INTRODUCTION
Tlus matter has come before the Hearing Exarruner Comnuttee on November 1'6,
1995 The members of the Comrruttee present are Brenda Bodenstein, Chair,
Toni Nersesian and Harry Gibbons
PROPOSAL
The sponsor, Lany Thompson, requests approval of a Zone Reclassificatlon,
ZE-42-95, from Urban Residential-3 5(UR 3 5) to Urban Residential-22 (UR-22)
for a dental office and those uses allowed in the Urban Residential-22 (UR-22)
zone
Fg1VDINGS OF FACT AND COIVCLUSIONS
1 The property is generally located north of and adjacent to Broadway Avenue,
approximately 250 feet east of Pines Road in the NW 1/4 of Section 15, Townslup
25 North, Range 44 EWM, Spokane County, Washington
2 The Comnuttee adopts the Planning Department Report as a part of tlus record
3 The existing land uses in the area include single fanuly residences and commercial
uses
4 The proposed use is compatible with exlsting uses in the area
5 The Comprehensive Plan category of the subject property is both Urban and Major
Commercial and the subject property is within the Priority Sewer Service Area
(PSSA) and the Aquifer Sensitive Area (ASA) Overlay Zone
The Major Commercial (C) Category is intended to provide the opportunity for
development of commercial uses, specifically commuruty and regional shopping
centers and commercial uses, directly related to major throughways The Urban
(U) Category is intended to provide the opportuniry for development of a"city-lilce"
environment wluch includes various land uses, intensive residential development
and publlc facihties and services (water, sanitary and storm sewer lines, police and
fire protection and other features) Due to the variery and Irux of land uses and
activities found in the Urban Category, there are few land use activities that would
be inappropnate The proposed zone reclassification implements the majority of the
Goals, Objectives and Decision Guidelines of the Urban and Major Commercial
Categones of the Comprehensive Plan
6 The proposed zoning does implement and conform to the Comprehensive Plan
7 The Arterial Road Plan designates Broadway Avenue as a Pnncipal Arterial In
order to unplement the Artenal Road Plan, the County Engineer has requested that a

. v 20 foot wide strip of property along Broadway Avenue be set aside as a future

8 The existing zoning of the property descnbed in the application is Uiban
Residenttal-3 5(UR-3 5) established in 1991, previously established as Agricultui al
Suburban (AS) in 1955 (99-55) and redesignated to Urban Residential-3 5(UR-3 5)
on January 1, 1991 pursuant to the Program to Implement the Spokane County
Zoning Code The proposal does conform to the requirements of the proposed zone
9 The provisions of RCW 43 21C (The State Environmental Policy Act) have been
complied with and a Deternunation of Nonsignificance (DNS) was issued The
Committee, after independent review, hereby adopts the DNS
10 The legal requirements for public notice have been fulfilled
11 The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use
12 The applicant has demonstrated that conditions have substantially changed since the
original zoning of this area and accordingly, the proposed zone reclassification is
justified Specifically, changed conditions include increased commercial
development along the Pines Road commercial corridor
13 The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing
agencies
14 The Cornriuttee additionally finds/concludes
a The applicant agrees with and accepts all the recommended conditions of
approval

1 All Conditions imposed by the Hearing Examiner Committee shall be binding on
the "Applicant," which term shall include the owner or owners of the property,
heirs, assigns, and successors-in-interest
2 The Zone Reclassification and Conditions of Approval apply to the real property
descnbed below

