HE Findings, Conelusians and Decision ZE-4-97 Page 1 ~ . ~ Environmental Review: The Division of Building and Planning isstied a Determination ~ of NonSignificance on April 17, 1997. Site Descriptiou: The site is approximately 2.69 acres in size and is relatively flat in topography. The property is centrally located between the Argonne/Mullan Road corridor, south of Sinto. The site is fully developed and is occupied by two single-family residences, a legally established non-conforming furnitlire store, carpet sales and a window treatment specialty shop including associated storage buildings. Site improvements consist of paved and curbed parking areas, landscaping, `208' drainage swales, fire hydrants and signage. Overhead transmission lines border the site along the east and west property lines. The site is located within the Interim Urban Growth Area boundaries designated by Spokane County pursaant to the Growth Management Act. Surrounding Conditions: The surrounding neighborhood consists primarily of established and new commercial strip development along the Argonne/Mullan Road corridor. Argonne Road and Mullan Road are designated on the County's Arterial Road Plan as Principal Arterials. Very few parcels of land are left vacant and undeveloped. Typical land uses within the vicinity of the proposal range from neighborhood to regional business developments. Streets are paved with cLirbs, some with sidewalks and street lighting. East and west of the Argonne/Mullan Road commercial corridor are residential areas developed at various densities, ranging from single- family to multifamily development. Project Descriptioo: The site development plan illustrates an existing 35,876 square foot building which is currently occupied by a furniture store, associated storage and two related retail sales areas. The site also encompasses four additional existing buildings (carpet sales, associated storage and two single family residences) which are to be relocated or demolished. A 17,057 square foot bLiilding addition is proposed to extend south from the existing furniture store providing additional furniture display area and storage for the existing furniture store. Access to the site will be provided from eight separate points of ingress/egress including four points along Argonne Road located west of and adjacent to the subject property, three points along Mullan Road located east of and adjacent to the site, and one point along Sinto Avenue located north of and adjacent to the site. Internal circulation is provided by parking lot travel lanes. A detailed parking lot and traffic circulation plan shall be submitted at the time of building permit application for review and approval by tlie Spokane County Division of Building and Planning and Division of Engineering and Roads. Access permits shall be obtained from the Spokane County Division of Engineering and Roads. B. C. ZONE RECLASSIFICATION ANALYSIS: Washin`ton case law generally provides that (1) there is no presumption in favor of a rezone, (2) the applicant for the rezone must prove that conditions have substantially changed in the area since the last zoning of the property, and (3) the rezone proposal must bear a substantial relationship to the public health, safety or welfare. ParkridQe v. Seattle, 98 Wn.2d 454, 462 (1978); Biarnson v. Kitsan Countv, 78 Wn. App. 840 (1995). Case law also indicates that a county's comprehensive plan provides guidance to the hearing body in making a rezone decision. Spokane County Zoning Code 14.402.020(1)(2), indicates that consistency with the Comprehensive Plan, detriment to the public welfare and changed circumstances are relevant considerations when a site-specific rezone is sought. The rezone proposal must also comply with the Spokane County Zoning Code, the State Environmental Policy Act, the County's Local Environmental Ordinance, and other applicable land use regulations. Conditions may be imposed to asstire the consistency of tlle proposal with applicable regulations. The following findings of fact and conclusions are made: 1. The nrooosed rezone Qenerallv conforms with the Spokane Countv Generalized Comnrehensive Plan. A county's comprehensive plan provides guidance to the hearing body in making a rezone decision. Belcher v. Kitsav Countv, 60 Wn. App. 949, 953 (1991). Deviation from a comprehensive plan does not necessarily render a rezone illegal, only general conformance is required. Bassani v. Cotintv Commissioners, 70 Wn. App. 389, 396 (1993). The site is designated within the Nlajor Commercial category of the Comprehensive Plan. The Major Commercial (C) Category is intended to provide the opportunity for development of commercial uses, specifically community and regional shopping centers and commercial uses directly related to major throughways. Major Commercial areas typically require a full line of public services and utilities, including public sewer. The Regional Business (B-3) zoning is iiltended to implement the Major Commercial category of the Comprehensive Plan, including HE Findings, Coilcltisions aild Decision ZE-4-97 Paue 3 those policies which encourage commercial