Thls matter has come before the Hearing Examiner Committee on November I6,
1995 The members of the Commtttee present are Brenda Bodenstein, Chair,
Toni Nersesian and Harry Gibbons
PROPOSAL
The sponsor, Richard Adams, requests approval of a Zone Reclassification,
ZE-41-95, from Urban Residential-3 5(UR-3 5) to Urban Residential-22 (UR-22)
for a 72 unit retirement center and those uses allowed in the Urban Residential-22
(UR.-22) zone
FINDINGS OF FACT A1VI) CONCLIJSIONS
1 The property is generally located between Mamer Road and Evergreen Road, lying
north of Boone Street (extended) in the NE 1i4 of Section 15, Township 25 North,
Range 44 EWM, Spokane County, Washington
2 The Committee adopts the Planning Department Report as a part of this record
3 The existing land uses in the area include single fannily, multi farruly and office
uses
4 The proposed use is compatible with existing uses in the area
5 The Comprehensive Plan category of the subject property is Urban The Urban (U)
category is intended to provide the opportunity for development of a"city-like"
envuonment wluch includes vanous land uses, intenslve residential development and
public facilities and services Residential net densities are suggested to range from 1 to
22 dwelling uruts per acre in the Urban category The proposed density of 12 83
dwelling urutslacre is consistent with the density range suggested by the Urban
Category The proposal is consistent with the Goals, Objectives and Decision
Guidelines of the Urban category
6 The proposed zoning does implement and conform to the Comprehensive Plan
7 The proposal is located adjacent to Evergreen Road on the east and Mamer Road on the
west Evergreen Road is designated as a Pnncipal Arterial on the Spokane County
Artenal Road Plan. To implement the Artenal Road Plan the County Engineer is
requesting dedication of 50 feet of additional right of way adjacent to Evergreen Road
8 The existing zoning of the property described in the application is Urban
Residential-3 5(UR-3 5) established in 1991, previously established as
Agncultural (A) in 1956 (112-56) and redesignated to Urban Residential-3 5

(UR-3 5) on January 1, 1991 pursuant to the Program to Implement the Spokane
County Zoning Code The proposal does conform to the requirements of the
proposed zone
9 The provisions of RCW 43 21C (The State Envuonmental Pohcy Act) have been
compLed wrth and a Deternunation of Nonsignificance (DNS) was issued The
Comnuttee, after independent review, hereby adopts the DNS
10 The legal reqwrements for pubhc notice have been fulfilled
11 The owners of adjacent lands expressed disapproval of the proposed use
Concerns expressed included traffic congestion, density and inadequate parking
12 The apphcant has demonstrated that conditions have substantially changed since the
onginal zotung of tlus area and accordingly, the proposed zone reclassification is
justified Specifically, changed condiuons include transition toward increased multi
fanuly uses in the area and plans for an I-90 - Evergreen Road interchange
13 The proposed use will not be detnmental to the public health, safery, morals or
welfare especially in hght of the conditions recommended by the reviewing
agencies
14 The Committee additionally finds/concludes
a The apphcant agrees with and accepts all recommended conditions of
approval
b Concerns of area residents were adequately addressed by recommended
conditions of approval including restnctions to density and linutation of

SPOKANE COUNTY DIVISION OF BUgLI)gNG AND PLANNING
1 The proposal shall comply with the Urban Residential-22 (UR-22) zone, as
amended -
2 The Division of Build~ng and Planrung shall prepare and record with the Spokane
Counry Auditor a Title Notice noting that the property in question is subject to a
vanety of special conditrons imposed as a result of approval of a land use action
Ttus Title Notice shall serve as public notice of the conditions of approval affecting
the property in question The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Division of Building and Planrung The Title Nouce shall generally provide as
follows
'I'he parcel of property legally described as [ ] is the
subject of a land use action by a Spokane County Hearing Body or
Administrative Official on [ imposing a variety of special
development conditions. File No. [ ] is available for
inspection and copying in the Spokane County Division of I3uilding
and Planning.
3 The applicant shall contact the Divlsion of Building and Planrung at the earliest possible
stage in order to be informed of code requuements adrrunistered/enforced as authonzed
by the State Building Code Act Design/development concerns include Addressing,
fire apparatus access roads, fire hydrantlflow, approved water systems, building
accessibility, construction type, occupancy classification, exiting, extenor wall
protection, and energy code regulations (Note The Division of Building and
Planning reserves the right to confirm the actual address at the time of building pernut )
4 The applicant shall develop subject property in stnet conformance with the site plan
presented to the Hearing Body on November 16, 1995 All aspects of the concept
and proposal shall be binding on the development, including proposed use
Variations, to be approved by the Planrung Director/designee, shall only be allowed
to meet regulation standards and conditions of approval Any other modification
must be presented to the Hearing Body for review and approval
5 Approval is requued by the Planning Director/designee of a specific lighting and
signing plan for the descnbed property pnor to the release of any building permits
6 A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Duector/designee shall be subnutted with a performance
bond for the project pnor to release of building pernuts Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
impaired
7 Direct light from any exterior area lighting fixture shall not extend over the property
boundary

