locational and compatibility criteria indicate that the proposed density
is excessive for the vicinity Adjoining densities range from 1 2 to 4 5
units per acre Provision of landscaping and buffering for mitigation of
visual and aesthetic impacts will not mitigate the issue of density
Design A minor site plan revision is necessary to accomplish relocation
of two 20'x20' off-street parking areas in compliance with the 25-foot
minimum front yard setback The two manufactured home spaces have direct
access to the frontage road with 50-foot stall width, creating a more
crowded effect than nearby single family residential Lot frontages of
adjoining residences range from 80 feet to 120, as opposed to the 50-foot
manufactured home spaces The lot frontage difference reflects the
inconsistency of the proposal with adjoining development
Bufferi= Recommend that dense, tall growth plantings be installed and
maintained in a 5-foot landscape strip along the north, west, and east
property lines, and a dense, high-low mix of trees, shrubs, and plantings
be installed along the south property line In addition, a 6-foot
sight-obscuring wooden fence (to be approved by the Zoning Adjustor) is
recommended at the site perimeter

IV SEPA ENYIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department The review considered
the specifics of the proposal, other available information, County
ordinances, other regulations and laws, possible standard Conditions
of Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines The Zoning Administrator has determined
that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Determination of
Non-Significance ("DNS")
The "DNS" was ci ftulated to eight other agencies of jurisdiction and
other agencies/departments affected by the future development for
review and comment The "DNS" comment period ends February 5, 1986,
and was advertised 15 calendar days before said date in the
newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on the proposal site
The Hearing Examiner Committee may consider additional environmental
related testimony and the "DNS" at the public hearing
V PLANNING SUMMARY
Although the Urban category encourages a variety of residential uses
and densities, and "fill-in" development, the proposed manufactured
home park appears incompatible with the specific locational and land
use compatibility objectives The proposed density of 5 88 units per
acre appears incompatible with adjoining single family developments
even though aesthetic impacts can be mitigated via landscaping and
bufferi ng
Should the Hearing Examiner Committee choose to approve the proposal,
the following conditions are recommended

VI. CONDITIONS OF APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors )
a) COUNTY PLANNING DEPARTMENT
1 Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building permits
2 A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shail be submitted with a performance bond for the
pro3ect prior to release of building permits Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired
3 Direct light from any exterior area lighting fixture shall not
extend over the property boundary
4 The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
perrnits
5 All current standards of the Residential Manufactured Home Zone,
as amended, shall be complied with in the development of this
site
6 That the project is subject to Section 4 16A 050, the Aquifer
Sensitive Area Overlay Zone of the Spokane County Zoning
Ordinance, which sets forth various measures for Aquifer
protection, specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff
7 That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Chapter 4 16A (Aquifer Sensitive Area Overlay
Zone) of the Spokane County Zoning Ordlnance kcordingly, as a
condition of approval, the sponsor/applicant shall be required
to file with the Spokane County Auditor, within thirty (30) days
of the signing of Findings and Order of the final decision in
this matter, a"Notice to the Public" which shall provide in
material as follows
PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR
CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE
ON TNE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT
SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROYISIONS
OF SPOKANE COUNTY ZONING ORDINANCE CHAPTER 4 16A
(AQUIFER SENSITIVE AREA OVERLAY ZONE) THE PROPERTY
WHICH IS THE SUBJECT OF THIS NOTICE IS MORE PARTICULARLY

stormwater runoff and provide necessary landscaping for runoff
10 Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits
11 Applicant shall comply with all agency's regulations as amended
prior to issuance of buTlding permits
12 That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43 21C 080 RCW and the Board of Spokane County
Commissioners Resolutlon #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements
13 That the 5-foot landscape strip along the north, west, and east
property lines be planted and maintained in a dense landscape
screen which is a minimum of 6-feet in height at installation or
maturity (3 years)
14 That the 5-foot landscape strip along the south property line be
planted and maintained in a dense high-low mix of trees, shrubs,
and plantings
15 That a 6-foot sight-obscuring wooden fence (fence detail to be
approved by the Zoning Adjustor) be installed at the site
perimeter
b) COUNTY ENGINEERING DEPARTMENT
1 That prior to issuance of a building permit or use of the
property as proposed, the applicant shall obtain an approach
permit from the County Engineer for any new driveway approaches
to the County road system

1 Pursuant to Board of County Commissioners' Resolution No
80-0418, the use of on-site sewer disposal systems is hereby
authorized This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Health
District
2 The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36 94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36 94 which includes the Owner(s) property PROYIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36 94
3 Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended
4 Each dwelling unit shall be double-plumbed for connection to
future areawide collection systems
d) COUNTY HEALTH DISTRICT
1 A combined surface water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer and the Spokane
County Health District prior to the issuance of any building
permit for this project
2 Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County
3 Subject to specific application approval and issuance of permits
by the Health Officer, the use of an on-site sewage disposal
system may be authorized
4 Water service shall be coordinated through the Director of
Utilities, Spokane County
5 Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
February 6, 1986, and the members of the Conani ttee present bef ng
Kathleen M. Carstens, Chairperson, Jane E. N(yers and Ron Odell.
B. PROPOSAL
The sponsor, Florence Ring, is requesting approval of a zone
reclassification, File No. ZE-62-85, Agricultural to Residential
Manufactured Home (RMH), for the purpose of establishing a-2-unit
Manufactured Home Park.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential (single family
and some manufactured homes i n vici ni ty ) and open area.
2. That the Comprehensive Plan designates this area as appropriate for
Urban development.

3. That the exi sting zoni ng of the property desc ri bed i n the appl i cati on
is Agricultural.
4. That the provisions of RCw 43.21C (The State Environmental Policy
:
Act) have been complied with, and the Comnittee concurs with the ~
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda '
Item have been fulfilled.
6. That the land in this area is unsuitable for the proposed use, or
uses within the proposed Zone Classification.
7. That the applicant has not demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone is not justified.
8. That the proposed use is incompatible with existing uses in the
area.

9. That the owners of adjacent lands expressed disapproval of the
proposed use.
10. The Hearing Examiner Conmittee finds the proposed use is not 1n
harmony with the general purpose and will be otherwise detrimental to
the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a) That the proposed density is excessive with ad,joining
properties.
b) That provision of landscaping Nill not mitigate the effects of
density and incompatible land uses.
c) That the proposed 50-foot stall widths is inconsistent with lot
frontages in the area.

finds that-the..application of Florence Ring for a zone reclassification as
