The property which was the subject of the zone change request and Environmental Determination of Non-Significance is generally located south of Mission Avenue, east of Marguerite Road, west of Argonne Road, and approx- imately 120 feet north of Si nto Avenue. more parti cul arly descri bed as fol 1 ows : Lots 1- 5, Block 1, Hutchinson's Addition, as recorded in Volume Q, Page 4 of Plats; and Lots 1- 8, Scaramore Subdivision, as recorded in Plat Book 2, Page 59, records of Spokane County, WA and together with vacated Maxwell Avenue Any person may appear at a time, place and date set for hereinabove and present testimony on the Environmental Determina tion of Non-Significance for the above re- ferenced proposal as wel 1 as any other environmental doctiments i n the f i 1 e. It should be noted that inasmuch as the approval of the project was not appealed, only environmental documents wi'l l be the subject of the publ ic hearing. That the proposal consi sts of a request to rezone approximately 6.6 acres from Agri cul tural and Local Busi ness to Comnerci a1 for the purpose of developing a Retail Center. 3 That the adopted Spokane County Generalized Comprehensive Land Use Plan indicates Major Commercial and Urban usage of the area encompassed by the proposal. 4 That the Pl anni ng Di rector and the P1 anni ng Department's pe rsonnel did adequatgly comply with a11 the procedural aspects of the State Enviroranental Policy Act, Chapter 43 21C RCW, and a11 rules and regulations praaulgate therefrom, and, further, that no party contested the procedural requirements compliance of the SEPA process 5. That the Board concurs with the conclusion of the Planning Department that the project as approved presents no probable significant adverse envi ronmental impacts. 6. That the Board has considered all environmental documents and oral and wri tten testimony rel ati ng to envi ronmental consi derati ons wi thi n the Planning Department's file and presented to the Board of County Comnissioners at the public hearing on June 17, 1986 7. That the Board recognizes the provisions of the Spokane County Code Section 11 10.170, which section requires the Board to afford substantial weight to a threshold determination made by the Responsible Official The Responsible Official issued a Determination of Nonsignificance. 8 That issues of noise and enforcement of environmental conditions were raised by the appellants at the public hearing. The Board finds that these issues are adequately addressed by the conditions of approval and legal provisions to ensure compliance and conditions. In particular, Condition No. 3 concerns noise and provides "That the proposed structu re be relocated to the minimum setbacks at the southwest corner of the property, and a 6-foot sight-obscuring fence be provided along the south property line, or a resi denti al ly decorated 12-foot masonry wal l may be provided along the setback requirertent The yard areas shall be maintalned in tall and low growing landscaping." ~ ~ z ~ 06 6 9 ~ FINDINGS OF FACT AND DECISION ZE-084-85 #2 The Hearing Examiner Cortmittee added the following to the PlanniAg Department's condition at their public hearing "That noise abatement techniques be utilized within the truck access lanes, as approved by a professional audiologist to reduce noise impacts as specified within the regulations of the Departnent of Ecol ogy. ° 9. That the Spokane County Hearing Examiner Comnittee held a public hearing on March 6, 19869 at which hearing they concurred with the Determi nation of Nonsi gni fi cance i ssued by the P1 anni ng Di rector, and by thei r Findings of Fact, Decision and Order dated March 6, 1986, they approved the proposal subject to c.ertain conditions, dealing with noise abatement and enforcement of envi ra~rnnental condi ti ons. , 10. That the proposal is neither detrimental nor otherwise ha nnful to the public health, safety and welfare 11. I hereby move that the appeal be denied In making this motion I have considered all environmental documents in the file, the environmental determination of non-significance and oral testlmony at the public hearing. Likewise I have considered the provisions of Spokane County Code Section 11.10.170 which requires that the Board give substantial weight to the determination made by-tbe lead agencies responsible official Lastly I have considered the provisions of State law found in WAC 197-11-340 which setf forth those circumstances under which the lead agency may withdraw a determination of non-significance I specifically find that the pro3ect as identified and conditioned wi11 not have a probable significant adverse impact on the enviornment Environment issues raised at the Public Hearing included noise and enforcement of environmental conditions. The project itself has been specifically conditioned to require . noise abatement techniques to be utilized within the truck access lanes, as approved by a Professional Audiologist~to reduce noise impacts as specified within the DOE regulations Likewise, adequate provisions exist in the Spokane County Zoning Ordinance to ensure that the applicantlsponsor complies with the conditions of approval. INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on March 6, 1986, and the members of the Conmittee present being Jane E. Nyers, Chairperson, and Gary Anderberg Mr. Neraas was not present to hear all of the testimony on this application, therefore, did not vote on the Committee's motion B PROPOSAL The sponsor, Gull Industries, is requesting approval of a zone reclassification, Fi1e No ZE-84-85, Agricultural and Local Business to Commercial, for the purpose of developing a Retail Center. C FINDINGS OF FACT 1 That the existing land use in the area is residential, commercial, bus pick-up (passenger and package), and vacant 2 That the Comprehensive Plan designates this area as appropriate for Major Commercial and Urban development. 