Broadway Avenue and Pines Road in Secnon 15, Township 25 N, Range 44 EWM,
Spokane County, Washington
2 The committee adopts the Planning Department Report as a part of this record
3 The existmg land uses in the area include retail shops, professional offices, North
Prnes Junior High School and single family and mulhple family residences
4 The Comprehensive Plan designates this site as Major Commercial The Major
Commercial category is intended to provide the opportunity for the development of
commercial uses, specifically, commuruty and regional shopping centers and
commercial uses directly related to major transportation routes
5 The Artenal Road Plan designates Broadway Avenue as a Pnncipal Artenal, with a
recommended nght of way width of 100 feet, The existing nght of way width is 60
feet The County Engineer has requued a 2 foot nght of way dedicaaon along
Broadway Avenue In addiaon, the County Engineer has requued 16 feet along
Broadway Avenue to be set aside as a future acquisition area for road improvements
Pines Road fronting the proposal is a State Highway

location, landscape plans and general allowable uses of the pernutted zone All
vanations must conform to regulanons set forth in the Spokane County Zoning
Code, and the onginal intent of the development plans shall be maintained
3 Approval is requued by the Planning Duector/designee of a specific lighting and
signing plan for the descnbed property pnor to the release of any building pemuts.
4 A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Plannuig Director/designee shall be subnutted with a performance
bond for the project pnor to release of building perauts Landscaping shall be

5 The Spokane County Planrung Department shall prepare and record with the
County Auchtor a Tide Noace specifying a future land acquisition area for road

utilities If any of the above unprovements are made within this area, they
shall be relocated at the applicant's expense when roadway unprovements are
made
d. The future acquisition area, until acqtured, shall be pnvate property and may
be used as allowed in the zone, except that any unprovements (such as
landscaping, parlang, surface draunage, drainfield, signs or others) shall be
considered intenm uses
e The property owner shall be responsible for relocating such "intenm"
unprovements at the time Spokane County makes roadway unprovements

Spokane County Health Distnct a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project, or pornon thereof, if the
development is to be phased.
5 A parlang plan and tiraffic cuculadon plan shall be subrrutted and approved by the
Spokane County EngYneer. The design, locanon and arrangement of parlang stalls
shall be ui accordance with standard traffic engineenng pracaces Paving or
surfacing as approved by the County Engrneer, will be requued for any portion of

6 The County Engineer has designated Typical Roadway Section Number One, Major
Artenal standard for the unprovement of Broadway Avenue, which is adjacent to
the proposed development
7 All requued improvements shall conform to the current State of Washmgton
Standard Specificanons for Road and Bndge Construcnon and other apphcable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater 1Vianagement in effect at the date of constnicuon, unless othervvise
approved by the County Engineer.
8 Applicant shall construct a paved and dehneated approach(es) to meet the existing
pavement on Broadway Avenue
9 Roadway standards, typical roadway sechons and drainage plan requu-ements are
found in Spokane Board of County Comrmssioners Resolution No 80-1592 as
amended and are apphcable to this proposal
10 This subd.ivision or development proposal is located withi.n a drainage basin which
has been identified by the Spokane County Engzneer's office as having stormwater
runoff problems Since this plat or development proposal is affected by or is a

measures must be ta.ken immediately to clean these surfaces

PLANNING DEPARTMENT REPORT
TO: SPOKANE COUNTY HEARING EXAMINER COMMITTEE
FROM: CURRENT PLANNING SECTION

SUBJECT: Zone Reclassificarion File No. ZE-3-92, from Urban Residentia13.5
(UR-3.5) to Regional Business (B-3) for an unspecified commercial use
as allowed in the Regional Business (B-3) zone. The subject property is
also located in the Aquifer Sensitive Area Overlay zone.
I. GENERAL INFORMATION

Location: Generally located at the northeast corner of the intersection of Pines
Road and Broadway Avenue in Section 15, Township 25 North, Range 44 EWNi,
Spokane County, Washington.
II. SITE INFORMATION
A. Site Size: .56 acres
B. Comprehensive Plan
1. Land Use Plan: The property is located within the Major Commercial
category of the Comprehensive Plan. The Major Commer+cial category is
intended to provide the opportunity for the development of commercial
uses, specifically, community and regional shopping centers and
commercial uses directly related to major throughways.
2. Arterial Road Plan: The Arterial Road Plan designates Broadway
Avenue fronting the site as a principal arterial with a recommended future
right of way width of 100 feet. The existing right of way width for
Broadway avenue is 60 feet. In arder to implement the Arterial Road Plan,
the County Engineer has required a dedication of 4 feet along Broadway. In
addirion to the 4 foot dedicarion,the County Engineer has also required that ~
16 feet along Broadway be set aside as a future acquisirion area to be
acquired by the County when needed for road improvements.
Pines Road, which fronts the west boundary of the site, is a State Highway.
Access and improvements to Pines Road must be approved by the State
Highway Dept. Since the specific use of the property is unknown at this

