This matter coming on for public hearing on October 17, 2001, the Hearing Examiner, after
review of the zone reclassification application and the entire record, hereby makes the following
findings of fact, conclusions of law and decision:
1. FINDINGS OF FACT
1. The application requests a rezone of 1.63 acres of land from the Urban Residential-3.5
(UR-3.5) zone to the Urban Residential-22 (UR-22) zone, for those uses allowed in the UR-22
zone.
2. The site is generally located south of Valley Way Avenue, east of Sullivan Road, in the SW
'/4 of Section 13, Township 25 North, Range 44 EWM, Spokane County, Washington.
3. The site is currently referenced as County Assessor's tax parcel nos. 45133.1223 and
45133.1218.
4. The applicant for the proposal is Greg Blessing, 9 South Washington Street, Suite 701,
Spokane, WA 99201. The site owner is Dennis and Christine Anderson, P.O. Box 607, Liberty
Lake, WA 99019-0607.
5. The Hearing Examiner heard the application pursuant to the County Hearing Examiner
Ord.inance (County Resolution No. 96-0171) and the County Hearing Examiner Rules of
Procedure (County Resolution No. 96-0294).
6. The requirements for notice of public heanng were met.
7 The Hearing Examiner conducted a site visit on October 15, 2001.
8. A public heanng was held on the proposed rezone on October 17, 2001.

10. The County Division of Planning issued a Determination of Nonsignificance for the project
on September 28, 2001.
11. The Hearing Examiner takes notice of the County Comprehensive Plan, the County Arterial
Road Plan maps, the County Zoning Code, other applicable development regulations, and land
use decisions in the vicinity.
12. The record includes the documents in the project file at the time of the public hearing, the
documents and testimony submitted at the public hearing, and the items taken notice of by the
Hearing Examiner.
13. The site is approximately 1.63 acres in size and is relatively flat in topography. Three
single-family residences and related accessory structures currently exist on the site.
14. A specific site plan was not submitted for the proposal. The existing homes would be
removed for site development, which will likely consist of offices, or a mixed multi-family and
office use. The site would be served with public sewer and water, and modern utilities.
15. Effective January 1, 1991, the zoning of the site was reclassified from the Agncultural zone
of fihe now expired County Zoning Ordinance to the Urban Residential-3.5 (UR-3.5) zone, under
the Pxogram to Implement the Spokane County Zoning Code. The site is also located in the
Aquifer Sensitive Overlay zone and the Public Transit Benefit Area designated by the Zoning
Code.
16. The site is designated in the Urban category of the Comprehensive Plan. The Major
Commercial category lies approximately 100 feet west of the site, and also 340 feet south of the
site. The Major Commercial category of the Comprehensive Plan extends along Sullivan Road
and Sprague Avenue, and along Broadway Avenue, east of Conklin Road, in the area.
17. The County Arterial Road Plan designates Valley Way Avenue as a Collector Arterial.
Sullivan Road, Broadway Road and Sprague Avenue in the area are all designated as Principal
A.rtenals. Sullivan Road is located approximately 230 feet west of the subject property, while
Sullivan Road is located less than 1,000 feet to the south. The Interstate 90 (I-90)/Sullivan Road
freeway interchange is located approximately one-half mile north of the site
18. The land bordenng Sullivan Road, the land lying between Broadway Avenue and I-90,
and the land located along Sprague Avenue in the area is almost exclusively zoned either
Regional Business (B-3) or Community Business (B-2), and developed for intensive commercial
uses. A Neighborhood Business (13-1) zone is found 400 feet northwest of the site. The land
uses and zoning surrounding the site are accurately described in the Staff Report.
19. The site and area are located inside the interim urban growth area boundaries designated by
the County pursuant to the State Growth Management Act.

