THIS MATTER, being the consideration by the Board of County Commissioners
of Spokane County, hereinafter refenred to as the "Board", of an appeal of the Spokane
County Hearing Examiner Committee decision of September 23, 1993, approving Zone
Reclassification File No. ZE-30-93, for the purpose of developing a professional office on
approximately 0.96 acres of land, hereinafter referred to as the "Proposal"; and the Board of
County Commissioners having held a de novo public hearing on November 2, 1993, and
having fully considered all testimony presented, the documents submitted and the public
record files; and the Board further having individually visited or being familiar with the site
and vicinity in quesdon, and having rendered an aral decision on the 16th day of November,
1993, denying the appeal and thereby approving the proposal with mod.ificarions, does
hereby enter the following:
FINDINGS OF FACT
1. The property is generally located at the southeast corner of Mullan Road and Cataldo
Avenue in the northwest 1/4 of Section 17, Township 25 North, Range 44 EWNi, Spokane County, Washington.
2. The proposal consists of a zone reclassification from Urban Residential-3.5 (LTR-3.5)
to Urban Residential-22 (UR-22) to allow a professional office and those uses
allowed in the Urban Residential-22 (UR-22) zone.
3. The Hearing Examiner Committee held a public hearing on September 23, 1993
subsequent to which by the Findings of Fact, Conclusion and Decision dated
September 23, 1993 the Hearing Examiner Committee approved the proposal.
4. Raymond Irvin, a pmperty owner in the area, filed an appeal of the Hearing Examiner
Committee's decision to the Board of County Commissioners on September 30,
1993, and listed the following as a basis for the appeal of the decision:
a. The proposal constitutes spot zoning.
b. The progosal fails to show benefit to the neighborhood.
5. The legal requirements for public notice have been met.
6. At the public hearing, the owners of adjacent lands expressed disapproval of the
proposed use, expressing concerns regarding the compadbility of the proposal with
adjacent uses, increased traffic, and reduced property values.
7. The Board adopts the public record files of the Planning Department and of the Board
for ZE-30-93 as part of the record.
8. The Board takes notice of the provisions of the Spokane County Generalized
Comprehensive Plan, the Spokane County Zoning Code and the Spokane County
Code.
9. The existing zoning of the property described in the application is Urban Residenrial-3.5
(UR-3.5), previausly established as Single Family Residential-1 (R-1) zoning in 1969
and redesignated to Urban Residenrial-3.5 (UR-3.5) on January 1, 1991 pursuant to the
Program to Implement the Spokane County Zoning Code.

10. The adopted Spokane County Generalized Comprehensive Land Use plan designates
the area encompassed by the proposal as Urban and Major Commercial, with
approximately 90% of the srte withui the Niajor Commercial category and 10°l0 of the
site wrthin the Urban category
11. The site is compnseci of two parcels jouled in an "L" shaped configuranon The
parcels are designated in the Major Commercial category of the Comprehensive Plan,
except for the east half of the easterly extended parcel, which is designated in the
Urban category of the Comprehensive Plan
12 The existing land use(s) in the area are single fanuly residential, commercial, and
pmfessional offices The proposed office bu.ild.ing is adjacent to single fanuly
residennal uses on the east property boundary and along a pornon of the south
property boundary
13 As oudined in the Planning Department's staff report, the proposal is consistent with
the Commercial category of the Comprehensive Plan The proposal is adjacent to a
Pruicipal Artenal and an established business and office area. The condiaons of
approval provide adequate buffenng of the proposal from the adjouung residential
area The proposal also provides transition between the existing residential area and
commercial uses and zoning to the west
14 The proposal is not uiconsistent with the Urban category of the Comprehensive Plen,
consideruig the nux of uses allowed in the Urban category, and consldenng the
hrYUted use of the easterly parcel for parking, its signif'icant buffenrig from the
adjacent residenbal area and its luruted extension into the residendal area The
proposal is consistent with the transinonal policies of the Comprehensive Plan
regarding proposals lying in fnnge areas between two land use areas
15 As cond.itioned, the proposal will not have excessive u-affic impacts on the adjacent
residennal neighborhood
16 Design modifications to the proposal, such as the installaaon of a 6 foot high sohd
wood fence and reduced parlang are necessary to provide compatibility of the
proposal with the adjacent resideneal uses
17 The proposal as condinoned vnll not have a sigcuficant probable adverse unpact on the
environment
18 The provisions of RCW 43 21C (The State Environmental Policy Act) have been
complied with and a Deternunaaon of Nonsigruficance was issued The Board
concurs with the Determinaaon of Nonsignificance
19 The apphcant has demonstrated that condiaons have substantially changed since the
ongmal zoning of the site of the property. Specifically, changed conditions include the
development of commercial and business uses along the Mullan-Argonne commercial
comdor, commercial rezoning along Mullan Road, and the designation of the Mullan
Road as a Pnncipal Artenal
20 The pubhc use and ulterest will be served by approval of the zone reclassification as
condinoned by the Board
21 The Heanng Examiner Committee's decision compnsed only a recommendation to the
Board regarding the approval sought by the apphcant The oral testimony subrrutted
to the Heanng Exanuner Committee on the proposal was not part of the record before
the Boand and was not considered by the Board
DECISaON
The Board does hereby deny the appeal and approves the zone reclassification ZE-30-93,
subject to the conditions of approval below

