INTRODUCTION , This matter having come before the Zoning Hearing Examiner Committee on August 6, 1981, and the members of the Committee present being Ron Odell, Chairman, and Gary N. Anderberg and John W. Skadan. B. PROPOSAL The sponsor, Craig Smith, et al, is requesting approval of a zone reclassification, File No. ZE-28-81 Agricultural to Community Business ~ B-2 } Zone, for the purpose of devel opi ng a retai 1 si te. C. FINDINGS OF FACT l. That the existing land use in the area is single family residences, duplexes, tavern, abandoned single family residence, large lot single family residence, outbuildings, and vacant land. 2. That the Comprehensive Plan designates this area as appropriate for MAJOR COMMERCIAL and UR6AN development, 3. That the existing zoning of the property described in the application i s Agri cul tural . 4. That the provisions of RCW 43.21C ~The State Environmental Policy Act} have been complied with, and the Committee concurs with the Determination of Non-Significance. 5. That the proper legal requirernents for adve rtisement of the Agenda Item have been fulfilled. 6. That the 1 and i n thi s area i s sui tabl e for the proposed use, or uses within the proposed Zone Classification. 1. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is justified. 8. That the proposed use is compatible with existing uses in the area. 9. That the owners of adjacent lands expressed neither approval nor disapproval of the proposed use. / ~ ~ ~ g C. FINDINGS OF FACT ~continued} ZE-28-87 10. The Nearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 11. The following are ad~itional findings of fact considered by the Hearing Examiner Committee: a~ The proposed rezone to Community Business (B-3) is consistent with the Major Commercial category and the transitional policy for the Urban category. Sullivan Road is still predominantly Single Family with Commercial uses replacing older residences. The Community Business {B-3} Zone provides adequate landscaping and buffering techniques to assure compatibility with the single family uses. D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (All Conditions imposed by the Zoning Hearing Examiner Committee shall be bi ndi ng on the "Appl i cant" , whi ch term shal 1 i nci ude the owner or owners of the property, hei rs, assi gns, and successors. ) HEARING EXAMINER COMMITTEE l. Add Health District Condition #1 as follows: "Use of private wells and water systems is prohibited." 2. Add County Engineering Condition #16 as follows: "Applicant shall submit for approval, by the Spokane County Engineer, road, drainage and access plans." 3. Modify Planning Department Condition #10 to read as follows: "That the area within the easterly 26 feet (designated as future acquisition by the County Engineer} of the subject site shall not be used for parking, '208', drainfield, or landscaping requirements and no advertising signs are allowed within the area. If any of the above are placed within this area, removal at the time of widening of Sullivan Road shall be at the applicant's expense." 4. Modify County Building and Safety Department's Condition #6 to read as follows: "Since the Department of Building and Safety has declared that some of the existing buildings on the subject property are unsafe and does constitute a fire hazard endangering public health and safety, it is being recommended that as a condition of approval "that by October l, 1981, the site be cleared of all buildings, waste accumulation, and debris,." ~  5- , ' ~ . D~ CONDITIONS OR CONT~NGENCIES APPLIED TO THIS APPROVAL (continued) ZE-28-87 a} COUNTY PLANNIN~ DEPARTMENT STANDARD: l. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits. 2. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prio r to release of building permits. Landscaping shall be installed and maintained such that sight distance at access points is not obscured or impaired. 3. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Variations when approved by the Zoning Administrator will be pe rmitted, including, but not limited to the following changes: Building location, landscape plans, and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the ZONING CODE FOR SPOKANE COUNTY. The o riginal intent of the development plans shall be maintained. . 4. Direct light f rom any exterior area lighting fixture shall not extend ove r the property boundary. 5. That the project is subject to Section 1.06, the Aquifer Sensitive Area Overlay Zone of the ZONING CODE FOR SPOKANE COUNTY, which sets forth various measures for Aquifer protection; specifically, measures dealing with wastewater disposal, spill protection measures, and sto rmwater runoff. b. That the present proposal is not detailed enough to determine whether o r not the use of or materials stored on the site are in compliance with Section 1.06 (Aquifer Sensitive Area Overlay Zone) of the ZONING CODE FOR SPOKANE COUNTY. Accordingly, as a condition of approval, the sponsor/applicant shall be required to file with the Spokane County Auditor, within thirty (30) days of the signing of Findings and Order of the final decision in this matter, a"Notice to the Public" which shall provide in material as follows: PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT SNALL BE RESPONSIBLE FOR COMPLYING WITN TNE PROUISIONS OF TNE ZONING CODE FOR SPOKANE COUNTY SECTION 1.Ob ~AQUIFER SENSITIVE AREa OUERLAY ZONE). Any division of land for the purpose of sale, lease or transfer, shall comply with RCW 58-17 and the Spokane County Platting Ordinances prior to issuance of bui lding permits. SPECIAL: 9. All current standards of the Community Business ~B-2) Zone, as amended, shall be complied with in the development of this site. 10. That the area within the easterly 26 feet (designated as future , acquisition by the County Engineer~ of the subject site shall not be used for parking or landscaping requirements and no advertising signs are allowed within this area. b~ COUNTY ENGINEERING DEPARTh1ENT STANUARD: 1. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire pro ject or portion thereof if the development is phased. 2. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard engineering practices. Paving or surfacing as approved by the County Engineer will be required for any portion of the project which is to be occupied or traveled by vehicles. 3. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge construction and other applicable county standards and/or adopted resolutions pertaining to Road standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 4. Roadway standards, typical roadway sections and drainage plan ' requirements are found in Spokane Board of County Cormissioners resolution 80-1592 as amended and are applicable to this proposal. 