20. The Staff Report accurately analyzes the consistency of the project with the relevant
policies of the Comprehensive Plan, and with the UR-22 zone. The Hearing Examiner hereby
adopts and incorporates such analysis by reference as findings of fact herein.
21. The only opposition to the proposal was expressed by the owner of a single-family
residence located on a 1.8-acre parcel lying directly northeast of the site, across Valley Way
Avenue. The parcel is long and narrow, with a 38-foot wide neck that extends south to Valley
Way from the main portion of the site. The main portion of the parcel is 150 feet wide. Such
owner expressed concern with the volume of traffic along Valley Way Avenue, the difficulty of
turning left at the intersection of Valley Way and Sullivan Road to the west, drivers cutting
through his property to reach the Walmart store located along the north side of Broadway to the
northeast, and the lack of a specific site plan for the proposal. See testimony of Lee Smith.
22. County Engineering conditions for the proposal require the applicant, along the frontage of
the site, to dedicate right of way; set aside a future acquisition area for right of way; and improve
Valleyway Avenue to a Collector Axterial standard, including the installation of additional
asphalt, sidewalk and curb. The applicant is also required to supply detailed traffic infonnation
to County Engineering at the time a specific site is submitted for development of the site under
the UR-22 zone, to determine the impacts of the project on traffic infrastructure in the area, and
potential mitigation of such impacts.
23. The intersection of Sullivan Road and Valley Way Avenue currently does not meet traffic
warrants for signalization. Depending on the cumulative traffic impacts from the project,
existing traffic and other approved development at the time a specific site plan is submitted, the
applicant may be required to participate in signalization of the subject intersection, or other off-
site improvements. The conditions of approval adequately mitigate the significant, probable
adverse impacts of the project.
24. The UR-22 zone conta.ins sigruficant landscaping and screening requirements for land
development, including special buffering for adjacent land that is zoned UR-3.5. The site abuts
Community Business (B-2) zoning on the west, and UR-3.5 zoning on the east. On May 7, 2001,
the Hearing Examiner approved a rezone to the UR-22 zone, without a specific site development
plan, for property located directly northwest of the subject property, along the north side of
Valley Way Avenue. See File No. ZE-34-00. On February 21, 2001, the Examiner approved a
rezone to the UR-22 zone of eight (8) acres located approximately 1,000 feet east of the site,
along the south side of Valley Way Avenue, to allow the development of 125 multi-dwelling
units. See File No. ZE-20-00.
25. No deficiencies with regard to the project's compliance with development regulations have
been established in the record. The project has been conditioned for compliance with the
development standards of the UR-22 zone and other applicable provisions of the County Zoning
Code, and the recommendations of the commenting public agencies. As conditioned, the project
will be reasonably compatible with, and not have a significant negative impact on, neighboring
land uses. The proj ect, as conditioned, generally conforms to the Comprehensive Plan.
26. No public agencies objected to the Determination of Nonsignificance (DNS) issued for the
proposal by the County Division of Planning. The proposal will not have more than a moderate
effect on the quality of the environment, and the Examiner concurs with issuance of the DNS.

The procedural requirements of chapter 43.21 C RCW and chapter 11.10 of the Spokane County
Code have been met.
27. Changed conditions have occurred since the zoning of the site was re-designated to the
UR-3.5 zone on January 1, 1991, pursuant to the Program to Implement the Spokane County
Zoning Code. This includes the availability of public sewer to the subject property; road
improvements to Sullivan Road and Sprague Avenue in the area; the rezoning and development
of land along Valley Way Avenue, Sprague Avenue, Sullivan Road and Broadway Avenue in the
area for commercial development; increased population growth in the area; and designation of
the site within the County's rUGA boundaries.
Based on the above findings of fact, the Hearing Examiner enters the following:
II. CONCLUSIONS OF LAW
1. The proposed rezone, as conditioned, generally conforms to the Comprehensive Plan.
2. The proposed rezone bears a substantial relationship, and will not be detrimental, to the
public health, safety or welfare.
3. A change in economic, technological, or land use conditions has occurred to warrant the
proposed rezone, and a substantial change of circumstances has occurred in the area since the site
was last zoned.
4. The procedural requirements of the State Environmental Policy Act and the County's Local
Environmental Ordinance have been met. The proposal, as conditioned, will not have a
sigruficant, probable adverse impact on the environment.
5. The proposed rezone meets the criteria established by Washington case law for approving a
rezone, and the criteria established in paragraphs 14.402.020 (1)(2) of the Cou.nty Zoning Code
for amending the County official zoning map.
6. Approval of the land use application is appropriate under section 11 of the County Hearing
Examiner Ordinance, adopted by County Resolution No. 96-0171.
III. DECISION
Based on the above Findings of Fact and Conclusions of Law, the application for a rezone
to tlze Urban Residential-22 (UR-22) zone is hereby approved, subject to the conditions of
approval of the public agencies stated below.
Any conditions of such agencies that have been added or significantly revised by the
Hearing Examiner are italccazed.

Failure to comply with the conditions of tlus approval may result in revocation of this
approval by the Hearing Examiner. This approval does not wa.ive the applicant's obligation to
comply with all other requirements of other agencies with jurisdiction.
SPOKA.NE COUNTY DIVISION OF PLAN1vING
1. All conditions imposed by the Hearing Examiner shall be binding on the "Applicant,"
which term shall include the owners, developers and users of the property, and their heirs,
assigns and successors.
2. The zone change applies to the parcel of land legally described in the Planning File No. ZE-
13-01, which parcel is currently referenced as County Assessor's tax parcel nos. 45133.1223 and
45133.1218.
3. Priox to any site development or issuance of a building pernut, the applicant shall submit a
site development plan to the County Division of Plarmng, which contains deta.iled specifics for
buildings, structures, landscaping, signs, parking and other improvements required to implement
conditions of approval and development regulations.
4. The site shall be developed in conformance to the Urban Residential-22 (UR-22) zone and
all other applicable provislons of the Spokane County Zoning Code, as amended.
5. Spokane County Division of Planning shall prepare and record with the County Auditor a
Title Notice t11at specifies a future land acquisition area for road right-of-way. The Division of
Planning shall release the Title Notice, in full or in part, when it is no longer necessary. The
Title Notice shall serve as public notice of the conditions of approval affecting the property in
question. The notice should be recorded within the same time frame as an appeal and shall
provide the following:
a. At least 12.5 feet of reserved future acquisition area for road right-of-way and utilities
adjacent to Valley Way, in addition to the newly dedicated right-of-way along Valley Way.
NOTE: The County Engineer has required 2.5 feet of new dedication.
b. Building and other setbacks required by the Spokane County Zoning Code shall be
measured from the reserved future acquisition area.
c. No required landscaping, parking, ground water percolations areas, drainfield or
allowed signs should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they shall be
relocated at the applicant's expense when roadway improvements are made.
d. The future acquisition area, until acquired, shall be pnvate property and may be used as
allowed in the zone, except that any improvements (such as landscaping, parking, surface
drainage, drainfield, signs or others) shall be considered interim uses.