1 The apphcant shall be requued to reduce the number of parku►g spaces in the
southeast portion of the site by 8 stalls, by
(a) reducing the total number of parking spaces for the proposal from 50 to 44,
which is the muiunum number required by the Spokane County Zoning Code,
and
(b) appl}nng for and receiving from the Spokane County Planning Department an
adnumstrative exception to the front yard setback from Mullan Road, pernumng
a 10% reduction of the requued 35 foot setback d.istance This would allow the
proposed budding to be moved forward 3 5 feet and reconfigured in a way that
allows two parkuig spaces to be moved from the southeast gomon of the site to
the north parking lot, and
2 The apphcant shall construct a six foot solid wood fence along the property boundary
adjacent to the sunround.ing property zoned Urban Residential-3 5(UR-3 5)
3 The proposal shall be hnuted to a methcal/dental or professional office use

proposed development This will requue the addhtion of approximately 10-12 feet of
asphalt along the frontage of the development The construction of curbuig and
sidewalk is also requued
9. All requued unprovements shall conform to the cun1ent State of Wastungton Standard
Specifications for Road and Bndge Consuucaon and other apphcable County
standards andlor adopted resoluaons pertaining to Road Standards and Stormwater
Management ul effect at the date of construction, unless otherwnse approved by the
County Engineer
10 Roadway standards, typical roadway secnons and drainage plan requirements are
found in Spokane Board of County Commissioners Resolunon No 80-1592 as
amended and are apphcable to this proposal
11 No construcnon work shall be perfonned within the exisung or proposed pubhc nght-
of-way until a permit has been issued by the County Engineer. All work withm the
pubhc road nght-of-way is subject to inspecnon and approval by the County
Engineer.

completed pnor to the release of a builchng permit, or a bond in an amount estunated
by the County Engineer to cover the cost of construcaon of unprovements shall be
filed with the County Engineer
13 There may exist utlhties, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition
Spokane County assumes no financial obhgation for adjustments or relocation
regarding these utihties. Apphcant(s) should check with the applicable utihty
purveyor and the Spokane County Engineer to deternune whether applicant(s) or the
utilrty is responsible for adjustment or relocation costs and to make airangements for
any necessary work.
SPOKANE COiJli1TY DIVISI0N OF U'g'aLI'I'IES
1 Pursuant to the Board of County Comnussioners Resolunon No 80-0418, the use of
on-site sewer disposal systems is hereby authonzed. This authonzaaon is
cond.itioned on compliance with all rules and regulanons of the Spokane County
Health Ihstnct and is further conditioned and subject to specific apphcation approval
and issuance of pernuts by the Health Distnct
2. The owner(s) or successor(s) in interest agree to authonze the County to place their
name(s) on a petition for the fonma.aon of ULID by petition method pursuant to RCW
36 94, which pention includes the owner(s)' property, and further not to object by the
signing of a protest peation agaulst the formanon of a ULID by resolution method

This matter has come before the Heanng Exanuner Comrruttee on September 23,
1993 The members of the Committee present are Harry Gibbons, Chairperson,
Frank Yuse and Phil Hams
PROPOSAL
The sponsor, Broadway/Mullan Partnership, requests approval of a Zone
Reclassification, ZE-30-93, from Urban Resldential-3 5(UR-3 5) to Urban
Residenaal-22 (UR-22) zoning within the Aquifer Sensiave Area (ASA) Overlay
zone
FINI)INGS O]F FACT AND CONCLUSIONS
1 The property is generally located at the southeast corner of Mullan Road and Cataldo
Avenue in the northwest 1/4 of Section 17, Township 25 N, Range 44 EWM,
Spokane County, Washington
2 The committee adopts the Planning Department Report us a part of Lhis recoid
3 The existing land use(s) in the area are single family residential, commercial, and
professional offices
4 The proposed use is compatible with exisang uses in the area
5 The Comprehensive Plan designates th.is site as Major Commercial and Urban The
Urban category is for the purpose of development of a"city-lilce" envuonment
including vanous land uses The Major Commercial category is for the development
of comrnercial uses, specifically community and reglonal shopping centers,
commercial and office uses duectly related to major artenals
6 The proposed zoning dces implement and conform to the Comprehensive Plan
8 The existing zoning of the property descnbed in the application is Urban Residenaal-
3 5(UR-3 5), previously established as Single Family Residential-1 (R-1) zoning in
1969 and reclassified to Urban Residential-3 5(UR-3 5) on January 1, 1991
pursuant to the Program to Implement the Spokane County Zoning Code
9 The provisions of RCW 43 21 C(The State Envuonmental Policy Act) have been
comphed with and a Determinahon of Nonsignificance was issued The Committee,
after independent review, hereby adopts the DNS

