ZE-031-94 ' NO. 95 0065 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF SPOKANE COUNTY, WASHINGTON ~ IN THE MATTER OF ZE-31-94, ZONE ) FINDINGS OF RECLASSIFICATION FROM URBAN RESIDENTIAL-3.5 ) FACT, (UR-3.5) TO URBAN RESIDENTIAL-22 (UR-22) ) DECISION A'n l CONrDI'I'IOtiS SFU~'>UR: DON, 1 H.:'NRiC: !S TIIIS INIA'I,TER, bc:.ing the consideration by tiiL Boa.rd of County ComnlissioncrS of Spokane County, hereinafter referred to as the "Board", of an appeal of the Spokane County Hearing Examiner Committee decision of August 22, 1994 approving Zone Reclassification File No. ZE-31-94, for the purpose of developing a fifty-two (52) urii t multi-family complex on approximately 2.4 acres of land, hereinafter referred to as the "Proposal"; and the Board of County Commissioners having held a de novo public hearing on October 11, 1994, and having fully considered all testimony presented, the documents submitted and the public record files; and the Board further having individually visited or being familiar with the site and vicinity in question and having rendered an oral decision c-, the 8th day of November approving said proposal with modifications, hereby enters the following: FINDINGS OF FAC"I' 1. The proposal is generally located east of and adjacent to McDonald Road, approximately 700 feet south of Mission Avenue, in the NE 1/4 of Section 15, Township 25 North, Ran~e 44 E,W.?~'I., Spokane Count~~, W~is~~irl~tnn. 2. The original proposal consists of a zone reclassification reque5t trom lirban Residential-3.5 (UR-3.5) to Urban Residential-22 (UR-22) for a 52 unit mulci- family complex on approximately 2.4 acres. 3. At the public hearing held by the Board, the applicant agreed to modify the proposal in conformance with conditions of approval recommended by the Planning Department, includ.ing changes to the proposed building height, setbacks, landscaping and density. This modification reduced the total number of unit~, in ti:-, proposal to 44 units; for an approximate density of 18.33. 4. The Hearing Examiner Committee (HEC) held a public hearing on August 18, 1994, subsequent to which by the Findings of Fact, Conclusion and Decision dated August 22, 1994, it approved the proposal. 5. The owners of adjacent property timely filed an appeal of the Hearing Examiner Committee decision with the Board on August 26, 1994. 6. The legal requirements for public notice for the public hearing held by the Board have been fulfilled. 7. The Board takes notice of the provisions of the Spokane County Generalized Comprehensive Land Use Plan, the Spokane County Zoning Code, the Spokane County Code, the expired Spokane County Zoning Ordinance, and the Program to Implement the Spokane County Zoning Code. 8. The Board adopts the Planning Department's and the Board of Counry Commissioners files in ZE-30A-89 and ZE-31-94 as part of the record. 9. The oral testimony presented at the public hearing before the Hearing Examiner Committee did not comprise part of the recori before the Board and was not considered by the Board in its decision. 10. At the public hearing held by the board, owners of adjacent property objected to the proposal based on the impacts to roadways, schools and neighborhood ~ r BOCC FINDINGS ZE-31-94 Page 2 compaability The appellants also contended that cond.inons had not substantially changed to support the requested rezone, that there was insufficient sewer capacity to serve the proposal, and that the apphcant should be reqmred to reunburse appellants for a parnon of theu costs incurred m financmg the installanon of pubhc sewer facihnes m McDonald Road 11 The Comprehensive Plan designates the area encompassed by the proposal as Urban 12 The onginal zonuig of the property descnbed in the apphcaaon was Agncultural Suburban (AS) adopted ui 1955 under the now expued Spokane County Zoning Ordinance The site was redesignated by Spokane County on January 1, 1991 to Urban Residential-3 5(UR-3 5) under the Spokane County Zorung Code, pursuant to the Program to Implement the Spokane County Zoning Code 13 In 1990, the site was given prehminary plat approval for six (6) lots, and Planned Unit Development (PUD) Overlay, under Planning Department Ffle No PE-1581-89/ PUDE-4-89, and a zone reclassification from Agncultural Suburban (AS) to Urban Residential-22 (UR-22) pursuant to Planrung Department File No ZE-54-89 granted subject to final plat approval The prelunuiary plat, if finalized, would create six (6) lots and common open space for development of inedical offices This condiaonal zonuig was not nulhfied by the 1991 redesignation of the site to Urban Residenaal-3 5(UR-3 5) 14 In 1989, a five acre site located directly north of the proposal, at the southeast corner of McDonald Road and 1Vlission Avenue, was rezoned (ZE-30-89) under the Spokane County Zoning Code to Urban Residential-22 (UR-22), for the purpose of developing medical offices Following the 1989 rezone, the five acre site was short platted uito a southerly pornon of 1 23 acres and a northerly pomon on which medical offices were later constructed 15 A request to change condhaons (ZE-30A-89) for the southerly 123 acres of the property rezoned