e. The property owner shall be responsible for relocating such "interim" improvements at
the time Spokane County makes roadway improvements after acquiring said future
acquisition area.
6. The Division of Planning shall prepare and record with the Spokane County Auditor a Title
Notice, which notes that the property in question is subject to a variety of special conditions
imposed as a result of approval of a land use action. The Title Notice sha.ll serve as public notice
of the conditions of approval affecting the property in question. The Title Notice should be
recorded within the same time frame as allowed for an appeal and shall only be released, in full
or in part, by the Division of Planning. The Title Notice shall generally provide as follows:
"The parcel of property legally described as [insert legal description] is the subject of a land
use action by the Spokane County Hearing Examiner on December 6, 2001, approving a rezone
of said property and imposing a variety of special development conditions. File No. ZE-13-01 is
available for inspection and copying in the Spokane County Division of Planning."
7. The Division of Planning shall file with the Spokane County Auditor, within the same time
frame as allowed for an appeal from the final disposition, including lapsing of appeal period, a
Title Notice, which shall generally provide as follows:
"Prior to the issuance of any building permit for any building or any use on the property
described herein, the applicant shall be responsible for complying with the provisions of Chapter
14.706 (Aquifer Sensitive Area Overlay zone) of the Spokane County Zoning Code. The
property that is the subject of this notice is more particulaxly described as follows: [insert legal
description from File No. ZE-13-01]."
SPOKANE COUNTY BUILDING AND CODE ENFORCEMENT
1. The applicant should contact the Division of Building and Code Enforcement at the earliest
possible stage in order to be informed of code requirements administered/enforced as authorized
by the state Building Code Act. Design/development concerns include addressing, fire apparatus
access roads, fire hydrant flow, approved water systems, building accessibility, construction type,
occupancy classification, existing exterior wall protection and energy code requirements.
SPOK.ANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior to the issuance of a building permit or at the request of the County Engineer in
conjunction with a County Road Project/Road Improvement District, whichever comes
first:
1. The applicant shall dedicate 2.5 feet on Valleyway Avenue for nght of way.
Prior to the release of a building permit or use of the property as proposed:
2. Approach permits are required prior to any access to the Spokane County Road System.

3. A Professional Engineer, licensed in the State of Washington, shall submit final road and
drainage plans, a drainage report and calculations that conform to the April 3, 2001 Edition of the
Spokane County Standards for Road and Sewer Construction, the current edition of the Spokane
County Guidelines for Stormwater Management, and all other standards and laws that are
applicable to this proj ect. Final plans and drainage report shall receive the County Engineer's
acceptance prior to release of a construction or building permit.
4. A parkang plan and traffic circulation plan shall be submitted and approved by the Spokane
County Engineer. The design, location and arrangement of parking stalls shall be in accordance
with standard engineering practices. Paving or surfacing as approved by the County Engineer
will be required for any portion of the project which is to be occupied or traveled by vehicles.
5. The construction of the roadway improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
6. The County Engineer has designated a Collector Arterial Roadway Section for the
improvement of Valley Way Avenue, which is adjacent to the proposed development. This will
require the additlon of approximately 8.5-10.5 feet of asphalt along the frontage of the
developrnent. Curbing and sidewalk must also be constructed.
7. All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bridge construction and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer.
8. Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane Cou.nty Resolution No. 1-0298 as amended and are applicable to this proposal.
9. No construction work is to be performed within the existing or proposed right of way until
a permit has been issued by the County Engineer. All work with.in the public road right of way is
subject to inspection and approval by the County Engineer.
10. All required construction within the existing or proposed public right of way is to be
completed prior to the release of a building permit or a bond in an amount estimated by the
County Engineer to cover the cost of construction or improvements shall be filed with the
County Engineer.
11. The County Arterial Road plan identifies Valley Way Avenue as a 70-foot Collector
Arterial. The existing right of way width of 20 feet, measured from the centerline, is not
consistent with that specified in the plan. In order to implement the Arterial Road Plan it is
recomrnended that in addition to the required right of way dedication, a strip of property 12.5 feet
in width along the Valley Way Avenue frontage be set aside in reserve. This property may be
acquired by Spokane County at the time when arterial improvements are made to Valley Way
Avenue.
12. The applicant is advised that there may exist utilities either underground or overhead
effecting the applicant's property, including property to be dedicated or set aside future
acquisition. Spokane County will assume no financial obligation for adjustments or relocation