1 The pioposal shall comply wi[h the Ucbiul Residential-22 (UR-22) zone and the ASA
Overlay zone, as amended
2 The applicant shall develop the subject property generally in accord with the concept
piesented to the Hearing Body Variations when approved by the Planning
Directorldesignee, may be perniitted, including, but not limited to building location
landscape plans and general allowable uses of the pernutted zone All variatioAS must
conform to regulations set forth in the Spokane County Zoning Code, and the original
intent of the development plans shall be maintained
3 The Division of Building and Planning shall prepare and record with the Spokane
County Auditor a Title Notice noting that the property in question is subject to a variety
of special conditions unposed as a result of approval of a land use action This Title
Notice shall serve as public notice of the conditions of approval affecting the property
in question The Title Notice should be iecorded within the same time frame as allowed
for an appeal and shall only be released, in full or in part, by the Spokane County
Division of Building Planning The Title Notice shall generally provide as follows
The parcel of property legally described as [ ] is the subject of a
land use action by a Spokane County Hearing Body or Acimznistrative
Official on [ imposing a variety of special development
conditions. File No. [ ] is available for inspection and copying in
the Spokane County Division of Building and F'lanning.
4 Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building pernuts
5 A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee sha11 be submitted with a performance
bond for the project prior to release of building pernuts Landscaping shall be
installed and mainta.ined so that slght distance at access points is not obscured or
impaired
6 Direct light from any exterior area libhting fixture shall not extend over the property
boundary
7 The Spokane County Division of Building and Planning shall prepare and record
with the County Auditor a Title Notice specifying a iuture Iand acquisition area for
road right-of-way and utilities The reserved futuie acquisition area Title Notice
shall only be released, in full or in part, by the Planning Department The notice
should be recorded within the same time frame as an appeal and shall provide the
following
a At least 20 feet of reserved future acquisition area for road ngbt-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Broadway Avenue
b Future building and other setbacks required by the Spokane County Zoning
Code shall be measuied from the reserved future acquisltion area
c No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located withln the future acquisition area for road right-of-way and

f utilities If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway impi ovements are
made
d The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses
9 The apphcant shall contact the Division of Building and Planrung at the earliest possible
stage in order to be informed of code requirements adrrunistered/enforced as authorized
by the State Building Code Act Design/development concerns include Addressing,
fire apparatus access roads, fire hydrant/flow, approved water systems, building
accessibility, construction type, occupancy classification, exiting, extenor wall
protection, and energy code regulations (Note The Division of Building and
Planning reserves the nght to confum the actual address at the time of building permit )

1 Access pernuts for approaches to the county road system shall be obtained from the
Spokane County Engineer
2 The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans
3 The apphcant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combiried on-site sewage system plan
and surface water disposal plan for the entire project, or portion thereof, if the
development is to be phased
4 A parlung plan and traffic cuculation plan shall be subriutted and approved by the
Spokane County Engineer The design, location and arrangement of parlang stalls
shall be in accordance with standard traffic engineering practices Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles
5 Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No 95-0498 as
amended and are applicable to this proposal
6 No construction work shall be performed within the existing or proposed public
nght-of-way until a pernut has been issued by the County Engineer All work
within the public road nght-of-way is subject to inspection and approval by the
County Engineer
7 The County Arterial Road Plan identifies Broadway Avenue as a 100 foot Principal
arterial The existing right-of-way width of 55 feet is not consistent with that
specified in the Plan In order to implement the Arterial Road Plan, in addrtion to
the required right-of-way dedication, a strip of property 20 feet in width along the
Broadway Avenue frontage shall be set aside in reserve Ttus property may be

acquired by Spokane County at the time when ai-terial improvements are made to

8 There may exist utilities, either underground or overhead, affecting the subject
property, including properry to be dedicated or set aside foi future acquisition
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to deternune whether applicant(s) or
the utility is responsible for adjustment or telocation costs and to make _
arrangements for any necessary work
SPOKANE COUNTY DIVISgON OF U~ILITIES
1 A wet (live) sewer connection to the area-wide Public Sewer System is to be
constructed Sewer connection perrrut is required
2 Applicant shall subrrut expressly to Spokane County Utihties Department
"under separate cover" only those plan sheets showing sewer plans and
specifications for Public Sewer tap and internal connections for review and
approval by the Utilities Department Pnor to issuance of pernut to connect
3 Arrangements for payments of additional sewer charges must be made for pnor
to issuance of sewer connection pemut
4 Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County , as amended
SPOKANE COUIVTY HEAI.TH DISTRICT
1 Sewage disposal method shall be as authorized by the Director of Utilitles, Spokane
County
2 Water service shall be coordinated through the Director of Utilities, Spokane, County
3 Water service shall be by an existing public watei supply when approved by the
Regional Engineer (Spokane), State Department of Health
4 A public sewer system will be made avallable for the project
5 Use or pnvate wells and water systems is prolubited
SPOKANE COUNTY AIR POLLYJTION C0NTROI. AUTHORITY
1 All air pollution regulations must be met
2 Alr pollution regulations requue that dust etnissions during demolition, construction
and excavation projects be controlled This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions Haul roads
should be treated, and eriussions from the transfer of earthen material must be
controlled, as well as errussions from all other construction-related activities