in ZE-30-89 to allow the installation of 26 multi-fa,mily uiuts at a density of 21 uruts per acre, in place of the med.ical offices proposal, was heard and approved by the Board at the same nme as the current proposal 16 A 10 7 acre parcel of land (owned by the appellants) located duectly east of the proposal was rezoned to the Urban Residenaal-22 (UR-22) and Urban Residenaal-12 (UR-12) zones in 1990 for development of 214 multi-family uruts at a density of 216 units per acre Further east, a rezone to the Urban Residential-12 (UR-12) and Urban Residential-22 (UR-22) zones was approved in 1992 for development of 154 muln- fanuly units, at a density of 19 35 units per acre, and for medical offices 17 Single family residences are located west of the site across McDonald Road and south of the site Single fanuly residences, multi-family dwellings, a renrement center and professional offices charactenze the area surrounduig the proposal, wnth Valley General Hospital located approxunately 1/4 nule west of the site 18 The proposal is located adjacent to McDonald Road, a designated artenal Pubhc sewer was installed in McDonald Road between 1991-1992, and the roadway was recently widened and improved to four lanes with curb and sidewallc through a County road project 19 The Spokane County Artenal Road Plan designates McDonald Road as a Muwor Artenal vvith a recommended nght of way vvidth of 80 feeL In order to unplement the Artenal Road Plan a stnp of property 8 and 1/2 feet ui width along McDonald Road should be set aside as future acquisition area (FAA) as recommended by the County Engineer The proposal has been condiuoned to set aside adequate nght of way for future acquisition by the County 20 The transportation element of the Comprehensive Plan recommends a 35 foot setback from designated artenals The proposal should be cond.itioned to provide a 35 foot structure setback from McDonald Road, in order to minimize the proposal's unpact on the suigle family area located to the west across McDonald Road 21 The proposal wnll generate less traffic than would use of the site for mechcal offices, as approved in the 1990 rezone and prehnunary plat of the site, including projected traffic impacts to the mtersecaon of Pines Road and 1Vhssion and to the Pines Road and I-90 Interchange ~ s BOCC FINDINGS ZE-31-94 Page 3 22 Inclusion of the condition of approval requested by the Washuigton State Deparnnent of Transportanon (WSDOT) in its letter to the Heanng Examiner Committee of August 17, 1994, lvauting traffic from the proposal to that wluch would have been generated under the medical offices proposed for the site, is necessary to nutigate the impact of the proposal on the area's tiansportaaon system 23 As ind.icated by the Central Valley School Ihstnct, there is vnadequate student housing to serve the area of the proposal The proposal will increase such deficiency when developed and the proposal should be conditioned to requue the apphcant to enter into a voluntary agreement with the school d.istnct to nutigate the unpact of the proposal on the school distnct The applicant's agent tesnf'ied at the public heanng before the Boand that the apphcant agreed to enter into such voluntary agreemenL 24 There is a deficiency of public park land in the East Valley area and the proposal will increase the need for park facilities when developed Approval of the change of condinons should be conditioned to require the applicant to negonate and enter uito a voluntary agreement vnth the Spokane County Department of Parks, Recreation and Fair to dedicate land or pay unpact fees in heu of dedication, pnor to the issuance of building permits, in order to nutigate such impacts The applicant's agent testified at the pubhc heanrig before the Board that the apphcant would agree to enter into such voluntary agreement, 25 Permanent design capacity in the McDonald Road pubhc sewer hne was previously allocated by County Utihties for the equivalent of 45 of the 70 muln-fanuly uruts being approved by the Board in ZE-30A-89 and ZE-31-94 26 It is reasonable for the County, through negotiated connecaon agreements, to allow pennanent connecaon of no more than 45 wuts in ZE-30A-89fLE-31-94 to the McDonald Road public sewer facihaes, and to allow temporary connection of the remaining units appnoved in ZE-30A-89/ZE-31-94 to such faclhties until the installation of public sewer facihties west of McDonald Road. 27 The County's 1991 developer connection agreement with Cedar Chateau Estates granted such owner the nght to reimbursement for $105,000 of its costs incurred for the McDonald Road sewer facilities, solely from any bond proceeds issued wittun ten years from the date of such agreement, pursuant to fonnanon of a Utility Local Improvement Distnct (ULID) utilizing such faciliaes and subject to assessment of Cedar Chateau Estate s property in such ULID 28 Under the 1991 developer connecaon agreement with Cedar Chateau Estates and the County's 1992 developer connection agreement with Cedar Chateau Estates B, the County has exclusive authonty to detemune who and under what circumstances other owners of property can connect to the County's