COMMITTEE FINDINGS AND Q,RDER, A INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on February 4, 1988, and the members of the Committee present being Jim Schurra, Chairman, and Ron Odell Phillip D Hanis withdrew because of a possible conflict of interest B PROPOSAL The sponsor, Charles E Simpson, is requesting approval of a zone reclassification, File No ZE-48-86, Agricultural to Neighborhood Business (B-1) Zone, for the purpose of retail and continued residential use Also, for a variance, File No VE-112-87, to allow a Neighborhood Business (B-1) Zone to be located approximately 160 feet from another B-1 Zone whereas Section 6 24 310 of the Zoning Code requires a separation of at least 2,640 feet between B-1 Zones C FINDINGS OF FACT 1 That the existing land use in the area is single family residences, apartments store engineering/surveying office and vacant 2 That the Comprehensive Plan designates this area as appropriate for MAJOR COMMERCIAL development 3 That the existing zoning of the property described in the application is Agricultural 4 That the provisions of RCW 43 21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Determination of Non-S ignificance S That the proper legal requirements for advertisement of the Agenda Item have been fulfilled 6 That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification 1 . - C FINDINGS OF FACT ZE-48-87 & VE-112-87 7 That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is justified 8 That the proposed use is compatible with existing uses in the area 9 That the owners of adjacent lands expressed neither approval nor disapproval of the proposed use 10 The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare 11 The following are additional findings of fact considered by the Hearing Examiner Committee a) That due to the uniqueness of the site and the fact that it has a preexisting use as non-conforming, the Hearing Examiner Committee does hereby direct the Zoning Administrator to use some flexibility in implementing the Neighborhood Business (B-1) standards as stated in Planning Condition #7 b) That the Hearing Examiner Committee concurs with the "Planning Summary" statements regarding the appropriateness of the zone change and variance request D('ONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL (All Conditions imposed by the Zoning Hearing Examiner Committee shall be binding on the "Applicant", which term shall include the owner or owners of the property, heirs, assigns, and successors ) a) COU N TY PLAN N IN G DEPARTMEN T Standard 1 Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits 2 A specific landscape plan, planting schedule and provisians for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits Landscaping shall be installed and maintained such that sight distance at access points is not obscured or impaired 3 The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permits 2 . ~ D('ONDITIONS OR CONTIIVGENCIES ZE-48-87 & VE-112-87 a) COUNTY PLANNING DEPARTMENT 4 All current standards of the Neighborhood Business (B-1) Zone, as amended, shall be complied with in the development of this s ite 5 That the present proposal is not detailed enough to determine whether or not the use of or materials stored on the site are in compliance with Chapter 4 16A (Aquifer Sensitive Area Overlay Zone) of the SP4KANE COUNTY ZONING ORDINANCE Accordingly, as a condiuon of approval, the sponsor/applicant shall be required to file with the Spokane County Auditor, within thirty (30) days of the signing of Findings and Order of the final decision in this matter, a"Notice to the Public" which shali provide in material as follows PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROVISIONS OF SPOKANE COUNTY ZONING ORDINANCE CHAPTER 4 16A (AQUIFER SENSITIVE AREA OVERLAY ZONE) THE PROPERTY WHICH IS THE SUBJECT OF THIS NUTICE IS MORE PARTICULARLY DES CRIBED AS FOLLOWS " 6 Any division of land for the purpose of sale, lease or transfer, shall comply with RCW 58-17 and the Spokane County Ptatting Ordinances prior to issuance of building permits S peci al 7 That the portion of the site devoted to business uses shall comply with the Neighborhood Business (B-1) Zone standards no later than May 15, 1988 T6e remainder of the site shall comply at the time the existing use change to a B-1 use This condition shall provide some discretion to the Zoning Administrator but at a minimum shall include five (5) feet of landscaping along Argonne, paved parking and sign compliance 8 Applicant shall comply with ' 208' recommendations concerning stormwater runoff and provide necessary landscaping for runoff This may be phased as required in Condition #7 above b) COUNTY ENGINEERING DEPARTMENT Pnor To The Issuance Of A Buildine Permit Or Use Of The Proaertv As Proaosed S tandard 1 Access permits for approaches to the County Road S ystem shall be obtained from the Spokane County Engineer 3 . ~ D C'ONDITIONS OR CONTINGENCIES ZE-48-87 & VE-112-87 b) COUNTY ENGINEERING DEPARTMENT 2 Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans 3 The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health Disuici a detailed combined on-site sewage system plan and surface water disposal plan for the entire project or any portion thereof, if the development is to be phased 4 A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles 5 The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer 6 All required improvemeots shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction, and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer 