statuatory legal counsel that we are required to act only upon written com-

Dear Mr. Gugliuzza:
The laws and regulations in our society are, at times, difficult to under-
stand and fully comprehend. This is true of zoning ordinances, which are
laws intended to protect and govern the many different uses of land in
Spokane County. It is my responsibility, as the Zoning Investigator, when
the situation arises, to help resolve conflicts involving the Spokane
County Zoning Ordinance.
This office has received reports regarding trees and shrubs located in what
is known as the clear -view triangle on your property, located at South 701
Girard Road, Spokane County, parcel number 24531-4004.
A recent visual inspection by our field inspector indicates, we believe,
that these reports are accurate.
Section 4.17.040 of the Spokane County Zoning Ordinance stipulates that,
"Corner lots in all zones shall not be permitted to have any fencing or
other sight -obstruction which constitutes a hazard to the traveling public
within the area designated as the 'clear -view triangle.' This area can be
determined by measuring eighty (80) feet from the center of two intersec-
ting streets along the center lines of each street, then connecting the two
points with a straight line forming the hypotenuse of the clear -view triangle.
Trees within the clear -view triangle shall have their branches removed at
the trunk from ground level to a minimum of seven (7) feet above ground
level. Shrubs within the clear -view triangle shall be maintained no higher
than three (3) feet above grade elevation of the center line of the adjacent
street."

Due to the hazardous nature of this matter, we are of the opinion that since
you have now been informed of the requirements of the Spokane County Zoning
Ordinance, a period of 14 days, beginning with your receipt of this letter,
should be sufficient time in which to bring your property into compliance.
Do not hesitate to act upon this important matter, since a violation of the
Spokane County Zoning Ordinance is a misdemeanor and does carry a penalty.
I am sure it is important to you, as it is to me, that we resolve this sit-
uation quickly.

Dear Mr. Gugliuzza:
It has been some time now since we last contacted you regarding the tree and
shrubbery located in what is known as the clear -view triangle on your prop-
erty, located at South 701 Girard Road, Spokane County, parcel number
24531-4004.
A recent visual inspection by our field inspector indicates, we believe,
that the property has yet to be brought into compliance with the requirements
of the Spokane County Zoning Ordinance.
As stated in our letter of February 4, 1981, Section 4.17.040 of the Spokane
County Zoning Ordinance stipulates that, "Corner lots in all zones shall not
be permitted to have any fencing or other sight -obstruction which consti-
tutes a hazard to the traveling public within the area designated as the
'clear -view triangle.' This area can be determined by measuring eighty (80)
feet from the center of two intersecting streets along the center lines of
each street, then connecting the two points with a straight line forming the
hypotenuse of the clear -view triangle. Trees within the clear -view triangle

Due to the length of time this matter has been pending, we are of the opinion
that a period of 14 days, beginning with your receipt of this letter, should
be sufficient time for you to bring your property into compliance with the
requirements of the Spokane County Zoning Ordinance. If these matters are

not taken care of within the previously mentioned 14 days, we will be unable
to grant any further extensions of time and will have no choice but to for-
ward this case to the Spokane County Prosecuting Attorney's Office for appro-
priate legal action. A violation of the Spokane County Zoning Ordinance is a
criminal offense and does carry a penalty of, "two hundred and fifty dollars
($250.00) or imprisoned in the County Jail for a term of not exceeding ninety
(90) days, for each offense. Each day that a violation is permitted to exist
shall constitute a separate offense."
Please be advised that this is not a matter that will go away if ignored. I
am sure it is important to you, as it is to me, that we resolve this situation
quickly.