expressed included incompatibility wlth adjacent uses, increased traffic, inadequate
landscaping, and reduced property values
12 The applicant has demonstrated that condztions have substannally chailged since the
onginal zoning af this area and accordingly, the proposed zone reclassification is
justified Specifically, changed conditions include the development of commercial and
business uses along the Mullan-Argonne comdor
13 The proposed use will not be detnmental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing agencies

1 All Conditions imposed by the Heanng Examiner Comrruttee shall be binding on the
"Applicant," which term shall include the owner or owners of the property, heirs,
assigns, and successors-in-interest
2 The following Condlnons of Approval apply to the real property descnbed below
Part of the east haIf of Tract sixty-one (61) of Opportunity in the County of Spokane
and State of Washingtor;, as per map thereof recorded in Book "K" of Plats, Page 20,
in the offlce of the Counry Auditor of said County, descnbed as follows Beginning
at a polnt twenty feet south and two hundred seventeen and 75/100 (217 75) feet west
of the northeast corner of Tract 61, thence south three hundred fourteen and 2/100
(314 02) feet to a point, thence west to the west line of che east half of Tract 61 (61),
thence northerly along the west line of the east half (E1/2) of Tract 61 three hundred
fourteen and 7/100 (314 07) feet to a point twenry (20) feet south of the north line of

location, landscape plans and general allowable uses of the pemutted zone All
vanations must conform to regulations set forth in the Spokane County Zomng
Code, and the onginal intent of the development plans shall be malntained
3 Approval is requued by the Planning Duector/designee of a specific hghang and
signing plan for the descnbed property pnor to the release of any building permits
4 A specif'ic landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be subnutted with a performance
bond for the project pnor to release of building permlts Landsc.aping shall be
installed and maintained so that sight distance at access points is not obscured or
impaired
5 Duect light from any extenor area lighang fixture shall not extend over the property

6 The Planning Department shall prepare and record with the Spokane Counry
Audltor a Title Notice noting that the property in quesaon is subject to a vanety of
special conditions imposed as a result of approval of a land use action This Title

frame as allowed for an appeal and shall only be released, in full or in part, by the

approved by the Spokane County Engineer
8 The County Engineer has designated Typical Roadway Section Number One, Local
Access standard for the improvement of Cataldo Avenue, which is adjacent to the
proposed development Thls will require the addition of approximately 10-12 feet
of asphalt along the frontage of the development The construction of curbing and
sidewalk is also requu-ed
9 All requued unprovements shall conform to the current State of Washington
Standard Specifications for Road and Bndge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
appmued by the County Engineer
10 Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No 80-1592 as
amended and are applicable to this proposal
11 No construction work shall be performed within the exishng or proposed public
nght-of-way until a pernut has been issued by the County Engineer All work
within the public road nght-of-way is subject to inspection and approval by the

approval and issuance of pernlits by the Health Disa-ict
2 The owner(s) or successor(s) in interest agree to authonze the County to place their
name(s) on a petiaon for the formanon of ULID by pention method pursuant to
RCW 36 94, which petition includes the owner(s)' property, and further not to
object by the signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36 94 which includes the owner(s)'
property PROVIDED, this condiaon shall not prohibit the owner(s) or
successor(s) from objecting to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a ULID by either
petition or resolution method under RCW Chapter 36 94

is within the Urban Impact Area (UTA) and Pnonty Sewer Service Area (PSSA)
The proposal is consistent with the purpose and intent of the Urban Residential-
22 (UR-22) zone category which allows offices to provide some of the service
needs generated by high-intensity land uses The Urban Residential-22 (L1R-22)
zone is also used to provide a transiaon between residential areas and intensive
commercial or low intensity indusmal uses

In this case, the landscape requuement would result in over 30% of the site being
