INTRODUCTION
This matter has come before the Hearing Exarruner Committee on September 21,
1995 The members of the Comrruttee present are Donald Moore, Chair, Brenda
Bodenstein and Frank Yuse
PROPOSAL
The sponsor, Lyle Burnett, requests approval of a Zone Reclassification,
ZE-28-95, on approximately 1 29 acres from Urban Residential-3 5(UR 3 5) to
Urban Residential-22 (UR-22) for 28 multi farruly residences and those uses
allowed in the Urban Residential-22 (UR-22) zone
FI1o1DINGS OF FACT AND COIVCLUSIONS
1 The property is generally located south of Maxwell Avenue, north of Sinto Avenue,
approximately 400 feet east of Pines Road in Section 15, Township 25 North,
Range 44 EWM, Spokane County, Washington
2 The Committee adopts the Planning Department Report as a part of this record
3 The ex.istLng land uses in the area include single farruly residences, medical offices,
commercial uses and Valley General hospital
4 The proposed use is compatible with existing uses in the area
5 The Comprehensive Plan category of the subject property is Urban and the subject
property is within the Pnonty Sewer Service Area (PSSA) and the Aquifer
Sensitive Area (ASA) Overlay Zone The Urban (U) category is intended to
provide the opporturuty for development of a"city-lilce" envuonment wluch
includes vanous land uses, intensive residential development and public facilitles
and services (water, sarutary and storm sewer lines, police and fire protection and
other features) Residential net denslues are suggested to range from 1 to 22
dwelling units per acre in the Urban category The proposed density of 217
dwelling units per acre is consistent with the density range suggested by the Urban
category of the Comprehensive Plan The zone reclassification from Urban
Residential-3 5(UR 3 5) to Urban Residential-22 (UR-22) implements the majorlty
of the Goals, Objectives and Decision Guidelines of the Urban category
6 The proposed zorung does implement and conform to the Comprehensive Plan
7 The proposal is located between Maxwell and Sinto Avenues Both Maxwell and
Sinto Avenues are local access streets and are not Pnncipal nor 1Vhnor Artenals as
defined by the Artenal Road Plan

8 The existing zoning of the property described in the apphcation is Urban
Residential-3 5(UR-3 5) previously established as Agncultural Suburban (AS)
zoning in 1955 and redesignated to Urban Residential-3 5(UR-3 5) on January 1,
1991 pursuant to the Program to Implement the Spokane Counry Zoning Code
The proposal does conform to the reqwrements of the proposed Urban Residential-
22 (UR-22) zone
9 The provisions of RCW 43 21 C(The State Environmental Policy Act) have been
complied with and a Deternunation of Nonsignificance (DNS) was issued The
Committee, after independent review, hereby adopts the DNS
10 The legal requuements for public notice have been fulfilled
11 The Gwners of acijacent lands expressed disapproval of the proposed use and the - -
concerns expressed by the opponents include traff'ic impacts, density, and
incompatible land uses
12 The applicant has demonstrated that cond.itions have substantially changed since the
onginal zoning of tlus area and accordingly, the proposed zone reclassification is
justified Specifically, changed conditions include that the neighborhood is in
transition from low density residential to more intensive uses such as multi fanuly
residences, offices, and medical facilities
13 The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in hght of the conditions recommended by the reviewing
agencies
14 The Commrttee additionally finds/concludes
a Traffic unpacts from the proposal are adequately nutigated through the
specific rrutigation measures specified by Washington State Department of
Transportation condltions 1, 2 and 3 and agreed to by the apphcant

of the subject graperty to which the agreement applies and also state the dollar
amount and any other agreed to rrutrgating measures
The Qwner shall also notify any potential purchasers who have made an agreement
to purchase property pursuant to the Revised Code of Washington {58 17 205},
that adequate provisions for school facllities must be made condrtioned on a future
agreement between the applicant and school district
Voluntary agreements between the Owner and School Distnct shall conform to the
requirements of the Revised Code of Wastungton Chapter 82 02

1 Sidewalks are required along Maxwell Avenue and Sinto Avenue
2 Access pernuts for approaches to the county road system shall be obtained from the
Spokane County Engineer
3 The applicant shall subnut for approval by the Spokane County Engineer road,
drainage and access plans
4 The applicant shall subrrut for approval by the Spokane County Engineer a surface
water disposal plan for the entire project, or portion thereof, if the development is to
be phased
5 A parking plan and traffic cuculation plan shall be subrmtted and approved by the
Spokane County Engineer The design, location and arrangement of parkuig stalls
shall be in accordance with standard traffic engineenng practices Paving or
surfacing as approved by the County Engineer, will be requued for any portion of
tlle project wluch is to be occupied or traveled by vehicles
6 The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer
7 All required improvements shall conform to the current State of Washington
Standard Specif'ications for Road and Bndge Construction and other appLcable
County standards andlor adopted resolutions perta.irung to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer
8 Apphcant shall construct a paved and dehneated approach(es) to meet the existing
pavement on Maxwell Avenue and Sinto Avenue
9 Roadway standards, typical roadway sections and drainage plan requuements are
found m Spokane Board of County Commissioners Resolution No 95-0498 as
amended and are applicable to tlus proposal
10 No construction work shall be performed witlun the existing or proposed pubhc
right-of-way until a pernut has been issued by the County Engineer All work
within the pubhc road right-of-way is subject to inspection and approval by the
County Engineer

Regional Engineer (Spokane), State Department of Health
4 A pubhc sewer system will be made available for the project and individual service will
be provided to the lot Use of indlvidual on-site sewage disposal systems shall not be
authonzed
5 Use of pnvate wells and water systems is prohibited

