Tlus matter came on for pubhc heanrig on February 19, 2003, the Heanng Examlrier, after
review of the zone reclassification application and the entue record, and finduig good cause
therefore, hereby makes the following findings of fact, conclusions of law and decision
I FINI)INGS OF FACT
1 The application requests a rezone of 2 42 acres of land from the Urban Residential-3 5
(UR-3 5) Zone, to the Urban Residential-7 (UR-7) Zone, to develop uses which are allowed in
the RU-7 Zone
2 The site is located north of and adjolmng Broadway Avenue, and approxunately 250 feet
west of Locust Road and approximately 270 feet east of Mullan Road in the Northwest Quarter
of Section 17, Townslup 25N, Range 55, EWM The site address is 9317 East Broadway
Avenue
3 The site is currently referenced as County Assessor's tax parcel number 45172 1215 and
1216
4 The site is legally descnbed as a platted lot of record whuch is descnbed as "Opporturuty
B62 N1/2 of W1/2 of W1/2 except N165FT" and "Opportunity PT of B2 except N165 FT of
E1/2 of W1/2 & STP E of and adj 7W of Walnut Add in the County of Spokane, Washington "

7 The Heanng Exa.nuner conducted a site visit on February 20, 2003, and held a public
heanng on the proposed rezone on February 19, 2003 The requirements for notice of public
heanng were met

10 The Hearing Examiner takes notice of the County GMA Comprehensive Plan and Capital
Facilities Plan, Phase I Development Regulations, County Resolution Nos 2-0037 and 2-0470,
County Zoning Code, County Code, other applicable development regulations, and pnor land use
decisions in the vicinrty
11 The record includes the documents in the project file at the time of the pubhc heanng, the
documents and testunony subnutted at the public heanng, and the items taken notice of by the
Heanng Examiner
12 The site is `L" shaped It contains approxunately 2 42 acres and is largely undeveloped
except for a house and a detached accessory structure
13 The project is located on Broadway Avenue, wluch is a paved four-lane Pnncipal Urban
Artenal according to the County's Artenal Road Plan Surrounding uses include single-family
residences to the north, east, south, and west of the site
14 An application for the project was submitted to the Division of Planning on December 16,
2002, and a techrucal review meeting was held on January 2, 2003 The Determination of
Completeness was issued on January 3, 2003, and the Notice of Applicahon was mailed on
December 23, 2002, with a 14-day comment penod ending on January 6, 2003 f
15 The adoption of Phase 1 Development Regulations to unplement the County's new Growth
Management Comprehensive Plan on January 15, 2002, did not change the existing zoning of the
subject site It is designated in the Comprehensive Plan as being within the Low Density
Residential Category There have been no issues related to concurrency which would prevent the
approval of this zone change
16 The applicant has submitted no detailed site plan, but seeks only to rezone the property
from UR-3 5 to UR-7 to allow uses which are allowed in the UR-7 Zone
17 The site and area are located within the Aquifer Sensitive Overlay Zone, and the Public
Transit Benefit Area defined in the zorung code Intensive commercial development and zorung
are found a short distance to the west along Mullan Road The site will be provided with a high
level of public services, including public sewer and water, and close proximity to public transit

18 The County received no letters from the pubhc in response to the Notice of Application or
Notice of Public Heanng, and no members of the publlc testified at the heanng on this matter
19 A memorandum was received from the City/County Histonc Preservation Off ce about the
single-family house on the site The memo said that the office would only support the zvne
change if the house was saVed, because it had some hlstonc sigruficance The house is not on
any histonc register, however, and the County does not have regulations in piace which could be
used to prohibit the demolition of the structure Whether the hvuse will be retained ar
demolished unll have to be the decision of the landowner
i 20 The Planning Staff, in its report, analyzed the consistency of the proposal with the GMA
Comprehensive Plan, the UR-7 Zone, and other appllcable development regulations, and found
the proposal to be in compliance with those land use controls The Hearing Examiner concurs
with that analysis and hereby adopts and incorporates the same by reference as findtngs of fact
herein
21 The project will have to comply with all requ2rements of the UR-7 Zone and other
applicable development regulations when development permlts are s4ught by the applicant
There was no evidence that the zone change will have any significant adverse impacts on the
envlronment or will be incompatible wrth neighbonng land uses
22 Condrtions have changed in the area slnce the zoning of the site Changes include the
adoption of the Growth Management Act Comprehensive Plan and Phase I Development
Regulations, increased population grourth in Spokane Valley, increased traffic an the adjacent
Artenal, Broadway Avenue, and the extension of pubhc sewer to the area
Based on the above findin s of fact the Heann Examiner enters the followin

