Thus matter having come before the Heanng Examiner Corrumttee on December 21,
1989, and the members of the Committee presen: bcing Chairperson Verona
Southern, Lunell Haught and Don Neraas.
PROPOSAL. '
The sponsar, Joe K. Staley, requests approval of a zone reclassification from
Agncultural (A) to Regional Business (B-3), File No ZE-33-89, for the purpose of
truck repair, boat starage and future commercial use
FINDINGS OF FACT AND CONCLiJSIONS
1. The property is generally located in the Greenacres area of the Spokane Valley, east
of and adjacent to Barker Road arid south of and adjacent to AHa Avenue in Section
17, Township 25 North, Range 45 EW1VI, in Spokane County, Washuigton
2. The committee adopts the Plammg Department Report as a part of this recorxi.
3. The exusting land uses in the area ar+e fuel oil bulk facdlty, storage, boat sales and gas
station, storage btulduig, single family residences and vacant
4. The Comprehensive Plan designates this site as Urban. The Urban category supports
a vanety of uses ranging from predonunandy suigle fanuly residences to
neighborhood, commercial and hght industnal. The more intensive uses should be
locat,ed along heavYly traveled smeets
5 The Artenal Road Plan designates Barker Road as an artenal, wnth a recommended
nght of way wndth of 100 feet Z'he County Enguieer is requmng 2' addinonal
dedicaaon with 8' set aside for futune acquisiaon
6. The exisang zonuig of the property descnbed in the application is Agnculturdl,
prevlously estabhshed in 1975
7. The provisions of RCW 43 21C ('I'he State Environmental Pohcy Act) have been
comphed with and a Deternunation of Nonsignificance was issued
8 The proper legal requumments for adverasement and nouce have been fulfilled
9 The owners of adjacent lands expressed disapproval of the proposed use

landscaping along Alki Avenue will enhance the area as well as buffer the existing

uses of the permitted zone All vanations must conform to regulations set forth in
the ZONIIVCi CODE FOR SPOK:ANE COUNTY The onginal intent of the
development plans shall be maintained.
5. The specific development plan will be subrrutted for Planning Departrnent review
and approval pnor to issuance of building pernuts
6. All current standards of the B-3 Zone, as amended, shall be comphed with in the
development of this site
7. The project is subject to Secaon 14 706, the Aqiufer Sensitive Area Overlay Zone
of the ZONIIVG CODE FOR SPOKANE COUNTY, wluch sets forth vanous
measures for Aquifer protection, specif'ically, measures dealing with wastewater
disposal, spill protecuon measures, and stormwater runoff
8 The present pmposal is not detailed enough to detemune whether or not the use of
or matenals stored on the site are ui comphance with Section 14 706 (Aquifer
Sensiave Area Overlay Zone) of the ZONING CODE FOR SPOKANE COUNTY
Accord.uigly, as a condition of approval, the sponsor/applicant shall be requued to
file with the Spokane County Auditor, wnthm thuty (30) days of the signing of
Findings and Or+der of the final decision in this matter, a"Notice to the Pubhc"
which shall pruvide m matenal as follows

OF OCCLJPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY
DESCRIBED HEREINAFTER, THE APPLICANT SHALL BE RESPOIVSIBLE
FOR COMIPLYIlVG WITH THE PROVISI4NS OF THE ZONIlNG CODE FOR
SPOKANE COUNTY SECTION 14 706 (AQUIFER SENSTITVE AREA
OVERLAY ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS
NOTICE IS 1VIORE PARTICULARLY DES CRIBED AS FOLLOWS.."

13 Builcimg and other setbacks requu-ed by the Spokane County Zoning Code shall be
measured from the future acquisiaon area reserved for road nght of way and
utilines
14 No requued landscaping, parlang, '208' areas, drainfield or allowed signs shall be
within the future acquisition area for road nght of way and utahties. If any of the
above unprnvements are made wnthin this area, they shall be relocated at the
applicant's expense when roadway unprovements are made.
15 The future acquisition area, unul acquued by Spokane County, shall be pnvate
property and may be used as allowed in the zone except any improvements (such as
landscaping, parking, surface draunage, drainfields, signs, or others) shall be
considered "intenm" uses
16 The property owner shall be responsible for relocaang such "int,enm"
improvements at the time Spokane County makes roadway unprovements after
acquuzng said future acquisition area.
17. This "Tide Noace" shall be signed by the applicant to serve as official notice and
acknowledgment of said futune acquisition area for road nght of way and ualines
18. Requued landscaping shall be placed as far away from future nght of way
unprovements as possible such that they may remaul after roadway unpmvements
are made
19. The Spokane County Plannuig Department shall prepare and recard with the
Spokane County Aud.itor a"Tide Noace" noang that the property ui question is
subject to a vanety of special conditions unposed as a result of approval of a land
use action Tlus "Title Noace" shall serve as official public noace regard.ing
condiaons of approval affecting the property in quesnon 1'he "Tide Nodce" shall