3. That the existing zoning of the property described in the application is Agricultural and Local Business 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Determination of Non-Significance. 5 That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6 That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification 7. That the proposed use is compatible with existing retail uses along Argonne, howeve r, maybe is not compatible with ad3acent single family uses along the north, west and south 8 That the owners of ad3acent lands and/or their representatives expressed disapproval of the proposed use 9 The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. ZONE RECLASSIFICATIOH NO ZE-84-85 ; C FINDINGS OF FACT (continued) 10. The following are additional findings of fact considered by the Hearing Examiner Committee a) That the Nearing Examiner Committee is concerned about the community and its people living within it, and does appreciate good developments as probably do the neighbors in this area. b) That the proposal does encroach into a residential area, therefore, special conditions within this action have been added to assure that bufferi ng, protecti on and compati bi 1 i ty can be mai ntai ned c) That as conditioned, the existing bus service terminal cannot expand without a public hearing before the Hearing Examiner Committee for consideration d) That the subject property is within the Argonne-Mullan Corridor and as such should be allowed to follow the trend for quality development D CONDITIONS OR CONTIHGENCIES APPLIED TO THIS APPROVAL (All Conditions imposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns, and successors ) 1. Replace Planning Condition No 1 with "That the approval of this zone change is for a retail center b ut does not allow a tavern, massage parlor or similar uses that may be offensive. The project ts to be developed in substantial conformance to the site plan Relocation of the proposed structure may be allowed if mitigation to adjacent resldences to the west and south can be provi ded Any si gni f i cant changes to the si te pl an and/o r i ts uses shall be reviewed and approved at a public hearing before the Hearing Examiner Committee a "That no increase 1n service for the existing bus terminal service is allowed without approval by the Hearing Examiner Committee at a public hearing b "That the revised sfte plan for the Gull Gas Service Station, dated 3-6-86, and approved by the Hearing Examiner Committee is hereby allowed, subject to the standards of the Zoning Ordinance and as conditioned herein " 2 Add to Planning Condition No 3 "That noise abatement techniques be utilized within the truck access lanes, as approved by a professional audiologist to reduce noise impacts as specified within the regulations of the Department of Ecology " ZONE RECLASSIFICATION NO ZE-84-85 0. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (continued) Add Department of Ecololy Condition as follows 1. "It appears that Hutchinson Irrigation District's water rights are not i n order, and a permi t or permi ts may be requi red from the Department of Ecology The district should make the necessary applications to the departrment as soon as possible " a) COUHTY PLANNING DEPARTMENT 1. That the approval of this zone change is for a Retail Center to be devel oped as condi ti oned by the Heari ng Exami ner Con~ni ttee No alterations to the site plan, proposed uses, the existing Gas Service or the Greyhound Bus Service is allowed without approval by the Heari ng Exami ner Committee 2, That landscaping along Mission be increased to at least 10-feet and along Argonne to a 5-foot strip. Said landscaping to be provided within the ownership of the subject property Landscaping within the right of way may be provided but not as a substitute to the above requirements 3 That the proposed structure be relocated to the minimum setbacks at the southwest corner of the property, and a 6-foot sight-obscuring fence be provided along the south property line, or a residentially decorated 12-foot masonry wa11 may be provided along the setback requirement The yard areas shall be maintained in tall and low growing landscaping 4. That should the alternative for building relocation be desired, by the applicant, to the minimum setbacks, then the masonry wall shall be replaced with a 6-foot sight-obscuring fence along the south property line and a 3-foot high meandering decorative masonry wall within the yard area along Marguerite Road 5 That landscaping be provided adjacent to the structure 6 That no access be allowed to Marguerite Road from the project 7 The Zoning Administrator shall approve a specific exterior lighting plan for the approved area prior to installation of such lighting (Such plan shall attempt to confine illumination to the area with full consideration to ad3acent properties ) 8 A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a perfomance bond for the project prior to release of building permits Landscaping shall be installed and maintained such that sight distance at access poi nts i s not obscured or impai red 3 ZONE RECLASSIFICATION NO ZE-84-85 a) COUNTY PLANNING DEPARTMENT (continued) 9 The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee Variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes Building location, landscape