The sponsor, John Freeze requests approval of a Zvne Reclassification, ZE-6-94,
from Urban Residennal-3 5(UR-3 5) and Community Business (B-2) to
Community Business (B-2) for retail sales, a beauty salon and those uses allowed
in the underl}nng zone

1 The praperty is generally located at the northwest carner of the intersecnon of
Asganne Road and Broadway Avenue, within the NE 1/4 of Section 18, Township
25 North, R.ange 44 EWM, Spokane County, Wash2ngton
2 The Committee adopts the Planning Department Report as a part of this record
3 The exist7ng land uses xn the area mclude commercial uses along the
Argonne/Mullan Road comdor, singie family residences and multiple farmly
complexes
4 The proposed use is compatible with existing uses in the area
5 The Gomprehensive Plan deslgnates this site as Major Commerclal and Urban The
Major Gotnmercial categary is intended to provide for the opportunity for
development of commercial uses, specifically communlry and regional shopping
centers, and offices duectly related to-major throughways
The Urban category 1s lntended to provide opportunity for development of a
"citylike" envu-vnment which lncludes vanous land uses
The proposal may be eonsistent with the Major Comrnercial and U'rban categones
of the Comprehenslve Plan 1f consldered under the transition policy
6 The proposed zoning does implement and canform to the Comprehensive Plan
7 The Artenal Rva.d Plan designates Argonne Road and Mullan Road as Pnncipal
Artenals, wnth a recommended nght of way width of 100 feet In order to
implement the Artenal. Road Plan, the County Eng2neer has requested
appmxunately 4- 7 feet of dedicanon and a stnp of property to equal 50 feet from

the centerline along Broadway Avenue The County Engineer has not requested
dedication or future acquisition area along Argonne Road
8 The existYng zoning of the property descnbed in the appucanon is Urban
Residential-3 5(UR-3 5) and Commumty Business (B-2) previously established as
Agncultural(A) zoning in 1947 and redesignated to Urban Residential-3 5(UR-3 5)
and Community Business (B-2) on January 1, 1991 pursuant to the Program to
Implement the Spokane County Zomng Code
9 The provisions of RCW 43 21C (The State Envuonmental Policy Act) have been
comphed with and a Determination of Nonsignificance (DNS) was issued The
Committee, after independent review, hereby adopts the DNS
10 The legal requuements for public notice have been fulfilled
11 The owners of adjacent lands expressed neither approval nor disapproval of the
proposed use An adjacent property owner did request a sight obscunng fence
along the west property hne to buffer the proposed use and adjacent land uses
12 The apphcant has demonstrated that condinons have substannally changed since the
onginal zoning of this area and accordingly, the proposed zone reclassificaaon is
justlfied
13 The proposed use will not be detnmental to the public health, safety, morals or
welfare especially in light of the conditions recommended by the revievving
agencies

resolution method pursuant to RCW Chapter 36 94 which includes the owner(s)'

1 A combuied surface water and sewage d.isposal detauled plan shall be approved by
the Spokane County Engineer and the Spokane County Health Distnct pnor to the
issuance of any on-site sewage dhsposal pernut or building pernut for this project
2 Sewage disposal method shall be as authonzed by the Duector of Unlines, Spokane
County
3 Water service shall be coordulated through the Director of Utilities, Spokane County
4 Water service shall be by an existing pubhc water supply when approved by the
Regional Engineer (Spokane), State Department of Health
5 Disposal of sewage effluent beneath paved surfaces is currently prohibited
6 Subject to specific applicanon approval and issuance of pemuts by the Health
Officer, the use of an individual on-site sewage d.isposal system may be authonzed
7 Use of pnvate wells and water systems is prohibited

1 The applicant shall contact the Division of Buildings at the earliest possible stage in
order to be inforcned of code requuements administered/enforced as authonzed by
the State Buildmg Code Act Design/development concerns include addressing,
fire apparatus access roads, fire hydrant/flow, approved water systems, building
accessibihty, construcaon type, occupancy classlfication, exiting, extenor wall
protection, and energy code regulations (Note The Division of Buildings reserves
the nght to confum the actual address at the nme of building permit )

1 All air polluhon regulations must be met
2 Au pollunon regulations requue that dust emissions dunng demolition, construction
and excavanon projects be controlled This may require use of water sprays, tarps,
spnnklers or suspension of activity dunng certain weather condinons Haul roads
should be treated, and enussions from the transfer of earthen matenal must be
controlled, as well as enussions from all other construcaon-related acnvities

