanks for the applicant to fill in indicating the proposed densrty of
a residential project, if bonus density is being requested and the particulars of the bonus density
request
C. ZONE IZ]ECLASSIEFgCA'g'ION ANAI,'YSIS:
To be approved, the zone reclassification application must comply with the requirements
of Washington case law and statutes for the approval of rezones and Spokane County Zoning
Code Section 14 402 020 (1)(2)
The follovving findings of fact and conclusions are made

1 The nrooosed zone reclassification P-enerallv conforms to the Spokane Countv Generalized
Comnrehensive Plan
The site is designated within the Ma~or Commercial category of the Comprehensive Plan
This category is intended to provide the opportunity for development of commercial uses,
particularly community and regional shopping centers along major traffic comdors Wtule
residential use is not intended to be a high pnonty, the Ma,Jor Commercial indicates that certain
residential uses, especially multifamily developments, may be compatible through the use of
proper screening and performance standards
Use of the site for commercial uses is compromised by the poor visibility of the site from
Sprague Avenue Multifarruly uses are located dtrectly south and west of the site The proposal
is basically a transitional use between intensive commercial uses along Sprague Avenue and
single-farruly uses to the north The site is appropnate for multifamily development, provided
there is adequate screening and buffenng to mitigate conflicts with adjoining properties
The conditions of approval require a six-foot high sight-obscucing bamer and Type III
landscaping along the east 90 feet of the north property line of the site, adjacent to the Urban
Residential-3 5(UR-3 5) zone and single-family uses Type III landscaping is also indicated along
those portions of the eastern boundary of the site that abut Urban Residential-3 5(UR-3 5)zoning
The development standards of the Urban Residential-22 (LTR-22) zone do not require landscaping
and buffenng along the west boundary of the site, which boundary lies adjacent to Urban
Residential-22 (LTR-22) and Neighborhood Business (B-1) zoning However, as requested by the
adjoimng landowner, the Heanng Examiner has made the installation of a 6-foot high sight-
obscunng bamer and Type III landscaping along such border a condition of approval Since the
applicant has requested a rezone, including bonus density, the decision-maker may impose
additional conditions of approval to ensure the public health, safety and welfare Requinng
additional buffenng and landscaping along the western border of the site is appropnate,
considenng the bonus density requested by the applicant, the proposed height of the buildings to
be located along the west property line of the site (40 feet), and the close proximity and height of
the apartment complex to the west

The northwest portion of the site is already zoned Urban Residential-22 (UR-22) The
viciruty has developed in such a way that the site does not have adequate visibility from Sprague
Avenue for commercial development Public sewer has been extended to the area, which allows
for higher residential densities The population of the area has steadily increased in the 1990s

The proposal generally complies with the Comprehensive Plan The site has been
appropnately buffered from adjacent properties There was no direct opposition to the proposal
dunng the public heanng process While access to the site is narrow and cuts through an existing

parlcing lot to the southwest, the access appears to be consistent with the owner's easement
nghts The applicant will be requtred to place a gate across the fire and emergency access at the
west border of the site The proposal helps fill a need for low cost housing in the Spokane Valley
The Hearing Examiner notes that the Washington State Department of Transportation
(VVSDOT) submitted a letter dated Apn124, 1996 requesting the applicant to prepare a trip
distnbution analysis to determine the proposal" impact on the Interstate 90/State Route 27
interchange This letter was not discussed at the public heanng and VVSDOT personnel did not
appear at the heanng In a telephone conversation with Leonard Cash, Regional Planning
Engineer for WSDOT, the Heanng Examiner was advised that WSDOT was withdrawing its
request for a trip distnbution analysis This was based on the distance between the proposal and
the Interstate 90/State Route 27 intersection A confirming letter will be provided by WSDOT

No significant, probable adverse environmental impacts were identified dunng the
environmental review process The procedural requirements of chapter 43 21 C RCW and chapter
11 10 of the Spokane County Code have been met

As noted above, bonus density must be authorized to allow the proposed density of 26 7
units per acre in the Urban Residential-22 (UR-22) zone Section 14 820 060 allows bonus
densities up to 27 units per acre for direct sanitary sewer hookup This includes 3 5 units per acre
for direct hook-up to public sewer, 5 units per acre for location within one-quarter mile walking
distance of public transit, 5 units per acre for off-site convemence shopping facilities that are
functionally accessible within walking distance, and 5 units per acre for pnmary means of access
via an arterial The proposal meets all these requirements The proposal is conditioned for
connection to public sewer Public transit is available at Sprague Avenue, in close proximity to
the site The proposal directly accesses onto Sprague Avenue, a Principal Artenal, via pnvate
dnveways Off-site convenience shopping is located in the vicinity along Sprague Avenue,
particularly at the intersections of Sprague Avenue with Pines Road and McDonald Road
Bonus density under Chapter 14 820 of the Zoning Code is only allowed if the development
standards of the underlying Urban Residential-22 (UR-22) zone are met and is not detnmental to
the public health, safety and welfare The Heanng Examiner finds that such standards have been
met and that the proposal as conditioned is not detnmental to the public health, safety and
welfare
M. DECISION
Based on the Findings and Conclusion above, the above zone reclassification and request
for bonus density is approved, subject to the following conditions

