Desagn Planned retention of the residennal character of the structure for an office
use should not have a significant adverse impact upon the neighborhood However,
at present, the property does not comply with landscaping, parking, or other
standards of the Zoning Code Providing landscaping and buffenng, with no activity
in the rear pomon of the lot helps to nutigate potenaal impacts to adjacent propernes
Prohibiting outdoor storage of related equipment or vetucles would also provide an
addiaonal mitigating measure
Buf'fergng/Landscaping Chapter 14 806 040 (d) of the Spokane County Zoning
Code requues 20 feet of Type I Landscaping where business uses are located adjacent
to the Urban Residential-3 5(UR-3 5) Zone In this case, site plan modif'icanon will

An Envuonmental Checklist was submitted by the sponsor and was reviewed by the
County Planrung Department The review considered the specifics of the proposal,
other available uiformation, County orclinances, other regulations and laws, possible
standard Conditions of Approval, the Genera.lized Comprehensive Plan, and other
County policies and guideluies The Plannuig Department has deternuned that "No
probable signif'icant ativerse unpacts" would result from the proposal beulg developed
and has issued a Dernungsion of NonsipufiGance ("DNS")
The "DNS" was cuculated to 9 other agencies of junsdichon and other
agencies,/departments affected by the future development for revlew and commenL '
The "DNS" comment penod ends September 17, 1991 and was advernsed 15
calendar days before said date in the newspaper, by letter to adjacent property owners
within 400 feet of the proposal, and by nonce on a sign posted on the proposal site
The Hearuig Examiner may consider addstional envlronmental related testimony at the
pubhc hearulg
V PLANNING DEPARTIVIENT SUMMARY
The proposed zorung reclassification is not consistent wlth current land use and
zomng trends of the sutroundhng neighborhood, and may not implement goals,
objectives and decision guidelines of the Comprehensive Plan The rezone to Urban
Residential-12 (UR-12), if approved would set a zonuig precedent for conversion of
residential uses to office and or multiple family use along Broadway Avenue in this
area. Broadway Avenue, however, has retained resldenaal zoning as no rezones
have been approved on either side of Broadway from just east of Ella Street to
Marquente Road As evidenced by an official complaint on file vvith the Plannulg
Department, the proposed office use is d.isruptive of neighborhood amenities The
resubnuttal of the request has not demonstrated changed cond.itions since the onguial
apphcation or addressed comphance with zoning standards The Planning
Department recommends derual

Standard Specifications for Road and Bndge Construcaon and other apphcable

the Spokane County Engineer and Spokane County Health Distnct pnor to lssuance

Proposal: Zone Reclassification from Urban Residential-3.5 (UR-3.5) to Urban _
Residential-12 (UR-12) to use an existing single family dwelling as a professional

II. SITE ANALYSIS
Comprehensive Plan: Category is Urban. Non residential uses within the Urban
category are encouraged along arterials and in areas with urban services. Measures to
mitigate compatibility impacts to residential uses are suggested in the Comprehensive
Plan and may include: screening, buffering, landscaping, and use transition.
Landscaping for visual aesthetics is also recommended.
Arterial Road Plan: The Spokane County Arterial Road Plan identifies Broadway
Avenue as a Principal Arterial without controlled access. As specified by the Plan,
Principal Arterials should have a minimum right of way width of 100 feet, with
required 35 foot setbacks measured from the ultimate right of way. Existing
Broadway Avenue right of way width of 55 feet is inadequate to implement the "
Arterial Road Plan

5 ae Pl@n Considerariona: The applicant proposes utilization of a converted single
family dwelling as office space for an electrical contractor. This has resulted in
some interior remodeling with little exterior modif'ication. Outside improvements
generally include only the addition of a 4 to 5 car gravel parlang lot within the
flanking yard (Bessie Road). Two additional parking spaces required by the
Zoning Code can be provided by the existing garage or extension of existing
parking area. Site plan also does not illustrate any future additions to existing
structure. The subject property is also subject to a zoning complaint on file with the
Spokane County Planning Department (see file No. CV-195-90) for operation of a
business in excess of Zoning Code standards. This complaint file has resulted in
the requested zone change.