action and shall only be extinguished by the Spokane County Planning Department

Secondary Artenal Standard for thc improvement of Barker Road which is adjacent
to the proposed development This will require the addition of approximately 4 to 6
ft of asphalt along the frontage of the development Curbing and sidewalk must
also be constructed

The County Engmeer has designated Typical Roadway Secaon Number One,
Access Smeet Standard for the unprovement of Alla Ave which is adjacent to the
proposed developmenL This vsnll reqture the addition of approximately 10 to 14 ft
of asphalt along the frontage of the dedelopment. Curbing and sidewallc must also
be constructed
3 A parlang plan and traffic c=ulanon plan shall be subrYUtted and approved by the
Spokane County Engineer. The design, locaaon, and arrangement of parking stalls
shall be in aocordance with standard traffic engineeruig practices Paving or
surfacing as appmved by the County Engineer, will be reqwred for any parnon of
the project wtuch is to be occupied or traveled by vehicles
4 The construction of the road unpruvements stated herein shall be accomphshed as
approved by the Spokane County Engineer
5 Access permits for approaches t,o the County Road System shall be obtained from
the Spokane County Engineer.
6. Apphcant shall submit for approval by the Spokane County Engineer road,
drainage, and access plans
7 The apphcant shall subrrut for approval by the Spokane County Enguieer and the
Spokane County Health Distnct a detailed combined on-site sewage system plan
and surface water disposal plan for the enare project or any poraon thereof, if the
development is to be phased.
8 All required unprovements shall conform to the curnent State of Washuigton
Standard Specifications for Road and Bndge Construction, and other applicable
County standards and/or adopted resoluuons pertaining to Road Standards and
Stormwater Nianagement in effect at the date of construction, unless othervvise
approved by the County Engineer
9 Roadway standards, typical roadway sections and drainage plan requuements are
found in Spokane Board of County Commissioners' Resoluuon No 80-1592 as
amended and are apphcable to this proposal
10 1Vo construcaon work is to te performed within the exisang or proposed public
nght-of-way unul a pernut has been issued by the County Engineer All work is
subject to inspection and approval by the Counry Engineer
11 All required construcnon vvithin the existing or proposed public nght of way is to
be completed pnor to the release of a building permit or a bond in the amount

12 The County Artenal Road plan idenafies Barker Road as a 1Vlinor Artenal The
exisang nght of way wndth of 62 ft is not consistent with that specified in the Plan
In order to unplement the Artenal Road Plan it is necommended that in addition to
the requu-ed nght of way dedication, a stnp of property 8 ft in width along the
Barker Road frontage be set aside in reserve. This property may be acquired by
Spokane County at the time when Artenal Improvements are made to Barker Road.

1 Pursuant to the Board of County Comrrussioners Resoluaon No 80-041 8, the use
of on-site sewer d.isposal systems is hereby authonzed This authonzation is
conditioned on compliance with all rules and regulations of the Spokane County
Health Ihstnct and is further condiaoned and subject to specific application
approval and issuance of pernmts by the Health Distnct.
2 The Owner(s) or Successor(s) in interest agree to authonze the County to place their
name(s) on a peation for the fonnanon of a ULID by petition methad pursuant to
RCW 36.94 which the petition includes the Owner(s) property and further not to
ob~ect by the signing of a protest pention against the formaaon of a ULID by
resoluaon method pursuant to RCW Chapter 36 94 which includes the Owner(s)
property. PROVIDED, this condhnon shall not prohibit the Owner(s) or
Successor(s) from objecaon to any assessment(s) on the property as a result of
unprovements called for in conjunction wnth the formation of a ULID by either
petition or resoluaon method under RCW Chapter 36 94.
3 Any water service for this project shall be provided in accordance wnth the
