original zoning of this area and accordingly, the proposed zone reclassification is
justified.

CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All Conditions imposed by the Hearing Examiner Committee shall be binding on the
"Applicant," which term shall include the owner or owners of the property, heus,
assigns, and successors-in-interest.
2. The following Conditions of Approval apply to the real property desci-ibed below:

SPUKANE COUNTY PLANNING DEYARTMENT CUNDITIONS
1. The proposal sha11 comply with the Regional Business (B-3) zone(s) as amell;i«i.
2. The applicant shall develop subject property generally in accordance within dlc
concept presented to the Hearing Body. Variarions, when approved by the
Planning Director/designee, may be permitted, including, but not limited to buil(j i 1ll-I
location, landscape plans and general allowable uses of the pernutted zone. All
variations must conform to regulations set forth in the Spokane County Zoning
Ordinance, and the original intent of the development plans shall be maintained.
3. Approval is required by the Planning Director/designee of a specific lighting and
signing plan for the described property prior to the release of any building permits.
4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a perfonnanctbond for the project prior to release of building pernuts. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured o:
impaired.
5. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
6. The Spokane County Planning Department shall prepare and record with the
County Auditor a Title Norice specifying a future land acquisition area for road
right-of-way and utiliries. The reserved future acquisition area Title Notice shall be
released, in full or in part, by the Planning Department. The notice should be
recorded within the same time frame as an appeal and shall provide the following:

utilities, in addition to the existing and/or newly dedicated right-of-way alon.:

with substanrial transition occurring from existing single family residences to
commercial uses.
F . Zoning Anaiysis: The proposal is located within the ASA Overlay Zone, UTA,
and .PSS k: 1,3undaries. The general zoning trend within 300 feet of Argonne, east
-m:> >Yvest, is of a commercial nature: Urban Residential-22 (UR-22),
Neighborhoocl Business (B-1), Community Business (B-2) and Regional
Business (B-3). Zoning 300 feet west of Argonne continues to remain
residenrial, particularly north of Muin Avenue.

F. Land Use Analysis: The proposed land use is for a professional office
building. The surrounding land uses are predominantly commercial
(professional offices) and public (schools, churches). With required
landscaping, the proposed development will be compatible with surrounding
land uses due to its commercial nature.
Site: The existing land use is vacant.
Northeast: Professional office.
Northwest: Vacant.
South: Church and school.
East: Church and single family residence.
West: Asphalt, fenced school yard.
G. Circulation: The site will be served by Valley Way, a designated 70 foot
Collector Arterial currently improved to 40 feet. The applicant shall dedicate 10
feet on Valley Way for right of way purposes and a strip of property S feet in
width must be set aside in reserve. No access will be allowed from Argonne.
The County Engineer standards for Collector Arterial's will require the addition of
approximately 10-12 feet of asphalt along the frontage of the development as well
as the construction of curbing and sidewalks along Valley Way.
H. Design: The submitted site plan meets the current Regional Business (B-3)
zoning requirements. Landscaping, signage and lighting plans will need to be
submitted and approved prior to building pernut sign-off.

The site plan submitted for review by the Hearing Examiner Committee is
general in nature. Detailed review to determine compliance with all
Ordinance regulations and conditions of approval is recommended to be
administrative and to occur at the Building Permit stage.
I. Drainage: A drainage plan and "208" compliance is required. This plan must be
reviewed and approved by the County Engineer's Department prior to
development.
J. Water Supply: The proposal is within the Hutchinson Irrigation District.
Water service shall be approved at the rime of building permit review.
K. Sewage Disposal: The applicant will make connection to the public sewer
system. A sewer connection permit is required.
L. School: The proposal is in the Central Valley School District No. 356.
M. Fire Protection: The proposal is within Fire District No. 1. The Fire District
and the Division of Buildings Department (Fire Marshall) are required to approve
fire protection provisions prior to finalizing the preliminary plat.
III. ENVIRONMENTAL REVIEW:
An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Department. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has detemuned that "No
probable signif'icant adverse impacts" would result from the proposal being developed
and has issued a Determination of NonsignificancP ("DNS").
The "DNS" was circulated to 10 other agencies of jurisdicrion and other
agencies/departments affected by the future development for review and comment.
The "DNS" comment period ends October 22, 1991 and was- advertised 15 calendar
days before said date in the newspaper, by letter to adjacent property owners within
400 feet of the proposal, and by notice on a sign posted on the proposal site. The
Hearing Examiner may consider additional environmental related testimony at the
public hearing.
I V. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
The Major Commercial category of the Comprehensive Plan generally supports
Regional Business (B-3) zoning and commercial uses such as those proposed on the

uses wnen required landscaping is installed.
The lan._': u,e to the north is a professional office zoned Urban Residential-22 (UR-22),
to the °rest is a school yard zoned Urban Residenrial-3.5 (UR-3.5), to the south is a
church zoned Community Business (B-2) and to the east, bordering Argonne, is an
additional church zoned Regional Business (B-3). The proposal is a reasonable
~:;iter:.>~ ~ of these uses. No public concerns have been recorded.