7 Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners' Resolution No 80-1592 as amended and are applicable to this proposal 8 No construction work is to be performed within the existing or proposed public right of way until a permit has been issued by the County Engineer AlI work within the public road right of way is subject to inspection and approval by the County Engineer 9 All required construction within the existing or proposed public right of way is to be completed prior to the release of a building permit or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements shall be filed with the County Engineer S pecial 10 Applicant shall dedicate 10 feet on Cataldo and a 20 foot radius on Argonne and Cataldo 4 D CONDITIONS OR CONTINGENCIES ZE-48-87 & VE-112-87 b) COUNTY ENGINEERING DEPARTMENT 11 The County Engineer has designated Typical Roadway Section Number One, Access Street standard for the improvement of Cataldo Avenue which is adjacent to the proposed development This will require the addition of approximatcly 10 to 12 feet of asphalt along the frontage of the development Curbing and sidewalks must also be constructed c) COUNTY UTILITIES DEPARTMENT Standard 1 Pursuant to Board of County Commissioners Resolution No 80- 0418, the use of on-site sewer disposal systems is hereby authorized This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District 2 The Owner(s) or S uccessor(s) in Ynterest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36 94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36 94 which includes the Owner(s) property PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36 94 3 Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County as amended S pecial 4*Each new structure or change in occupancy shall be double plumbed for connection for future area-wide collection systems *Only applies if modifying existing sewer system d) COUNTY HEALTH DISTRICT S tandard 1 Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County 5 D CONDITIONS OR CONTINCENCIES ZE-48-87 & VE-112-87 d) COUNTY HEALTH DISTRICT 2 Water service shall be coordinated through the Director of Utilities, Spokane County 3 Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services 4 Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on-site sewage system may be authorized 5 Use of private wells and water systems is prohibited e) COUNTY BUILDING AND SAFETY DEPARTMENT S tandard 1 The site is located in Fire District #1 2 No change shall be made in the character of occupancies or use of any building which would place the building in a different division of the same group of occupancy or in a different group of occupancies, without first obtaining a change in use permit from the Department of Building and S afety S pecial 3 A building permit was issued on October 28, 1985, for interior remodeling of the grocery store Proper inspections have been made f) WATER PURVEYOR 1 Water Purveyor is Hutchinson Irrigation District #16, and they will supply the site with adequate water for domestic, fire and irrigation uses g) COUNTY AIR POLLUTION CONTROL AUTHORITY All air nolludon reeulations must be met This includes but is not limited to the followin e 1 Air pollution regulations require that dust emissions during demolition, excavation and construction projects be controlled This may require use of water sprays, tarps, sprinklers, or suspension of activity during certain weather conditions Haul roads should be treated and emissions from the transfer of earthen material must be controlled as well as emissions from all other construction related activities 6 D ONDITIONS OR CONTINGENCIES ZE-48-87 & VE-112-87 g) COUNTY AIR POLLUTION CONTRUL AUTHORITY 2 Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces 3 All travelled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean 4 SCAPCA Regulation I, Article VI and SCAPCA Regulation II, Article IV addresses emission standards All emission standards must be met 5 Demolition and renovation projects must coraply with the requirements of CFR 40 Part 61, Subpart M Intent to Demolish and Renovate forms are available at the S CAPCA office 7 • QgD-Eg ZE-48-87 & VE-112-87 The Zoning Hearing Examiner Committee, pursuant to the aforementioned, finds that the application of Charles E Simpson for a zone reclassification and variance as described in the application should be APPROVED to the Neighborhood Business (B-1) Zone Motion by Ron Odell Seconded by Jim Schurra Vote (2-0) UNANIMOUS TO APPROVE TO Department supports the variance request to atlow Neighborhood Business (B-1) zoning within 1/2 mile of another B-1 or Local Business Zone This B-1 Zone would provide for a smoother transiaon for the more intensive areas between Mullan and Argonne westward to the residential areas Granting the variance does not authorize a use otherwise prohibited and does not constitute a granting of special policies and guidelines The Zoning Administrator has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Detenrunaaon of Non-Significance ("DNS IV SEPA ENVIRONMEN"_rAr, ttFVTFw ZE-48-87 & VE-11Z-87 The "DNS" was circulated to eight other agencies of jurisdiction and other agencies/departments affected by the future development for review and comment The "DNS" comment period ends February 3, 1988, and was adverased 15 caleadar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site The Hearing Examiner may consider additional environmental related tesnmony and the "DNS" at the public hearing V PLANNINC
