This matter has come before the Hearing Examiner Committee on June 22,1995.
The members of the Committee present are: Verona Southern, Chair, Brenda
Bodenstein and Jane Myers.
PROPOSAL
The sponsors, Tom and Patricia Caldwell, request approval of a Zone
Reclassification, ZE-17-95, from Urban Residential-3.5 (UR-3.5) to Regional
~ Business (B-3) for retail sales, restaurant and those uses allowed in the Regional
Business (B-3) zone.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located north of and adj acent to Sprague Avenue, south
of Riverside Avenue, approximately 100 feet east of Adams Road in Section 14,
Township 25 North, Range 44 EWM, Spokane County, Washington.
2. The Committee adopts the Planning Department Report as a part of this record.
3. The e~sting land uses in the area include single family residences, strip commercial
and light industrial development.
4. The proposed use is compatible with existing uses in the area.
5. The Comprehensive Plan designates this site as Major Commercial, within the Priority Sewer Service Area (PSSA) and Aquifer Sensitive Area (ASA} Overlay
Zone.
The Maj or Commercial Category is intended to provide the opportunity for
development of commercial uses, specifically community and regional shopping
centers and commercial uses, directly related to major throughways. The proposal is consistent with the Maj or Commercial Category of the Comprehensive Plan and ~
implernents the Goals, Objectives and Decision Guidelines of that category.
6. The proposed zoning does implement and conform to the Comprehensive Plan,
7. The subject property is adjacent to Sprague Avenue which is identified as a Principal Arterial on the Spokane County Arterial Road Plan. The existing right of
way width of 110 feet is not consistent with the future right of way width of 130
feet recommended in the Plan. An additiona110 feet of right of way along Sprague
Avenue will be set aside as a future acquisition area to implement the Arterial Road
Plan.

8. The existing zoning of the property described in the application is Urban
Residential-3.5 (UR-3.5) previously established as Agr~cultural Suburban (AS)
zoning in 1958 and redeslgnated to Urban Residentlal-3.5 (UR-3.5) on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code.
The proposal does conform to the requirements of the proposed Regional Business
(B-3) zone.
9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been ~
complied with and a Determination of Nonsignificance (DNS) was issued. The
Committee, after independent review, hereby adopts the DNS.
10. The legal requirements for public notice have been fulfilled.
11. The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use.
12. The applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed zone reclassification is
justified. Specifically, changed conditions include adoption of the Spokane County
Comprehensive Plan, the Spokane County Zoning Code and substantial commercial
development of the Sprague Avenue commercial corridor.
13. The proposed use will not be detrimental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the reviewing agencies.
14. The Committee additionally finds/concludes:
~ a. The applicant agrees with and accepts all recommended conditions of
approval.
CONDITIONS OR CONTINGENCIES APPLIED TU THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on
the "Applicant," wh~ch term shall include the owner or owners of the property,
helrs, asslgns, and successors-in-lnterest.
2. The Zone Reclassification and following Conditions of Approval apply to the real
property described below:
Lots 2, 3 and 4, Block 2, and Lots 1 and 4, Block 3, Veradale Homes Subdivision of
Tract 61 of Vera, according to Plat recorded in Volume 2, Page 41, in Spokane County, Washington, and including vacated Marcus Road and that portion of vacated
Sprague Avenue bounded by west line of said Lot 4, Block 3 projected south and east
l~ne of Lot 4, Block 2 pro~ected south.
SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Regional Business (B-3) zone, as amended.

2. The five existing parcels shall be aggregated into a single parcel with a certificate of
exemption prior to issuance of a building permit.
3, The applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be permitted, including, but not limited to building
locatlon, landscape plans and general allowable uses of the permltted zone. All
variations must conform to regulations set forth in the Spokane County Zoning ~
Code, and the original intent of the development plans shall be maintained.
4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning D~ectorldesignee sha11 be submitted for the project prior
to release of building permits. The Planning Department may require performance
bonds or other appropriate security to ensure the landscaping will be installed and
maintained according to the approved plans and specifications. Landscaping shall
be installed and maintained so that sight distance at access points is not obscured or impaired. Landscape plan indicates 20 foot wide Type II landscaping and 3 foot
h~gh berm along the north property line ad~acent to Riverside Avenue.
5. Approval is required by the Planning Directorldesignee of a specific lighting and
signing plan for the described property prior to the release of any building permits.
6. The Spokane County Planning Department shall prepare and record with the
County Auditor a Title Notice specifying a future land acquisition area for road right-of way and utilities. The reserved future acquisition area Title Notice shall
only be released, in full or in part, by the Planning Department. The notice should
be recorded within the same time frame as an appeal and shall provide the
following:
a. At least 10 feet of reserved future acquisition area for road right-of way and
utilities, in addition to the existing andlor newly dedicated right-of way along Sprague Avenue.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road right-of way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements {such as landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
7. The Planning Department sha11 prepare and record with the Spokane County
Auditor a Title Notice noting that the property in question is subject to a variety of
special conditions imposed as a result of approval of a land use action. This Title Notice sha11 serve as public notice of the conditions of approval affecting the
property in question. The Title Notice should be recorded within the same time

