businesses or individual parcels clustered along a heavily traveled street or

allow a 15 foot setback from the property luie adjacent to Riverside Avenue
whereas the proposed Regional Business (B-3) Zone requires a rrunimum
35 faot setback from the property line on a pnvate road The Vanance
Analysis section of this report will analyze the Vanance request in greater
detail
I Variance Analysis The applicant has requested a Vanance from the mmimum
flanlang yard setback requuements of the Spokane County Zoning Code and
Regional Business (B-3) Zone, to allow a 15 foot setback from the property hne
along Riverside Avenue, whereas the proposed B-3 Zone specif'ies a flanlang
yard setback of 35 feet from the property luie on a pnvate road In the Vanance
request the applicant contends that the lot width is narrow and that the subject
property is adjacent to three streets each of which requues a front or flanking
yard setback as specif'ied by the Spokane County Zoning Code The applicant
also states that the proposed 15 foot setback from the property line is not
detrunental to the general pubbc, envuonment, or adjacent propernes In
addition, the proponent contends that stnct application of required setbacks
renders the subject property too small to warrant investment
Given the above information, and physical charactensncs of the subject property
the Planning Department response is as follows
The subject property is affected by the unique situation of having frontage on
three streets, and having to ma.intain three front and/or flanking yard setbacks
Size of the subject property is a minor hardship in site design and development
Site configuration may allow a reasonable use of property as proposed
Smct application of the required setback only marglnally affects the abihty to
utilize the property in a reasonable manner The reqwred setback does not deny
the applicant reasonable use of the property, and would not affect the proposed
use of an automotive garage for which the zone reclassification is being sought
Applicanon of requued setbacks merely reduces the size of the proposed 4,800
square foot retail building
The apphcant has not demonstrated the burden of proof necessary to substantiate
the vanance request
In recogrution of the above statements, the Planning department recommends
denial of Vanance VE-4-93 This recommendation recogruzes that the subject

from Neighborhood Business (B-1) to Regional Business (B-3) VE-4-93, Vanance
for reduction of flanlang yard setback, within the Aquifer Sensiave Area Overlay

FINDINGS OF FAC'T A1VD CONCLUSIONS
1 The property is generally located at the northwest corner of Sprague Avenue and
McDonald Road in the SW 1/4 of Section 15, Township 25 North, Range 44 EWM,
Spokane County, Washington
2 The committee adopts the Plannuig Department Report as a part of this record
3 The existing land uses in the area are commercial and residential uses
4 The proposed use is compatible wnth existing uses in the area
5 The Comprehensrve Plan designates this site as Major Commercial The Major
Commercial category is for the purpose of the development of commercial uses,
specifically those commercial uses related to major artenals
6 The proposed zoning does implement and conform to the Comprehensive Plan
7 The Artenal Road Plan designates Sprague Avenue as a Pnncipal Artenal, with a
recommended nght of way vvidth of 130 feet 1VIcDonald Road is identified as a
Niinor Artenal with a recommended nght of way width of 80 feet,
8 The existing zonuig of the property descnbed ui the apphcatton is Neighborhood
Business (B-1) previously established as Local Business (LB) zorung ul 1955 and
reclassified to Neighborhood Business (B-1) on January 1, 1991 pursuant to the
Progratn to Implement the Spokane County Zorung Code