11 COIVCLUSIONS OF LAW
1 The proposed rezone conforms to the GMA Comprehensive Plan
2 The proposed rezone, as condrtioned, bears a substantial relationshlp, and will not be
detnmental to the public health, safety and welfare
3 A change in economic, technological, or land use conditions has occurred to warrant the
proposed rezone, as condrtioned A substantial change of circumstances has occurred zn t.he area
since the sXte wa.s last zoned
4 The procedural requirements of the State Environmental Polzcy Act and the Caunty's Local
Envuonmental Ordinance have been met The proposed rezone from UR-3 S to UR.-7, as
eonditioned, will not have a significant, probable adverse unpact on the environment

5 The proposed rezone, as conditioned, meets the cntena established by Waslungton case law
for approving a rezone, and the cntena established in paragraphs 14 402 020 (1)(2) of the County
Zoning Code for amending the County official zoning map
6 Approval of the land use application is appropnate under section 11 of the County Heanng
Examiner Urdinance, adopted by County Resolution Na 96-0171

Based on the above Findings of Fact and Conclusions of Law, the application for a rezone
from the Urban Residential-3 5 (LTR-3 5) Zone to the Urban Resldential-7 (LJR-7) Zone for
development consistent with the UR-7 Zone, is hereby approued, subject to the conditions of
approval of the public agencies as stated below
Failure to comply with the conditions of tus approval may result in revocation of tlus
approval by the Heanrig Examiner This apprvval does not waive the applicant's obligation to
comply with all other requirements of other agencies with junsdiction

5 Site plan review is admuustrative and shall be conducted pnor to the issuance of any
building permits to determine performance compliance with the Urban Residential-7 (UR-7)
zone and all applicable chapters of the Spokane County Zoning Code as amended
6 Any future division of the parcel shall demonstrate compliance with the Spokane County
Subdivision Ordinance
7 The Division of Planrung shall prepare and record with the Spokane County Auditor a
Title Notice noting that the property in question is subject ta a vanety of special conditions

1 Approach Permits are required for any access to the Spokane County road system
2 A Professional Engineer (P E), hcensed in the State of Washington, shall submit road and
storm drainage construction plans and a draulage report that conform to the versions of the
Spokane County Standards for Road and Sewer Construction, the Guidelines for Stonnwater
Management, and all applicable federal, state, and local regulations and laws that are in effect at
the time of the plan subnuttal or at the tune of the development permit application(s) The final
road and storm drainage plans and drainage report shall receive the County Enguleer's acceptance
pnor to release of any Gradulg, Bullding or Right-of-Way Permrts
3 A parkuig plan and traffic circulation plan shall be subnutted and approved by the Spokane
County Engineer The design, location and arrangement of parkulg stalls shall be in accordance
with standard engineenng practices
4 The construction of the roadway improvements stated herein shall be accomplished as
approved by the Spokane County Engineer
5 No vnprovements are required to Broadway Avenue because CRP 1409 and ULID 02-01
constructed these improvements NOTE A five-year moratonum on pavement cut is in effect
for this segment of Broadway Avenue due to the recent paving through ULID #02-01
6 All required improvements shall conform to the current State of Washington Standard
Specifications for Road and Bndge Construction and other applicable County standards and/or
adopted resolutions pertairung to Road Standards and Stormwater Management in effect at the
date of construction, unless otherwise approved by the County Engineer
7 Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane County Resolution No 1-0298, as amended, and are applicable to tlus proposal