regarding these utilities. The applicant should contact the applicable utilities regarding
responsibility for adjustment or relocation costs and to make arrangements for any necessary
work.
13. The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards.
14. The zone change did not include a specific development proposal or site plan. At such time
as a site plan is submitted for review, the applicant shall submit detailed traffic informafiion for
review by the County Engineer to determine what traffic impacts, if any, that the development
would have on sunounding infrastructure. The applicant is advised that mitigation may be
required for off-site improvements.
SPOKA.NE REGIONAL HEALTH DISTRICT
1. The sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service need not be coordinated through the Director of Utilities, Spokane County.
3. Water service shall be by an existing public water supply when approved by the Regional
Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the project and individual service will be
provided to each lot prior to sale. Use of individual on-site sewage disposal systems shall not be
authorized.
5. The use of private wells and water systems is prohibited.
SPOKANE COUNTY DIVISION OF UTILTTIES
1. A wet (live) sewer connection to the area-wide Public Sewer System is to be constructed.
Sewer connection permit is required. Commercial developments shall submit historical and or
estimated watez usage prior to the issuance of the connection permit in order to establish sewer
fees.
2. Applicant shall submit expressly to Spokane County Division of Utilities "under separate
cover", only those plan sheets showing sewer plans and specifications for the public sewer
connections and facilities for review and approval. Commercial developments shall submit
histoncal and or estimated water usage as part of the sewer plan submittal.
3. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the issuance
of the sewer connection permit.

4. Arrangements for payment of applicable sewer charges must be made prior to issuance of
sewer connection permit. Sewer charges may include special connection charges and general
facilities charges. Charges may be substantial depending upon the nature of the development.
5. Any water service for this proposal shall be provided in accordance with the Coordinated
Water System plan for Spokane County, as amended.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All applicable air pollution control regulations sha11 be met.
SPOKANE COUNTY FIRE DISTRICT NO. 1
1. The District will have requirements at the time of building permit application.

Description of the Site:
The subject property fronts ,on the south side of Valley Way and it is relatively flat. Three single
family dwellings and related accessory structures exist on the site.~ With site development the
existing homes will be removed.
Descript6on of the Surroundin4 Neighborhood:-
The surrounding neighborhood is a mix of development that includes community and regional
serving businesses, a power substation, major church complex, low and medium density single
family dwellings, undeveloped parcels and pasture land. The zaning designations within 1000
feet of the_ project site include Neighborhood Business (B-1), Community Business (B-2), Regional
Business (B-3), Urban Residential-3.5 (UR-3.5) and Urban Residential-22 (UR-22). Land uses in

. the surrounding area include single. familp dwellings, professional office buildings and a variety of
commercial retaii uses. Interstate 90 is approximatefy %a mile north of the project site and parceis
east and west of Sullivan Road are zoned Regional Business (13-3) and Community Business (13-
2) with some parcels zoned Neighborhood 6usiness (B-1). Parcels fronting on both sides of
Sullivan Road from Interstate 90 to Sprague Avenue are developed with a variety of commercial
uses and the Sprague Avenue corridor south of the subject site is heavily developed with regional
serving businesses. The commercial uses adjacent and south of the subject parcel front on
Sprague Avenue.
Sullivan Road is 400 feet west of the project site and is classified a Principal Arterial by the
Spokane County Arterial Road Plan. Sullivan Road and fronting properties together form a major
commercial corridor connecting Interstate 90 and the north Spokane Valley area with Sprague
Avenue about 1,200 feet south of the project site. Valley Way Avenue is classified a Collector
Arterial by the County Arterial Road Plan. Valley Way has 40 feet of right of way and the Arterial
Road Plan requires 70 feet of right of way. To implement the County Arterial Road Plan the
Division of Engineering is requiring a road dedication and is asking for afuture acquisition reserve
area in its recommended conditions of approval.
Peolect Descriation and Background:
The reclassification application was submitted in July, 2001 to reclassify the subject parcels from
Urban Residential-3.5 (UR-3.5) to Urban Residential-22 (UR-22) for those uses allowed in the
UR-22 Zone. No site development plan was submitted with the reclassfication application. A
Technical Review meeting was held on August 9, 2001 and the application was determined to be
Technically Complete on August 30, 2001. The appficant does not propose a specific site
development plan. The applicant is seeking a generic zone reclassification for -all those uses
allowed in the Urban Residential-22 Zone so that he may develop or market the parcels for any
use pemnitted in the Urban Residential-22 Zone without subsequent review by the Hearing
Examiner.
Staff Analysis:
Comprehensive Plan: The project site is located in the Urban Category of the Comprehensive
Plan and the area suROUnding the project sfte is also designated Urban. A Major Commercial
designation exists 204 feet west of the subject s'rte adjacent to Sullivan Road.
The Urban category is intended to provide a city-like environment which includes various land
uses, public facilities and services. Urban areas will be the most intensely developed of 'all
categories and is primarily a residential category intended for single family, twafamily, multifamily,
and condominium buildings with residential net densities ranging from 1 to 17 dwelling units per
acre. Although the site is not necessarily intended for multi family dwellings, the requested Urban
Residential-22 (UR-22) aone is intended to implement the Urban category of the Comprehensive
Plan and allows a maximum residential net density of 22, dwelling units per acre as allowed by
Chapter 14.622 (UR-22 Zone) of the Spokane County Zoning Code. Multifamily structures are a
transitional use between single famiiy residential and the more intensive areas. The zoning
designations within 1000 feet of the project site include Neighborhood 6usiness (13-1), Community
Business (B-2), Regional Business (13-3), Urban Residential-3.5 and Urban Residential-22. Land
uses in the surrounding area include single family dwellings, professional office buildings and
numerous businesses retailing a variety of goods and services. Due to the mix of zones and land
uses and the close proximity to arterial roads in the immediate vicinity of the subject parcels, the
trend away from single family dwellings to more intensive development within the vicinity is well
established.
The Goals, Objectives and Decision Guidelines identified in Section 1 of the Comprehensive Plan
are used to determine whether a proposal in the Urban category should be approved, approved

