Land uses in the area are primarily business along the Sprague Avenue
cammercial corridor and residenrial uses north of the corridor. Business uses
range from low intensity office uses to large neta~l centers. D~rectly to the east and
narth of the proposal are single family nesidences. Design features including landscaping and lightinng plans will be required to mitigate impacts to the adjacent
residences.
G. Circulation; The site currently has access to both Sprague Avenue and Bolivar
Road. The site plan submitted for review illus~rates one access point to Sprague
Avenue.
H. Design: The applicant has proposed a 2,760 square foot retail building for auto
accessories sales and installarion. All internal parking and travel a~~eas will be

the minimum requirements of Chapter 14.80b.040. Minimum landscaping
requirements must be met prior to issuance of building pemuts.

III. ENVIRONMENTAL REVIEW:
An Environmenta~ Checklist was submitted by the sponsor and was reviewed by the
County Planning Department, The review considered the speci~cs of the proposal,
other available information, County ordinances, other regularions and laws, possible standard Condirions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has detennined that "No
probable signi~icant adverse impacts" wou~d result from the pnaposal being developed
and has issued a Determination of Nonsigni~icance ("DNS").
The "DNS" was circulated to 13 other agencies of jurisdiction and other
agencies/departments affected by the future development for review and commen~
The "DNS" comment period ends August 1 b,1994 and was adverrt~sed 15 calendar days before said date in the newspaper, by letter to adjacent property owners within
400 feet of the proposal, and by notice on a sign posted on the proposal site. The

IV. FLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
The zone reclassi~ication is generally consistent with the develapment standards of the
Regional Business (B-3) zone, the Goals, Objecaves, and Decision Guidelines of the
Major Commercial category of the Comprehensive Plan, and is compatible with
existing land uses in the area. Landscaping buffers and other design featunes required
by the Zoning Code provide measures to mirigate impacts to the adjacent residenrial
uses. The Planning Department recommends approval, as conditioned.
V. CONDITIONS OF APPROVAL
i. All conditions imposed by the Hearing Examiner ~ommittee shall
be binding on the "Applicant~', which terms shall include the
owner or owners of the property, heirs, assigns and successors.
Il. The zone reclassification applies to the following real property:
Lot 7 of the Ptat of Zeigler's Subdivision, as recorded in Plat
Book 2, Page 8, Records of Spokane County, Washington.

~ 1. The proposal shall comply with the Regional Business (B-3) zone and the Aquifer
Sensl~ve Area tASA) zone, as amended. Modlficat~ons to the site plan at building
permit stage appear to be necessary to comply with all Regional Business (B-3)
development standards.
2. The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning DirectorJdesignee, may be permitted, includ.ing, but not limited to building
loca~on, landscape plans and general allowable uses of the pernutted zone. All
variarions must conform to regulations set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintained
3. Approval is required by the Planning Director/designee of a specific lightinng and
sign~ng plan for the descr~bed property pnor to the release of any bu~ld~ng perm~ts.
4. A speci~c landscape plan, pianting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the project prior to release of building permits. La.ndscaping shall bz
~nstalled and ma~ntau~ed so that s~ght d~stance at access po~nts ~s not obscured or impaired.

6. The Spokane County Planning Department shall prepare and necord with the
County Auditor a Title Notice specifying a future land a~cquisition area for road right~of way and utilities. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Planning Departmen~ The norice should be
~ recorded within the same time fr~ame as an appeal and shall provide the following:
a. At least 10 feet of reserved future acquisirion area for road right-of-way and
urilities, in addition to the existing and/or newly dedicated right-of-way along
Sprague Avenue.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisirion area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
u~lities. If any of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisirion area, unril acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drain~ield, signs or others) sha11 be
considered interim uses.
e. The property owner shall be responsible for relocatinng such "interim"
improvements at the rime Spokane County makes roadway improvements
after acquiring said future acquisition area.
7. The Planning Department shall prepare and record with the Spokane County
Auditor a Tit1e Norice noting that the property in question is subject to a variety of special condirions imposed as a result of approval of a land use acrion. This Tit1e
Norice shall serve as public norice of the condi~ons of approval affecring the
~ property in quesrion. The Title Notice should be recorded within the same rime
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Noace shall generally provide as follows:
