of Spokane County, hereinafter referred to as the "Board", of an appeal of the Spokane
County Hearing Examiner Committee decision of August 22, 1994 approving Zone
Reclassification File No. ZE-31-94, for the purpose of developing a fifty-two (52) urii t
multi-family complex on approximately 2.4 acres of land, hereinafter referred to as the
"Proposal"; and the Board of County Commissioners having held a de novo public hearing
on October 11, 1994, and having fully considered all testimony presented, the documents
submitted and the public record files; and the Board further having individually visited or
being familiar with the site and vicinity in question and having rendered an oral decision c-,
the 8th day of November approving said proposal with modifications, hereby enters the
following:
FINDINGS OF FAC"I'
1. The proposal is generally located east of and adjacent to McDonald Road,
approximately 700 feet south of Mission Avenue, in the NE 1/4 of Section 15,
Township 25 North, Ran~e 44 E,W.?~'I., Spokane Count~~, W~is~~irl~tnn.
2. The original proposal consists of a zone reclassification reque5t trom lirban
Residential-3.5 (UR-3.5) to Urban Residential-22 (UR-22) for a 52 unit mulci-
family complex on approximately 2.4 acres.
3. At the public hearing held by the Board, the applicant agreed to modify the proposal
in conformance with conditions of approval recommended by the Planning
Department, includ.ing changes to the proposed building height, setbacks,
landscaping and density. This modification reduced the total number of unit~, in ti:-,
proposal to 44 units; for an approximate density of 18.33.
4. The Hearing Examiner Committee (HEC) held a public hearing on August 18,
1994, subsequent to which by the Findings of Fact, Conclusion and Decision dated
August 22, 1994, it approved the proposal.
5. The owners of adjacent property timely filed an appeal of the Hearing Examiner
Committee decision with the Board on August 26, 1994.
6. The legal requirements for public notice for the public hearing held by the Board
have been fulfilled.
7. The Board takes notice of the provisions of the Spokane County Generalized
Comprehensive Land Use Plan, the Spokane County Zoning Code, the Spokane
County Code, the expired Spokane County Zoning Ordinance, and the Program to Implement the Spokane County Zoning Code.
8. The Board adopts the Planning Department's and the Board of Counry
Commissioners files in ZE-30A-89 and ZE-31-94 as part of the record.
9. The oral testimony presented at the public hearing before the Hearing Examiner
Committee did not comprise part of the recori before the Board and was not
considered by the Board in its decision.
10. At the public hearing held by the board, owners of adjacent property objected to the
proposal based on the impacts to roadways, schools and neighborhood

compaability The appellants also contended that cond.inons had not substantially
changed to support the requested rezone, that there was insufficient sewer capacity
to serve the proposal, and that the apphcant should be reqmred to reunburse
appellants for a parnon of theu costs incurred m financmg the installanon of pubhc