with a Countv Road ProtectlRoad Imnrovement District. whichever action comes first
1 Applicant shall dedicate 50 feet on Evergreen Road for right-of-way
Prior to release of a buildine oernut or use of the nronertv as nrooosed
2 Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer
3 The applicant shall subnut for approval by the Spokane County Engineer road,
drainage and access plans
4 A parking plan and traffic circulation plan shall be subnutted and approved by the
Spokane County Engineer The design, location and arrangement of parlcing stalls
shall be in accordance with standard traffic engineering practices Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles
5 To construct the roadway improvements stated herein, the applicant may, wlth the
approval of the County Engineer, join in and be willing to participate in any
petition or resolution which purpose is the formation of a Road Improvement
District (RID) for said improvement, pursuant to RCW 36 88, as amended
Spokane Counry will not participate in the cost of these improvements This is
applicable to Evergreen Road
6 As an alternative method of constructing the road unprovements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated hereul by joirung and participating in a County Road Project
(CRP) to the extent of the required improvement Spokane County will not
participate in the cost of these improvements Tlus is applicable to Evergreen
Road
7 The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer
8 The County Engineer has designated a Special Roadway Section 5 Lane Principal
Artenal standard for the improvement of Evergreen Road, wh.ich is adjacent to the
proposed development This will require the addition of varying amounts of
asphalt along the frontage of the development The construction of curbing and
sidewalk is also required
9 The Counry Engineer has designated Typical Roadway Section Local Access
standard for the improvement of Mamer Road, which is adjacent to the proposed
development Tlus will requife the addition of approximately 4- 6 feet of asphalt
along the frontage of the development The construction of curbing and sidewalk is
also required
10 All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bndge Construction and other applicable
County standards and/or adopted resolutions pertairung to Road Standards and

~ Stormwater Management in effect at the date of coiistruction unless otheiwlse
appioved by the County Engineer
11 Appllcant shall construct a paved and delineated approach(es) to meet the existing
pavement on Evergreen Road
12 Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No 95-0498 as
amended and are apphcable to this proposal -
13 No construction work shall be performed within the existing or proposed public
right-of-way until a pernut has been issued by the County Engineer All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer
14 All required construction witlun the existing or proposed public nght-of-way is to
be completed prior to the release of a building pernut, or a bond in an amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer
15 Applicant shall sign and record Spokane County Notice to the Public No 6 which
specifies the following
The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement Distnct (RID) by
the petition method pursuant to Chapter 36 88 RCW, which petition includes the
owner(s) property, and further not to object, by the signing of a ballot, the
formation of a RID by the resolutron method pursuant to Chapter 36 88 RCW,
wluch resolution includes the owner(s) property If an RID is formed by either the
petition or resolution method, as provided for in Chapter 36 8$ RCW, the owner(s)
or successor(s) further agree
(a) that the improvement or construction contemplated within the proposed RID is
feasible,
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceeds the cost and expense of formation of the RID, and
(c) that the property within the proposed RID is sufficiently developed
Provided further that the owner(s) or successor(s) shall retain the ngfit, as
authorized under RCW 36 88 090, to object to any assessment on the property as a
result of the improvements called for in conjunction with the formation of the RID
by either petitlon or resolution method under Chapter 36 88 RCW
This requirement applies to Evergreen Road, from which the subject parcel takes
access
16 There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilrties Applicant(s) should check with the appllcable utility
purveyor and the Spokane County Engineer to deternune whether applicant(s) or