3 Measures must be taken to avoid the deposition, of dirt and mud from unpaved
~ surfaces onto paved surfaces If tracking or spills occur on paved surfaces,
measures must be taken unmed.iately to clean these surfaces
4 Debris generated as a result of ttus project must be disposed of by means other than
burning (i e, construction waste, etc )
5 Demolition and renovation projects must comply with the requuements of CFR 40,
Part 61, Subpart M and of SCAPCA Regulation I Article IX, both of wtuch addiress
asbestos concems Intent to Demohsh and Renovate forms are ava.ilable at the
SCAPCA office
6 SCAPCA Regulation I, Article, V requues that a Notice of Construction and
Apphcatron for Approval be submitted to and approved by our Agency pnor to the
construction, installauon or estabhshment of air pollution source Tlus includes any
fuel fired equipment rated at greater than 400,000 BTU-hour (boilers, hot water
heaters, ovens, etc ) It also includes paint booths, and other sources of air
contanunants

property is both Urban and Major Commercial and the subject property
is witlun the Pnonty Sewer Service Area (PSSA) and the Aquifer
Sensitive Area (ASA) Overlay Zone
The Major Commercial (C) Category is intended to provide the opportunity
for development of commercial uses, specifically commuruty and regional
shopping centers and commercial uses, directly related to major
throughways The Urban (U) Category is intended to provide the
opportuniry for development of a"ciry-like" environment whlch includes
vanous land uses, intensive residential development and pubhc facihties and
services (water, sanitary and storm sewer lines, pohce and fire protection
and other features) Due to the vanety and nux of land uses and activities
found in the Urban Category, there are few land use activities that would be

Avenue, which is identified by the Spokane County Arterial Road Plan as a
Prulcipal Artenal Implementation of the Artenal Road Plan requues that
the apphcant reserve 20 feet of property along Broadway Avenue as a
Future Acquisitron Area (FAA)
3. County Parks Plan: Valley Mission Park is located approximately two
rrules northwest of the subject property and is the Spokane County Park
closest to the site
C. Site Characteristics• The site is compnsed of a single residential lot that is
83 feet wide and 325 feet deep There is a one story bnck residence converted
into a dental office on the front of the lot and a large garden/lawn area in the
rear of the lot
D. rleighborhood Characteristics The subject property is in a
neighborhood that appears to be in transition from single family uses towards
more intensive development including offices and commercial uses The
property fronts on a major east/west artenal comdor and is one-half block
west of Pines Road, a major north/south commercial corndor
E. Zoning Analysis The Urban Residential-22 (UR-22) zone was estabhshed to
provide for the orderly development of residential property in a manner that
provides a desirable hving envuonment that is compatible with surrounding land
uses and assures the protection of property values It is intended that this zone
be used as an implementation tool for the Urban Comprehensive Plan Category
Med.ical offices are pemutted in the UR-22 zone in order to provide some of the
service needs generated by high-intensity land uses The proposed zoning is

SUBJECT: ZONE CHANGE CONDITIONS # ZE-042-95 / THOMPSON, LARRY
The following "Conditions of Approval" for the above referenced zone change
are submitted to the Spokane County Hearing Examiner Committee for inclusion
in the "Planning Report" and "Findings and Order" of the public hearing
scheduled November 16, 1995.
Prior to release of a building permit or use of property as proposed:
E40 Access permits for approaches to the County Road System shall be obtained from the
County Engineer.
E43 Applicant shall submit for approval by the Spokane County Engineer drainage and access
plans.
E44 The applicant shall submit for approval by the Spokane County Engineer and the Spokane
County Health District a detailed combined on-site sewage system plan and surface water
disposal plan for•the entire project or portion thereof if the development is phased.
E45 A parking plan and traffic circulation plan shall be submitted and approved by the
~ Spokane County Engineer. The design, location and arrangement of parking stalls shall
be in accordance with standard engineering practices. Paving or surfacing as approved
. by the County Engineer will be required for any portion of the project which is to be
occupied or traveled by vehicles
E55 Roadway standards, typical roadway sections and drainage plan requirements are found
in Spokane Board of County Commissioners resolution 95-0498 as amended and are
applicable to this proposal.
E58 No construction work is to be performed within the existing or proposed right of way
until a permit has been issued by the County Engineer. All work within the public road
right of way is subject to inspection and approval by the County Engineer.
E61 The County Arterial Road plan identifies Broadway Avenue as a 100 foot Principal
Arterial. The existing right of way width of 55 feet is not consistent with that
specified in The Plan. In order to implement the Arterial Road Plan it is recommended
that a strip of property 20 feet in width along the Broadway Avenue f rontage be set
aside in reserve. This property may be acquired by Spokane County at the time when
Arterial Improvements are made to Broadway Avenue.
E90 The applicant should be advised that there may exist utilities either underground or
overhead affecting the applicants property, including property to be dedicated or set
aside future acquisition. Spokane County will assume no financial obligation for
adjustments or relocation regarding these utilities. The applicant should check with
the applicable utilities and Spokane County Engineer to determine whether the applicant
or utility is responsible for adjustment or relocation costs and to make arrangements
for any necessary work.

