PROPOSAL
The sponsor, Ronald McCloskey, requests approval of a zone reclassification from
Agncultural Suburban (AS) to Urban Resident►al-22 (UR-22), File No ZE-12-90
for the purpose of developing two single story office buddings at 10,000 sq ft each
FINDINGS OF FAC'g' AND CONCLiJSION5
1 The property is generally located m the Spokane Valley, east of Park Road at the
northwest corner of Broadway Avenue and Ella Road in Section 18, Township 25
N, Range 44 EWNi, Spokane County, Washington
2 The commrttee adopts the Planning Department Report as a part of this record
3 The existing land uses in the area are single and multiple fanuly residential, Park
Junior High School and office buildmgs
4 The Comprehensive Plan designates this site as Urban The Urban category is for the
purpose of developmg a vanety of uses, includuig residennal densities, and office
uses along heavily traveled streets The Industnal category hes immediately south of
Broadway, and as these occur, the proposed uses could serve as a good transition for
land use compatibihty
5 T'he Artenal Road Plan designates Broadway Avenue as a Pnncipal Artenal, wnth a
recommended nght of way wulth of 100 feet The County Engineer is not requesting
addiuonai nght of way but has indicated a need to set aside 22 5 feet for future
acquisition building setbacks are to be measured from the future acquisiaon area
6 The existing zoning of the property descnbed in the apphcation is Agncultural
Suburban (AS) previously estabhshed in 1959
7 The provisions of RCW 43 21C ('The State Envuonmental Pohcy Act) have been
comphed with and a Detercrunanon of Nonsignificance was issued
8 The legal requirements for pubhc notice have been fulfilled
9 The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use
10 The proposed use is compatible with exisnng uses in the area
11 The proposed zoning does implement and conform to the Comprehensive Plan

acceptable to the Plammmg Dmctor/designee shall be subnutted vnth a perfonnance
bond for the project pnor to release of buflchng pemuts Landscapuig shall be
installed and maintained such that sight dhstance at access points is not obscured or
unpau~ed
3 The apphcant shall develop subject property generally in accord.ance wnthin the
concept presented to the Heanng Exarniner Comnuttee Vanations, when approved
by the Planning Duwtor/designee, wfll be pertrutted, including, but not hnuted to the
followmg changes builduig location, landscape plans, and general allowable uses of
the pernutted zone All vanations must conform to regulations set forth in the
ZONING CODE FOR SPOKANE COUNTY The onguial intent of the development
plans shall be mauitained.
4 The specific development plan wnll be subnutted for Planning Department review and
approval pnor to issuance of building pernuts
5 All current standards of the Urban Residential-22 Zone, as amended, shall be
comphed with in the development of this site
6 The present proposal is not detailed enough to detemune whether or not the use of or
matenals stored on the site are in compliance with Section 14 706 (Aquifer Sensitive
Area Overlay Zone) of the ZONIlVG CODE FOR SPOKANE COUNTY
Accordingly, as a condiuon of approval, the sponsor/applicant shall be required to file
with the Spokane County Auditor, within thirty (30) days of the signing of Findings
and Order of the final decision in this matter a' Notice to the Public" wluch shall
provide in matenal as follows

OF OCCUPANCY FOR ANY BUILDING OR ANY USE ON THE PROPERTY
DESCRIBED HEREINAFTER THE APPLICANT SHALL BE RESPONSIBLE
FOR COIVIPLYING WITH THE PROVISIONS OF THE ZONING CODE FOR
SPOKANE COUIVTY SECTION 14 706 (AQUIFER SENSITIVE AREA
OVERLAY ZONE) THE PROPERTY WHICH IS THE SUBJECT OF THIS
NOTICE IS MORE PARTICULARLY DESCRIBED AS FOLLOWS
7 Landscapung shall be provided for this site, in conformance with Standards as
idenafied in Seceon 4 07A 120 Landscaping of the SPOKANE COUNTY ZOIVING
ORDINANCE
8 A 6-foot sight-obscunng cyclone fence shall be provided along the north and west
property lunes of this proposal to provide a buffer for the exisang school and
residential uses A comparable substitute to the cyclone fencmg may be approved by
the Planrung Duector/designee
9 Apphcant shall comply wnth '208' recommendations concerning stonnwater runoff
and provide necessary landscaping for runoff
10 Any division of land for the purpose of sale, lease or transfer, shall comply with
RCW 58 17 and the Spokane County Platang Orduiances pnor to issuance of
budding permits
11 The applicant shall comply with all agency's regulations as amended pnor to issuance
of builduig penruts
12 Spokane County Plannuig Department is requued to record with the County Auciitor a
"Tide Notice," as prepared and signed by the applicant, for a future acquisidon area
for road nght-of-way and utihaes to run with the land, and the future acquisiuon area
reservation shall not be removed without pnor approval by the Spokane County
Planrung Deparnnent Noace shall be recorded pnor to the issuance of a biulduig
pernut and shall provide the following
a 22 1/2 feet of future acquisition area for road nght-of-way and utihties along
Broadway Avenue
b Building and other setbacks requu~ed by the Spokane County Zomng Code shall
be measured 25 from the north edge of the Future Acquisition Area that is
reserved for road nght-of-way and utihties along Broadway Avenue
c The following nunlmum unprovements necessary to support the use within the
zone classification as reyuued by the Spokane County Zoning Code standards
should not be located within the Future Acquisition Area

