The sponsor, MCC Propernes, requests approval of a zone reclassification, File No
ZE-6-91, from Urban Residenaal-3 5(UR-3 5) to Industnal Park (I-1)

approximately 400 feet east of Pines Road in Section 15, Township 25 North, Range
44 EWM, Spokane County, Waslungton
2 The comrruttee adopts the Plannuig Department Report as a part of this record
3 The exisang land uses in the area are light industry, commercial, multiple fanuly
residences, and single family residences
4 The Comprehensive Plan designates this site as Urban The Urban category is for the
purpose of creatulg a"city lilce" environment includ.ing residennal, neighborhood,
commercial, llght industry, public and recreanonal land uses
5 The Artenal Road Plan designates Desmet Avenue as a local access street, with a
recommended nght of way width of 60 feet The existing nght of way width is 40
feet The County Engineer requued dedication of a 10 foot vvide stnp of land along
the entire length of the site for addiaonal Desmet Avenue nght of way
6 The exisang zorung of the property descnbed in the apphcation is Urban Residenaal-3 5
(UR-3 5) which was established on January 1, 1991 accord.ing to the program to
implement the Spokane County Zomng Code
7 The provisions of RCW 43 21C (The State Environmental Pohcy Act) have been
complied with and a Detemunanon of Nonsignificance was issued
8 The legal requuements for public notice have been fulfilled
9 The owners of adjacent lands expressed a number of concerns regardmg the proposal
including landscaping/buffenng, buildmg height and color, fence height and color,
traffic and allowed uses in the Industnal Park (I-1) zone
10 The proposed use is compaable with existing uses in the area
11 The proposed zoning does unplement and conform to the Comprehensive Plan

That the proposal as subrrutted by the sponsor depicts access to the site from the
adjacent parcel located to the west of the site and that no direct access to the site from
Desmet Avenue is proposed The proposal as subnutted by the sponsor is for
manufacture of fabnc supphes and sevcnng of garments No other land use is
proposed for the site

1. All current standards of the Indusmal Park (I-1) zone, as amended, shall be
comphed with in the development of this site
2 The apphcant shall develop subject property in stnct conformance with the site plan
presented to the Heanng Body on Apnl 18, 1991 All aspects of the concept and
proposal shall be binding on the development, including the pronosed use
Vanations, to be approved by the Plammmg Duector/designee, shall only be allowed
to meet regulaaon standards and cond.inons of approval Any other mod.lfication
must be presented to the Hearmg Body for review and approval
3 The Planning Deparmnent shall prepare and record vvith the Spokane County
Auditor a Title Notice noting that the property in question is subject to a vanery of
special conditions imposed as a result of approval of a land use action This Title
Nonce shall serve as pubhc notice of the conditions of approval affecting the
property in question The Title Noace should be recorded witlun the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planrung Department The Title Notice shall generally provide as follows
The parcel of property legally described as [ ] is the
subject of a land use action by a Spokane County Hearing Body or
Administrative Official on April 18, 1991 imposing a variety of
special development conclitions. File N0. ZE-6-91 is available for
inspection and copying in the Spokane County Planning Departaraent.
4 The Planning Department shall file with the Spokane County Auditor, within the
same time frame as allowed for an appeal from the final d.isposition, includuig
lapsing of appeal penod, a Title Notice, which shall generally provide as follows
"Pnor to the issuance of any building permit for any building or any use on the
property descnbed herein, the apphcant shall be responsible for complying with the
provisions of the Zoning Code for Spokane County, Section 14 706 (Aquifer
Sensitive Area Overlay Zone) The property which is the subject of this noace is

acceptable to the Plannuig Director/designee shall be subnutted with a performance

2 Access pernuts for approaches to the county road system shall be obtauled from the
Spokane County Engineer
3 The apphcant shall submit for approval by the Spokane County Engineer road,
drainage and access plans
4 The applicant shall subnut for approval by the Spokane County Engineer and the
Spokane County Health Distnct a detailed comuined on-site sewage system plan
and surface water disposal plan for the entire project, or pornon thereof, if the
development is to be phased.
5 A parlang plan and traffic cuculation plan shall be subnutted and approved by the
Spokane County Engineer The design, location and arrangement of parking stalls
shall be ui accordance with standard traffic engineenng pracnces Paving or
surfacing as approved by the County Enguieer, will be requued for any pornon of
the project which is to be occupied or traveled by vehicles
6 The construction of the road unprovements stated herein shall be accomphshed as
approved by the Spokane County Engineer
7 The County Engineer has designated Typical Roadway Section Number One, Local
Access standard for the unprovement of Desmet Avenue, which is adjacent to the
proposed development This will requue the add.iaon of approximately 10-12 feet
of asphalt along the frontage of the development The construcaon of curbing and
sidewalk is also required
8 All requued unprovements shall conform to the current State of Washington
Standard Specificanons for Road and Bndge Construction and other apphcable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer
9 Roadway standards, typical roadway sections and drainage plan requuements are
found in Spokane Board of County Commissioners Resolution No 80-1592 as
amended and are applicable to ttus proposal
10 This subdivision or development proposal is located withul a drainage basin which
has been identified by the Spokane County Enguieer's office as havuig stormwater
runoff problems Since this plat or development proposal is affected by or is a
contnbutor to stormwater flows, property owners should parncipate in the plannulg
and unplementaaon of a future basinwide stormwater management system The

The proposal is located in the urban category of the Comprehensive Plan Light
industry is supported by the Urban category when it is located near heavily traveled
streets and is compauble with adjacent land uses _
The site is located adjacent to Industnal Park (I-1) zorung and apparel manufactunng
on the west To the south the land is zoned Urban Residential-3 5(UR-3 5) but
existing land uses include a Washington Water Power substation and Modern Electnc
storage yard Residences are located to the north and east Impacts on the residences
are somewhat rrnagated by the requued 50 foot building setbacks and landscaping
The fact that all vehlcular access to the site will be from the Industnal Park (I-1)
zoned property west of the site also helps to mitigate impacts on nearby residents
For the above reasons the Planning Department recommends approval of the proposal
subject to the condinons of approval

9. That the Variances granted are those along the south property
line and in the southeast corner of the site as shown on the
site plan reviewed by the Hearing Examiner Committee on March 6,
1986 and-received by the Planning Department on February 24,
1986.
b) COUNTY ENGINEERING DEPARTMENT
Prior to Issurance of a Building Permit:
1. Applicant shall dedicate 10 feet on Desmet Avenue for
right-of-way prior to any use of the property.
2. Access permits for approaches to the County Road System shall be

3. Access permits and improvements to Pines Road must be approved •
by the Washington Department of Transportation.

location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
8. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