1 The applicant shall subrrvt a revised site plan, showing Type III landscaping and the six (6)-
foot-lugh sight-obscuring bamer descnbed in Section 14 622 365 (2) of the Zoning Code along
the west border of the site The revised site plan shall also show a gate across the fire apparatus
and emergency access road at the west border of the site, meeting fire distnct requirements The
revised site plan shall further show the required six (6)-foot high site-obscunng bamer along the
east 90 feet of the northern boundary of the site The applicant shall provide and maintain all
required landscaping, bamers and gates

3 The Spokane County Division of Building and Planning shall prepare and record with the
Spokane County Auditor a Title Notice noting that the property in question is subject to a variety
of special conditions imposed as a result of approval of a land use action This Title Notice shall
serve as public notice of the conditions of approval affecting the property in question The Trtle
Notice should be recorded within the same time frame as allowed for an appeal and shall only be
released, in full or in part, by the Division of Building and Planning The Title Notice shall
generally provide as follows

and Planning, to provide for emergency access and to meet the minimum frontage standard of the

Pnor to release of a building permit or use of the property as proposed
1 Access permits for approaches to the County Road System shall be obtained from the
County Engineer
2 Applicant shall submit for approval by the Spokane County Engineer drainage and access
plans
3 A parking plan and traffic circulation plan shall be submitted and approved by the Spokane
County Engineer The design, location and arrangement of pa.rlang stalls shall be in accordance
with standard engineenng practices Paving or surfacing as approved by the County Engineer vvill
be required for any portion of the project which is to be occupied or traveled by vehicles
4 Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane Board of County Commissioners resolution 95-0498 as amended and are applicable to
tlus proposal
5 Applicant shall sign "Spokane County Notice to the Public Number 6" which specifies the
following
The owner(s) or successor(s) in interest agree that in consideration of Mutual Benefits
now or to be hereafter denved, do for themselves, their heirs, grantees, assigns and successor(s)
in interest hereby request and authonze Spokane County to include the above described property
in a Road Improvement Distnct (RID) and to support the formation of a Road Improvement
Distnct for improvement of the road(s) described below by requesting and authonzing Spokane
County to place their name(s) on a petition for the formation of a Road Improvement Distnct
pursuant to RCW 36 88 050, or by requesting and authonzing Spokane County to cast their ballot
in favor of a RID being formed under the resolution method pursuant to RCW 36 88 030, andJor
by not filing a protest against the formation of a RID being formed under the alternative
resolution method provided for in RCW 36 88 065 and Chapter 35 43 RCW

If a RID is proposed for improvement of the road(s) descnbed below, said owner(s) and
successor(s)further agree (1) that the improvements or construction contemplated witimn the
proposed RID are feasible and (2) that the benefits to be denved from the formation of the RID
by the property included therein, together with the amount of any County participation, exceeds
the cost and expense of formation of the RID, and (3) that the property within the proposed RID
is sufficiently developed, provided, themselves, their heirs, grantees, assigns and successor(s)
shall retwn the right, as authonzed under RCW 36 88 090, to object to any assessment(s) on the
property as a result of the improvements called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36 88 RCW and to appeal to the Superior
Court the decision of the Board of County Commissioners confirming the final assessment roll,
provided further, it is recognized that actual assessments may vary from assessment estimate so
long as they do not exceed a figure equal to the increased true and fair value improvement(s)
add(s) to the property
It is further acknowledged and agreed that at such time as a RID is created or any County
Road Improvement project is authorized by Spokane County, the improvements required shall be
at the sole expense of the owner(s) of property within the RID or served by the improvements
wnthout any monetary participation by Spokane County
The RID waiver contained in this agreement shall expire after ten (10) years from the date
of execution below This provision is applicable to Sprague Avenue

1 A wet (live) sewer connection to the area-wide Public Sewer System is to be constructed
Sewer connection permit is required
2 Applicant shall submit expressly to Spokane County Utilities Department "under separate
cover", only those plan sheets showing sewer plans and specifications for Public Sewer
Connections and Facilities for review and approval by the Utilities Department pnor to
finalization of the project and or the issuance of permit to connect
3 Arrangements for payments of applicable sewer charges must be made for pnor to
issuance of sewer connection permit
4 Any water service for this project sha11 be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended

suspension of activity dunng certain weather conditions Haul roads should be treated and
emissions from the transfer of earthen matenal must be controlled as well as emissions from all
other construction related activities
3 SCAPCA strongly recommends that all traveled surfaces (i e, ingress, egress, parking
areas, access roads) be paved and kept clean to minimize dust emissions
4 1Vleasures must be taken to avoid the deposition of dirt and mud from unpaved surfaces
onto paved surfaces If tracking or spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces
5 SCAPCA Regulation I, Article V, requires that a Notice of Construction and Application
for Approval be subrrutted to and approved by our Agency pnor to the construction, installation
or establishment of an air pollution source This includes any fuel fired equipment rated at greater
than 400,000 BTU/hour (boilers, hot water heaters, ovens, etc ) It also includes paint booths,
