MANSON, DIRECTOR RE: Move -on Garage - East 11205 Frederick Avenue Dear Mr. Deviny: On March 4, 1986, this office sent a certified letter to you at the above -noted address regarding the move -on garage and your building permit number 9590. To date, we have not received any verification from the post office that you accepted delivery of the letter. The purpose of that letter is to inform you that the period of time granted to Mr. Art Noll, agent for Guthrie Investments, by letter on January 23, 1986 has expired and to date no effort has been made to take corrective action. Pursuant to Chapter 9 of the Spokane County Code, Title 3, the Department of Building and Safety has declared that the move -on structure is in such a condition of deterioration that it is materially detrimental to the surrounding properties. Further, said structure is in violation of Section 4.04A.090(b) of the Spokane County Zoning Ordinance. Therefore, the intent of this letter is to notify you that the move -on garage shall be removed from the property within ten (10) days from the date of this letter. Failure to comply will result in this matter being referred to the Prosecuting Attorney's Office for appropriate legal action. Do not hesitate to act upon this important matter, since a violation of the Spokane County Code is a misdemeanor and does carry a penalty. Your immediate attention is being requested. As you are aware, the contents of that letter specified a period of thirty days in which to either commence with the reconstruction of the garage or its removal. On February 7, 1986, you were issued a building permit (number 9590) to construct a garage 14 feet in width in order to comply with the setback requirements of 30' feet from the front property line along, Railroad Avenue. As of February 26, 1986, no action has been initiated. Pursuant to Chapter 9 of the Spokane County Code, Title 3, the Department of Building and Safety has declared that the move -on structure is in such a condition of deterioration thatit is materially detrimental to the surrounding properties. We question the "soundness and safety of the other relocated houses and are requesting a structural analysis or inspection to meet current odes for each of the three relocated houses. The garage adjacent to the green house at 11205 E Frederick does not meet the minimum requirements. We have been promised various methods to help muffle the noise problem due to the close proximity of the railroad tracks. In 1978 a noise buffer- and fence was agreed to as Part of the development. Tc this date no construction method , landscaping or fencing has been implemented to mitigate the noise problem. Also. , is there a time frame for the noise buffer and _/ or fence that was originally prnpos`ed in 1973 . Our neighborhood organization would appreciate notification of proposed changes or requests for change of conditions specific to our neighborhood. MANSON, DIRECTOR Enclosed is a copy of the County's requirements for relocated structures. Our district inspector, Reed Ockey, found that the three structures within Pines West Subdivision were inspected prior to being relocated and were found to be structurally sound. Further, compliance with the minimum requirements of the Uniform Building Code can be achieved without the expenditure of substantial amounts of monies and labor. Inspections of these structures to date include footings, foundation, and plumbing rough -in only. Framing and final inspections have yet to be called for by the developer. Through the expression of concerns by residents of Pines West Subdivision, this office will be reviewing code provisions relating to relocated structures. It is evident that amendments such as requiring a specified time frame for completion may be in order. MANSON, DIRECTOR Our district inspector reports that a relocated garage has been placed on your property located at E. 11205 Frederick, parcel number 09542-1301, without a valid building permit. In accordance with Section 301 of the Uniform Building Code as adopted by Spokane County, such work requires that you first obtain the appropriate permit. Further, the relocation of any building in Spokane County shall comply with the requirements specified in Chapter 3-03 of Title 3, as well as the setback requirements in Section 4-04A.090(b) of the County Zoning Ordinance. Section 304(d) of the Uniform Building Code requires that a double fee be charged whenever any work for which a permit is required has commenced without first obtaining such permit. The intent of this letter is to waive the double fee, provided, you take the appropriate action to obtain a permit within ten (10) days of the date of this letter. I can assure you a double fee will be assessed should you fail to comply with this request. A recheck of our files will be conducted immediately following the time frame specified above. There are underlying health hazards connected with these structures A. They have been moved in for nearly -a year, but have not been brought up to safety standards. C. They were set on daylight basement foundations which appear to be substandard for a relocated structure.