development along Principal Arterials or highways . and the establishment of regional-serving commercial uses. Zoning Code 14.628.100. The proposed rezone clearly implements sLich policies, since it is located along a Principal Arterial and B-3 Lises are intended for the site. The Major Commercial category indicates that commercial developments should be bLiffered to protect adjacent areas. Goal 6.1, Objective 6.1.a. Most of the site is surrounded by other commercial uses. The development standards of the B-3 zone ensure adequate buffering for the project in relation to adjacent uses. 2. Conditions in the area in which the pronertv is located huve chanaed substantiallv since the proDertv was last zoned. In applying the changed circumstances test, courts have looked at a vanety of factors, including changed public opinion, changes in land use patterns in the area of the rezone proposal, and changes on the property itself. The Zoning Code references changes in "economic, technological or land use conditions" as factors that will support a rezone. Spokane County Zoning Code 14.402.020 (2). Washington courts have not required a"strong" showing of change. The rule is flexible, and each case is to be judged on its own facts. Bassani v. Colintv Commissioners, 70 Wn. App. 389, 394 (1993). Recent cases have held that changed circumstances are not required for a rezone if the proposed rezone implements policies of a comprehensive plan. Biarnson, at 846; Save Our Rural Environment v. Snohomish Countv, 99 Wn.2d 363, 370-371 (1983). As indicated above, the proposal generally conforms with the Comprehensive Plan. Changes which support the proposed rezone include the growth in business on the property; and increased traffic, commercial activity and B-3 rezoning along the Argonne/Mullan commercial corridor. 3. The Dronosed rezone bears a substantial relationship and is not detrimental to the public health. safetv and izeneral welfare. General consistency with a local government's comprehensive plan is relevant in determining whether a rezone bears a substantial relationship to the public welfare. Bassani, at 396-98. As noted, the proposal generally conforms to the Comprehensive Plan. No opposition was expressed to the proposal during the public hearing process. The proposal will provide regional business services to the growing population in the Spokane Valley. The current Neighborhood Business (B-1) zone and Urban Residential-3.5 (UR-3.5) zone applicable to the site are inconsistent with the current use of the site. At the request of the Division of Building and Planning, the Hearing Examiner has added a condition of approval requiring the applicant to approve a blanket easement on the site for the benefit of Modern Water District. 4. The pronosed zone chanee complies with the provisions of the State Environmental Policv Act and the Countv's Local Environmental Ordinance. Tlle procedtiral requirements of chapter 43.21C RCW and chapter 11.10 of the Spokane County Code have been met. The Hearing Examiner concurs with the Determination of NonSignificance issued by the Division of Building and Planning. As conditioned, the proposal will not have more • than a moderate effect on the quality of the environment. 5. The oroDOSaI, as conditioned, complies with the Reizional Business (B-3) zone, the Spokane Countv Zonina Code (SCZC), and applicable land use reaulations. The proposal has been conditioned for compliance with the permitted uses and development standards of the B-3 zone. Compliance with such standards and other applicable land use I'ZuUI1t10I1S will be ensured through the administrative site plan review process. III. DECISION Based on the Findings and Conclusion above, the above zone reclassification application is approved, subject to the conditions of the various public agencies specified below. Failtire to comply with the conditions of this approval may result in revocation of this approva] by the Hearing Examiner. This approval does not waive the applicant's obligation to comply with all other requirements of other agencies with jurisdiction over land development. SPOhANE COUNTY DIVISION OF BUILDING AND PLANNING l. The proposal shall comply with the Regioilal Business (B-3) zone as amended. 2. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner. Variations, when approved by the Director of the Division of Building and Planning/designee, may be permitted, including, but not limited to building location, landscape plans and ;eneral allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Code, and the original intent of t11e development plans shall be maiiitained. 3. Approval is required by the Director of the Division of Building and Planning/designee of a specific lighting and signing plan for the described property prior to the release of any building permits. 4. Direct light from any exterior area lighting fixture shall not extend over the property boundarv. 