~ The Urban category encourages the retention and development of residential
areas with opportunities for neighborhood services and industry. Specific
reference is made to the approval of home occupations when they are
non-disruptive of neighborhood amenitieso It must be found that the home
, occupation in the existing residential area will not:
a) disrupt residential amenities concerning sight, sound, smell and
similar factors; or
b) create traffic which exceeds road design or which develops traffic
hazards within the neighborhood; or
c) negatively affect the intended uses within this Category.
Additionally, Objective 12.1.L of the Energy Management section states
that cottage industry uses are encouraged in order to reduce the arnount of
transportation required to and from work. There are no specific
guidelines for implementation of this objective.

photo/portrait studio consisting of 570 square feete Only one
person, not residing on the premises, will be employed at the site.

incorporated into the landscapingo Maximum hours of operation could

remain and be augmented where needed. The proposed parking area will

- The site plan submitted for review by the Zoning Hearing
Examiner Committee is general in nature. Detailed review to
determine compliance with all Ordinance regulations and
conditions of approval is recommended to be administrative and
to occur at the Building Permit stage.
III. SITE DEVELOPMENT RECOMMENDATIONS
Conditional Use Standards: The basic requirements for a home industry are
spelled out in the Zoning Code. The Hearing Examiner Committee may add,
if necessary to mitigate an identifiable problem, to the following
standards:
a) The property shall retain its residential appearance and character;
b) The use shall be carried on in a primary residence or may be allowed
in accessory9 detached structures which are not, in total, larger
than two (2) times the gross floor area of the primary residence;
c) Only members of the family residing on the premises, and no more than
two (2) employees outside of the family, may be engaged in the home
i ndu stry ;
d) Signs identifying the home industry shall be unlighted and may be
attached or detached per the following standards:
ii. In the SR-1, SR-1/2, UR-3.5, and RS Zones, signs totaling a
maximum of four (4) square feet on a face;
e) Window or outside displays may be allowed as approved by the Hearing
Body;
f) There shall be no stock stored nor commodity kept for sale on the
premises which is not necessary to the occupation, profession, or'
craft;
g) All material or mechanical equipment shall be used in such a manner
as to be in compliance with WAC-173-60 regarding noise;
h) Parking, traffic, and storage requirements shall be as approved by
the Hearing Body; and
i) A11 storage areas shall be enclosed or completely screened from view
by a maximum six (6) foot high sight-obscuring fence meeting
accessory use setback requirements.
Desicn: Review of exterior building remodel to be adminisrative to insu re
continuance of residential appearance and character. No window or outside
displays are proposed.
Parkinq: Parking area in front will have less of impact on adjoining
residential uses than location elsewhere on the interior of the property.
Landscapinq: Additional landscaping along the north and south ends of the
parking lot may be necessary per Section 8002.240-(5)-(6)-(8) of the
Zoning Code.

Circulation/Access: Engineer's requires a 16-foot dedication along
University Road within an additional 2-foot utility easement reservation.
Driveway access must be approved by Engineering.
Sewaqe Disposal: The applicant has designed parking and driveway areas
away fromn the two existing drainfield systemso
Critical Materials/Use Activity: Use and handling of chemicals for photo
business must be in conformance with Aquifer Sensitive Area Overlay Zone
and will be reviewed at building permit stage.
IVo SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was
rediewed by the County Planning Department. The review considered
the specifics of the proposal9 other available information, County
ordinances, other regulations and laws, possible standard Conditions
of Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines. The Zoning Administrator has determined
that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Determination of
Non-Siqnificance ("DNS")o
The "DNS" was circulated to eight other agencies of jurisdiction and
other agencies/departments affected by the future development for
review and commente The "DNS" comment period ends April 2, 1986, and
was advertised 15 calendar days before said date in the newspaper, by
letter to adjacent property owners within 400 feet of the proposal;
and by notice on a sign posted on the proposal site. The Hearing
Examiner Committee may consider additional environmental related
testimony and the "DNS"at the public hearing.
V. PLANNING SUMMARY
The requested rezone to Urban Residential 3.5 (UR 3e5) should be
approved because:
1) it is consistent with, and implements, the Comprehensive Plan;
and
2) the area is scheduled to crossover to UR 305 in 1991e
The requested Conditional Use Permit for the home industry is the
major issue of the two requested actions. Minimum requirements in
the Zoning Code are intended to protect adjacent residential uses, if
the Conditional Use Permit is approvede Additional conditions may be
added_to mitigate problemsa The request should be approved, with all
recommended conditions, for the following reasons:

- The Comprehensive Plan supports approval of home professions and
industries, provided that the adjoining residential areas will
be adequately protected;
- The minimum Conditional Use Permit standards and other
recommended conditions serve to meet the three Guidelines'
criteria of the Comprehensive Plan and protect adjacent uses;
- The site plan and application indicate an intent to develop and
operate the home industry with minimal impacts to adjacent
residential uses by retaining as much as possible a residential
character;
- A photo/portrait studio is a low intensity use that should not

Attached is a letter from Bill Eichelberg which addresses a zone change pro-
posal which will go before the Zoning Hearing Examiner Committee in April, 1986.
Mr. Eichelberg is requesting that his property be rezoned from A.gricultural Suburban
to UR 3.5 (new zoning code). The UR 3.5 zone is an urban residential zone. He is
also requesting a"conditional use permit" for a portrait studio as a home industry.
We would concur with his request for a"Land for Improvement" agreement as
suggested in his letter. Please advise us of your decision so that we may attach

My wife and I have resided at North 413 University for about
one year since we gurchased the property. The legal description
of this property is: North half of lot 6; East 10 feet of South
half of Lot 6; and Lot 9 and the North half of Lot 7. all located
in Block 108 Opp Bevins; Section 17, Township 25, Range 44.
We understand that the county, because of heavy traffic flow
on University Road, is in the process of planning to widen
University Road. As you know, tAis project will involve County purchase9 of home owners land to widen the existing road.
On January 17, 1986 I met with the County Planning Dept. to iniate
a Zone change on our property. I have applied for UR 3.5 (New
County Crossover) along with a conditional use for Home Industry
CUP. Our Application for Zone Reclassification number is ZE - 3- 86.
and Conditional Use Permit File #CUE - 2- 86. vVe are scheduled
for a public hearing on April 3, 1986. Essentially, the new
zoning would be residential under the new comprehensive zoning
plan and dllow us to work out of our home. We would like to
open a small portrait studio. This Studio would be located in
our garage, which we plan to remodel. The majority of the building
would continue to be used as our home. The amount of traffic
generated by the studio would be very little. We would like
to dedicated to the Spokane County the needed land deemed necessary
to widen the road and construct sidewalk and curbing. However,
if we were obligated to pay for the sidewalk and curbing, it
would be burden that we feel we should not have to carry.
In January I talked to Mr. Dick Hoover from the Spokane County
Right-A-Way Supervisors Office. In our telephone discussion
he stated that he would recommend a LAND/FOR/IMPROVEvIENT in this
particular case. Your support and authorization of this trade of
land for sidewa.lk and curbing is needed. Your help and approval
in this matter would be greatly appreciated.