with conditions or denied. A description, of the applhcable Goals, Objectives and Decision
Guidelines is provided below and an analysis of how the proposal does or does not comply with
these policies.
Detailed Definition B specifies that urban areas will be the most intensely developed of,all the
categories, it is primarily intended for residential category of single family, two family and
multifamily uses along with certain neighborhood commercial and light industrial uses. The more
intensive land uses will be located near the heavily traveled streets, while the least intensive
residential uses will be isolated from the noise and heavy traffic. Detailed Definition D states that
due to the variety and mix of land uses and activities found in the Urban category, few land use
activities would be inappropriate. Many uses may require screening or other standards to make
them compatible with one another. The subject property is located near Sullivan Road, a heavily
traveled Principal Arterial, and it fronts on a Collector Arterial, a street, having a modest level of
traffic. If the subject parcel is developed with multifamily dwellings or professional offices,
screening and buffering from adjacent low density residential development will be required by the
Spokane Zoning Code.
Goal 1.1 and related Objectives and Decision Guidelines encourage a variety of housing types
and densities within Urban areas. "Fill-in" is promoted within developed areas where utilities,
arterials, schools and community facilities have already been established. Higher density
developments such as multifamily should be located with direct or near direct access to major
arterials and planned/existing public transit routes rather than on interior neighborhood streets. It
is recommended that when multifamily dwellings are to be located adjacent to single family areas,
careful consideration must be given to density and design of the multifamily development so as to
' ensure protection of the amenities of the single family area. The site is currently developed to
medium density ~single_ family homes. The proposal can be considered "fill-in" development as the
surrounding properties are all developed at various stages of intensity, ranging ftom regional
serving commercial businesses to large single family dwelling tracts. The site is located adjacent
to Valley Way which is identified as a Collector Arterial by the Spokane County Arterial Road
Plan. Sullivan Road, a Principal Arterial, is 400 feet to the west of the subject property and is
currently served by public transit. Public utilities and senrices are available to serve the site and
include public water and sewer, paved streets, electricity,, telephone, gas, cable services, schools,
parks and libraries. Manned fire stations, medical facilities, and post offices are also available.
Decision Guidelines 1.3.3 and 1.6.1 recommend the provision of sanitary and storm sewer for
developments to protect water quality when the provision is consistent with County plans, policies,
and regulations. Public sewers are available to serve the site. Stormwater containment and
filtr.ation consistent with Spokane County Stormwater Management Guidelines will be required
with site development.
Decision Guideline 1.5.1 recommends the use of buffering and/or landscaping to mitigate the
difference between proposed business uses and existing residential uses. Section 14.806.040 of
the Spokane County Zoning Code requires,a strip of Type I landscaping, a minimum of'20 feet'in
width, along all property lines adjacent to,the existing Urban Residential-3.5 (UR-3.5) Zone. The
subject site is bordered on the east, south and north by the UR-3.5 Zone. In addition, Section
14.622.365 of the Zoning Code (UR-22 Zone) requires a six (6) foot high fence, wall or solid
landscaping to be constructed along the property boundaries. This requirement is intended to
supplement the required landscaping.
Decision Guideline 1.5.4 recommends that sidewalk facilities be required along arterials
connecting residential areas with commercial area. The proposal as conditioned will require the
construction of sidewalks along the Valley Way frontage.