The site plan submitted for review by the Hearing Examiner Comrnittee is
general in nature. Detailed review to determine compliance with all Qrdinance
regulations and conditions of approval is recommended to be administraave and
to occur at the Building Permit stage. '
III. SITE DEVELOPMENT RECOMMENDATIONS Design: Planned retention of the residential character of the site for an office use
should not have an adverse impact on the neighborhood. Provision of landscaping

and buffering, and no activity on the rear portion of the lot help to nutigate potential
impacts. This includes no storage of related equipment or vehicles on the site.
Professional office use is allowed, while a contractors office and yard are pernutted
only in the Light Industrial (I-2) or Heavy Industrial (I-3) zones.
Buffering/Landscaping: Chapter 14.806.040 (d) of the Spokane County Zoning
Code requires 20 feet of Type I Landscaping where business uses are located adjacent
to the Urban Residential-3.5 (UR-3.5) zone. In this case, site plan modification will
be required to illustrate this landscaping along the east and south property lines. The
Zoning Caie also requires a 6 foot sight obscuring fence where the Urban
Residential-12 (UR-12) zone abuts the Urban Residential-3.5 (UR-3.5) zone and
provision of 20 feet of Type III Landscaping adjacent to Broadway Avenue and
Bessie Road. Additional landscaping consisting of a 36 inch wall, sight obscuring
fence, or 3 foot Type I Landscape strip is required when off-street. Parking areas
abut or are visible from a public street Substantial site plan modifications would be
required to demonstrate compliance with the above referenced zoning code standards.
Administrative review of specific landscape plans are recommended, if approved.
Signage: Signs for the office uses are regulated by Section 14.804.080 (7) (A) of
the Spokane County Zoning Code. Generally, this allows one attached 32 square
foot sign, or one detached sign of 16 square feet per side with a maximum width of
15 feet.
. Circulation/Access: All off-street parking spaces front on and access Bessie Road
only. Additional off=street parking could be provided by expansion of existing
. parlang area, or within an existing garage.
Stormwater Drainage: Compliance with "208" stormwater regulations is
; required.
Sewage Disposal: The cuirent septic system is sized for residential use and
upgrading of system may be required by the Health Officer.
Fire Protection: The proposal is located within Spokane County Fire District No.

I V. SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Department. The review considered the specifics of the proposal,
other available informarion, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has deternuned that "No
. probable signif'icant adverse impacts" would result from the proposal being developed
and has issued a Determination of NonsignificancP, ("DNS").
The "DNS" was circulated to S other agencies of jurisdiction and other
agencies/departments affected by the future development for review and comment.
The "DNS" comment period ends April 16, 1991 and was advertised 15 calendar
days before said date in the newspaper, by letter to adjacent property owners within

400 feet of the proposal, and by notice on a sign posted on the proposal site. The
Hearing Examiner may consider additional environmental related testimony at the
public hearing.
V . PLANNING DEPARTMENT SUMMARY
The proposed zoning reclassification is not consistent with current land use and
zoning trends of the surrounding neighborhood, and may not implement goals,
objectives and decision guidelines of the Comprehensive Plan. The rezone to Urban
Residential-12 (UR-12), if approved would set a zoning precedent for conversion of
residential uses to office and or multiple family use along Broadway Avenue in this
area. Broadway Avenue in this area has received pressure to change from residential
to more intensive uses. Broadway Avenue, however, has retained residential zoning
as no rezones have been approved on either side of Broadway from just east of Ella
Street to Marquerite. As evidenced by an official complaint on file with the Planning
Department, the proposed office use may be disruptive of neighborhood amenities.
Measures to mitigate compatibility between proposed use and adjacent residential uses
may include: screening, landscaping, use transition, sign restrictions, and limiting
hours of operation. The Planning Department recommends denial.
V I. CONDITIONS OF APPROVAL
i. All Conditions imposed by the Hearing Examiner Committee shall
be binding on the "Applicant," which term shall include the owner

SPOKANE COUNTY PLANNING DEPARTMENT CONDITIONS

assigns and successors.
2. The proposal shall comply with the Urban Residential-12 (UR-12) zone as
amended.
3. The applicant shall develop subject property generally it1 accordance within the
concept presented to the Hearing Body. Variaaons, when approved by the
Planning Director/designee, may be pernlitted, including, but not limited to building
location, landscape plans and general allowable uses of the permitted zone. All ,
variations must conform to regulations set forth in the Spokane County Zoning
Ordinance, and the original intent of the development plans shall be ma.intained.
4. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.

5. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
impaired.
6. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
7. The Spokane County Planning Department shall prepare and record with the
County Auditor a Title Norice specifying a future land acquisition area for road
right-of-way and utilities. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Planning Department. The notice should be
recorded within the same time frame as an appeal and shall provide the following:
a. At least 22.5 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing and/or newly dedicated right-of-way along
Broadway Avenue.
h. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured from the reserved future acuisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
' shall be relocated at the applicant's expense when roadway improvements are
_ made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
SPOKANE COUNTY ENGINEER'S OFFICE CONDITIONS
Prior to issuance of a building permit or at the request of the County Engineer in
conjunction with a County Road ProjectJRoad Improvemen[ District, whichever
action comes first:
1. Applicant shall dedicate 6.5 feet on Broadway Aventie for right-of-way. .
2. Applicant shall dedicate 5 feet on Bessie Street for right-of-way.
' 3. The applicant shall dedicate the applicable radius on Bessie Street and Broadway
Avenue.

