FINDINGS AND ORDER
A. INTRODUCTION
This roatter having come before the Zoning Nearing Examiner Committee on
October 2, 1986, and the members of the Committee present being
Jerry Williams, Chairman, Ron Odell and Jim Schurra
B PROPOSAL
The sponsor, Harold E. Schimmels, is requesting approvat of a zone
rec]assification, Agricultural Suburban to Light Industrial (I-2), Fi1e
No ZE-27-86, for the purpose of developing a Contractor's Storage Yard
and Metal Stud Storage and Sales.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential (single family
and manufactured homes), contractor's yard, storage building and
outdoor storage of equipment and supplies.
2 That the Comprehensive Plan designates this area as appropriate for
Urban development
3. That the existing zoning of the property described in the application
is Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legai requirements for advertisement of the Agenda
Item have been fuTfilled.
6. That the land in this area is suitable for the proposed use, as
conditfoned for landscaping and sight-obscuring fencing, or uses
withtn the proposed Zone classification.

7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed rezone as conditioned is justified.
8 That the proposed use is compatible with existing uses in the area,
and the required landscaping will help to make the proposal of it
better with the adjoining single family uses
9. That the owners of adjacent lands expressed both approval and
disapproval of the proposed use
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the publ ic health, safety, and welfare.
11. The following are additional findings of fact cansidered by the
Hearing Examiner Committee
a) That denial of the zone change would totally disregard the past
activity on-site since 1955, as a non-conforming use.
b) That the landscaping required by the conditions of approval are
reasonable as a buffer which recognizes the adjoining single
family residences as wel l as the long term use of the land for a
variety of uses.

a) COUNTY PIANNING DEPARTMENT
1 The following conditions are required to be complied with upon
approval of the zone change
A) That a mix of evergreen and deciduous trees be planted
along the north, east and south property lines
B) That a 5-foot landscape strip be provided along Ella Road
and Harrington Avenue
C) That the existing fence be modified as necessary to be
sight-obscuring except at access points and the clear-view
triangle at the intersection
2. That complete compliance with the 1-2 Zone standards is required
wi th the i ssuance of the next bui 1 di ng permi t for any structure
on thi s si te
3 A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Admi nistrator shal l be submi tted wi th a performance bond for the
project pri or to rel ea se of bu i 1 di ng permi ts Landscapi ng shal l
be installed and maintained such that sight distance at access
points is not obscured or impaired.
4 The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Comni ttee Vari ations when approved by the Zoni ng Admi ni strator
will be permitted, including, but not limited to the following
changes Building location, landscape plans, and general
allowable uses of the permitted zone. A11 variations must
conform to regulations set forth in the ZONING CODE FOR SPOlCANE
COUNTY The original intent of the development plans shall be
maintained

7 That the pro3 ect is sub3 ect to Section 7 06, the Aquifer
Sensitive Area Overlay Zone of the ZONING COOE FOR SPOKANE
COUNTY, which sets forth various measures for Aquifer
protection, specifically, measures dealing with wastewater
disposal, spi l l protecti on measures, and storniwater runof f
8 That the present proposal is not detailed enough to determine
whether ornot the use of or materials stored on the site are in
compliance with Section 7.06 (Aquifer Sensitive Area Overlay
Zone) of the ZONING CODE FOR SPOKANE COUNTY. Accordingly, as a
condition of approval, the sponsor/appl i cant shall be required
to fi1 e wi th the Spokane County Audi tor, wi thi n thi rty (30) days
of the si gni ng of Fi ndi ngs and Order of the fi nal deci si on in
this matter, a"Notice to the Public" which shall provide in
material as follows

b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit
1 Applicant shall dedicate 5 feet on Narrington Avenue for
ri ght-of-way pri or to any use of the property
2 Applicant shall dedicate 10 feet on Ella and a 20 foot radius on
Ella Road and Harrington Avenue for right-of-way prior to any
use of the property
3 Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer
4. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans.
5 The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire pro3ect or portion thereof, if development
is to be phased
6 A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design,
location, and arrangement of parking stalls shall be in
accordance wi th standard traffic engi neeri ng practices. Pavi ng
or surfacing as approved by the County Engineer, will be
requi red for any porti on of the project whi ch i s to be occupi ed
or traveled by vehicles
7 The word "applicant" sha11 include the owner or owners of the
property, his heirs, assigns, and successors
8 The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer
9 The County Engineer has designated Typical Roadway Section
Humber One, Access Street standard for the improvement of Ella
Road which is adjacent to the proposed development This will
require the addition of approximately 8 feet to 10 feet of
asphalt, curb and sidewalk along the frontage of the
development
10 The County Engineer has designated typfcal Roadway Section
Number One, Access Street standard for the improvement of
Harrington Avenue which is adjacent to the proposed
development This Mill require the addition of approximately 11
feet to 14 feet of asphalt, curb and sidewalk along the frontage
of the development.