plans, and general allowable uses of the permitted zone All variations must conform to regulations set forth in the Spokane County Zoning Ordinance The original intent of the development plans shall be maintained 10 The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permi ts 11 All current standards of the Comnercial Zone, as amended, shall be complied with in the development of this site 12 That the present proposal is not detailed enough to determine whether or not the use of or materials stored on the site are in compliance with Section 7 06 (Aquifer Sensitive Area Overlay Zone) of the Spokane County Zoning Ordinance Accordingly, as a condition of approval, the sponsor/applicant shall be required to file with the Spokane County Auditor, within thirty (30) days of the signing of Findings and Order of the final decision in this matter, a"Notice to the Public" which shall provide in material as follows PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROVISIONS OF SPOKANE COUNTY ZONING ORDINANCE CHAPTER 4 16A (AQUIFER SENSITIVE AREA OVERLAY ZONE). THE PROPERTY WHICH IS THE SUBJECT OF THIS NOTICE IS MORE PARTICULARLY DESCRIBED AS FOLLOWS " 13 Signs for this pro3ect shall conform to standards as set forth in Section 4 09 125 Signs 14 Applicant shall comply with '208' recomnendations concerning stormwater runoff and provide necessary landscaping for runoff 15 Any division of land for the purpose of sale, lease or transfer, shall comply with RCW 58-17 and the Spokane County Platting Ordinances prior to issuance of building permits 4 ZONE RECLASSIFICATION NO ZE-84-85 a) COUNTY PLANNING DEPARTMENT (continued) 16 That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43 21C.080 RCW and the 6oard of Spokane County Convnissioners Resolution #77-1392 be initiated by the project app1icant within thirty (30) days of final disposition of this application, and prior to any on-site improvements, or file appropriate docurtaents to the effect that the NOTICE OF ACTIOH is waived in accordance with Spokane County Commissioners' Resolution #82-0458 dated May 4, 1982 COUNTY ENGINEERING DEPARTMENT Prior To The Issuance Of A Building Permit 1 Applicant shall dedicate a 30 foot radius on Mission Avenue and Argonne Road prior to any use of the property 2 Applicant shall dedicate 10 feet on Marguerite Road and a 20 ft radius on Marguerite Road and Mission for right-of-way prior to any use of the property 3 Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer 4. Applicant shall improve Mission Avenue in a manner consistent wi th Spokane County TYP ICAL roadway secti on No 1 mi ni mum pavi ng width Secondary Arterial Standard 5 Applicant shall improve Marguerite Road in a manner consistent with Spokane TYPICAL roadway section No 1 minimum paving width Access Standard 6 App1icant shall submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a bui 1 di ng permi t on the property 7 The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property 8 A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or travel ed by vehi cl es 5 ZONE RECLASSIFICATION HO ZE-84-85 b) COUNTY ENGINEERING DEPARTMENT (continued) 9 The word "applicantu shall include the owner or owners of the property, his heirs, assigns, and successors 10. The construction of the road improvements stated herein sha11 be accomplished as approved by the Spokane County Engineer 11. All required improvements shall conform to the current State of Washington Standard Speciflcations for Road and Bridge Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Storniwater Management in effect at the date of construction, unless otherwise approved by the County Engineer 12. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Conmissioners' Resolution No. 80-1592 as amended. c) COUNTY UTILITIES DEPARTMENT 1. Pursuant to Board of County Conmissioners Resolution No 80-0418, the use of on-site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditloned and subject to specific application approval and issuance of permits by the Health Df strict. 2. The owner(s) or Successor(s) in interest agree to authorize the County to pl ace thei r name ( s) on a peti ti on for the formati on of a ULID by petition method pursuant to RCW 36 94 which the petition includes the Owner(s) property and further not to object by the si gni ng of a protest peti tion agai nst the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in con3unction with the formation of a ULID by either petition or resolution method under RCW Chapter 36 94 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4 The pro3ect shall be double-plumbed for connection to future areawide collection systems 6 ZONE RECLASSIFICATION NO ZE-84-85 d) COUNTY NEALTH DISTRICT 1 A combined surface water and sewage disposal detailed plan shall be approved by the Spokane County Engineer and the Spokane County Health District prior to the issuance of any building permit for this project 2 Sewage disposal method shall be as authorized by the Director of Util i ties, Spokane County 3 Subject to specific application approval and issuance of permits by the Health Officer, the use of an on-site sewage disposal system may be authorized 4. Water service shall be coordinated through the Director of Utilities, Spokane County 5 Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social 8 Health Services 6 Use of private wells and water systems is prohibited 7. Disposal of sewage effluent beneath paved surfaces is currently prohi bi ted. e) COUNTY 6UILDING AND SAFETY DEPARTMENT 1 The site is located in Fire District # 1 2 Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property.
