allowed m the Regional Business (B-3) zone

1 The property is generally located east of and adJacent ta Pines Road, south of and
adjacent to Qhve Awenue in the southwest qvarter of Section 15, Township 25
North, Range 44'EWM, Spokane County, Washington
2 The Commuttee adopts the Planning Department Report as a part of this record
3 The existmg land uses in the area include multi fariuly residences, paint supply
cvmgany, gas station, converuence store, barber shop,lnsurance business and
srngle family residences
4 The proposed use is compatible with existtng uses in the area
5 The property is located withln the Major Comm.ercial and Urban categones of the
Spokane County Comprehensive Plan The western port.ion of the proposal, adjacent
to Pmes Road, hes withm the Niajor Commercial and the eastern portlon of the project
hes witYua the Urban category Therefore, the transition pohcy of the Comprehensive
plan is apphcable to the site
The Nlajor Commercial category is mtended to provide the opgomuv.ty far development
of commercial uses, specifically commuruty and regional shopping centers clirectly
related to major throughways The Urban category is intended ta provide the
vpportunity for development of a"citylilce" envuonment which includes vanous land
uses mcludmg intensive residential development
The proposed zone change from Neighborhood Business (B-1) and Urban
Residential-3 5(UR-3 5) to Regional Business (B-3) is consistent with, and
unplements the Goals, Objectives and Decision Gu.ideluies of the underlyrng TVlajor
Commercial category of the Comprehensive Plan and is consistent with the

7 This project does not have frontage on an artenal road as designated by the Spokane

vanations must conform to regulations set forth in the Spokane County Zorung
Code, and the ongulal intent of the development plans shall be maintained

Tlus will require the add.ition of approximately 10 - 12 feet of asphalt along the

Standard Specifications for Road and Bndge Constniction and other apphcable

and excavation projects be controlled This may reqwre use of water sprays, tarps,
sprinklers or suspension of acuvity dunng certain weather condltions Haul roads
should be treated, and enussions from the transfer of earthen matenal must be
controlled, as well as enussions from all other construction-related activities
3 SCAPCA strongly recommends that all traveled surfaces (i e, ingress, egress,
parking areas, access roads) be paved and kept clean to muurruze dust eirussions
4 Measures must be taken to avoid the deposition of dirt and mud from unpaved

development of commencial uses, specifically community and regional
shopping centers duectly related to major throughways
The Urban category is intended to provide the opportunity for development
of a"cirylike" envuonment which includes vanous land uses including
intensive residential development
A portion of the proposed zone change is located in the "transition area" (the
area zoned Urban Residential-3 5(UR-3 5) It is recogruzed that a specific
proposal may cross Comprehensive Plan boundanes and be situated in a
"transition area" if the proposal does not intrude too greatly into the adjacent
land use category and intrusion is consistent with existing land uses
The proposed zone change from Neighborhood Business (B-1) and Urban
Residential-3 5(UR-3 5) to Regional Business (B-3) as well as the
transition area, is consistent with, and unplements the Goals, Objectives and
Decision Guidelines of the underlying major commercial category of the
Comprehensive Plan
The eastern portion of the site, presently zoned Urban Residential-3 5
2. Arterial Road Plan Tlus project does not have frontage on an arterial
road as designated by the County's Artenal Road Plan Access to the site is
provided by Pines Road, identified as a state lughway and Olive Avenue
3. County Parks Plan: The nearest county park is Valley Mission Park
near the intersectioa of Pines Road and Mission Avenue to the north of the
project

residences and residential vegetation The site is relatively flat and the existing
structures wdl be removed

tended to develop in tlus area due to the close proxurury to a major artenal (Pines

feet) continues to maintaui a presence several hundred feet off of Pines Road to -

The Washuigton State Department of Transportation (WSDOT) requues that any
off-prerruse signage visible to I-90 be prohibited until traffic problems/issue in
regard to the I-90/Pines Road interchange can be resolved as deternuned by the
WSDOT All signage and drainage plans are reqwred to be reviewed by the
WSDOT
Pnor to construction, the apphcant must obtain a road approach pernut from the
WSDOT in order to obtain legal access to Pines Road (SR-27) The proposed

County Planrung Department The review considered the specif'ics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Conditions of Approval, the Generalized Comprehensive Plan, and other
Counry policies and guideluies The Planrung Department has detenruned that "No
probable sigruficant adverse impacts" would result from the proposal being
developed and has issued a Deternunation of Nonsignificance ("DNS")
The "DNS" was cuculated to 13 other agencies of junsdiction and other
agencies/departments affected by the future development for review and comment
The "DNS" comment penod ends November 14, 1995 and was advertised 15
calendar days before said date in the newspaper, by letter to adjacent property
owners witlun 400 feet of the proposal, and by notice on a sign posted on the
proposal site The HeazYng Exarruner may consider additional envuonmental related
testimony at the pubhc hearing

E36A Prior to issuance of a building permit or at the request of the County Engineer in
conjunction with a County Road Project/Road Improvement District, whichever comes

After reviewnng the above development proposal the Wastungton State Department of
Transportation (WSDOT) has the following comments concerning this proposal
1 Due to the lack of capacity and operational problems currently being expenenced at the
Pines/Mssion intersection and at the Pines/I-90 interchange, we would ask that
developments in this area not further contnbute to this problem with out rrvtigation In
particular as it relates to this proposed Dairy Queen fast food restaurant it would seem
unlikely that tlus development would contnbute significant traffic to this intersection due

are submitted to the Spokane County Planning Department for inclusion in the
Design Review Meeting scheduled October 4, 1995
E36A Prior to issuance of a building permit or at the request of the County Engineer in
conjunction with a County Road Project/Road Improvement District, whichever comes

E39 Applicant shall dedicate a 24 feet from centerline on Olive Avenue and the applicable
radius on Olive Avenue and Pines Road
Prior to release of a building permit or use of property as proposed:
E40 Access permits for approaches to the County Road System shall be obtained from the
County Engineer
E41 Access permits and improvements to Pines Road must be approved by the Washington State
Department of Tramsportation (W S D O T)
E43 Applicant shall submit for approval by the Spokane County Engineer road, drainage and
access plans
E44 The applicant shall submit for approval by the Spokane County Engineer and the Spokane
County Health District a detailed combined on-site sewage system plan and surface water
disposal plan for the entire project or portion thereof if the development is phased