3 SCAPCA strongly recommends that all traveled surfaces (ingress, egress, parlang
areas, access roads) be paved and kept clean to minunize dust errnssions
4 Measures must be taken to avoid the deposiuon of dut and mud from unpaved
surfaces onto paved surfaces If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces
5 SCAPCA Regulanon I, Amcle V, requues that a Nonce of Construction and
Apphcation for Approval be subrrutted to and approved by our agency pnor to the
construction, installation or establishment of an air polluaon source
6 Debns generated as a result of this project must be d.isposed of by means other than
burning (i e, construcnon waste, etc )
7 Demohnon and renovation projects must comply with the requuements of CFR 40,
Part 61, Subpart M and of SCAPCA Regulanon I Article IX, both of which address
asbestos concerns Intent to Demolish and Renovate forms are available at the
SCAPCA office
8 All sohd fuel burning devices (wood stoves, pellet stoves, etc ) must comply with
local, state, and federal rules and regulanons

A. Site Size: Approximately 36,500 square feet
B. Comprehensive Plan
1. Land Use Plan: The property is located within the Urban and Major
Commercial categories of the Comprehensive Plan and may be considered a
transitional area. Transitional areas which are between two (2) or more
Comprehensive Plan land uses categories may comply with either of the land
use categories dependent upon the decision makers' site specific approval.

The boundary between the two (2) Comprehensive Plan Land Use categones is
also the present line between the two (2) zone classifications of the subject
property The eastern portion of the site, wluch is approximately the eastern
1400 feet, is presently within the Major Commercial category, and the
remainder of the site is within the Urban category

The Urban category is intended to provide opportunity for development of a
"citylice" envuonment which includes vanous land uses The Urban category
is pnmanly a residential category with commercial uses intended to be
"neighborhood" centers implemented by the Neighborhood Commercial (B-1)
zone The proposed Community Business (B-2) zone is not intended to
unplement the Urban category of the Comprehensive Plan

The Major Commercial category is intended to provide for the opportunity for
development of commercial uses, specifically community and regional shopping
centers, commercial and office uses directly related to major throughways
Highway and artenal stnp commercial areas will usually be made up of
businesses or individual parcels clustered along a heavily traveled street or
highway, each providhng off-street parking
The proposal may be consistent with the Major Commercial and Urban
categones of the Comprehensive Plan xf considered under the transition pohcy
The proposal has direct access to two (2) pnricipal artenals, and provides off-
street parlang which is consistent wnth commercial developments in the Major
Commercial category
2. Arterial Itoad Plan The site fronts Argonne Road and Broadway Avenue
which are both designated by the Spokane County Artenal Road Plan as
Pruicipal Artenals with future nght-of-way widths of 100 feet The County
Engineer is not requesnng dedicaaon or future acquisition area (FAA) along
Argonne Road, but is requesting 4-7 feet of dedication and approxunately
fifteen (15) feet of future acquisition area (FAA) along Broadway Avenue
The proposal has been conditioned to provide for this needed nght-of-way and
future acquisition area (FAA)
C. Site Characteristics The site is presently occupied by a single farruly residence
and accessory structures The residence will remain as part of the project and the
other structures will be removed The remainder of the site is landscaped with grass,
deciduous trees and shrubs
I) . Neeghborhood Characteristics The surrounding area is charactenzed by both
residential and non-residennal uses The Argonne/Mullan Road Comdor has
developed with vanous businesses includmg a travel agency, pet store, photography
studio, medical offices, convenience store, gas station, and others Multi-family
dwellings and single farruly residences are also within the area Less intensive land
uses occur along the flanks of this comdor
E . Zoning Analysis
Pnor to the unplementaaon of the Spokane County Zoning Code on January 1, 1991,
the enare site was zoned Agncultural (A), and within two (2) Comprehensive Land

a Use categones, Urban and Major Commercial Pursuant to the Program to
Implement the Zomng Code on January 1, 1991, land which was zoned Agncultural
(A) and withul the IVlajor Commercial category was redesignated to Commumty
Business (B-2), and land which was Agncultural (A) and within the Urban category
was redesignated to Urban Residential-3 5(UR-3 S) Consequently, the subject
property became a parcel with two (2) zone classlfications, Urban Residential-3 5
(UR-3 5) and Community Business (B-2) This zone change, if approved, would
designate the ennre site as Community Business (B-2)
Most of the properaes along the Argonne/Mullan Road Comdor have been rezoned
over the last ten (10) years to business and multi-family zones Those areas along
Argonne Road north and south of the site are zoned for commercial, professional,
and multi-family uses The area west of the site along Broadway Avenue is zoned to
allow professional offices, single fanvly and multi-family dwellings The most recent
zone reclassificanon in the area was from Urban Residential-3 5(UR-3 5) to
Community Business (B-2) for a medical office building at the northeast corner of
Broadway Avenue and Mullan Road
(ZE-38-92) in 1992
The proposed Community Business (B-2) zone is generally compatible vvith zorung
land use trends in the area

and should not exceed 50 square feet

comment penod ends Apnl 19, 1994 and was advernsed 15 calendar days before said

proposal, and by notice on a sign posted on the proposal site The Heanng Examiner
