Environmental lteview The Division of Building and Planning issued a Determination
of Nonsignificance on September 25, 1998
Site Description The site is approximately 9,485 square feet in size and is rectangular in
shape The property is relatively flat in topography, but sits above street level due to a slight
incline along the frontage of the site The pnmary access is via Sprague Avenue, which abuts the
site on the south Curbs, sidewalks, and street lights are found along the frontage of the site
An existing vacant two-story building is located in the middle west portion of the site, and a
detached storage building is located in the northwest corner of the site The property is located
inside the County's intenm urban growth area boundanes designated under the Growth
Management Act
Surrounding Conditions Sprague Avenue adJacent to the site is designated as a Pnncipal
Artenal by the County Artenal Road Plan, and compnses a major traffic and commercial comdor
in the southerly Spokane Valley area The land lying east of the site is zoned UR-22 and B-1, and
is improved with medical office building The parlcing lot for the medical office abuts the site on
the north, and is zoned B-1 The land lying west of the site is improved with a single-family
residence, but is zoned B-1 and UR-22 B-3 zorung is found further to the east and west of the
srte The land lying south of the srte across Sprague Avenue is zoned B-3, and is improved with
retail commercial uses
Project Description No specific development is currently proposed for the site The applicant
proposes to retain the existing two-story building on the site, but to remove the existing detached
storage building on the site to allow additional parlang The site development plan submitted on
August 14, 1998 illustrates six (6)-feet of landscaping along the west half of the frontage of the
property and a 20 foot high, 140 square foot sign at the east comer of the front yard

C ZONE RECLASSIFICATION ANALYSIS
The County Heanng Examiner Ordinance authonzes the Hearing Examiner to grant, deny
or grant with such conditions, modifications and restnctions as the Examiner finds necessary to
make a zone reclassification application compatible with the Spokane County Generalized
Comprehensive Plan and development regulations See County Resolution No 96-0171,
Attachment A', paragraphs 7(d) and section 11, and RCW 36 70 970
Washington case law generally provides that (1) there is no presumption in favor of a
rezone, (2) the applicant for the rezone must prove that conditions tiave substantially changed in
the area since the last zoning of the property, and (3) the rezone proposal must bear a substantial
relationship to the public health, safety or welfare Parkndae v Seattle, 98 Wn 2d 454, 462
(1978)
Spokane County Zorung Code 14 402 020(1)(2), uidicates that consistency wrth the
Comprehensive Plan, detnment to the public welfare and changed circumstances are relevant
considerations when a site-specific rezone is sought The rezone proposal must also comply with
the Spokane County Zoning Code, the State Environmental Policy Act, the County s Local
Environmental Ordinance, and other applicable land use regulations Conditions may be
imposed to assure the consistency of the proposal with applicable regulations
The following findings of fact and conclusions are made
1 The nronosal. as conditioned, 2enerallv conforms with the Spokane Countv Generalized
Comnrehensive Plan. bears a substantial relationship to and will not be detnmental to the public
health safetv and Qeneral welfare. and complies with the Spokane County Zoninp- Code and
other aonlicable develoument re2ulations
Deviation from a comprehensive plan does not necessanly render a rezone illegal, only
general conformance is required Crtczens for Mount Vernon v Ccty of Mount Vernon, 133 Wn 2d
861 873 (1997), and Cathcart v Snohomish County, 96 Wn 2d 201, 211-12 (1981) Bassani v
Countv Commissioners, 70 Wn App 389, 396 (1993)

