A request to rezone an approximate 22,000 square foot site from
Residential Office to Community Business (B-2) Zone for the purpose
of service and retail uses with additional signage.

Tne site is generally located at the northwest corner of Sprague
Avenue and Walnut Road in Section 17-25-44.

from the Zoning Code intended to implement the Major Commercial category.
It contains development criteria, including sign standards, consistent
with the Comprehensive Plan.

Commercial Zones, with a few exceptions9 are found along a11 Sprague
Avenue frontages in this area. The o1d Commercial Zone from the
Spokane County Zoning Ordinance contains very few development
standards.
The existing Residential Office Zone was approved in 1971 as a large
block rezone along Sprague Avenue. Other parcels that were included
in that action have since been upgraded to Local Business or
Commercial Zones.
Existing zones are scheduled to c rossover in 1991, per the Program to
Implement the Zoning Code, as follows:
Two-Family Residential (R-2) becomes Urban Residential 7(UR- 7)
Multiple Family Suburban becomes Urban Residential 22 (UR-22)
Residential Office becomes Urban Residential 22 (UR-22)
Local Business becomes Neighborhood Business (B- 1)
Commercial becomes Community Business (B-2) OR
Regional Business (B-3)

Other Site P1an Considerations: The existing building was constructed
under the Residential Office Zone standards. Per those standards, parking
is oriented to the rear yard, landscaping of all areas, not committed to
building or parking, has been completed, and a screen of shrubs has been
provided between the parking area and adjoining residence. The strict
signage standards prevented the installation of a detached sign consistent
with those in the area. The proposed sign, under the B-2 Zone, would be a
detached structure approximately 21 feet tall consisting of about 172
square feet per sign face.

note:
- The site plan submitted for review by the Zoning Hearing
Examiner Committee is general in nature. Detailed review to
determine compliance with all Ordinance regulations and
conditions of approva] is recommended to be administrative and
to occur at the Building Permit stage.
III. SITE DEVELOPMENT RECOMMENDATIONS
Design: Future development or redevelopment of the site will be required
to comply with all standards of the Zoning Code for Spolcane County.
Signage: Installation of the sign will require compliance with Section
9.0 , Signage Standards, of the Zoning Code. That section places a
maximum iimit on size and number of free-standing signs; for this site one
free-standing sign with a maximum 200 square feet per face is allowed.
Additionally, this sign must ue set back 10 feet from rights of way and
comply witn the 'clearview triangle'.

IV o SEPA ENV I RONN9ENTAL REY I EW
An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The review considered
the specifics of the proposal, other available information, County
ordinances, other regulations and laws, possible standard Conditions
of Approval9 the Generalized Comprehensive Plan, and other County
policies and guidelines. The Zoning Administrator has determined
that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Determination of
Non-Significance ("DNS")e
The "DNS" was circulated to eight other agencies of jurisdiction and
other agencies/departments affected by the future development for
review and commento The "DNS" comment period ends April 30, 1986,
and was advertised 15 calendar days before said date in the
newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on the proposal site.
The Hearing Examiner Committee may consider additional environmental
related testimony and the "DNS" at the public hearing,

The proposed rezone is supported and should be approved for the
following reasonso
~ That the character of the area along Sprague Avenue, in terms of
both zoning and land use, has drastically changed since the
areawide zoning of this, and other parcels, to Residential
Office in 1969. Predominate development has been under Local
Business and Commercial Zoning,
- That the Community Business (B-2) Zone is one of the zones
intended to implement the Major Commercial category of the
Comprehensive Plan.
- That development standards of the B-2 Zone provide for adequate
deveiopment and continued protection of commercially designated
areas.
If a decision to approve is reached, the Hearing Examiner Committee
is encouraged to adopt the above findings, as well as others that may
be brought out at the public hearing9 as reasons for the decision.

VI. CONDITIONS OF APPROVAL
(A11 Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successorso)
a) COUNTY PLANNING DEPARTMENT
1. All current standards of the Community Business (B-2) Zone, as
amended, sha11 be complied with in the development of this
site. 2. Applicant shall comply with '208' reconmendations concerning
stormwater runoff and provide necessary landscaping for runoff.
3. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
4. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners' Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTION is
waived in accordance with Spokane County Commissioners'
Resolution #82-0458 dated May 4, 1982,
5. That the installation of the sign will comply with Section 8.04
of the Zoning Code for Spokane County; specific attention is
called to Section 8004.180 Sign Location and Setback.
6. That future development, redevelopment, or change in use on the
site will be reviewed for compliance with a11 provisions of the
Zoning Code of Spokane County.
b) COUNTY ENGINEERING DEPARTMENT

c) COUNTY UTILITIES DEPARTMENT
lo Pursuant to Board of County Commissioners' Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Health
District.
