The sponsor, Ardith Divuie, requests approval of a Zone Reclassification, ZE-36-94,
from Urban Resideatial-3 5(UR-3 5), Neighborhood Business (B-1), and Regional
Busmess (B-3) to Regional Busmess (B-3) for auto repair, car wash, service station,
impound yard, and those uses allowed in the Regional Busmess (B-3) zone
FINi)INGS OF FACT AND COIVCLUSgOr1S
1 The property is generally located at the southeast corner of the intersection of Pines
Road (State Route 27) and Niission Avenue in the NW 1/4 of Section 15, Township
25 North, Range 44 EVVM, Spokane County, Washington
2 The Comnuttee adopts the Plammmg Deparnnent Report as a part of this record
3 The existing land uses in the area include professional offices, commercial uses and
a hospital
4 The proposed use is compatible with existmg uses in the area
5 The Comprehensive Plan designates this site as Urban and Major Commercial wluch
may be considered a transiaonal area. Transitional areas which are between two (2)
or more Comprehensive Plan land uses categones may comply with either of the
land use categones dependent upon the decision makers site specific approval
The Urban category is intended to provide opportunity for development of a citylilce
envuonment which includes vanous land uses and the Major Commercial category is
intended to provide the opporturuty for development of commercial uses, specifically
community and regional shopping centers, commercial and office uses directly related
to major throughways
6 The proposed Regional Busmess (B-3) zone dces unplement and conform to the
Comprehensive Plan
7 The Spokane County Artenal Road Plan identifies 1Vhssion Avenue as a IViu►or
Artenal with an existing nght-of-way vndth of 60 feet and a pla.nned nght-of-way
width of 80 feet In order to implement the Artenal Road Plan, the Spokane
County Engineer is requesnng that a stnp of property 10 feet in width along
Mission Avenue be set aside as Future Acquisiaon Area (FAA) Maxwell Avenue
is a local access street and is not designated as an artenal Pines Road (State Route
27) is a state highway controlled by the VVashuigton State Departinent of
Transportation (WSDO71)
8 The existing zonuig of the property descnbed in the apphcaaon is Urban
Residential-3 5(UR-3 5), Neighborhood Busmess (B-1) and Regional Busmess
(B-3) previously established as Agncultural Suburban (AS), Local Business (LB)
and Commercial (C) zomng in 1955,1980 and 1981 respecavely (ZE-99-55, ZE-
64-80C, ZE-147-81C) and redesignated to Urban Residenaal-3 5(UR-3 5),
Neighborhood Busmess (B-1) and Reglonal Busmess (B-3) on January 1, 1991
pursuant to the Program to Implement the Spokane County Zorung Code The
proposal does conform to the requuements of the proposed Regional Business
(B-3) zone
9 The provYSions of RCW 43 21C (The State Envuonmental Policy Act) have been
comphed with and a Determination of Nonsignificance (DNS) was issued. The
Comriuttee, after independent review, hereby adopts the DNS
10 The legal requuements for pubhc notice have been fulfilled
11 The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use
12 The apphcant has demonstrated that condiaons have substantially changed since the
onginal zorung of this area and accordmgly, the proposed zone reclassificanon is
justified. Specifically, changed conditions mclude the designaaon of Mission
Avenue as an artenal and the estabhshment of commercial uses along the Pines
Road comdor
13 The proposed use vvill not be detnmental to the public health, safety, morals or
welfare especially in light of the condiaons recommended by the revievnng
agencies

4 A specif'ic landscape plan, planting schedule and provisions for maintenance
acceptable to the Planrung Director/designee shall be submitted with a perfomiance

6 The Spokane County Planning Department shall prepare and record with the

recorded within the same hme frame as an appeal and shall provide the following

unplement the Urban category of the Comprehensive Plan

The most recent zone reclassification in the general anea occurred approxunately
1/4 mile southwest of the proposal along the west side of Pines Road. The zone
reclassification, ZE-7-94, from Urban Residential-22 (LJR-22) to Commuruty
Busmess (B-2) on approxunately 11 acres for a funeral home was approved by
the I3eanrig Examiner Comnuttee in Apnl, 1994
The proposed zone reclassificauon is generally consistent wnth land use and
zoning trends ui the surrounding area

Dear Mr. Cash:
I have been requested by Ardith Divine to write the following letter. The above referenced land use
action is currendy pending with the Spokane County Planning Departrnent A meeting was held on the
13th of July, 1994, to discuss the merits of this application. The following is a description of the
project and a request to forego the possibility of a tiaffic study.
The proponents are applying for a zone change to enable them to acquire two add.itional small parcels
of land. When this is accomplished a new building will replace the existing one. The same function
will occur, namely light automotive repair. The old gas tanks and islands will also be replaced with
new ones that will meet current regulations for underground strorage tanks and vapor recovery.
It is the proponents position that as a nesult of not changing use or conditions from that of the curnent
use, they should not have to do a traffic study. Furthetmore, we are proposing that only one curb cut
be used for access to the new building from Mission and only one from Pines as opposed to the
current situation of two per each of these streets. We also have designed each of the new curb cuts to
be as far back from the intersection as is possible.
In summary, we are not changing use or type of business at this location, we ar+e eliminaiing the small
pottery shop on pines, we are reducing the number of curb cuts and placing them further from the
intersection. Therefore we are respectfully requesting that your department not require a traffic study
for this application or for the subsequent building pennit application that will follow.

Re: SR-27 Hardy's Restaurant
Dear Mr. Davenport:
After reviewing the above development the Washington State Department of
Transportation (WSDOT) has the following comments concerning this proposal:
1. As you may be aware WSDOT is very concerned about the operation of the Pines Road
(SR-27)/I-90 Interchange. Our concern at this interchange stems from recent traffic
growth in this area, and the limited capacity available at this interchange to
accommodate it. In addition to this, the intersection of Pines and Mission, which is
located adjacent to this proposed development has been experiencing an unusually high
number of intersection accidents.
Because of these concerns and the substantial trip generation associated with fast food
restaurants WSDOT in conjunction with Spokane County Engineers requires that the
developer prepare a"traffic Study for this project. This tra.ffic study will need to
address the issues outlined in the attached traffic study requirements form. In particular
this traffic study will need to address the projects impacts to the following intersections:
• Pines and Mission
• Pines and the North I-90 Ramp Terininals
• Pines and the South I-90 Ramp Terminal:
2. This traffic analysis will need to be included in the SEPA documentation prepared for
this rezone to adequately address Section 14 (Transportation) of the SEPA checklist.
This traffic analysis must be approved by both WSDOT and Spokane Countv
Engineer's before a final SEPA deternunation is reached.
3. Due to the fact that the traffic impacts this development will potentially create have not
yet been analyzed, WSDO'f reserves the right to comment further on this developmelit
after reviewing the traffic study.

4. Access to Pines Road from this development must be approved by WSDOT. WSDOT
requires that a valid road approach be obtained in order to have legal access to Pines
Road.
5. Because of the above issues WSDOT requests that a sign off block be provided to
WSDOT on the building permit release form.

mitigating measures as outlined i.n the above traffic study. These
mitigating measures must be approved by both WSDOT and
Spokane County Engineers.
III. Due to the trip generation potential, any fu.rther development other
than what is proposed will require further review by WSDOT to
assure additional trips are safely accommodated.