The site is designated within the Ma~or Commercial category of the Comprehensive Plan
The B-3 zone is specifically intended to ►rnplement such category The proposal will be served
by a high level of public services, including public sewer Applicable policies and descnptions
of the Major Commercial category are set forth in the Staff Report, which finds the project to
generally conform with the Comprehensive Plan The Examiner agrees with the analysis of the
Comprehensive Plan set forth in the Staff Report, and adopts the same by reference as findings of
fact and conclusions
The only non-business use near the site is a single-family home According to the applicant,
such use appears to exist as a life tenancy that will likely yield to retail use upon its expiration
The applicant does not plan any major expansion of improvements on the site, and the proposed
use of the site appears compatible with adjoining land uses The development standards of the
B-3 zone ensure adequate buffenng for the project in relation to adJacent uses The proposal will
provide regional business services to the growing populatlon in the Spokane Valley, and will
serve the public health, safety and general welfare
The only objection to the project was voiced by a representative of a KFC restaurant located
across from the site along the south side of Sprague Avenue, who expressed concern over
possible competition if the site was developed for a restaurant See testimony of Steven Haus
Economic competition is part of the free enterpnse system, and is not relevant to the Examiner's
approval of the rezone under the Comprehensive Plan and applicable development regulations
The applicant expressed concern with the application of County Division of Building and
Planning conditions #3 and #6 to the site, which require compliance with the B-3 zone and
County Zoning Code, and the submittal of a landscaping plan pnor to issuance of a building
permit The slte shows general compliance with the development standards of the B 3 zone, with
the apparent exception of required landscaping in parking areas and the installation of "208 '
drainage
The Examiner feels it necessary to clanfy the discussion of the above issue at the public
heanng The installation of landscaping and "208 drainage in paved parking areas ls required
by Zoning Code 14 802 OSO and 14 802 220 The application of such requirements is addressed
by Zoning Code 14 802 020, which imposes such requirements for any change to a building, or
any change in use of a building or site to the extent a permit or certificate of occupancy is
necessary The landscaping requirements for paved parking areas under Zorung Code
14 802 220 are separate from the landscaping requirements of Zorung Code Chapter 14 806, the
applicability of which is separately addressed under Zoning Code 14 806 020 Zoning Code
14 806 020 (2) exempts developments involving additions or alterations to existing structures or
improvements in which the cost does not exceed 50 % of the value of the existing structures or
improvements from the landscaping requirements of Chapter 14 806 This exemption, however,
does not apply to the installation of landscaping in parking areas required by Zoning Code
14 802 220
Spokane County Code (SCC) 9 14 020 authonzes the County Engineer to require the
submittal of road, approach and drainage plans for vanous land use actions, including rezones,
and building permits for new construction or ` substantial improvement" Substantial
improvement" means any repair reconstruction or improvement of a structure the cost of which
equals or exceeds 50% of the market value of the structure before such improvement or repair is

started SCC 9 14 020 (7) Drainage control mus't be in compliance with the County's adopted
Guidelines for Stormwater Management Guidelines which calls for `208 drainage control
for development located !n the County s Aquifer Sensitive Area, like the current site County
Engineering condition #3 for the project provides that the roadtivay and drainage standards set
forth in County Resolution No 95-0498 apnly to the current proposal Resolution No 95-0498
adopts the Guicielines, as well as the County Standards for Road and Sewer Construction
The 50% %ule stated in SCC 9 14 020 (7) is referenced in the memorandum dated August 6,
1998 from the County s Stormwater Utility (a part of County Utilities) for the project Such
memorandum states that the drainage facilities for the enttre site w211 need to be retrofitted to
comply with the Guidelines if any improvemenLs or altei ations exceed 50% of the assessed value
of the property The Division of Building and Planning may construe SCC 9 14 020 (7) as
controlling when "208 drainage must be provided in existing paved parking areas under Zoning
Code 14 802 OSO, in circumstances when a building permit is sought for substantial improvement
of a structure on a site whlch has been rezoned
The application of the above requirements to any future use of the site would be determined
administratively for the project by County departments at the time a certificate of occupancy or
building perrriit is issued for any future use of the site The Examiner has modified Building and
Planning condition #6 to reflect the role of a certificate of occupancy under Zoning Code
14 802 020
The proposal has been conditioned for compliance with the permitted uses and development
standards of the B-3 zone Compliance with such standards and o#her applicable land use
regulations will be ensured through the adm.inistlative site plan review process