pubhc sewerage system through the McDonald Road Facihties 29 The County is not obligated to reqwre the owners of property ui ZE-30A-89/ ZE-31-94 to reimburse Cedar Chateau Estates or Cedar Chateau Estates 'B for Cedar Chateau's costs to finance the McDonald Road sewer faciliaes Such owners will be required to pay an equitable share of the costs of the County's pubhc sewer system through connecaon agreements with the County 30 The proposal is generally consistent with the Goals, Objectives and Decision Gtudeluies of the Comprehensive Plan (references ui the findings herein and below to the "proposal' mean the proposal as modified by the applicant and as cond.itioned by the Board) 31 The proposal is consistent with the intent of the Urban category, which is intended pnmanly for residenual development, including multi-fanuly The Urban category contemplates a nuxture of suigle fanuly, two family and multi-fanuly along with neighborhood commercial and hght industnal uses 32 The proposal is consistent with the recommendations of the Urban category for multi-fanuly development, with duect access to 1VIcDonald Road and near access to Mission Avenue, both artenal streets, as well as access to public transportation service 33 The pnoposal, along with the proposal in ZE-30A-89, provides a-ansinon between the medical offices to the north and the single fanuly area to the south The height hnutaaon for builduigs, the 35 foot setback requued along McDonald Road and the s { BOCC FINDINGS ZE-31-94 Page 4 FAA setback provide transition between the suigle family area located west of McDonald Road and the taller 2-3 story buildings located east of the proposal 34 T'he structure height lunitation, 60 foot setback and the 20 foot Type I landscaping buffer required for the proposal along its south property boundary, as well as the reduced density of the proposal ul the south 200 feet of the site renders the proposal consistent with the single fanuly area located to the south 35 1'he proposal will maintain the consistency of adjacent single farruly ameniaes, and will not negatively unpact the arctutectural character of the neighborhood The proposal is compatible vvith surrounding land uses 36 Cmumstances have substantially changed in the area since the ongYnal zorung of the property was approved in 1955 to warrant approval of the proposal Further, substanaal changes have occurred in the area even suice the conditional rezonuig and prehnunary plat of the property in 1990 and the crossover zoning of the property in 1991 to Urban Residential-3 5(tJR-3 5) to wamant approval of the proposal, including the installanon of pubhc sewer in McDonald Road, road unprovements to McDonald Road, the uicreased and continuing demand for residential housing, and land use and zoning mends in the area 37 The proposal will not have a sigmficant probable adverse impact upon, and bears a substanaal relahon to, the pubhc health, safety, and general welfare 38 The provisions of RCVV 43 21C (The State Environmental Pohcy Act) have been complied with and a Deternunation of Nonsigruficance was issued The Board concurs with the Deternunation of Nonsignificance 39 The proposal is consistent wnth the requuements of the Zonmg Code and other applicable land use controls DECISI0N The Board does hereby approve the zone reclassificauon request from Urban Residenaal-3 5 (UR-3 5) to Urban Residenaal-22 (UR-22), (as modified by cond.itions of approval) subject to the follownng additional conditions IN REFERENCE TO THE ATTACHED FINDINGS AND ORDER. All work within the public road right-of-way is subject to inspection and apprvval by the Counry Engineer. 7. The County Arterial Road Plan identi..fies MeDonald Rvad as a Minor Arteri:al. The existing right-of-way width of 63 feet is not consistent with that specified in the Pla.n. In vrder to implement the Arcerial Road Plan, in acidrtion to the arequued right-of-way dedication, a szrip of pmperty 8,5 feet i.n width al4ng the McDonald Road fx-vntage shali be set aside in areserve. This prvperty may be acquined by SpQkane County at the time when arterial improyemencs are made to McDanald Road. All air pollution regulations must be met. 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construction-related activities. 3. SCAPCA strongly recommends that all traveled surfaces (i.e., in~rtss, e~ress, parking areas, access roads) be paved and kept clean to minimize dust emission s. 4. Measures must be taken to avoid the deposition of dirt and mud from unpav-d surfaces onto paved surfaces. All solid fuel burning devices (wood stoves, pellet stoves, etc...) must comply with local, state, and federal rules and regulations. WASHINGTON STATE DEPARTMENT OF TRANSPORTATION 1. Due to the operational problems currently being experienced on Pines Road, this proposed project shall not generate traffic in excess of the original proposed project for medical offices (in PE-1581-89/PUDE-489/ZE-54-89), based on the most current trip generation rates. Prior to release of a buildinq permit or use of property as proposed: E40 Access permits for approaches to the County Road System shall be obtained from the County Engineer.