1 All air pollution regulations must be met
2 Au pollution regulations requue that dust emissions during demohtion, construction
and excavauon projects be controlled Tlus may require use of water sprays, tarps,
sprinklers or suspension of activity dunng certain weather conditions Haul roads

controlled, as well as enussions from all other construction-related activities
3 SCAPCA strongly recommends that all traveled surfaces (i e, ingress, egress,
parkulg areas, access roads) be paved and kept clean to rrurumize dust enussions
4 1Vleasures must be taken to avoid the deposition of dul and mud from unpaved
surfaces onto paved surfaces If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces
5 SCAPCA Regulation I, Article V, reqwres that a Notice of Construction and
Apphcation for Approval be subrrutted to and approved by our Agency pnor to the
construction, installation or estabhshment of an air pollution source Tlus includes
any fuel fired equipment rated at greater than 400,000 BTU/hour (boilers, hot water
heaters, ovens, etc ) It also includes paint booths, and other sources of air
contanunants
6 Debns generated as a result of tlus project must be disposed of by means other than
burning (i e, construction waste, etc )
7 Demohtion and renovation projects must comply with the requirements of CFR 40,
Part 61, Subpart M and SCAPCA Regulation I, Article IX, which address asbestos
abatement issues Intent to Demolish forms are available at the SCAPCA office

foot radius turn to get past the dumpsters into the parlung lots We also will reqture

1 Without sufficient rrutigation the intersection of Pines and 1Vbssion will fail as a
result of developments in this area, to which this development does contribute
1Vfitigation of these impacts is possible by providuig improvements at the Pines and
1Vfission intersection in addition to WSDOT's already planned interchange
improvements
2 WSDOT has deternuned that add.ing an extra southbound left tune lane on Pines at
1Vlission would add capacity to tlus intersection wluch is needed to serve
developments such as tlus Our scoping estimate has estimated the cost of this
improvement at $400,000
Based on a traff'ic study that both Spokane County and WSDOT have reviewed for
an apartment complex proposal just east of the tlus site on Mission the pro-rata
share was calculated to be $114 00 per hving urut Due to the proximity of tlus
simi.lar development it would be reasonable, in the absence of a site specif'ic detailed
traffic study, to apply the same $114 00 per urut fee to ttus development proposal
Based on this calculation these proposed 28 uruts would be responsible for a

$3,192 99 fee in 1995 dollars As with previous developments this fee would be
collected at building pernut stage
3 That prior to the issuance of building pernuts for this site, the applicant shall
provide a traffic nutigation fee to WSDOT for Pines Road (SR-27) unprovements
Based on the cost of the needed improvements the pro-rata share for this
development has been calculated to be $114 00 per hving urut (for apartments) in
1995 dollars

northwest of the subject property and is the Spokane County Park closest to

C Site Charactergshcs The site is composed of two lots that extend between
Mission and Sinto Avenues A single fanuly dwelling urut with an accessory
structure is on one lot and a duplex is on the other Both residences front on
Maxwell Avenue and are vacant in the rear portion adjacent to Sinto Avenue
D Neighborhood Characteristics The subject property is 1/2 block west
of the Valley Medical Center Medical and other offices are located to the
north and west Across Sinto Avenue is a parlcing lot for a funeral home
There are two single family residences to the east and four single family
residences to the west towards Pines Road The neighborhood does not
appear to be fully developed in that many lots are vacant The neighborhood

unplement the Urban Comprehensive Plan Category The purpose of the Urban
Residential-22 (UR-22) zone is to set standards for the orderly development of

is compatible with surround.ing land uses and assures the protection of property
values The surrounding uses are largely low density single fanuly residential
The surrounding zones are largely Urban Residential-3 5(UR-3 5) The existing
higher densiry residential zorung Urban Residential-22 (UR-22) in the
neighborhood is adjacent to Pines Road or iViission Avenue
It is intended that the Urban Residential-22 (UR-22) zone be used to add to the
vanety of housing types and densities and as an implementation tool for the
Urban Category of the Comprehensive Plan The lughest density residential
zone, Urban Residential-22 (UR-22), is intended pnmarily for multiple-farruly
dwellings and is usually located adjacent to major or secondary artenals where
movements of people can be handled efficiently and with least overall adverse
impact It should be noted that the proposal does not front on nor is rt adjacent to
a major or secondary artenal roadway as defined on the Artenal Road Plan The

letter was received from the Washington State Department of Transportation
(WSDOT) The letter stated that the SR 27 / I-90 interchange is expenencing
operational difficulties and that there is a poor level of service regardsng the
interchange ramp ternunals WSDOT states that it cannot support any
development, lilce the subject proposal, that would fiurther exacerbate the

The following "Conditions of Approval" for the above referenced zone change
are submitted to the Spokane County Planning Department for inclusion in the
Design Review Meeting scheduled July 12, 1995
Prior to release of a building permit or use of property ae proposed
E18 Sidewalks are required along Maxwell Avenue and Sinto Avenue
E40 Access permits for approaches to the County Road System shall be obtained from the
County Engineer
E43 Applicant shall submit for approval by the Spokane County Engineer sidewalk drainage
and access plans
E44 The applicant shall submit for approval by the Spokane County Engineer a surface water
disposal plan for the entire project or portion thereof if the development is phased
E45 A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer The design location and arrangement of parking stalls shall
be in accordance with standard engineering practices Paving or surfacing as approved
by the County Engineer will be required for any portion of the project which is to be
occupied or traveled by vehicles
E48 The ccnstruction of the roadway improvements stated herein shall be accomplished as
approved by the Spokane County Engineer
E51 All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bridge construction and other applicable county standards
and/or adopted resolutions pertaining to Road Standards and Stormwater Management in
effect at the date of construction unless otherwise approved by the County Engineer
