1'his matter having came before the Hearulg Exanuner Comnuttee on July 20, 1989,
and the members of the Committee present being Jane Myers, Chauperson, Ron
Odell and John Skadan

The sponsor, VVAIVI Enterpnses, requests approval of a zone reclassificanon and
change of cond.iaons, Ffle No ZE-25-89 and ZE-84A-85, for the purpose of
reclassifying the zoiung from Agncultural (A) to Community Business (B-2) for retail
or office use and a change of conditions for an existing Commercial zone to modify
the approved site plan and condiuons of approval.
FINDINGS OF F'ACT AND CONCLUSIONS
1. The property is generally located on the block bounded by 1Viission and Smto
Avenues and Argonne and 1Viarguente Roads ui the northeast 1/4 of Section 18,
Township 25 North, Range 44, E W.1VI , Spokane County, Washuigton
2. The committee adapts the Planniag Department Report as a part of this record.
3. The existing land use(s) in the anea are suigle family residential, duplexes, vacant,
and various commercial uses.
4. 1'he Compreheasive Plan designates this site as IViajor Commercial and Urban
5. The existing zonuig of the property described in the apphcation is Agnculun,al
previously estabhshed in 1947 aad Cammercial estabhshed in 1985.
6. The provisions of RCVV 43.21C (I'he State Environmental Policy Act) have been
comphed vvith and a Detenoninataon of Nonsignificance was issued.
7 The proper legal requirements for advcrtisement and notice have been fulfilled.
8. 'I'he owners of adjacent lands eRpressed both approval and disapproval of the
proposed use.
9. The Committee additionally finds that:
a. Aocess to Sinto Avenue firom the zone change par+cel (I.ot 10, Block 1 of
Scaramore Sutdivision) wiIl not have a detnmental impact upon adjoining
property owners since the nwnber of vehicles using said access is lnmited by
square footage of proposed structurc, exisaag lot size, off stneet parking
spaces, and landscaping rea}uuements of the Spokane County Zoning Code,
b. No adjoirung lots or ownership shall acoess Sinto Avenue through the subject
property, and

zone change expands to include the zone change parcel (Lot 10, Block l,

expansion or aggregation should be adnunistratively reviewed by the Plammng
DepardmenL
10. 1'he Committee concludes:
a The proposed use is compadble with exisdng uses in the area,

reclassification and change of condiaons is justified

Scaramore Subdivision. Detached signs for this lot shall be onentated toward the
shopping center located to the north.
5 Approval is requlmd by the Planning Director/designee of a specific hghtmg and
sigmng plan for the descnbed property pnor to the release of any building pernuts
6 The negulations of the Nauonal Flood Insurance Program shall be observed since
the propcpsed plat is affected by aF1oad Hazard Zone. A development permit shall
be obtauied from the (;ounty Engineer before construcaon or development begins

7. The applicant shall develop subject property generally in avcordance within the
concept presented to the Hearing Exanuner Committee. Vanations, when approved
by the Planrung I)irector/designee, will be pernutted, including, but not limited to
builduig location, landscape plans, and general allowable uses of the penrutted
zone. All vanations must conform to regulations set forth in the ZONING CODE
FOR SPOK:ANE COUNTY. The onginal intent of the development plans shall be
maintained.
` 8. Z'he specific development plan will be submitted for Planning Department review
and approval prior tio issuance of builduig percmts.
9. All current standards of the B-2 zone, as amended, shall be comphed with in the
development of this site.
10 The project is subject to Section 14.706, the Aquifer Sensitive Area Overlay Zone
of the ZONING CODE FOR SPOKA1VE COUN'I'Y, which sets forth various
measures for Aquifer protection; specifically, measures deahng with wastewater
disposal, spill prmteceion gneasures, and stormwater runoff.

FINDINGS AND ORDER
A. IPITRODUCTION
This matter hading come before the Zoning Hearing Examiner Committee on
March 6, 1986, and the members of the Comnnittee present being
Jane E. Myers 9 Chai rperson, and Gary Anderberge Mr. Pleraas was not
present to hear all of the testimony on this application; therefore9 did
not vote on the Committee's motione
B. PROPOSAL
The sponsor, Gull Industries9 is requesting approval of a zone
reclassification, File No. ZE-84-85, Agricultural and Local Business to
Commercial, for the purpose of developing a Retail Center.
C o F I PdD I NGS OF FACT
1. That the existing land use in the area is residential, commercial9
bus pick-up (passenger and package)9 and vacanta
2. That the Comprehensive Plan designates this area as appropriate for
Ma,jor Commercial and Urban development.
3e That the existing zoning of the property described in the application
is Agricultural and Local Businesso
4. That the provisions of RCW 43e21C (The State Enviromnental Policy
Act) hade been complied with, and the Committee concurs vuith the
Determination of Pdon-Significance.