In applying the chan ged circumstances test, courts have looked at a vanety of factors,
includin; changed pubiic opinion changes in land use patterns ln the area of the rezone proposal,
and changes on the property itself The Zorung Code references changes in economic,
technological or land use conditions' as factors that will support a rezone Spokane County
Zoning Code 14 402 020 (2) Washington courts have not requued a strong' showing of
change The rule is flexible and each case is to be judged on its own facts Bassaru v Countv
Commissioners 70 Wn App 389, 394 (1993) Recent cases have held that changed
circumstances are not required for a rezone if the proposed rezone closely implements policies of
a comprehensive plan Blarnson, at 846, Save Our Rural Environment v Snohomish Countv, 99
Wn 2d 363 370-371 (1983) As indicated above, the proposal generally conforms wlth the
Comprehensive Plan
The southerly half of the site was zoned Local Business (LB) under the now expired County
Zoning Ordinance in approximately 1962 and the northerly half of the site was zoned Multi-
Family Suburban (MFS) uader the Zoning Ordinaiice in approximately 1970 In 1991, this
zoning crossed over to the current zorung of the site, pursuant to the Program to Implement the
Spokane County Zoning Code Changes in the area which support the proposed rezone include
increased traffic, commercial activity and B-3 rezoning along the Sprague commercial comdor

A rezone from the B-1 zone to the B-3 zone was granted in 1989 for a site located just west of
the site See Fnal rezone decision in File No ZE-24-89
3 The nronosed zone change complies wlth the provislons of the State Environmental
Policv Act and the Countv's Local Environmental Ordinance
The procedural requirements of chapter 43 21 C RCW and chapter 11 10 of the Spokane
County Code have been met The Heanng Examiner concurs with the Determination of
NonSignificance issued by the Division of Building and Planning No adverse comments were
received from the reviewing public agencles As conditioned, the proposal will not have more
than a moderate effect on the quality of the environment
IgI DECISION
Based on the Findings and Conclusion above, the above zone reclassification application is
approved, subject to the conditions of the vanous public agencies specified below Any
conditions which have been added or revised by the Examiner in any matenal way are rtalicized
Failure to comply wnth the conditions of this approval may result in revocation of this
approval by the Heanng Examiner This approval does not waive the applicant s obligation to
comply with all other requirements of other agencies with junsdiction over land development

1 All conditions imposed by the Spokane County Heanng Examiner shall be binding on the
"Applicant," wluch term shall include the developer and owner of the property, and their heirs,
assigns and successors

the Director of the Division of Building and Planning/designee shall be submitted with a

conditions imposed as a result of approval of a land use action This Title Notice shall contain

provisions of the Zoning Code for Spakane County, Section 14 706 (Aquifer Sensitive Area