11 The Comprehensive Plan designates the area encompassed by the proposal as
Urban
12 The onginal zonuig of the property descnbed in the apphcaaon was Agncultural
Suburban (AS) adopted ui 1955 under the now expued Spokane County Zoning
Ordinance The site was redesignated by Spokane County on January 1, 1991 to
Urban Residential-3 5(UR-3 5) under the Spokane County Zorung Code, pursuant
to the Program to Implement the Spokane County Zoning Code
13 In 1990, the site was given prehminary plat approval for six (6) lots, and Planned Unit
Development (PUD) Overlay, under Planning Department Ffle No PE-1581-89/
PUDE-4-89, and a zone reclassification from Agncultural Suburban (AS) to Urban
Residential-22 (UR-22) pursuant to Planrung Department File No ZE-54-89 granted
subject to final plat approval The prelunuiary plat, if finalized, would create six (6) lots
and common open space for development of inedical offices This condiaonal zonuig was
not nulhfied by the 1991 redesignation of the site to Urban Residenaal-3 5(UR-3 5)
14 In 1989, a five acre site located directly north of the proposal, at the southeast
corner of McDonald Road and 1Vlission Avenue, was rezoned (ZE-30-89) under the
Spokane County Zoning Code to Urban Residential-22 (UR-22), for the purpose of
developing medical offices Following the 1989 rezone, the five acre site was short
platted uito a southerly pornon of 1 23 acres and a northerly pomon on which
medical offices were later constructed
15 A request to change condhaons (ZE-30A-89) for the southerly 123 acres of the
property rezoned in ZE-30-89 to allow the installation of 26 multi-fa,mily uiuts at a
density of 21 uruts per acre, in place of the med.ical offices proposal, was heard and
approved by the Board at the same nme as the current proposal
16 A 10 7 acre parcel of land (owned by the appellants) located duectly east of the
proposal was rezoned to the Urban Residenaal-22 (UR-22) and Urban Residenaal-12
(UR-12) zones in 1990 for development of 214 multi-family uruts at a density of 216
units per acre Further east, a rezone to the Urban Residential-12 (UR-12) and Urban
Residential-22 (UR-22) zones was approved in 1992 for development of 154 muln-
fanuly units, at a density of 19 35 units per acre, and for medical offices
17 Single family residences are located west of the site across McDonald Road and
south of the site Single fanuly residences, multi-family dwellings, a renrement
center and professional offices charactenze the area surrounduig the proposal, wnth
Valley General Hospital located approxunately 1/4 nule west of the site
18 The proposal is located adjacent to McDonald Road, a designated artenal Pubhc
sewer was installed in McDonald Road between 1991-1992, and the roadway was
recently widened and improved to four lanes with curb and sidewallc through a
County road project
19 The Spokane County Artenal Road Plan designates McDonald Road as a Muwor
Artenal vvith a recommended nght of way vvidth of 80 feeL In order to unplement
the Artenal Road Plan a stnp of property 8 and 1/2 feet ui width along McDonald
Road should be set aside as future acquisition area (FAA) as recommended by the
County Engineer The proposal has been condiuoned to set aside adequate nght of
way for future acquisition by the County
20 The transportation element of the Comprehensive Plan recommends a 35 foot
setback from designated artenals The proposal should be cond.itioned to provide a
35 foot structure setback from McDonald Road, in order to minimize the proposal's
unpact on the suigle family area located to the west across McDonald Road
21 The proposal wnll generate less traffic than would use of the site for mechcal offices,
as approved in the 1990 rezone and prehnunary plat of the site, including projected
traffic impacts to the mtersecaon of Pines Road and 1Vhssion and to the Pines Road
and I-90 Interchange

22 Inclusion of the condition of approval requested by the Washuigton State
Deparnnent of Transportanon (WSDOT) in its letter to the Heanng Examiner
Committee of August 17, 1994, lvauting traffic from the proposal to that wluch
would have been generated under the medical offices proposed for the site, is
necessary to nutigate the impact of the proposal on the area's tiansportaaon system
23 As ind.icated by the Central Valley School Ihstnct, there is vnadequate student
housing to serve the area of the proposal The proposal will increase such
deficiency when developed and the proposal should be conditioned to requue the
apphcant to enter into a voluntary agreement with the school d.istnct to nutigate the
unpact of the proposal on the school distnct The applicant's agent tesnf'ied at the

24 There is a deficiency of public park land in the East Valley area and the proposal

Recreation and Fair to dedicate land or pay unpact fees in heu of dedication, pnor to

to enter into such voluntary agreement,

allocated by County Utihties for the equivalent of 45 of the 70 muln-fanuly uruts
being approved by the Board in ZE-30A-89 and ZE-31-94
26 It is reasonable for the County, through negotiated connecaon agreements, to allow
pennanent connecaon of no more than 45 wuts in ZE-30A-89fLE-31-94 to the
McDonald Road public sewer facihaes, and to allow temporary connection of the
remaining units appnoved in ZE-30A-89/ZE-31-94 to such faclhties until the
installation of public sewer facihties west of McDonald Road.
27 The County's 1991 developer connection agreement with Cedar Chateau Estates
granted such owner the nght to reimbursement for $105,000 of its costs incurred
for the McDonald Road sewer facilities, solely from any bond proceeds issued
wittun ten years from the date of such agreement, pursuant to fonnanon of a Utility
Local Improvement Distnct (ULID) utilizing such faciliaes and subject to
assessment of Cedar Chateau Estate s property in such ULID
28 Under the 1991 developer connecaon agreement with Cedar Chateau Estates and
the County's 1992 developer connection agreement with Cedar Chateau Estates B,
the County has exclusive authonty to detemune who and under what circumstances
other owners of property can connect to the County's pubhc sewerage system
through the McDonald Road Facihties
29 The County is not obligated to reqwre the owners of property ui ZE-30A-89/
ZE-31-94 to reimburse Cedar Chateau Estates or Cedar Chateau Estates 'B for
Cedar Chateau's costs to finance the McDonald Road sewer faciliaes Such owners
will be required to pay an equitable share of the costs of the County's pubhc sewer
system through connecaon agreements with the County
30 The proposal is generally consistent with the Goals, Objectives and Decision
Gtudeluies of the Comprehensive Plan (references ui the findings herein and below
to the "proposal' mean the proposal as modified by the applicant and as cond.itioned
by the Board)
31 The proposal is consistent with the intent of the Urban category, which is intended
pnmanly for residenual development, including multi-fanuly The Urban category
contemplates a nuxture of suigle fanuly, two family and multi-fanuly along with
neighborhood commercial and hght industnal uses
32 The proposal is consistent with the recommendations of the Urban category for
multi-fanuly development, with duect access to 1VIcDonald Road and near access to
Mission Avenue, both artenal streets, as well as access to public transportation
service
33 The pnoposal, along with the proposal in ZE-30A-89, provides a-ansinon between
the medical offices to the north and the single fanuly area to the south The height