5. The applicant shall submit for approval by the Spokane County Engineer road,
drainage and access plans.
6. The applicant shall submit for approval by the Spokane County Engineer and the
Spokane County Health District a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project, or portion thereof, if the
development is to be phased.
7. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
8. To construct the roadway improvements stated herein, the applicant may, with the
approval of the County Engineer, join in and be willing to participate in any
petition or resolution which purpose is the formation of a Road Improvement
District (RID) for said improvement, pursuant to RCW 36.88, as amended.
Spokane County will not participate in the cost of these improvements. This is
applicable to Bessie Street.
9. As an alternative method of constructing tle road improvements stated herein, the
applicant may, with the approval of the County Engineer, accomplish the road
improvements stated herein by joining and participating in a County Road Project
(CR.P) to the extent of the required improvement. Spokane County will not
participate in the cost of these improvements. This is applicable to Bessie Street.
10. The-construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
11. The County Engineer has designated Typical Roadway Section Number Two,
Local Access standard for the improvement of Bessie Street, which is adjacent to
the proposed development. This will require the addition of approximately 9-11
feet of asphalt along the frontage of the development. Curbing must also be
constructed.
12. The County Engineer has designated Typical Roadway Section Number Qne, Major
Arterial standard for the improvement of Broadway Avenue, which is adjacent to
the proposed development.
13. All required improvements shall conform to the cunent State of Washington
Standard Specifications for Roa.d and Bridge Construction and other applicable
County standards and/or adopted resoluaons pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the Counry Engineer.

14. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal. -
15. This subdivision or development proposal is located within a drainage basin which
has been identified by the Spokane County Engineer's office as having stormwater

runoff problems. Since this plat or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the planning
and implementation of a future basinwide stormwater management system. The
following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design,
constructing, maintaining or operarion of stormwater control facilities."
~ 16. No construcrion work shall be performed within the existing or proposed public
right-of-way until a pennit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
17. Applicant shall sign and record Spokane County Notice to the Public No. 6 which
specifies the following:
- The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a Road Improvement District (RID) by
the petition method pursuant to Chapter 36.88 RCW, which petition includes the
owner(s) property, and further not to object, by the signing of a ballot, the
formation of a RID by the resolution method pursuant to Chapter 36.88 RCW,
which resolution includes the owner(s) property. If an RID is formed by either the
. petition or resolution method, as provided for in Chapter 36.88 RCW, the owner(s)
• or successor(s) further agree:
, (a) that the improvement or construction contemplated within the proposed RID is
- - feasible;
(b) that the benefits to be derived from the formation of the RID by the property
included therein, together with the amount of any County participation,
exceeds the cost and expense of formation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as
authorized under RCW 36.88.090, to object to any assessment on the property as a
result of the improvements called for in conjunction with the fonnation of the RID
by either petition or resolution method under Chapter 36.88 RCW. This provision
is applicable to Bessie Street. .
18. The County Arterial Road Plan identifies Broadway Avenue as a Principal Arterial.
The existing right-of-way width of 55 feet is not consistent with that specified in the
' Plan. In order to implement the Arterial Road,Plan, in addition to the required
right-of-way dedication, a strip of property 2M feet in width along the Broadway
. Avenue frontage shall be set aside in reserve. This property may be acquired by
Spokane Counry at the time when arterial improvements are made to Broadway
Avenue.
19. There may exist utilities, either underground or overhead, affecting the subject
property, includ.ing property to be dedicated or set aside for future acquisition.

Spokane County assumes no financial obligation for adjustments or relocation
regarding these utiliries. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to detennine whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
SPOKANE COUNTY UTILITIES DEPARTMENT CONDITIONS
. 1. Sewerage facilities are not affected by this proposal therefore no recommendation.
SPOKANE COUNTY HEALTH DISTRiCT CONDITI4NS
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane
County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. Disposal of sewage effluent beneath paved surfaces is currently prohibited.
5. Subject to specif'ic application approval and issuance of permits by the Health
Officer, the use of an individual on-site sewage disposal system may be authorized. -
NOTE: The current system is sized for residential use. Upgrad.ing of system may
be required by the Heaith Officer.
SPOKANE COUNTY BUILDING AND SAFETY DEPARTMENT
1. The applicant shall contact the Department of Buildings at the earliest possible stage
of design/development in order to be informed of code requirements
administered/enforced by the department; e.g., State Building Code Act regulations
such as requirements for fire hydrantJflow, fire apparatus access roads, street
address assignment, barrier-free regulations, energy code regulations, and general
coordination with other aspects of project implementation.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps, '
sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be .
controlled, as well as emissions from all other construction-related activities.
2. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.