Staff AnalVsis:
Comprehensive Pian: The subject property is located in the Major Commercial Category of the
Comprehensive Plan. The Major Commercial Category is intended to provide the opportunity for
development of commercial uses, specifically community and regional shopping centers and
commercial uses, directly related to major throughways. Highway and arterial strip commercial areas
will usually be made up of businesses on individual parcels clustered along a heavily traveled street or
highway, each providing off-street parking. Shopping is not done by walking from one store to
another, but rather is of a single-purpose nature.
Most commercial development will be on relatively flat land and building of low profile. Paved parking,
streets and man-made structures will dominate the site with few natural features to be found.
Landscaping, screening, lighting, signage and other architectural treatment will provide for
aesthetically pleasing development. Major Commercial areas require a full line of public services and
utilities. These include service by or commitment to sanitary and storm sewers, public water systems
and underground utilities such as telephone, gas and electricity. The subject property is located on a
Principal Arterial and will be served by public services including public water and sewer.
Goal 6.1 of the Major Commercial category is to "Promote development of commercial land in a
manner which is complimentary and compatible with adjacent land uses and the surrounding
environment." Specifically: Decision Guideline 6.1.1 states that: "The best means of encouraging
compatibility between commercial uses and adjacent land use categories will be accomplished by
considering provision of buffering needs; and the provision of landscaping needs." The adjoining
areas along the Sprague Avenue commercial corridor are dominated by commercial uses and the
proposed Regional Business (B-3) zone is compatible with adjacent land uses Decision Guideline
6.1.6 states that: "Before approving proposed commercial developments, it should be determined
that: a) the proposal has adequate on-site areas for existing and potential parking and storm drainage
control; and b) the proposal considers the impact upon existing or planned transportation facilities and
conforms to County transportation plans and policies; and c) the proposal considers access to existing
and planned public transit facilities and routes." Review of the site plan of record indicates that the
subject property has adequate off-street parking and has direct access to the public transit route along
Sprague Avenue.
This proposal is generally consistent with the Goals, Objectives and Decision Guidelines of the Major
Commercial category.
Zoning Analysis: The purpose and intent of the Regional Business (B-3) zone is to implement the
Major Commercial category of the Comprehensive Plan and to provide for the location of a wide range
of retail and service activities. The uses within this zone will often require large areas for customer
parking, retail services, some outside activities, display and other commercial activities. General
characteristics of these areas include paved roads and sidewalks, public sewer and water, and a full
line of public services including manned fire protection and public transit accessibility. Chapter
14.628.315 (Minimum Lot Area and Minimum Frontage) of the Spokann., County Zoning Code requires
Regional Business (B-3) zones to have frontage on a Principal Arteria! or higher classification and this
proposal has direct frontage on Sprague Avenue, `vhich is designated on the Spokane County Arterial
Road Plan as a Principal Arterial.
Existing zoning in the surrounding area is a mix of Urhan Residen#ial-3.5 (UR-3.5), Urbafn Residential-
22 (UR-22), Neighborhood Business (B-1), Commun+ty.f3usiness. (B-2) and r~_gicnal Business (B-3).
Regional Business (B-3) is the predominate zoning found along the south side of the Sprague
Avenue commercial corridor. The properties adjacent to the site are zoned UR-22, B-1 and B-3.

The applicant is not proposing any development at this time nor provided a detailed site development
plan and has requested those uses allowed in the B-3 zone The site plan of record reflects what
currently exists on the subject property

conditions of approval
The proposed zone reclassification from Urban Residential-22 (UR-22) and Neighborhood Business

reclassification submitted to this office Although some items listed below can be identified in the staff report to the
Hearing Examiner, it may be of a benefit to the applicant to revise the site development plan to ensure that the proposed
development is in substantlal compliance to the plpn presented to the Hearing Examiner Hence, the following comments
are provided

4. Prior to issuance of a building permit, a specific lighting and signing plan shall be submitted
to the Division of Building and Planning for review and approval.
5. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
6. A specific landscape plan, planting schedule and provisions for maintenance acceptable to
the Director of the Division of Building and Planning/designee shall be submitted with a
performance bond for the project or other suitable guarantee prior to release of building
permits. Landscaping shall be installed and maintained so that sight distance at access
points is not obscured or impaired.
7. The Spokane County Division of Building and Planning shall prepare and record with the
County Auditor a Title Notice stating that the subject property is subject to a variety of
conditions imposed as a result of approval of a land use action. This Title Notice shall
contain the following statement: "Prior to the issuance of any building permit for any
building or any use on the property described herein, the applicant shall be responsible for
complying with the prov;sions of the Zoning Code for Spokane County, Section 14.706
(Aquifer Sensitive Area Overlay Zone). The property which is the subject of this notice is

There appears to be a life-tenancy agreement for the westerly residential unit