5. COUNTY ENGINEERING DEPARTMENT ~continued~ 6. No construction work is to be performed within the existing or proposed right of way until a permit has been issued by the County Engineer. All work within the public road right of way is subject to inspection and approval by the County Engineer. 7. Al l requ i red construct i on wi th i n the ex i st i ng or proposed pub 1 i c right of way is to be completed prior to the release of a building permit or a bond in an amount estimated by the County Engineer to cover the cost of construction of improvements shall be f i 1 ed wi th the County Eng i neer. SPECIAL: 8. Applicant shall dedicate ten feet on Valley Way for right of way. 9. Applicant shall adhere to an additional 2b foot setback (total setback b0 feet) on Sullivan Road. This will facilitate road right of way acquisition when future improvements are constructed. 10. Appl icant shal 1 dedicate a 20 foot radius on Val ley Way and Sullivan Road. 11. To construct the roadway improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be wi l ing to participate in any petition or resolution which purpose is the format~on of a Road Improvement D~strict ~RID) for said improvement pursuant to RCW 36.88, as amended. This condition is a~plicable to the improvements which have been specified for Sul ~ ivan Road. 12. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project ~CRP) to the extent of the required improvement. Spokane County will not participate in the cost of these improvements. This condition is aQ~licable to the imQrovements which have been speci~ied ~or Su 1~ i van Road. 13. The County Engineer has designated Typical Roadway Section Number One, Major Arterial standard for the improvement of Sullivan Road which is adjacent to the proposed development. Th i s wi 11 requ i re the add i t i on of approx i mate ly 4 to 6 feet of asphalt along the frontage of the development. Curbing and sidewalks must also be constructed. 14. The County Engineer has designated Typical Roadway Section Number One, Collector Street standard for the improvement of Valley Way which is adjacent to the proposed development. This wi 11 require the addition of approximately 10 to 12 feet of a spha 1 t a 1 ong the f rontage of the deve 1 opment. Applicant shall sign and record Spokane County Notice to the Publ ic No. b which specif ies the fol lowing: The owner(s) or successor~s) in interest agree to authorize the County to place their name( s} on a petition for the formation of a Road Improvement District ~RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s~ property, If a RID is formed by either the petition or resolution method, as provided for in Chapter 3b.88 RCW, the owner(s) or successor(s) further agree: (1) that the improvement or construction contemplated within the proposed RID ~s feasible, (2) that the benef~ts to be der~ved from the f ormat i on of the R I D by the property i nc 1 uded there i n, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed. Provided, further, the ownerts) or successor(s~ shall retain the right, as authorized under RCW 3b.88.090, to object to any assessment on the property as a result of the improvements called for in conjunction with the formation of the RID by either petition or resolution method under Chapter 36.88 RCW. c) COUNTY UTILITIES 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Nealth D i strict and i s~urther cond i t i oned and sub ject ot spec i f i c app 1 i cat i on approval and i ssuance of permi ts by the Hea 1 th District. 2. The Owner(s~ or Successor(s~ in interest agree to authorize the County to p 1 ace thei r name ~ s~ on a pet i t i on f or the f ormat i on of a ULID by petition method pursuant to RCW 36,94 which the petition includes the Owner(s} property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 6 , " v , L` D. A dry sewer connection to the future area-wide Sewerage System is to be constructed. Plans and specifications for the dry sewer connection are to be reviewed and approved by the Ut i 1 i t i es Department. d) COUNTY HEALTH DISTRICT STANDARD: 1. A comb i ned surf ace water and~ sewage d i sposa 1 deta i 1 ed p 1 an sha 11 be approved by the County Engineer and the Health District prior to the i ssuance of any bu i 1 d i ng permi t for th i s pro ject. 2. Sewage.disposal method shall be as authorized by the Director of Ut~l~t~es, Spokane County. 3. Water service sha11 be coordinated through the Director of Utilities, Spokane County. 4. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 5. Disposal of sewage effluent beneath paved surfaces is currently prohibited. SPECIAL: 6. Subject to specific application approval and issuance of permits by the Health Off icer, the use of an individual on-site sewage system may be authorized. e) COUNTY BUILDING AND SAFETY DEPARTMENT STANDARD: 1. The s i te i s 1 ocated i n F i re D i str i ct # 1. 2. Fire hydrants shall be located so as to be accessible to fire apparatus and not be obstructed by any structure or vegetation or have the vi sibi 1 ity impaired for a d i stance of f ifty feet in the direction of ve~icular approach to the hydrant. 3. Specific lacation of hydrants shall be determined by the fire district. 4. Commercial dumpsters and containers with an individual capacity of 1.5 cubic yards or greater shall not be stored or placed within five feet of combustible walls, openings or combustible roof eave 1 ines. ~  / • w D. The appiicant shall provide verification from the Fire District to the Department of Building and Safety that provisions have been made for adequate fire protection prior to the release of bui lding permits. Water Purveyor is Vera Water and Power Company, and they will ~ supply the site with adequate water for domestic, fire and irrigation uses although satisfactory arrangements have not been made. g~ COUNTY AIR POLLUTION CONTROL AUTNORITY All air pollution regulations must be met. This inciudes but is not 1 imi ted to the fol lowi ng: STANDARD: 1. Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled. This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions. Naul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities. 2. Measures must be taken to avoid the deposition of dirt and mud f rom unpaved surf aces onto paved surf aces. If track i ng or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 3. All travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 4. Some objectionable odors will likeiy result during the construction phase of the project and from motor vehicles using the s i te f o 11 ow i ng comp 1 et i on of the pro ject and f rom occupants of the proposed project. ~  0 r ~ , . t~ D. Generalized Comprehensive Plan, and other County policies and guidelines. The Zoning Administrator has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of Non-Si~nificance ("DNS"). ~  ~ . , ~ . , . . . , . , IU.