17 The applicant shall provide for slope easements along Evergreen Road

1 Sewage disposal method shall be as authonzed by t.he Director of Utilities, Spokane
County
2 Water service shall be coordinated through the Director of Utilities, Spokane, County
3 Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health
4 A public sewer system will be made available for the project and individual service wdl
be provided to each building Use of individual on-site sewage disposal systems shall
not be authonzed
5 Use or private wells and water systems is prolubited
SPOKANE COUNTY AIR POg.,I,UTION CONTItOL AUTHORITY
1 All air pollution regulations must be met
2 Air pollutron regulations require that dust errussions dunng demolition, construction
and excavation projects be controlled This may require use of water sprays, tarps,
sprinklers or suspension of activity dunng certa.in weather conditions Haul roads
should be treated, and enussions from the transfer of earthen matenal must be
controlled, as well as enussions from all other construction-related activities
3 SCAPCA strongly recommends that all traveled surfaces (i e, ingress, egress,
parking areas, access road) be paved and kept clean to minirruze dust errussions
- 4 Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces If traclung or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces
5 Debris generated as a result of this project must be disposed of by means other than
burning (i e, construction waste, etc )
6 Demoliuon and renovation projects must comply with the requirements of CFR 40,
Part 61, Subpart M and of SCAPCA Regulauon I Article IX, both of which address
asbestos concerns Intent to Demolish and Renovate forms are available at the
SCAPCA office
7 All solid fuel burning devices (wood stoves, pellet stoves, etc ) must comply with
local, state, and federal rules and regulaUons

1 A Covenant Agreement shall be signed stating The name(s) on a petition for
the formation of a ULID by petition method pursuant to RCW 36 94 which the
petition includes the Owner(s) property and further not to object by signing of a
protest petition against the formation of a ULID by resolution method pursuant
to RCW 36 94 which includes the Owner(s) property Provided, this condition
shall not protvbit the Owner(s) or Successor(s) from objection to any
assessment(s) on the property as a result of improvements called for in the -
conjunction with the formation of a ULID by either petition or resolution under
RCW 36 94
2 A wet (live) sewer connection to the area-wide Public Sewer System is to be
constructed Sewer connection pernvt is required
3 Applicant is required to sign a Sewer Connection Agreement prior to issuance
of permit to connect
4 Applicant shall subrrut expressly to Spokane County Utilities Department
"under separate cover" only those plan sheets showing sewer plans and
specifications for Public Sewer connections for review and approval by the
Utilities Department Pnor to issuance of pernut to connect
5 Security shall be deposited with the Utilities Department for construction of
public sewer connections
6 Arrangements for payments of additional sewer charges must be made for pnor

7 Any water service for ttus project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended
WASHINGTON STATE DEPARTMENT OF TRANSPORTATION
1 Based on the proposed 72 unit retirement apartment units, a mutigation fee of
$20 00 per unit shall be payable to WSDQT pnor to issuance of building
permits
2 Due to the location of ttus development, if the construction for the proposed
Evergreen Interchange and connection to Evergreen Road south of I-90 is
assured, the fee outline in number one above shall be waived by WSDOT due to
the availability of alternative access
3 The above SEPA mitigation fees shall be used for WSDOT to construct needed
improvements on Pines Road (SR-27) in the vicinity of I-90 and Mission
Avenue wtuch will be used directly by the traffic generated by this
development
4 To ensure that this rYUtigation is provided for, we request a sign-off block be
included for WSDOT on the building pernut

The Evergreen Road and Interstate-90 intersection is planned for a future interchange
at such time as commercial property to the north is developed The Waslungton
State Department of Transportation (WSDOT), in a letter dated September 13, 1995,
stated that a portion of the proposal hes witlun the footpnnt of the proposed
interchange WSDOT has requested that a 5 to 10 foot area on the northerly portion
of the site be set aside as future acqwsition in order for the site to remain a viable
use
C. Site Characteristics The site is relatively flat with an existing single fanuly

adjacent to Mission Avenue between Pines Road and Evergreen Road The

An Envuonmental Checklist was subirutted by the sponsor and was reviewed by the
Division of Bwlding and Planning The review considered the specifics of the
proposal, other available information, County ordinances, other regulations and laws,
possible standarddConditions of Approval, the Generalized Comprebensive Plan, and
other County pohcies and giudelines The Division of Builduig and Planrung has
determined that ,No probable sigiuficant adverse unpacts would result from the
proposal being developed and has issued a Deternunation of Nonsigruficance ("DNS")
The "DNS" was cuculated to 15 other agencies of junsdiction and other agencies/
departments affected by the future development for review and comment The
"DNS" comment penod ends November 14, 1995 and was advertised 15 calendar
days before said date in the newspaper, by letter to adjacent property owners wrthin
400 feet of the proposal, and by notice on a sign posted on the proposal site The
