STANDARD: ~
1. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building perrnits.
2. A specific landscape plan, planting schedule and provisions for
rnaintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a perf ormance bond for the
project prior to reiease of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired.
3. The applicant shall develop subject property generally in
accordance within the concept presented to the Nearing Exa~~iner
Com~ittee. Variatians when approved by the Zoning Adi~inistrator
wi11 be permitted, including, but not limited to the following
changes: Bui lding location, landscape plans, and general
allowable uses of the perr~itted zone. Al1 variations «ust
conform to regulations set forth in the ZONING CODE FOR SPOKANE COUNTY. The original intent of the development plans shall be
maintained.

stormwater runoff and provide necessary landscaping for runoff.

SPECIAL:

b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Buildin~ Permit Or Use Of The Property As Proposed:
STANDARD:
1. Access permits for approaches to the County Road System shall be
obtained f rorn the Spokane County Engineer.
2. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Nealth District a detailed
combined on-site sewage system plan and surf ace water disposal
plan for the entire project or any portion thereof, if the
development is to be phased.
3. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design, location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surf acing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
4. To construct the road improvements stated herein, the applicant
~~ay, wi th the approva 1 of the County Engi neer, jo i n i n and be a willing participant in any petition or resolution which purpose
is the formation of a Road Improvement District (RID~ for said
improvement pursuant to RCW 36.88, as arnended. Spokane County
wi 11 not participate in the cost of these i«~provet~ents.

the required road improvement. Spokane County will not

improvements or construction contemplated within the proposed
RID is feasible, (2~ that the benefits to be derived fro~n the

County, as amended.

d) COUNTY HEALTH DISTRICT
STANDARD:
l. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
2. Water service shall be coordinated through the Director of
Utilities, Spokane County.
3. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Nealth Services.
4. A public sewer system will be made available f or the project and individual service will be provided to each lot prior to sale.

f) WATER PURUEYOR
1. Water Purveyor is Vera Water and Power, and they will supply the site with adequate water for domestic, fire and irrigation uses,
although satisfactory arrangements have not been made to serve
this proposal.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
STANDARD:
1. Air pollution regulations require that dust emissions during
de~~olition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Hau1
roads should be treated and emissions from the transfer of
earthen ~~aterial i~ust be controlled as weil as e~~issions from all other construction related activities.
2. ~~easures ~~~ust be taken to avoid the deposition of dirt and mud
f rom unpaved surf aces onto paved surf aces. I f track i ng or
spi 1~ s occur on paved surfaces, i~easures r~ust be taken

Adjoining Streets: Sullivan Road to the east of the site is a 64
foot County right of way i~~proved with four lanes
- no sidewalk or curb.
The County Engineer has designated Sullivan Road as a P~lajor Arterial,
Section Number One. This will require 4' to 6' of additional paving, curbing and sidewalks. They are also requiring an additional 26'
setback along Sul l ivan Road to faci 1 itate future acquisition when
further ir~prove~~ents are needed.

IV. SEPA ENVIRONMENTAL REUIEW
An Envi ron~~enta 1 Check 1 i st was sub~~~i tted by the sponsor and was
reviewed by the County Planning Department. The review considered
the specifics of' the proposal, other available information, County
ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines. The Zoning Administrator has determined
that "No probable signif icant adverse impacts" would result from the
proposal being developed and has issued a Deterraination of
Non•Significance ~"DNS").
The "D(dS" wa s c i rcu 1 ated to n i ne other agenc i es of jur i sd i ct i on and ' other agencies/departments affected by the future development for
review and comment. The "DNS" comment period ends September 30,
. 1981, and was advertised 15 calendar days before said date in the
newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on the proposal site.
The Hearing Examiner Comnittee may consider additional environmental

V. PLANNING SUMMARY
The proposed rezone to Community 6usiness (B-3~ is consistent with
the Ma jor Corn~ercial category and the transitional pol icy for the
Urban category. Su 11 ivan Road i s st i 11 predomi nant ly Si ng 1 e Fami ly
with Commercial uses replacing older residences. The Cocnr~unity Business (B-3) Zone provides adequate landscaping and bufferng
techniques to assure compatibility with the single fami)y uses.
Therefore, the Planning Department recommends approval of this rezone.

2, A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access

3. The applicant shall develop subject property generally in
accordance within the concept presented to the Nearing Examiner
Committee. Variations when approved by the Zoning Adr~inistrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
' allowable uses of the permitted zone. All variations must conform to regulations set forth in the ZONING CODE FOR SPOKANE
_ COUNTY. The original intent~of the development plans shall be

STANDARD:
1. Access permits for approaches to the County Road System shall be
obtained fro~~ the Spokane County Engineer.
2, The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-sit~ sewage system plan and surface water disposal
plan for the entire project or any portion thereof, if the
development is to be phased.
3. A parking plan and traffic circulation plan sha11 be submitted
and approved by the Spokane County Engineer. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
4. To construct the road irnprovements stated herein, the applicant
~nay, with the approval of the County Engineer, join in and be a
wi 11 ing participant in any petition or resolution which purpose
is the for~~ation of a Road Irnprovernent District ~RID) for said

l. Water Purveyor is Vera Water and Power, and they will supply the
site with adequate water for domestic, fire and irrigation uses,
although satisfactory arrangements have not been made to serve
this proposal.
g) COUNTY AIR POLLUTION CONTROL AUTNORITY
STANDARO:
1. Air pollution regulations require that dust emissions during
de~~olition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and e~~issions from the transfer of earthen ~naterial r~~ust be controlled as well as e~~~issions from
all other construction related activities.
2. Measures rnust be taken to avoid the deposition of dirt and i~ud
from unpaved surfaces onto paved surfaces. If tracking or
spills o~cur on paved surf aces, measures ~~ust be taken

the Comprehensive Wastewater Management Plan as affecting the Spokane Valley
•Rathdrum Prairie sole source aquifer, and the owners of such property have
made appllcatlon for a permit or approval trom 5pokane County, which applica-
tion requires the execution ot this Utility Local Improvement District Real Prop-
erty ~ovenant and Agreement.
(1) OBLIGATION
In a~cordance with the conditions of application approval in conjunction
with Land Use Application No. set forth hereinabove, the owners hereby cove•
nant and a9ree for themselves, their heirs, successors, assigns and personal
representatives, to join in any valid petition for the formation a Utility Local
Improvement Oistrict established pursuant to Chapter 36.94 RCW, for the in-
stallation, maintenance or operation of sewer service and facilities which may be
proposed to be established for the area in which the above-described property
is located, and which will serve the above-described property, and said owners
for themselves, their heirs, suc~essors, assigns and personal representatives
covenant and a~ree not to protest the establishment of such Utility Lotal Im-
provement Oistrict as authorited under RCW 36.94, 240 for su~h area, in serv;ng
said property, whether proposed by petition or resolution of the appropriate
governmental agency. PROVIOEO, H~WEVER, this obligation shal{ not con-