8 No construction work is to be performed within the existing or proposed nght of way until
a permit has been issued by the County Engineer All work withul the public road nght of way is
subject to inspection and approval by the County Engineer
9 All requued construction witlun the existing or proposed public nght of way is to be
completed pnor to the release of a building permit or a bond in an amount estimated by the
County Englneer to cover the cost of construction or improvements shall be filed with the County
Engineer
10 The applicant is advised that there may exist uhlities either underground or overhead
affecting the applicant's property, including property to be dedicated or set aside for future
acquisition Spokane County will assume no financial obligation for adjustments or relocation
regarding these utilities The applicant should contact the applicable utilities regarding
responsibility for adjustment or relocation costs and to make arrangements for any necessary
work
11 The applicant shall grant applicable border easements adjacent to Spokane County Right of
Way per Spokane County Standards
12 This proposed zone change is not being requested for a specific development proposal or
srte plan at tlus time At such time a srte plan is submitted for review, the applicant shall submit
detailed traffic uiformation for review by the County Engineer to determine what traffic impacts,
if any, that the development would have on surrounding infrastructure The applicant is advised
that mitigation may be requued for off-site unprovements NOTE When a specific
development proposal or site plan is submitted, these plans will be reviewed for Transportahon
Concurrency in accordance with the Phase 1 Development Regulations
SPOKANE COgTNTY DIVISION OF UTILITIES
1 As per the Spokane County Zoning Code Phase One Development Regulations a wet (live)
sewer connection to the area-wide public sewer system shall be constructed A sewer connection
permit is required Commercial developments shall submit histoncal and/or estimated water
usage pnor to the issuance of the connection permit in order to establish sewer fees
2 The applicant shall submit expressly to Spokane County Division of Utilities, "under
separate cover," only those plan sheets showing sewer plans and specifications for the pubhc
sewer connections and facilities for review and approval Commercial developments shall
submit histoncal and/or estimated water usage as part of the sewer plan submittal
3 Sewer plans acceptable to the Division of Utilities shall be submitted pnor to the issuance
of the sewer connectlon permit
4 Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended

1 The sewage disposal method shall be as authonzed by the Director of Utilities, Spokane
County
2 Water service shall be coordulated through the Director of Utilities, Spokane County
3 Water service shall be by an existuig public water supply when approved by the Reglonal
Engineer (Spokane), State Deparhnent of Health The use of pnvate wells and water systems is
prolubited
4 A public sewer system will be made available for the project

BACKGROUND The application for the proposal was submitted to the Division of Pianning on
December 16, 2002 and a Technical Review Alleeting was held on January 2 2003 The
Determination of Completeness was issued on January 3, 2003 and the Notice of Application was
mailed on December 23, 2002 with a 14 day public comment period ending on January 6 2003
The existing zoning of the site is Urban Residential-3 5(UR-3 5) established in 1991 and previously
classified as Agriculturai Suburban (AS) (File # 69-69) The adoption of Phase I Development
Regulations to implement the the comprehensive Plan on January 15, 2002, Resolution #2-0037 did
not change the existing zoning of the subject site
Section IV Concurrency of the Phase I Developmen4 Regulations requires applications for Zone
Reclassifications within the Urban Growth Area (UGA) to be evaluated for both transportation and
water and sewer concurrency The Spokane County Division of Engineering has stated that if the
requested Zone Reclassification is approved, A Transportation Concurrency Certificate wiil be issued
at the time of buiiding permit issuance The Spokane County Division of Utilities and IVlodern Electric

1. FOOTING - when forms and reinforcement are in place and prior to placement of concrete-all structures, including manufactured homes.
NOTE: This inapection includes review of the structure's setbacks irom property Ilnes. Minimum setbacks are established by County zoning
regulaaons. Typically, side and rear yard setbacks are measured from property lines, while setbacks for yards abutting streets are measured from
the property line or the center line of the roadway right-of-way, whichever provides the greater setback from the center line of the roadway right-of-
way. Curb lines and fence lines are not necessarily indicative of property lines. In some residential areas, the County can own as much as 20 feet of
right-of-way between your property and the actual improved streeUcurb. The responsibility to comply with applicable setback provisions lies solely
with the permittee-neither Spokane County nor its authorized representatives assume any responsibility for the verification or locabon of your
property lines. Pleass verify their location prior to locating your structure. Failure to properly locate the structure may require its relocation at the

a period of 180 days, unless a written request for an extension of the permit (s recelved and approved by the Building Official prfor to expiration. At e