McDonald Road and the taller 2-3 story buildings located east of the proposal
34 T'he structure height lunitation, 60 foot setback and the 20 foot Type I landscaping
buffer required for the proposal along its south property boundary, as well as the
reduced density of the proposal ul the south 200 feet of the site renders the proposal
consistent with the single fanuly area located to the south
35 1'he proposal will maintain the consistency of adjacent single farruly ameniaes, and
will not negatively unpact the arctutectural character of the neighborhood The
proposal is compatible vvith surrounding land uses
36 Cmumstances have substantially changed in the area since the ongYnal zorung of
the property was approved in 1955 to warrant approval of the proposal Further,
substanaal changes have occurred in the area even suice the conditional rezonuig
and prehnunary plat of the property in 1990 and the crossover zoning of the
property in 1991 to Urban Residential-3 5(tJR-3 5) to wamant approval of the
proposal, including the installanon of pubhc sewer in McDonald Road, road
unprovements to McDonald Road, the uicreased and continuing demand for
residential housing, and land use and zoning mends in the area
37 The proposal will not have a sigmficant probable adverse impact upon, and bears a
substanaal relahon to, the pubhc health, safety, and general welfare
38 The provisions of RCVV 43 21C (The State Environmental Pohcy Act) have been
complied with and a Deternunation of Nonsigruficance was issued The Board
concurs with the Deternunation of Nonsignificance
39 The proposal is consistent wnth the requuements of the Zonmg Code and other
applicable land use controls

The Board does hereby approve the zone reclassificauon request from Urban Residenaal-3 5
(UR-3 5) to Urban Residenaal-22 (UR-22), (as modified by cond.itions of approval) subject to

SPOKANE COL7NTY DIVISIUN OF ENGINEERING AND ROADS
1. Access perrzuts for approaches to the cvunry rvad system shaU be vbtain+ed fram the
Spokane Gaunty Engineer.
2. 'The applicant shall submit for apprvval by the Spokane Caunty Engineer and the
Spokane Caunry Health District a det.ai.led combined on-site sewage system plan
and surface water dispvsal plan for the entire prvject, ar portion therev#', if the
development is co be phaseci.
3. A parking pian and traffic circulation plan shall be subnutted and appmved by the
Spokane County Engineer. The design, lvcativn and anrangement of parking stalls
shali be in accardanee with standard traffic engineering pracrices. Paving ar
suxfacing as approved by the County Engineer, will be required for any partion of
the project whieh is ta be oceupiecl or traveled by vehicles.
4. Applicant shall canstruct a paved and +delineated approach(es) ta meet the exisring
pavement on McDaraald Raad.

found in Spokane Bvard of County Cnmrnissioners Resolution NQ, 80-1592 as

6. No cvnstruction work shar.Il be gerfvrmed within the exisiing vr groposed public
nght-of-way until a pennit has been issued by the Cvunty Engineer. All work
within the public road right-of-way is subject to inspection and apprvval by the
Counry Engineer.
7. The County Arterial Road Plan identi..fies MeDonald Rvad as a Minor Arteri:al. The
existing right-of-way width of 63 feet is not consistent with that specified in the
Pla.n. In vrder to implement the Arcerial Road Plan, in acidrtion to the arequued
right-of-way dedication, a szrip of pmperty 8,5 feet i.n width al4ng the McDonald
Road fx-vntage shali be set aside in areserve. This prvperty may be acquined by
SpQkane County at the time when arterial improyemencs are made to McDanald
Road.

SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.
3. SCAPCA strongly recommends that all traveled surfaces (i.e., in~rtss, e~ress,
parking areas, access roads) be paved and kept clean to minimize dust emission s.
4. Measures must be taken to avoid the deposition of dirt and mud from unpav-d

The County Artenal Road plan identifies McDonald Road as a 80 foot wide Minor Artenal and
is measured 40 feet from each side of centerluie The existing nght of way width from
centerline in front of ZE-30A-89 (Tract "B" of SP 778-92) is 35 feet This is five feet Iess than
that specified in the plan In order to unplement the Artenal Road Plan a smp of property 5
feet m width would need to be held m reserve by the apphcant The existing nght of way width
from centerline in front of ZE-31-94 is 31 5 feet In order to innplement the Arterial Road Plan
in this case, a stnp of property 8 5 feet wide would need to held in reserve by the applicant

The following "Conditions of Approval" for the above referenced subdivision
are submitted to the Spokane County Hearing Examiner Committee for inclusion
in the "Planning Report" and "Findings and Order" of the public hearing
scheduled August 18th, 1994.
Prior to release of a buildinq permit or use of property as proposed:
E40 Access permits for approaches to the County Road System shall be
obtained from the County Engineer.
E44 The applicant shall submit for approval by the Spokane County Engineer
and the Spokane County Health District a detailed combined on-site
sewage system plan and surface water disposal plan for the entire
project or portion thereof if the development is phased.
E45 A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer. The design, location and
arrangement of parking stalls shall be in accordance with standard
engineering practices. Paving or surfacing as approved by the County
Engineer will be required for any portion of the project which is to be
occupied or traveled by vehicles
E53 The applicant shall construct a paved and delineated approach(s) to meet
the existing pavement on McDonald Road.
E55 Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners
resolution 80-1592 as amended and are applicable to this proposal.
E58 No construction work is to be performed within the existing or proposed
right of way until a permit has been issued by the County Engineer. All
work within the public road right of way is subject to inspection and
approval by the County Engineer.
E61 The County Arterial Road plan identifies McDonald Road as a Minor
Arterial. The existing right of way width of 63 feet is not consistent
with that specified in The Plan. In order to implement the Arterial
Road Plan it is recommended that in addition to the required right of
way dedication, a strip of property 8.5 feet in width along the McDonald
Road frontage be set aside in reserve. This property may be acquired by
Spokane County at the time when Arterial Improvements are made to
McDonald Road.
E90 The applicant should be advised that there may exist utilities
either underground or overhead affecting the applicants property,
including property to be dedicated or set aside future acquisition.
Spokane County will assume no financial obligation for adjustments
or relocation regarding these utilities. The applicant should
check with the applicable utilities and Spokane County Engineer to
determine whether the applicant or utility is responsible for
adjustment or relocation costs and to make arrangements for any
necessary work.
SPECIAL INFORMATION:
The applicant is advised that no road improvements or RID\CRP
statement is required at this time. Road improvements to McDonald

After further research into the above zone change/change of conditions, we were led to
believe after the pre-design meeting that there was an error in the labeling of the two
properties Due to this perceived error, we filed correspondence from Mr Jeffreys (see
attached) with the ZE-30A-89 file, when it should have been filed with the ZE-31-94
file After further conversations wnth Don Hennchs and Steve Davenport, we were able
to discover ttus error and have since corrected the problem As a result of this, we
would request that our previous correspondence bs unthdrawn from the record on
these two above actions, and the conditions in this letter instead be placed upon the
development
The reason we are concerned vrnth proposed developments in tius area stems from the
lack of available capacity on Pines Road (SR-27) to provide adequate safe access to
developments in this area We base this statement on two areas of concern
o Recent capacity analyses for the Pines Road and I-90 Interchange indicate
tius facility is currently failing as it operates at LOS "F"
o The intersection of Pines Road and 1VLssion has been expenencing one of the
highest intersection accident rates in our Distnct We have recently
implemented alternate signal tirrungs to help alleviate ttus accident problem
but this will further reduce capacity at tlus intersection
We do also realize that these properties are cucrently approved for medicaUdental
offices and could be built today without further environmental review, if they where
constructed as onginally proposed Realizing that medical dental offices could be
built and the new proposed land use, generates less traffic than the medicaUdental
use we are not opposed to this project as less tnps will ultimately be generated

in January of 1990 However, final plamng, which would have unplemented
Urban Residennal-22 (UR-22) zoning, did not occur If ttus proposal is