C. FINDINGS OF FACT (continued)
l0e The following are additTOnal findings of fact considered by the
Heari ng Examiner Corrami ttee:
a) That the Nearing Examiner Committee is concerned about the
community and its people living within it; and does appreciate
good dedelopments as probably do the neighbors in this area.
b) That the proposal does encroach into a residential area;
thereforea special conditions within this action have been added
to assure that buffering, protection and compatibility can be
maintainede
c) That as conditioned, the existing bus service terminal cannot
expand without a public hearing before the Hearing Examiner
Committee for consideration.
d) That the subject property is within the Argonne-Mullan Corridor
and as such should be allowed to follow the trend for quality
development.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property9 heirs9 assigns, and successorse)
1. Replace Planning Condition Ploo 1 with:
"That the approval of this ione change is for a retail center but
does not allow a tavern, massage parlor or similar uses that may be
offensive. The project is to be developed in substantial conformance
to the site plan. Relocation of the proposed structure may be
alloa►ed if mitigation to adjacent residences to the west and south
can be provided. Any significant changes to the site plan and/o r its
uses shall be rediewed and approved at a public hearing before the
Hearing Examiner Committee.
a. "That no increase in service for the existing bus terminal
service is allowed without approval by the Hearing Examiner
Committee at a public hearing.
b. "That the revised site plan for the Gull Gas Service Station,
dated 3-6-86, and approved by the Hearing Examiner Committee is
hereby allowed, subject to the standards of the Zoning Ordinance
and as conditioned herein."
2. Add to Planning Condition No. 3:
"That noise abatement techniques be utilized within the truck access
lanes, as approved by a professional audiologist to reduce noise
impacts as specified arithin the regulations of the Department of
Ecology."

Add Department of Ecoloqy Condition as follows:
1. "It appears that Hutchinson Irrigation District's water rights a re
not in order, and a permit or permits may be required from the
Department of Ecology. The district should make the necessa ry
applications to the departrment as soon as possibleo"
a) COUNTY PLANNING DEPARTMENT
1. That the approval of this zone change is for a Retail Cente r to
be developed as conditioned by the Hearing Examiner Cort~nittee.
No alterations to the site plan, proposed uses, the existing Gas
Service or the Greyhound Bus Service is alloa►ed without approval
by the Heari ng Exami ner Corr~ni ttee.
2. That landscaping along Mission be increased to at least 10-feet
and along Argonne to a 5-foot strip. Said landscaping to be
provi ded wi thi n the ownershi p of the subject property.
Landscaping within the right of way may be provided but not as a
substitute to the above requirements.
3. That the proposed structure be relocated to the minimum setbacks
at the southwest corner of the property9 and a 6-foot
sight-obscuring fence be provided along the south property line,
r or a residentially decorated 12-foot masonry wall may be
provided along the setback requirement. The yard areas shall be
maintained in tall and low growing landscaping.
4. That should the alternatide for building relocation be desired,
by the applicant, to the minimum setbacks, then the masonry wall
shall be replaced erith a 6-foot sight-obscuring fence along the
south property line and a 3-foot high meandering decorative
masonry wall within the yard area along Marguerite Road.
5. That landscaping be provided adjacent to the structuree
6. That no access be allowed to Marguerite Road from the project.
7. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of
such lighting. (Such plan shall attempt to confine illumination
~ to the area with full consideration to adjacent propertieso)
8. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shalT be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
- be installed and maintained such that sight distance at access
points is not obscured or impaired.

9. The applicant shall develop subject property generally in
accordance within the concept presented to the Nearing Examiner
Committee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable use s of the permitted zoneo All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
be maintained.
10. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
11. All current standards of the Corr~nercial Zone, as amended, shall
be complied with in the development of this site.
12. That the present proposal is not detailed enough to determine
arhether or not the use of or materials stored on the site are in
compliance with Section 7.06 (Aquifer Sensitive Area Overlay
Zone) of the Spokane County Zoning Ordinancee Accordingly, as a
condition of approval, the sponsor/appl i cant shall be required
to file with the Spokane County Auditor, within thirty (30) days
of the signing of Findings and Order of the final decision in
this matter, a"Notice to the Public" which shall provide in
material as follows:

accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.

be approved by the Spokane County Engineer and the Spokane
County Health District prior to the issuance of any building
permi t for thi s project.

3. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an on-site sewage disposal
system may be authorized.
4. Water service shall be coordinated through the Director of
Utilities9 Spokane County.
5. Water service shall be by an existing public water supply when
approded by the Regional Engineer (Spokane), State Department of
Social & Health Services.
6. Use of private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
e) COUtdTY BUILDING AND SAFETY DEPARTMENT
le The site is located in Fire District # 1.
2. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible
and legible from the street or road fronting the property. Said
numbers shall contrast with their background.
3. Reclassification of an existing building shall require an
application for change of occupancy .permit and subsequent
inspection for approval.
4. Due to the sensitive storage requirements over the Aquifer9 and
this site lies within the Waste Water Management area, we feel
that some language should address the possible storage of
flammable or critical materialswithin these structures.
5. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
6. Building permits will be required for each structure.

e) COUNTY BUILDING AND SAFETY DEPARTMEIdT (continued)
7e Fire hydrants which meet the fire flow are required to be
installed prior to any construction. These hydrants shall be
placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of
the hydrant shall be no less than 18 inches above grade. A
water plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10.04 of the Uniform Fire Code is required prior to
construction of the water service. All required fire protection
facilities shall be installed and made serviceable prior to and
during the time of construction.
8. The Building & Safety Department is hereby informing the sponsor
that depending upon the materials used in construction, adequate
fire flows may not be available adjacent to the site. Adequate
water service is available within an adjacent water district.
Annexation would be required to obtain water service from Modern
Electric Water Coe or adequate extensions of water service is
required to the site from Hutchinson Irrigation District #16.
f) WATER PURVEYOR
lo Water Purveyor is Hutchinson Irrigation District #169 and they
arill supply the site with adequate water for domestic, fire and
irrigation uses. Satisfactory arrangements have not been made
to serve this proposale
g) COUNTY AIR POLLUTION CONTROL AUTNORITY
All air pollution regulations must be met. This includes but is not
limited to the following:
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of actierity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2e Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
invmediately to clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.

4. Some objectionable odors will likely result during the
construction phase of the project and from motor vehicles using
the site following completion of the project and from occupants
of the proposed project.
5. Demolition and renovation projects must comply with the
requirements of CFR 40 Part 61, Subpart M. Intent to Demolish
and Renovate forms are available at the SCAPCA office.
E. ORDER
The Zoning Hearing Examiner Comittee, pursuant to the aforementioned,

There seem to be some inconsistencies between the approve,.
str^eet plan5 for, the above mentioned pr,o.ject and the "E/15/90 upuAre
punch list". Item #i on this punch list says ta move power pole
located in sidewalk at Sta. 29+25 on Marguerite Road, however, the
stationing on Marguerite Road runs fr-om Sta. 44+E9.27 to Sta.
51+30.94. Item #3 on this punch list says - Need to finish curb,
sidewalk, and road widen on Sinto Ave. from asbuilt Sta 21+49.5 tc,
pre plans Sta. 21+03.5 however,, the plans were revised as we

(Safeway), retail store (Pay N Save), speculative retail
space, and additional speculative retail space loeated near
Building No 3 Tatal square footage of the proposal will

I Planning Department (456-2205)
A Discussion/Requirements
1 Since the site inccarporates quite a few lots,
it was suggested that the lots be aggregated
into one lot which will require a Certif icate
of Exemption being f iled with the Planninq
Department
2 The site is subject to 3 separate zone b- "
changeso file numbers ZE-84-85, ZE-28-88o and
ZE-49-88 All of the conditions of these
zone changes are to be met It was also
stated that there is one zone change
application pending on Lot 10

3 The site is located in the Aquifer Sensitive
Area (ASA) and the provisions of the ASA must
be met A critical materials listing shall
be completed This list will be supplied by
Building and Safety and should be returned to
them f or review
4 A specific lighting and signage plan shall be
submitted for review and approval.
5. Regarding parking, the site plan i3.ltastrated
436 parking stalls Only 400 parking stal.].s - are (base1d on 80% retail, which is computed
as 1 space per 200 square feet of floor area
and 20% storage, computed as 1 space peg 2000
square feet of floor area) required. Paxtial
use og the building can be classified as ,

of floor area is in excess of 1,000 square

2 Regarding Right-of-Way dedications, 10 feet
along Sinto and a 20 foot radius at Sinto and
Argonne per ZE-28-88, 5 feet along Sinto per
ZE-49-88, a 30 foot at Mission and Argonneo a
20 foot radius at Marguerite and Mission and
a 10 foot Right-of-Way along the frontage of
Marguerite A copy of a recorded property
deed for the site needs to be submitted
(The Right-of-Way dedication is also
explained in the Engineer's section of the
zone change conditions)
• 3 Street improvements shall be made to Mission
Avenue, Marguerite Road, and Sinto Avenue

final disposition of the existing sewage
systems shall be completedo When found, the

SECTION 11 - HEADINGS
The article headings in this agreement have been inserted solely for the
purpose of convenience and ready reference. In no way do they purport to, and
shall not be deemed Co, define, limit or extend the scope or in`en -)f the
articles to which they appertain.
SECTION 12 - ALL WRITINGS CONTAINED HEREIN
This agreement contains all the terms and conditions agreed upon by the
parties. No other understandings, oral or otherwise, regarding the subject
matter of this agreement shall be deemed to exist or to bind any of the parties
hereto. The Licensee has read and understands all of this agreernent, and now
states that no represeritation, promise, or agreement not expressed in this
agreement has been made to induce the Licensee to execute the same.