, Objective 1.5.e recommends that when aveighborhood experiences pressure for a change 'of
character, such change shall be permitted upon appropriate review. The,subject property is
experiencing pressure for change. The property has direct access to an arteriai and it is within
close proximity to a larger transportation network. Commercial uses are found west of the site
along the east side of Sullivan Road. The area west of the site has been developing into a dense
commercial area. This same type of transition is occumng on properties located to the south of
Valley Way. The proposed use is a more intensive use than what currently exists in the adjacent
area east of the sfte along Valley Way which is low and medium density single family dwelljngs.
Required landscaping, fenc+ng and building setbacks will help to reduce impacts to residential
homes located along Valley Way east of and adjacent to the subject site.
Goal 1.6, Objecfive 1.6.a and Decision Guideline 1.6.1 recommend that an orderly pattern of
development be established in relation to the extension of water and sewer service. Prior to
approval land use proposals should conform to utility and transportation plans and take steps to
mitigate impacts on existing utility and transportation systems. The site will be served by the Vera
Irrigation Districi #15 and the County sewer system. The Division of Utilities,and ttie Division of
Engineering have recommended conditions of approval to ensure consistency with utility and
transportation plans. Prior to release of building permits the project proponent will be required to
demonstrate compljance with the Spokane Regional Health District and Vera Irrigation Dis#rict #15
water service requirements.
The proposal is located in the Aquifer Sensitive Area (ASA) Overlay Zone. Section 10 of the
Comprehensive Plan addnesses water quality protection. This chapter is intended to coordinate
land uses over aquifers in the County. The recommended conditions of approval require
comptiance with the Spokane County Zoning ASA Overlay Zone requirements specified by
Section 14.706 of the Spokane County Zoning Code. Additionally, the recommended conditions
of approval require compliance with Spokane County stormwater management regulations which
inctude stormwater filtration requirernents.
Decision Guideline10.1.6 states that new utban and suburban type developments within the
adopted sewer service areas, dependent upon location, shall be conditioned to require immediate
connection to sewer. Objective 10.1.d specifies that "fill-in" development and development with
densities that support existing or proposed sewer systems will be preferred. The Spokane
County sewage collection system is available to the project site and the County is willing and able
to serve the proposal assuming the applicant complies with all County sewer connection
requirements. The proposal as conditioned will require connection to the public sewer system.
!n summary, the proposal as conditioned is genera►I!y consistent with the Goals, Objectives and
Decision Guidelines of the Urban category of the Comprehensive Plan if developed as
conditioned. The project site is also located in the IrYterim Urban Growth Area (IUGA) established
pursuant to RCW 36.70A, the Growth Management Act and Spokane County Resolution No. 97-
0321.
Zoning: The purpose of the Urban Residential-22 (UR-22) zone is to set standards for orderly
developrnent of residential property in a manner that provides a desirable living environment that
is compatible with surrounding land uses and assures the protection of property values. It is the
intent of this zone to be used to add to the variety of housing types and densities, and as an
impiementation tool for the Urban category of the Comprehensive Plan. General characteristics
of these areas include paved roads, public sewer and water, accessibility to schools and libraries,
and a full line of public services including manned fire protection and public transit accessibility.
The highest density residential zone, UR-22, is intended primarily for multifamily dwellings, less
intense office space and is usually located adjacent to major or secondary arterials. It is used as
a transition between low and medium density multiple family uses and intensive commercial or
low intensity indust(ial uses and to provide for a higher density housing in locations.close to

employment, shopping and major transportatioti roates wtTere movements of peopie can be 1
handled efficiently and with the least overall adverse impacts.
The site is located adjacent to a Coliector Arterial (Valley Way) and 400 feet from Sullivan Road, a
Principai Arterial. Spokane County will provide sewer service to the site. Vera Irrigation District
will provide water service to the site. Schools are in the vicinity of the site and are available for
future needs. Other services available include manned fire protection, public transit, police
protection, solid waste collection and a post,office. The site is located in an area transitioning
from low/medium density residential uses to intensive commercial uses. lhe proposal is generally
consistent with the purpose and intent of the Urban Residential-22 (UR-22) zone.
The variety of services and facilities described above necessary, to serve an Urban Residential-22
Zone are available to the project site, except sidewalks do not exist on Valley Way. Howeuer, the
recommended conditions of approval require development of curbing and sidewalks. No specific
residential or business development is proposed. Detailed review to determine compliance with
all applicable regulations and conditions of approval is recommended to be administrative and to
occur at the building permit stage.
Changed Conditions: Section 14.402.020(2) of the Spokane County Zoning Code states that
amendments to the Zoning Map may occur when it is found that "Changes in economic,
technological, or land use cond'itions has occurred to warrant modification." Changed conditions
in the area of the proposal may include land use transition from low and medium density
residential which is prevalent east of the subject property, to commercial retail uses immediately
south and west of the subject property. Previous land use actions in the project vicinity
demonstrate changed conditions.
Staff Summarv: As conditioned by the reviewing agencies, the proposal demonstrates general
consistency with the applicable Goals, Objectives and Decision Guidelines of the Urban Category
of the Comprehensive Plan. The subject property is in an area in transition from lower density
residential land uses to higher density land uses, primarily commercial uses. Site development will
be required to comply with the development standards of the UR-22 Zone and all applicable
County and State development regulations. The proposal is consistent with the purpose and
intent of the Urban Residential-22 (UR-22) Zone.