The following "Conditions of Approval" for the above referenced zone change
are submitted to the Spokane County Planning Department for inclusion in the
Design Review Meeting scheduled October 4, 1995
Prior to release of a bus.lding permit or use of property ae proposed:
E40 Access permits for approaches to the County Road System shall be obtained from the
County Engineer
E43 Applicant shall submit for approval by the Spokane County Engineer dsainage and access
plans
E44 The applicant shall submit for approval by the Spokane County Engineer and the Spokane
County Health District a detailed combined on-site sewage system plan and surface water
disposal plan for the entire project or portion thereof if the development is phased
E45 A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer The design, location and arrangement of parking stalls shall
be in accordance with standard engineering practices Paving or surfacing as approved
by the County Engineer will be required for any portion of the project which is to be
occupied or traveled by vehicles
E55 Roadway standards, typical roadway sections and drainage plan requirements are found
in Spokane Board of County Commissioners resolution 95-0498 as amended and are
applicable to this proposal
E58 No construction work is to be performed within the existing or proposed right of way
until a permit has been issued by the County Engineer All work within the public road
right of way is subject to inspection and approval by the County Engineer

l. Reimburse Spokane Cuuuty for project review and inspection fees as specified in Cl~:~~:;:•;
9.14 of the Spokane Couiity Code. The fees will be based on actual salary costs incurred
by Spokane County for project reviews and / or inspectiolis plus a ten percenc
administrative charge, and will be billed nioiithly as accrued. Any billing amounts due,
including any expenses incurred in the collection of an overdue account, must be pai(l
prior to the County's acceptance of the project for filing. If a project is approved and/or
filed with a balaiice still owing, the unpaid balance shall be paid within 30 days of the
invoice date.
2. The undersigned agrees that these fees are due and payable upon receipt of the billiiig as
specified above.
3. Any invoices not paid witliin 30 days of tlie invoice date will be coilsidered delinquent.
!f any outstanding balance on the account for tliis project is not paid within 30 days of
the invoice date, no further reviews of the proJect documents will be conducted until the
entire account balaiice is paid. Any balance on the account for this project not paicl
within 65 days of the invoice date may result in legal action or the initiation of othel-
collection procedures, iiicluding referral to a collection agency. Tlie Sponsor will be
liable for any and all expenses incurred by the County for the collection of overdue
accounts.

SUMMARY
This project is located at E 12319 Broadway Avenue (north of Broadway Ave and east of Pines Road)
The project has an existing zorung of UR-3 5 and is being rezoned UR-22 As part of the rezone, the existing
gravel parking area north of the building will be enlarged and paved Calculations for stormwater runoff were
made on this north basin At present, stormwater from the south portion of this project flows toward Broadway
Avenue No increase in runoff is anticipated for the south basin
The north basin is composed of two subareas, 1) grass lawn and pond, and 2) unpervious roof, patio, and
asphalt paved parking Stormwater flows overland across roofs, grass lawns, and the asphalt parl.ing area into
the grass pond
The grass pond was calculated to hold the first 1/2" of rainfall runoff over the asphalt parking area
Figure 2, page 6-3, of the "Guidelines for Stormwater Management", by Spokane County Engineers, was used
for rainfall intensity and duration occurnng at a 10-year storm frequency
The R.ational and Bowstnng Methods were used to calculate the peak stormwater runoff for the basin, and the
type and number of drywells needed for the basin based on the storage capacity of the pond
In accordance with "Soil Survey, Spokane County, Washulgton", 1968, the soil at the site is categonzed as
GgA, Garnson gravelly loam
Ttus type of soil is considered acceptable for drywell installation per Section 4-4 1 of "Guidelines for Stormwater
Management"