rime, the Washington State Dept. of Transportation has requested that.a
traffic study be prepared for the site when a specific use is known. The
recomniendations for traffic mitigarion should be implemented prior to
occupancy of the site.
C. Site Characteristics: The site is essentially flat. The site is currently vacant.
D. Neighborhood Characteristics: The proposal is located in an established
urban area. The area is slowly transitioning as more intensive commercial and
high density residenrial uses are developing along Pines Road. The residential
properties set back from Pines Road appear to be in transirion as well. Many
apartments including some large scale projects have been constructed in recent
years.
E. Zoning Analysis: Prior to January 1, 1991, the property was zoned
Agricultural Suburban under the old Zoning Ordinance. When the new zoning
code was fully implemented on January 1, 1991, the site was reclassified Urban
Residential-3.5 (UR-3.5). Nearly all the property along Pines Road within 1/2
mile north and south of the subject property is currently zoned Neighborhood
Business (B-1), Regional Business (B-3) or Urban Residenrial-22 (UR-22).
Other than the Zoning Code implementation discussed above, there have been
only two zone reclassificarions along Pines Road within 1/2 mile of the subject
property since 1985. One rezone to Regional Business (B-3) was approved north
of the site and 1 rezone to Urban Residential-22 (UR-22) was approved south of
the site.
Proposal: Reclassify land presently zoned Urban Residential-3.5 (UR-3.5)
established in January 1,1991 to Regional Business (B-3).
North: Neighborhood Business (B-1) established January 1, 1991
South: Urban Residential-22 (UR-22) established January 1, 1991 ~
East: Urban Residenrial-3.5 (UR-3.5) established January 1, 1991
West: Neighborhood Business (B-1) established January 1, 1991
F. Land Use Analysis: The land use along Pines Road within 1/2 mile north and
south of the site is dominated by retail businesses, offices and apartments. To the
west and east of the Pines Road comdor are single family residential areas. A
number of apartment complexes and duplexes have been constructed in recent
years both east and west of Pines Road. North Pines Junior High School is
located southwest of the site across Pines Road.
Site: The site is currently vacant. A Washington Water Power substation
was located on the site in the past. No specific land use is proposed '
for the site. Due to the site's location at the intersection of two majar
transportation routes, Pines Road and Broadway Avenue, commercial
development is likely. If the request for Regional Business (B-3) is
approved, any of the uses pernutted in the (B-3) zone may be
established on the site.

South: Office center
East: Driveway to Modern Electric maintenance facility and single family
residence
West: Office center
G. Circulation: Access to the site may be from Pines Road or Broadway Avenue
or both. Access to Fines Road must be approved by the Washington State Dept.
of Transportation. Access to Broadway Avenue must be approved by the County
Engineer. Due to the center median in Pines Road, no left turns in or out of the
site from Pines Road will be possible. Full turning movements may be allowed
from Broadway Avenue subject to approval by the County Engineer.
H. Design: Since no site plan has been submitted, the project design is unknown at
this time. The proposal must meet all the standards of the Regional Business
(B-3) zone. The major requirements are shown below.

Proposed Buffering/Landscaping Techniques: Along the east
boundary of the site a 20 foot wide strip of type I(visual screen)
landscaping is required to buffer the adjacent Urban Residential-3.5 Zone.
No landscaping is required along the site's north boundary since the north
boundary is located adjacent to Neighborhood Business Zoning. Along
Broadway Avenue and Pines Road a 5 foot strip of type III (see through
buffer) landscaping is required.
No site plan has been submitted for review by the Hearing Examiner
Committee. Detailed site plan review is recomniended to be administrative
at the Building Pemut stage with guidance from the Comprehensive Plan,
Ondinance requirements, condidons of approval, and other County policies
and guidelines.

I. Drainage: A drainage plan is required. This plan must be reviewed and
approved by the County Engineees Department prior to development The site is
located in an area that has been identified by the County Engineer as having
stormwater runoff problems. Owners will be required to participate in the
planning and implementation of stormwater control facilities.
J. Water Supply: The proposal is within the Modern Electric Water DistricL The
Water District has ind.icated that they are able to serve the site.
K. Sewage Disposal: Public sewer is available to the site. Connecdon to the
public sewer is required prior to occupancy.
L. School: The proposal is in the Central Valley School District No. 356.
M. Fire Protection: The proposal is within Fire District No. 1. The Fire District
must approve fire protection provisions prior to issuance of building permits.
N. Cultural Resources: None have been idenrified.
III. ENVIRONMENTAL REVIEW:
An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Department. The review considered the specifics of the proposal,
other available information, County ard.inances, other regulations and laws, possible
standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Depa.rtment has determined that "No
probable significant adverse impacts" would result from the proposal being developed
and has issued a Detenmination of Nonsienificance ("DNS").
The "DNS" was circulated to 9 other agencies of jurisdicdon and other
agenciesldepartments affected by the future development for review and comment.
The "DNS" comment period ends February 18, 1992 and was advemsed 15 calendar
days before said date in the newspaper, by letter to adjacent property owners within
400 feet of the proposal, and by notice on a sign posted on the proposal site. The
Hearing Examiner may consider add.irional environmental related testimony at the
public hearing.
IV. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
The proposal is located in the Major Commercial category of the Comprehensive Plan.
Past zoning decisions along Pines Road indicate a trend toward commercial and high
density residential development. The existing zoning and land use adjacent to the site is
primarily commercial and office and should be compadble with the uses allowed in the
proposed Regional Business Zone. The proposal is located at the intersecrion of 2
major transportation routes.
Due to the facts stated above the Planning Department has recommended that the
proposal be approved subject to the conditions of approval shown below.

