the rezone must prove that conditions have substantially changed in the area since the last zoning of the property, and 3) the rezone proposal must bear a substantial relationslup to the public health, safety or welfare Parkrzdge v Seattle, 98 Wn 2d 454, 462, 573 P 2d 359 (1978), and Bjarnson v Kitsap County, 78 Wn App 840, 899 P 2d 1290 (1995) A comprehensive plan is considered as a general bluepruit for land use regulation by local governments Only general conformance with a comprehensive plan is required to approve a rezone See Cituens for Mount Yernon v City of Mount Vernon, 133 Wn 2d such condltions, modificahons and restnctions as the Examiner finds necessary to make a rezone application compahble wlth the Spokane County Generahzed Comprehensive Plan and applicable development regulations See County Resolution No 96-0171, Attachment `A', paragraphs 7(d) and section 11, and RCW 36 70 970 Development regulations include without limitation the County Zorung Code, the State Environmental Policy Act (SEPA) and the County's Local Environmental Ordmance (chapter 11 10 of the Spokane County Code) Section 14 402 020 of the Zorung Code authonzes amendments to the Code based on Commercial areas typically require a full line of publlc services and utilrties, including public sewer The Major Commercial category indicates that commercial HE Findings, Conclusions and Decision ZE-47-97 Pacre 3 . ~ developments should be buffered or spatially separated to protect adjacent areas Comprehensive Plan, Section 6, Goa16 1, Objective 6 1 a and Decision Guideline 6 12 The site is currently zoned Neighborhood Business (B-1) The purpose of the B-1 zone is to allow for limited small-scale neighborhood-serving retail and office uses, as a means of implementing the Urban, Major Commercial and Suburban categones of the Comprehensive Plan Within the Major Commercial category, B-1 zones are also mtended to provide land use transition between the Major Commercial category and less intense land use categones of the Comprehensive Plan Such B-1 zones are to be located within and on the fnnges of a Major Commercial category, with site access provided by a Minor Artenal or lugher classification artenal Zoning Code 14 624 100 The applicant proposes to rezone the site to the Regional Busmess (B-3) zone, for speculative commercial development utilizing the existing building on the site The B-3 zone is intended to implement the Major Commercial category of the Comprehensive Plan, including those policies wluch encourage conunercial development along Pnncipal Artenals and the establishment of regional-serving commercial uses Zoning Code 14 628 100 The proposed rezone clearly implements such policies, since it is located along a Pnncipal Artenal and B-3 uses are intended for the site The proposal is also served by a high level of public services and facilities, except for public sewer While the project will initially be served with on-site sewage disposal, the site does lie witlun an area scheduled for public sewer service wlthin 15 years This satisfies the County's intenm development regulations adopted for land located mside the County's intenm urban growth area (IIJGA) boundanes, pursuant to the State Growth Management Act The site lies withul such boundanes Such intenm regulations require that any new rezone proposals for land lying inside the IUGA boundanes to either be served by public sewer or lie within the County's 15-year sewer program area County Resolution No 97-0321 The County Utilities conditions of approval require the project to double-plumb the property for connection to such sewer The County Sewer Code generally requires land to connect to public sewer as soon as it becomes available The current site appears to be located 200-300 feet inside tlie easterly edge of the Major Commercial category in the area The land located northeast of the site is zoned B-3 and developed for a large moteUhotel The land 1}nng east of the site is zoned B-1 and is approved for offices The current B-1 zorung of the site does not implement the Major Commercial category any better than the proposed B-3 zone, since the site is not located on the fnnge of the Major Commercial category and is not needed to buffer any less mtense category of the Comprehensive Plan The site is located along a Pnncipal Artenal, wtuch road classification is particularly suited to the location of B-3 zone uses B-3 zoning, as well as Community Business (B-2) zoning is found in the area along the Argonne-Mullan comdor The development standards of the B-3 zone ensure adequate buffenng for the project in relation to adjacent uses No opposition was expressed to the proposal dunng the public hearing process The proposal will provide regional business services to the growing population in the Spokane Valley The Examiner agrees with the Staff Report that the project is consistent with the Comprehensive Plan, and will serve the public welfare HE Findings, Conclusions and Decision ZE-47-97 Page 4 ~ The proposal appeazs to be consistent with the development standards of the B-3 zone, and has been conditioned for compliance with such standards The procedural requirements of chapter 43 21 C RCW and chapter 1 l 10 of the Spokane County Code have been met The Heanng Examuier concurs with the Determmahon of NonSignificance issued by the Division of Building and Planning No adverse comments were received from the reviewing public agencies As conditioned, the proposal vvill not have more than a moderate effect on the quality of the environment IV DECISION Based on the Findmgs of Fact and Conclusions of Law above, the above rezone application is hereby approved, subJect to the conditions of the vanous public