frame as allowed for an appeal and shall only be released, in full or in part, by the

2. Access permits for approaches to the county road system shall be obtained from the Spokane County Engineer.
3. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
4. A parking plan and traff'ic circulation plan shall be submitted and approved by the
Spokane Counry Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard ~af~ic engineerin~ practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the pro~ect wh~ch is to be occupied or traveled by veh~cles.
5. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Constr~.iction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and ~ Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.
6. Applicant shall construct a paved and delineated approach(es) to meet the existing
pavement on Sprague Avenue.
7. Access to Riverside Avenue shall be prohibited until such time as specifically authorized by the Spokane County Engineer.
~ 8. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolut~on No. 80-1592 as
amended and are applicable to this proposal.
9. No construction work shall be performed within the existing or proposed public
right-of way until a permit has been issued by the County Engineer. All work
within the public road right-of way is subject to inspection and approval by the
County Engineer.
10. All required construction within the existing or proposed public right-of-way is to
be cornpleted prior to the release of a building permit, or a bond in an amount

estimated by the County Engineer to cover the cost of construction of improvements
sha11 be filed with the County Engineer.
11. The County Arterial Road Plan identi~ies Sprague Avenue as a 130 foot Principal Arterial. The existing right-of way width of 110 feet is not consistent with that
specified in the Plan. In order to implement the Arterial Road Plan, in addition to
the required right-of way dedication, a strip of property 10 feet in width along the
Sprague Avenue frontage sha11 be set aside in reserve. This property may be •
acquired by Spokane County at the time when arterial improvements are made to
Sprague Avenue.
12. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocation
regarding these utilities. Applicant(s) should check with the applicable utiliry
purveyor and the Spokane County Engineer to determine whether applicant{s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
13. Applicant sha11 comply with the conditions of record for the vacation of Marcus
Road.
SPOKANE COUNTY DIVISIUN OF UTILITIES
1. Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
2. A wet (live) sewer connection to the existing area-wide Public Sewer System is to be
constructed. Sewer connection permit is required,
3. Applicant sha11 submit expressly to Spokane Counry Utilities Department "under
~ separate cover" only those plan sheets showing sewer plans and specifications for
public sewer double plumbing private sewer or dry sewer connections for review and
approval by Utilities Department prior to issuance of permit to connect.
4. Arrangements for payments of additional sewer charges must be made for prior to
issuance of sewer connection permit.
SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal method sha11 be as authorized by the Director of Utilities, Spokane
County.
2. ~Vater service shall be coordinated through the Director of Utilities, Spokane County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.

4. A public sewer system will be made available for the project and individual service will
be provided to the lot. Use of individual on-site sewage disposal systems shall not be
authorized.
5. Use of private wells and water systems is prohibited.

pratection, and energy code regulations. (Note: The Department of Buildings reserves
the right to confirm the actual address at the time of building permit.)
SPOKANE CUUNTY AIR PULLUTION CONTRUL AUTHORITY
1. All air pollution regulations must be met.
2. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,
s rinklers or suspension of activity during certain weather conditions. Haul roads P
should be treated, and emissions fram the ~ansfer of earthen material must be
controlled, as well as emissions from a11 other construction-related activities.
3. SCAPCA strongly recommends that all traveled surfaces (i.e., ingress, egress,
parking areas, access roads) be paved and kept clean to minimize dust emissions.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
~ surfaces onto paved surfaces (Sprague Avenue). If tracking or spills occur on
paved surfaces, measures must be taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than
burning (i.e., construction waste, etc.).
6. Some objectionable odors may result from this project . SCAPCA's regulations
state that effective control apparatus and measures must be used to reduce odors to a minimum. '

7. Any project affecting the ~regional transportation network may be required to
perform a conformity analysis, and be required to mitigate transportation related air .
quality concerns.