A 5 acre parcel drectly north of the subject property was rezoned in 1989 to
Urban Residentxal-22 (UR-22) (ZE-30-89) for the development of inedical offices
only The 1989 approval was not developed, and subsequently, an apphcaaon
for a Change of Conditions (ZE-30A-89) to the 1989 approval was submitted and
is currendy under review The Change of CondiUons would allow 26 apartment
units on the south 12 acres of the site, and is scheduled for pubhc hearmg before

(SEPA) review
In a letter subnutted at the design review meeting on Apn120, 1994, WSDOT
expressed concerns about capacity at the Pmes Road//Interstate 90 Interchange and
the Intersecuon of Pmes Road and 1Vlission The letter stated that the Pmes
Road/Interstate 90 Interchange is presently at capacity and that the Pmes and
Mission Interchange has been expenencuig an unusually high number of
intersection accidents WSBOT requeseed a study of na~'ic umpacts as part af the

In a second letter, dated August 5, 1994, WSDOT responded to the Plannung

Plan and previous decisions of the Heanng Exanuner Committee (see Section II B of

Additionally, the apphcation dces not adequately address environmental concerns under
the State Envmnmental Pohcy Act (SEPA) Analysis of traffic unpacts has not been
provided by the apphcant as requested by the Washuigton State Department of
Transportation (VVSDOT), and dVSDOT has requested that the Deternninatlon of
Nonsigmficance (DNS) be withdrawn (see Secaon II G of this report)

Wastungton State Department of Transportation (WSDOT) has the following
comments
WSDOT would like to reiterate the comments stated in our letter dated Apnl 20, 1994
As you are aware, The Pines Road (SR 27)/I-90 Interchange is presently at capacity in
the PM peak hours, and does not have the reserve capacity to handle additional traffic
in these hours We have also recently confirmed that the south ramp ternunals are
expenencing Level of Service F conditions in the PM peak hours (see attached)
PM peak hour traffic from this proposed development would be expected to use this
interchange due to theu proxunate location RCW 58 17 110 states that adequate
facilities, including transportation facilities, must exist for a proposed subdivision to be
approved This issue of adequate transportation facilities should be addressed in
Section 14 of the SEPA documentation for this project
Also of concern in the area is the intersection of Pines and NLssion, wlvch is in the
V.cuu~y of t:us projEC~ Th,s inter5ect on has bcc-i expe;,enLing an ur~ubua~ly lugh
number of intersection accidents
In addition, in Seetion 14 of the environmental checkLst, it is stated that the complex
would generate an estimated four tnps per apartment per day The ITE Tnp
Generation ivlanual states a complex of tlus size would generate approximately 6 5 tnps
per apartment per day Local tnp generation information for apartment complexes as
gathered by Spokane Regional Transportation Council would indicate that at least the
ITE tnp generation should be used for thus complex Tlus understatement of
approximately 130 tnps is of sigruficant concern If it is still desired to use the four tnp
per day estimate, a justification of ttvs rate should be provided
Because of these concerns, we feel that a DNS is not appropnate for this development
at tlus time We would request that the DNS be withdrawn until the applicant can

Several changes are occurring in this area The area, in general, has had
significant residential development in the last few years Adjacent property
has been developed for multi family use With recient improvements of
Mission Avenue, it is becoming more desirable for further residential
development nearby Access to the site is only several hundred yards off of
Mission on a minor arterial, McDonald Road Sewer hookup is also available
and desired in a development such as what is proposed
2 WHAT IMPACT WILL THE PROPOSED ZONE RECLASSIFICATION
HAVE ON THE ADJACENT PROPERTIES
The reclassification will allow a current unused piece of property to be
converted into a multi-family development to serve the communities need for
housing The landscape buffering being proposed, coupled with residential
character of design and materials, will create visually pleasing structures and
site The utilization of the B P A power easement for parking and '208' areas
serves to reduce the negative nature of the required right-of-way, thus adding

As you are aware The Pines Road/Interstate 90 Interchange is presently at capacity in
the PM peak hours and does not have the reserve capacity to handle addittonal tra.ffic in
these hours PM peak haur traffic from these proposed apartment complexes would be
expected to use thfs interchange due to their proximate location RCVV 5$ 17 114
states that adequate facilities, including transportation facilities must exist for a
proposed subdivision to be appraved This issue of adequate transportation facilities
should be addressed in Section 14 of the SEPA documentation that will be prepared for
this project
In addition the intersection of Pines and Mission which is also proximate to these
proposed developments has been experiencing an unusually high number af
intersection accidents This also is an area of concern