The property owner shall be responsible for relocaung such intenm
unprovements at the time Spokane County makes roadway unprovements after

e Ttus "Title Notice" shall be signed by the apphcant to serve as official noace and
acknowledgement of said Future Acqwsinon Area for road nght-of-way and
utihties
13 The Spokane County Planrung Department shall prepare and record wnth the Spokane
County Auditor a"Title Notice noting that the property in question is subject to a
vanety of special conditions unposed as a result of approval of a land use action
This ' Tide Noace" shall serve as official pubhc noace regarding condiuons of
approval affecting the property in quesaon The Tide Notice' shall be recorded
wnthin fifteen (15) days of final disposiaon of the approved land use action and shall
only be exnnguished by the Spokane County Planning Department. The Title
Noace" shall generally provide as follows

Pnor To The Issuance Of A Building Permit Or LTse Of The Pronertv As Prouosed
1 The apphcant shall dedicate 5 feet on Ella Road and a 30 -foot radius on Ella Road
and Broadway Avenue
2 Access pernuts for approaches to the county road system shall be obtauned from the
Spokane County Engineer
3 The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans
4 The apphcant shall subrrut for approval by the Spokane County Engineer and the
Spokane County Health Distnct a detailed combined on-site sewage system plan and
surface water disposal plan for the entire project, or portion thereof, if the
development is to be phased
5 A parking plan and traffic circulation plan shall be subrrutted and approved by the
Spokane County Engineer The design, location and arrangement of parking stalls
shall be in accordance with standard rraffic engineenrig practices Paving or
surfacing as approved by the County Engineer, will be requumd for any poraon of the
project which is to be occupied or traveled by vehicles

6 The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer
7 The County Engineer has designated Typical Roadway Section Number One, Access
Stroet Standard for the improvement of Ella Road, which is adjacent to the proposed
development This wnll require the addition of approxunately 8 to 12 feet of asphalt
along the frontage of the development The construction of curbing and sidewalk is
also requued
8 All required improvements shall confornn to the current State of Waslungton Standard
Specifications for Road and Bndge Construcaon and other applicable County
standards and/or adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construcaon, unless otherwise approved by the
County Engineer
9 Roadway standards, typical roadway secnons and drainage plan requirements are
found in Spokane Board of County Commissioners Resolunon No 80-1592 as
amended and are apphcable to this proposal
10 This subdivision or development proposal is located within a drainage basin which
has been identlfied by the Spokane County Engineer s office as having stoimwater
runoff problems Since this plat or development proposal is affected by or is a
contnbutor to stormwater flows, property owners should participate in the planrung
and unplementauon of a future basinvvide stomnwater management system The
followuig statement shall be placed in the plat dedicanon
The owner(s) or successor(s) in interest agree to join in any County-approved
Y stormwater management program and to pay such rates and charges as may be fixed
through public hearings for seivice or benefit obtained by the planrung, design,

filed with the County Engineer
13 The County Artenal Road Plan idennfies Broadway Avenue as a Pnncipal Artenal
The exisang nght-of-way width of 57 5 feet is not consistent with that specified in
the Plan In order to implement the Artenal Road Plan, in add.ition to the requimd
nght-of-way dedicanon, a stnp of property 22 5 feet in width along the Broadway
Avenue frontage shall be set aside in reserve This property may be acquued by
Spokane County at the time when artenal improvements are made to Broadway
Avenue

and issuance of permits by the Health Distnct
2 The dedicaaon shall state The owner(s) or successor(s) in interest agree to
authonze the County to place theu name(s) on a petiaon for the formation of a ULID
by petition method pursuant to RCW 36 94, which the petition includes the owner(s)'
property, and further not to object by the signing of a protest petiaon agamst the
formanon of a ULID by resolution method pursuant to RCW Chapter 36 94 wtuch
includes the owner(s)' property PROVIDED this condihon shall not prohibit the
owner(s) or successor(s) from objecting to any assessment(s) on the property as a
result of improvements called for in conjunction with the formation of a ULID by

Prior to the release of a building permit or use of the property as

County pohcies and guideluies The Planning Deparcmene has determuned thae "No

Comprehensive Plan. The intended office use of the property would be a good
transition between nndustnal uses to the south and the juluor high school to the