1. All conditons imposed by the Hearing Examiner shall be binding on the "Applicant," which
term shall include the owner or owners of the property, heirs, assigns and successors.
2. The zone change applies only to the parcel legally described in the Planning Division
project application, file designated ZE-13-01, Assessor's tax parcel nos. 45133.1223 and
45133.1218.
3. The development of the subject reclassification site shall comply with the Urban
Residential-22 (UR-22) Zone and.all applicable chapters of the Spokane County Zoning
Code, as amended.
4. Spokane County Division of Planning shall prepare and record with the County Auditor a
Title Notice specifying a future land acquisition, area for road right-of-way. The reserved
future acquisition.area Title Notice shall be released, in full or in part, by the Division of
Planning. The Title Notice shall serve as public notice of the conditions of approval
affecting the property in question. The notice should be recorded within the same time
frame as an appeal and shall provide the following:
a. At least 12.5 feet of reserved future acquisition area for road right-of-way and
utilities adjacent to Valley Way, in addition to the newly dedicated right-of-way along
Velley Way. NOTE: The County Engineer has required 2.5 feet of new dedication.
b. 8uilding and other setbacks required by the Spokane County Zoning Code shall be
measured frorin the reserved future acquisition area.
c. No required landscaping, parking, ground water percolations areas, drainfeld or
allowed signs should be located within the future acquisition area for road right-of-
way and utilities. If any of the above improvements are made within this area, they
shall be relocated at tfie applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may be used
as allowed in the zone, except,that any improvements (such as landscaping, parking,
surface drainage, drainfield, signs or others) shall be considered interirn uses.
e. The property owner shall be responsible for relocating such "interim" improvements
at the tirne Spokane County makes roadway improvements after acquiring said
future acquisition area.

5. The Division of Pianning shall prepare and record witii the Spokane County Auditor a Trt1e
Notice noting that the property in question is subject to a variety of special conditions
imposed as.a result of approval of a land use action. This 1-it1e Notice shall serve as public

should be recorded within the, same time frame as allowed for an appeal and shall only be
released, in full or in part, by the Division of Planning. The T'le Notice shall generally
provide as follows:

described herein,,the applicant shall be responsible for complying with the provisions of

foilowing "Conditions of Approvaf" are submitted to the Spokane County Division of Planning for
inclusion in the "Findings of Fact, Conclusions and OrderlDecision" should the request be approved.
Prior to the issuance of a buitding perrnit or at the request of 4he County Engineer in
conjunction with a County Road Project/Road Improvernent District, whichever comes frst:

Prior to the retease of a buiiding permit or use of the property as proposed:
2. Approach permits are required prior to any access to -the Spokane County, Road System.
3. A Professional Engineer, licensed in'the State of Washington, shall submit final road and drainage
plans, a drainage report and calculations that conform to the April 3, 2001 Edition of the Spokane
County Standards for Road and Sewer Construction, the current edition of the Spokane County
Guidelines for Stonnwater Management, and all other standards and laws that are applicable to
this project. Final plans and drainage report shall receive the County Engineer's acceptance prior
to release of a construction or building permit. 4. A parking plan and traffic circulation plan shall be submitted and approved by 'the Spokane
County Engineer. The design, location and arrangement of parking stalls shall be in accordance
with standard engineering prac#ices. Paving or surfacing as approved by the County Engineer will
be required for any portion of the project which is to be occupied or traveled by vehicles.
5. The construction of the roadway improvements stated herein shall be accomplished as approved
by the Spokane County Engineer.

6. The County Engineer has designated a Collector Arterial Roadway Section for the improvement
of Valleyway Avenue, which is adjacent to the proposed development. This will require the
addition of approximately 8.5-10.5 feet of asphalt along the frontage of the development. Curbing
and sidewalk must also be constructed.
7. All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bridge construction and other applicable county standards andlor
adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer.
8. Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane Board of County Commissioners resolution 1-0298'as amended and are applicable to
this proposal.
9. No construction work is to be performed within the existing or proposed right of way until a permit
has been issued by the County Engineer. All work within the public road right of way is subject to
inspection and approval by the County Engineer.
10.A11 required construction within the existing or proposed public right of way is to be completed
prior to the release of a building permit or a bond in an amount estimated by the County Engineer
to cover the cos#, of construction or improvements shall be filed with the County Engineer.
11.The County Arterial Road plan identifies Valleyway Avenue as a 70 foot Collector Arterial. The
existing right of way width of 20 feet, measured from the centedine, is not consistent with that
specifred in the plan. In order to implement the Arterial Road Plan it is recommended that in
addition to the required right of way dedication, a strip of property 12.5 feet in width along the
Valleyway Avenue frontage be set aside in reserve. This property may be acquired by Spokane
County at the time when arterial improvements are made to Valleyway Avenue.
12. "The applicant is advised that there may exist utilities either underground or overhead effecting
the applicant's property, including property to be dedicated or set aside future acquisition.
Spokane County will assume no financial obligation for adjustments or relocation regarding these
utilities." "The applicant should contact the applicable utilities regarding responsibility for
adjustment or relocation costs and to make arrangements for any necessary work."
13.The applicant shall grant applicable border easements adjacent to Spokane County Right of Way
per Spokane County Standards.
14.This proposed zone change is not being requested for a specific development proposal or site
plan at this time. At such time a site plan is submitted for review, the applicant shall submit
detailed traffic information for review by the County Engineer to determine what traffic impacts, if
any, that the development would have on surrounding infrastructure. The applicant is advised that
mitigation maybe required for off-site improvements.