recorded within the same time frame as an appeal and shall provide the following:
a. At least 5 feet of reserved future acquisition area for road right-of-way and
utilities, in addition to the existing andlor newly dedicated right-of-way along
Valley Way. NOTE: The County Engineer has required 10 feet of new
dedication.
b. Future building and other setbacks required by the Spokane County Zoning
Code shall be measured, from the reserved future acquisition area.
c. No required landscaping, parking, '208' areas, drainfield or allowed signs
should be located within the future acquisition area for road right-of-way and
utilities. If any of the above improvements are made within this area, they
shall be relocated at the applicant's expense when roadway improvements are
made.
d. The future acquisition area, until acquired, shall be private property and may
be used as allowed in the zone, except that any improvements (such as
landscaping, parking, surface drainage, drainfield, signs or others) shall be
considered interim uses.
7. The Planning Department shall prepare and record with the Spokane County
Auditor a Title Notice noting that the property in question is subject to a variety of
special conditions imposed as a result of approval of a land use action. This Title
Norice shall serve as public norice of the conditions of approval affecting the
property in question. The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Title Notice shall generally provide as follows:

Spokane County Health District a detailed combined on-site sewage system plan
and surface water disposal plan for the entire project, or portion thereof, if the
development is to be phased.
6. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering pracrices. Paving or
surfacing as approved by the County Engineer, will be requireci fnr any portion c>f
the project which is to be occupied or traveled by vehicles.
7. The construction of the road improvements stated herein shall be accomplishecl
approved by the Spokane County Engineer.
8. The County Engineer has designated Typical Roadway Section Number One,
Collector Arterial standard for the improvement of Valley Way, which is adjacent to
the proposed development. This will require the addition of approximately 10-1

13. This subd.ivision or deveIopment proposal is located within a drainage basin which
has been identified by the Spokane County Engineer's office as having stormwater
runoff problems. Since this plat or development proposal is affected by or is a
contributor to stormwater flows, property owners should participate in the planninand implementation of a future basinwide stormwater management system. The
following statement shall be placed in the plat dedication:
"The owner(s) or successor(s) in interest agree to join in any County-approved
stormwater management program and to pay such rates and charges as may be fixed
through public hearings for service or benefit obtained by the planning, design,
constructing, maintaining or operation of stormwater control facilities."

14. No construction work shall be performed within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspection and approval by the
County Engineer.
15. All required construction within the existing or proposed public right-of-way is to
be completed prior to the release of a building pennit, or a bond in an amount
estimated by the County Engineer to cover the cost of construction of improvements
shall be filed with the County Engineer.
16. The County Arterial Road Plan identifies Valley Way as a Collector Arterial. The
existing right-of-way width of 40 feet is not consistent with that specified in the
Plan. In order to implement the Arterial Road Plan, in addirion to the required
right-of-way dedication, a strip of property 5 feet in width along the Valley Way
frontage shall be set aside in reserve. This property may be acquired by Spokane
County at the time when arterial improvements are made to Valley Way.
17. There may exist utilities, either underground or overhead, affecting the subject
property, including property to be dedicated or set aside for future acquisition.
Spokane County assumes no financial obligation for adjustments or relocarion
regarding these utiliries. Applicant(s) should check with the applicable utility
purveyor and the Spokane County Engineer to deternune whether applicant(s) or
the utility is responsible for adjustment or relocation costs and to make
arrangements for any necessary work.
Special Condition:
18. Applicant shall demonstrate to the satisfaction of the Counry Engineer that adequate site
distance is provided for at the point of ingress and egress to the site.
SPOKANE COUNTY DIVISION OF UTILITIES CONDITIONS
1. The applicant will make connection to the Public Sewer System.
2. Plans and specificarions are to be reviewed and approved by the Utilities Department.
3. Sewer connecrion petmit is required.
SPOKANE COUNTY HEALTH DISTRICT CONDITIONS
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane
County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.

4. A public sewer system will be made available for the platlproject, and individual
service will be provided to each lot/tract prior to sale. Use of individual on-site
sewage disposal systems shall not be authorized.
5. The dedicatory language on the plat shall state: "Use of private wells and water
systems is prohibited."
SPOKANE COUNTY DIVISION OF BUILDINGS CONDITIONS
1. The applicant shall contact the Deparnnent of Building and Safety at the earliest
possible stage of design/development in order to be informed of code requirements
administered,/enforced by the department, e.g., State Building Code Act
regulations, such as requirements for fire hydrant/flow, fire apparatus access roads,
street address assignment, barrier-free regulaaons, energy code regularions and
general coordinarion with other aspects of project implementation.
2. Requirements of Fire District No. 1 need to be satisfied during the building pemnit