5. A specitic landscape plan, planting schedule and provisions for maintenance acceptable to the Director of the Division of Building and Planning/designee shall be submitted with a performance bond for the project or other suitable guarantee prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired. 6. The Division of Building and Planning shall prepare and record with the Spokane County Auditor a Title Notice noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded HE Findino's, Concliisions and Decision ZE-4-97 Page 5 a within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Building and Planning. The Title Notice shall generally provide as follows: "The parcel of property legally described as: A portion of Block 21 Qpportunity, records of Spokane County WA. Described as follows: The West %z of said Block 21, except the South 177.81 feet tllereof and except roads is the slibject of a land use action by a Spokane County Hearing Examiner or Administrative Official on May 14, 1997 imposing a variety of special development conditions. File No. ZE-4-97 is available for inspection and copying in the Spokane County Division of Building and Planning." 7. Any division of the subject property for the purposes of creating additional lots/parcels shall be reviewed by the Director of the Division of Building and Planning/designee for compliance with the Spokane County Subdivision Ordinance and all other applicable local, state and federal ordinances and development regulations, as amended 8. A filed avigation easement satisfactory to the Spokane International Airport Board, Fairchild Air Force Base and/or other air traffic control agency shall be provided prior to the Division of Building and Planning sign-off on a building permit. 9. The Division of Building and Planning shall file with the Spokane County Auditor, within the same time frame as allowed for an appeal from the final disposition, including lapsing of appeal period, a Title Notice, which shall generally provide as follows: "Prior to the issuance of any building permit for any building or any use on the property described herein, the applicant shall be responsible for complying with the provisions of the Zoning Code for Spokane County, Section 14.706 (Aquifer Sensitive Area Overlay Zone). The property which is the subject of this notice is more particularly described as follows: "A portion of Block 21 Opportunity, records of Spokane County WA. described as follows: The West '/z of said Block 21, except the South 177.81 feet thereof and except roads." 10. All building permit applications shall be reviewed and approved by Modern Electric and Water Company prior to issuance of said building permit, to assure that no conflicts occur with proposed construction on the site and Modern Electric and Water Company easements, as such easements are described in Volume E, Page 267 of Contracts, records of the Spokane County Auditor. SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior to release of a building per-mit or use of property as proposed: 1. Access perniits for approaches to the County Road System shall be obtained from the County Engineer. 2. Applicant shall submit for approval by the Spokane County Engineer drainage and access plans. The design, location and arrangement of parking stalls shall be in accordance with standard engineering practices. Paving or surfacing as approved by the County Engineer will be reqtiired for any portion of the project which is to be occupied or traveled by vehicles 4. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge construction and other applicable county standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 5. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners resolution 95-0498 as amended and are applicable to this proposal. 6. No construction work is to be performed within the existing or proposed right of way until a permit has been issued by the County Engineer. All work within the public road right of way is subject to inspection and approval by the County Engineer. 7. The applicant is advised that if the proposed improvements to the existing building exceed 50% of the assessed value, than the entire site may be required to retrofitted to comply with Spokane County Guidelines for Stormwater Management. The applicant shall be further advised of this regulation at the time of application for a building permit. S. The applicant shall grant applicable border easements adjacent to Spokane Coiinty RiQht of Way per Spokane County Standards. SPOKANE REGIONAL HEALTH DISTRICT 1. A combined surface water and sewacre disposal detailed plan shall be approved by the Spokane County Engineer and Spokane Regional Health District prior to the issttance of any on- site sewage disposal permit or building permit for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane CoLinty. Water service shall be coordinated tlu-ough the Director of Utilities, Spokane County. 4. Water service shall be by an existinc, public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 5. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 6. Subject to specific application approval and issuance of permits by the Health Otticer, the use of an individual on-site sewa~e disposal system may be authorized. 7. Each new Linit shall be dotible plumbed for connection to future area wide collection systems. 3.