~ Geologically, the soils are glaciofluvial deposits. These .geological structures generally yield moderate
to very large amounts of water. Data from wells in Ihe area referenced in sectiaA 1 g shows, they are
from 81' to 487' deep and have static water levels varying from 47' to 120' belov►r the surface. The Vera
Water and Power Co. has indicated that it can supply domestic use water for the project upon
completion of agreements with the proponent.
3. Required (maadatory) Conditions If Approved:
a) Sewage clisposal method shall be as authorized by the Director of Utilities, Spokane Caunty.
b) Water service sha11 be coordinated through the Director of Utilities, Spokane County.
c) Water service shall be by an existing public water supply when approved by the Regional Engineer
(Spokane), State Department of Health.
d) A public sewer sy,stem will be made available for the project and individual service will be provided to
each lot prior to sale. Use of individual on-site sewage disposal systems shall not be authorized.
4. Recommended Conditions of Approval:

Ttie Spokane County Engineering Department has reviewed the above referenced application. The
following "C_onditions of Approval" are submitted to the Spokane County Division of Planning, for
inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be approved.
Prior to the issuance of a building perinit or at the request of the County Engineer in
conjun,ction with a County Road ProjecdRoad Improvemen4 District, whichever comes first:
1. Applicant shall dedicate 2.5 feet on Valleyway Avenue for right of way.
Prior to the release of a building permit or use of the property as proposed:
2. Approach permits are required prior to any access to the Spokane County Road System:
3. A Professional Engineer, licensed in the State of Washington, shall. submit final road and drainage
plans, a drainage report and calculations that conform to the April 3, 2001 Edition of the Spokane
County Standards for Road and Sewer Construction, the current edition of the Spokane County
Guidelines for Stormwater Management, and all other standards and laws that are,applicable to
this project. Final plans and drainage report shall receive the County Engineers acceptance prior
to release of a construction or building permit.
4. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane
County Engineer. The design, location and arrangement of parking -stalls shall be in accordance
with standard engineering practices. Paving or surfacing as approved by the County Engineer will
be required for any portion of the project which is to be occupied or traveled by vehicles.
5. The construction of the roadway 'improvements stated herein shall be accomplished as approved
by the Spokane County Engineer.

6. The County Engineer has designated a Collector Arterial Roadway Section for the improvement
o,f Valleyway Avenue, which is adjacent to 'the proposed development. This will require the
addition of approximately 8.5-10.5 feet of asphait along the frontage of the development. Curbing
and sidewalk must, also be constructed.
7. All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bridge construction and other applicable county standards and/or
adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer.
8. Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane Board of County Commissioners resolution 1-0298 as amended and are applicable to
this proposal.
9. No construction work is to be performed within the existing or proposed right of way until a permit
has been issued by the County Engineer. All work within the public road right of way is subject to
inspection and approval by the County Engineer.
10. All required construction within the existing or proposed public right of way is to be completed
prior to the reiease of a building permit or a bond in an amount estimated by the County Engineer
to cover the cost of construction or improvements shall be filed with the County Engineer.
11. The County Arterial Road plan identifies Valleyway Avenue as a 70 foot Collector Arterial. The
existing right of way width of 20 feet, measured from the centerline, is not consistent with that
specified in the plan. In order to implement the Arterial Road Plan it is recommended that in
addition to the required right of way dedicatiori, a stdp of property 12.5 feet in width along the
Valleyway Avenue frontage be set aside in reserve. This property may be acquired by Spokane
County at~the time when arterial improvements are made to Valleyway Avenue.

the applicant's property, including property to be dedicated or set aside future acquisition.
Spokane County will assume- no financial obligation for adjustments or relocation regarding these
utilities.", "The applicant 'should contact the applicable utilities regarding responsibility for
adjustment or relocation costs and to mak& aITangements for any necessary work."
13. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way
per Spokane County Standards.
14. This proposed zone change is not being requested for a specific development proposal or site
plan at this time. At such time a site plan is submitted for review, the applicant shall submit
detailed traffic information for review by the County Engineer to determine what traffic impacts, if
any, that the development would have on surrounding infrastructure. The applicant is advised that
mitigation maybe required for off-site improvements.

ihe Spokane County Code. Tlie fees will be based on actual salary costs incurred by Spokane
County for project reviews and / or inspections plus a ten percent administrative charge, and will
be billed monthly as accrued. Any billing amounts due, including any expenses incurred in the
collection of an overdue account, must be paid prior to the County's acceptance of the project for
tiling. If a project is approved and/or filed with a baIance still owine, the unpaid balance shall be
paid %ti•ithin 30 daYs of the invoice date.

Any invoices not paid within 30 days of tfle invoice date will be considered delinquent. If any
oucscanding balance on the account fvr this project is not paid within 30 days of the invoice date,

paid. Any balance on the account for this project not paid within 65 days of the invoice date rnay
result in legal action or the initiation of other collection procedures, including referral to a
collectian agency. The Sponsor will be liable for any and all expenses incurred by the Counry for
