This is a Planning Department inspired variance request, insofar as
the preferred zon ing on the west side of Argonne is 1 ower t ntens i ve
offices and businesses, typical of the Neighborhood Business (B-1)
Zone, in order to make a smooth transition fron the more intensive
areas between Mullan and Argonne westward to the residential areas
Granting the variance does not authorize a use otherwise prohibited '
in this zone. With conditions of approval the variance does not
constitute a granting of a special privilege inconsistent with .
limitations on other properties in this vicinity and similar zones

The purpose of the Planning Department inspired variance is to ensure
that the intent and purpose of the Zoning Ordinance is achieved with
regard to sight design, appearance and landscaping The net effect
of granting the variance is to protect and ensure the public's
interest and general welfare The location of the property on the
west side of the Mullan-Argonne Corridor is one of the special
circumstances recognized in the State and local laws as a variance
criteria. This property at this location when combined with the
half-mile standard of the Zoning Ordinance creates practical

historical trend of the Corridor's development

planned to be screened by a 6' fence. The garage may need to be
reaoved to accomodate some erttergency veh ic 1 es as we 11 as heavy
equipment necessary to pave the parking lot at the rear of the site.
Other Site Plan Considerations Except for the parking lot, the site
will remain as is with only interior changes.

IV. SEPA ENYIRONMENTAL REYIEW
An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department The review considered
the specifics of the proposal, other available information, County
ordinances, other regulations and laws, possible standard Conditions -
of Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines The Zoning Administrator has determined
that "No geing robable significant adverse impacts" would result from the proposal developed and has issued a Determination of
Non-Significance ("ONS").
The "DNS" was circuiated to ten other agencies of jurisdiction and
other agencies/departments affected by the future development for
review and conment. The •DNS" comment period ends November 4, 1987,
and was advertised 15 calendar days before said date in the
newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on the proposal site.
The Hearing Examiner Coraraittee may consider additional environmental
related testimony and the "DNS" at the public hearing.
V. PLANNING SUNaIARY
The proposed Neighborhood Business (B-1) Zone is consistent with the
Major Commercial and Urban categories of the Comprehensive Plan
Zone change activity along the west side of Argonne has been slow in
the past because of water service limitations. The zoning trend
within this area has primarily been more intense within the one-way
roads with Residential Office, Mu1ti-Family Suburban, Urban
Residential-22, Local Business and now Neighborhood Business (8-1)

conform to regulations set forth in the ZONING COOE FOR SPOKANE
COUNTY. The original intent of the development plans shall be
maintained.
3. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building

4. That the project is subject to Section 7 06, the Aquifer
Sensitive Area Overlay Zone of the ZONING CODE FOR SPOKANE
COUNTY, which sets forth various measures for Aquifer
protection, specifically, measures dealing with wastewater

STANDARD

1. Pursuant to Board of County Comnissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
appl ication approval and issuance of permits by the Health
District.
2. The Owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36 94

d) COUNTY HEALTH OISTRICT
STANDARD
1. Sewage disposal inethod sha11 be as authorized by the Director of
Utilities, Spokane County.
2. Water service shall be coordinated through the Director of
Utilities, Spokane County.
3. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
4. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
5. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an individual on-site sewage
disposal system may be authorized.
6. Any critical material user sha11 meet the requirements of the
Aquifer Sensttive Area Overlay Zone Ordinance, andy any critical ~
waste roaterials generated shall be under the jurisdiction of the
Department of Ecology.
7. Use of private wells and water systems is prohibited.
e) COUNTY BUILOING AND SAFETY DEPARTMENT
1. The site is located in Fire District #1.
2. 7he Department of Building and Safety will require the applicant
to identify critical materials and submit design requirements
for the contairnnent prior to the issuance of a building permit.
3. The applicant shall provide verification from the Fire District
to the Department of Building and Safety that provisions have
been made for adequate fire protection prior to the release of
bui lding permits
4. Fire apparatus access roads shall be provided and maintained in
accordance with the provisions of Section 10 207 of the Uniform
Fire Code or as per requirements of the Fire District Chief
5. Exterior walls of any existing or proposed buildings shall have
fire resistance and opening protection from the property line as
set forth in the Uniform Building Code

This matter having come before the Zoning Hearing Examiner Committee on
November 5, 1987, and the members of the Conunnittee present being Phillip
D. Narris, Chairman, and Jim Schurra and Ron Odell
B PROPOSAL
The sponsor, Bi11 Adams, is requesting approval of a zone
reclassification, File No ZE-48-87, AGRICULTURAL to NEIGHBORHOOD BUSINESS
(B-]) Zone, for the purpose of developing a photography studio Also, a
request for a variance, File No. VE-93-87, TO ALLOW NEIGNBORNOOD BUSINESS
ZONE WITNIN 112 MILE OF ANOTNER NEIGHBORHOOD BUSINESS UR LOCAL BUSINESS
ZONE.
C FINUINGS OF FACT
1 That the existing land use in the area is single family residential
and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
MAJOR COMMERCIAL and URBAN development.
3. That the existing zoning of the property described in the application
is Agricultural
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Determination of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
I tem have been f u 1 fi11 ed.
6. That the land use in this area is suitable for the proposed use, or
uses within the proposed Zone Classification
7 That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and

a) That the proposal is consistent with the Comprehensive Plan and
land use trends within the Argonne-Mu11an Corridor
b) That the variance request meets the criteria for approval as
discussed in detail within the Planning Department Report dated
November 5, 1987.

a) NEARING EXAMINER COMMITTEE
1. That the details of parking area location and necessary
landscaping to buffer the parking area, shall be as approved by
the Zoning Adrninistrator. Every attempt sha11 be made to retain
the residential appearance of the site.
2. That landscaping within the front yard setback area and along
the north property line sha11 be a visual buffer but not
intended to provide a visual screen. Landscaping within these
areas shall comply with the clear-view triangle standards
3. That should the Zoning Administrator and applicant not be able
to resolve the above conditions, this matter shall be resolved
by the Hearing Examiner Committee at a public hearing.