V. CONDITIONS OF APPROVAL
i. All conditions imposed by the Hearing Examiner Cornmittee shall
be binding on the "Applicant", which terms shall include the
owner or owners of the property, heirs, assigns and successors.
i i. The zone reclassification applies to the following real property:
The west 130.43 feet of the south 205.65 feet of Tract 77 of
Opportunity. EXCEPT any portion lying within the west 128.48
feet of the north 120 feet of the south half of Tract 77, in Section
15, Township 25 North, Range 44 EWM, Spokane County,
Washington. Recorded in Volume K of plats, page 20.
SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Regional Business (B-3) zone(s) as amended.
2. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be permitted, including, but not limited to build.ing
location, landscape plans and general allowable uses of the permitted zone. All
variarions must conform to reguladons set forth in the Spokane County Zoning
Ordinance, and the original intent of the development plans shall be maintained.
3. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.
4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning I?irector/designee shall be submitted with a perfornlance
bond for the project prior to release of building pernuts. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
impaired.
5. The Spokane County Planning Department shall prepare and record with the
County Auditor a Tide Notice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Planning Department. The notice should be
recorded within the same time frame as an appeal and shall provide the following:
a. At least 16 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Broadway Avenue. NOTE: The County Engineer has required 4 feet of new
dedication.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisidon area for road right-of-way and
utilities. If any of the above improvements are made within this area, they

shall be relocated at the applicant's expense when roadway impravements are
made.
d. The future aoquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
e. The property owner shall be responsible for relocating such "interim"
improvements at the time Spokane County makes roadway impmvements
after acquiririg said future aoquisition area.
6. The Planning Deparnnent shall prepare and record with the Spokane County
Auditor a Tide Notice noting that the property in question is subject to a variety of
special conditions imposed as a result of approval of a land use action. This Title
Notice shall serve as public notice of the conditions of approval affecting the
property in question. The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Notice shall generally provide as follows:
The parcel of property legally described as [ ] is the subject
of a land use action by a Spokane County Hearing Body or
Administrative Officiai on [ imposing a variety of
special development conditions. File No. ZE-3-92 is available for
inspection and copying in the Spokane County Planning Department.
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior to issuance of a build.ing permit or at the request of the County engineer in conjunction
with a County Road Project/Road Improvement District, whichever comes first:
1. Applicant shall dedicate 4 feet on Broadway Avenue for right-of-way.
2. The applicant shall dedicate the applicable radius on Broadway Avenue and Pines
Road.
Prior To Issuance Of A Building Pernvt Or Use Of The ProneM As Pronosed:
1. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
2. Access pernuts and improvements to Pines Road must be approved by the •
Washington State Department of Transportation (WSDO'I).
3. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
4. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan
and surface water disposal plan far the entire pmject, or portion thereof, if the
development is to be phased.

5. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
6. The County Engineer has designated Typical Roadway Section Number One, Major
Arterial standard for the improvement of Broadway Avenue, which is adjacent to
the proposed development.
7. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
8. Applicant shall construct a paved and delineated approach(es) to meet the existing
pavement on Broadway Avenue.
9. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resoludon No. 80-1592 as
amended and are applicable to this proposal.
10. This subdivision or development proposal is located within a drainage basin which
has been identif'ied by the Spokane County Engineer's office as having stormwater
runoff problems. Since this plat or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the planning
and implementation of a future basinwide stormwater management system The
following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design,
constructing, maintaining or operadon of stormwater control facilides."
11. No construction work shall be perfonned within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
12. The County Arterial Road Plan identifies Broadway Avenue as a Principal arterial.
The existing right-of-way width of 60 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addirion to the required
right-of-way ded.ication, a strip of property 16 feet in width along the Broadway
Avenue frontage shall be set aside in reserve. This property may be acquired by
Spokane County at the time when arterial improvements are made to Broadway
Avenue.
13. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocarion
regarding these utilities. Applicant(s) should check with the applicable utility

purveyor and the Spokane County Engineer to determine whether applicant(s) or
the utility is responsible for adjustment or relocarion costs and to make
arrangements for any necessary work.
14. Applicant shall submit for review and approval by the County Engineer access plans to
Broadway avenue and Pines Road. Safe site distance and reducrion of accident
potential shall be demonstrated from the access.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Sewerage facilides are not affected by this proposal; therefore, no recommendation.
Note: Depending on the use, additional general facility charges may be required.
SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilides, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane County
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the plat/project, and individual