11 All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/ar
adopted resolutions pertaining to Road Standards and Stornrwater
Management in effect at the date of construction, unless
otherwi se approved by the County Engi neer.
12 Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Conmissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal
13. No constructi on work i s to be performed wi thi n the exi sti ng or
proposed public right of way until a permit has been issued by
the County Engineer. All work within the public road right of
way i s subject to f nspecti on and approval by the County Engi neer.
14 Al l requi red constructi on wi thi n the exi sti ng or proposed publ ic

building permit A bond in the amount estimated by the County

be approved by the Spokane County Engineer prior to the issuance
of any on-site sewage disposal permit or building permit for

Utilities, Spokane County.
3 Sub3ec t to specific application approval and issuance of permits

materials. It is recortmended that the applicant contact the

and containment requirements prior to the issuance of any
building permit
3 Any proposed conditions relating to building location, design,
and occupancy shall be reviewed by Building and Safety for
compliance with the Uniform Building and Fire Codes prior to
finalization of action

4 No change shall be made in the character of occupancies or use
of any building which would place the building in a different
division of the same group of occupancy or in a different group
of occupancies, unless such building is made to comply with the
requirements of County codes for such division or group of
occupancy.
5 Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or non-protected eaves
6 Depending on the extent of existing water mains and hydrant
1 ocations, fi re hydrants which meet the mi nimum fi re fl aw
requirements as enumerated in Chapter 6, Title 3 of the Spokane
County Code, may be required to be installed prior to any
construction
7. Approved numbers or addresses shall be placed on all new and

The site is generally located at the northeast corner of Marrington
Avenug and Ella Road in Section 15-25-44
II SITE ANALYSIS
Comprehensive Plan
URaAN Category
- Inside General Sewer Service Area (GSSA) Boundary
- Inside Priority Sewer Service Area (PSSA) Boundary
- Inside Urban Impact Area (UTA) Boundary
The project is located wiithin the Urban category with Industrial adjacent
to the west The Urban category of the Comprehensive Plan indicates light
industrial, and neighborhood commercial will be located near the heavily
traveled streets gtany uses may require screening or other performance
standards to make them compatible with one another The existing
residences will most likely continue for some time into the future, and
new high density projects would be consistent with the Comprehensive Plan
as possible future uses

The property has been zoned Agricultural Suburban since 1956,
however, it has been used with non-conforming status for a variety of
uses and has so been recognized by the Planning Oepartment This is
based upon a letter dated June 7, 1979, which indicated the property
was used for the manufacture of septic tanks and drainfields from
1949 to 1955, while zoned Unclassified
As stated above, single family residential borders the site on three
sides, and, therefore, some buffering as a transition between the two
uses should be provided
The I-2 Zone requires outside storage areas be sight-obscuring,
fenced not less than 6-feet in height and to a height to screen the
storage areas Also required is a 20-foot landscape screen, with
evergreen trees bei ng i nstal l ed wi thi n the 5-feet nearest the
property line Trees are to grow together within three (3) years
And, lastly, that storage uses comply with setbacks of the zone,
which are the same for structures

The Planning Department recommends that all of the above standards be
complied with, if the zone change is approved, except strict
compliance with the 20-foot landscape strip It is recommended that,
based upon the present use of the property, that the trees be planted
and maintained with a sprinkler system, but that the width of the
strip be reduced from 20-feet to 10-feet, until additional structures
are placed on the property, then the strip be increased as required
by the I-2 Zone A minimum 5-foot landscape strip is required along
Ella and Harrington and also should be installed now as a condition,
if the zone change is approved

An Envirornnental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department The review considered
the specifics of the proposal, other available information, County
ordinances, other regulations and laws, possible standard Conditions
of Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines The Zoning Administrator has determined
that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Determination of
Non-Si gni f i cance ( "DNS")
The "DNS" was circulated to eight other agencies of jurisdiction and
other agencies/departments affected by the future development for
review and comment The "DNS" comment period ends October 1, 19869
and was advertised 15 calendar days before said date in the
newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on the proposal site
The Hearing Examiner Committee may consider additional environmental
related testimony and the "ONS" at the public hearing

defined in the Comprehensive Plan Text, if properly buffered to
adjacent residential uses, as discussed in the Land Use section of
this report Based upon the above, the Planning Department
recommends approval of this zone change request
VI CONDITIONS OF APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors )
a) COUNTY PLANNING DEPARTMENT
1 The following conditions are required to be complied with upon
approval of the zone change
A) That a mix of evergreen and deciduous trees be planted
along the north, east and south property lines
6) That a 5-foot landscape strip be provided along Ella Road
and Harrington Avenue
C) That the existing fence be modified as necessary to be
sight-obscuring except at access points and the clear-view
triangle at the intersection
2 That complete compliance with the I-2 Zone standards is required
with the issuance of the next building permit for any structure
on this site
3 A specific landscape plan, planting scheduie and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
