ZE-23-01 r , SPOKANE COUNTY HEARING Ex;AMINER RE: Zone Reclassification from the UR-3.5 ) FINDINGS OF FACT, Zone to the UR-22 Zone; ) CONCLUSIUNS OF LAW, Applicant: Ray Veley ) AND DECISION File No. ZE-23-01 ) This matter coming on for public hearing on February 6, 2002, the Hearing Examiner, a#~er review of the zone reclassi~ication application and the entire record, and finding good cause therefore, hereby mal~es the following findings of fact, conclusions of law and decision: I. FINDINGS OF FACT ~ 1. The application requests a rezone of 3.39 acres of land from the ~7rban Residential-3.5 (UR-3.5) zone to the Urban Residential-22 (UR-22) zone, for the development of rofessional p offices. 2. The site is located at the northeast corner of the intersection of Evergreen Road and Valley Way Avenue, in the SW'/a of Section 14, Township 25 North, Range 44 EWM, Spokane County, Washington. 3. The site is currently referenced as County Assessor's tax parcel no. 45143.15b2. The subj ect property is legally described as Tracts A and B of Short Plat No. SP-1251-00, recorded on July 17, 2001, in Book 17, Page 66 of Short Plats, Spokane County Auditor. 4. The applicant is Raymond C. Veley, 20215 North Spotted Road, Deer Park, WA 99006. The site owner is the Estate of Frieda A. Thornberg, c/o Raymond C. Veley, 20215 North Spotted Road, Deer Park, ~VA 9900b. 5. The Hearing Examiner heard the application pursuant to the County Hearing Examiner Ordinance (County Resolution No. 96-0171} and the County Hearing Examiner Rules of Procedure (County Resolution No. 96-0294). 6. The requirements for notice of public hearing were met. 7. The Hearing Examiner conducted site visits on February 5, 2002 and March 3, 2002. S. A public hearing was held on the proposed rezone on February 6, 2002. 9. The County Division of Planning issued a Determination of Nonsignificance for the project ~ on January 18, 2002. ~ 11. The Hearing Examiner takes notice of the County Generalized Comprehensive Plan, GMA Comprehensive Plan and Capital Facilities Plan, GMA Comprehensive Plan map, Phase I development regulations, County Resolution Nos.1-1033 and 2-0037, County Arterial Road Plan maps, County official zoning maps, County Zoning Code, County Code, other applicable development regulations, and prior land use decisions in the vicinity. 12. The record includes the documents in the proj ect file at the time of the public hearing, the documents and testimony submitted at the public hearing, and the items taken notice of by the Hearing Examiner. 13. The site is approximately 3.39 acres in size and rectangular in shape. The property is relatively flat in topography, with a moderate rise in topography from south to north. The northwest portion of the site is improved with a single-family residence, detached garage and two sheds. On July 17, 2001, a final short plat was filed to divide the site from north to south into ~ two lots, for the development of single-family homes. 14. The site plan of record for the proposal illustrates the development of 26,700 square feet of professional office space, contained in six (6) buildings ranging in size from 3,500 square feet to 5,600 square feet, and associated paxking. The existing house and accessory structures on the site would be remaved. A six (6)-foot high, sight-obscuring fence, and Type I(sight-obscuring) landscaping are illustrated along the north and east borders. An enclosed dumpster is illustrated along the northerly border of the east half of the subject property. Access to the proposal is illustrated along Evergreen Road, and to Valley Way Avenue at a point located 30-35 feet from the west boundary of the east half of the site. 15. The site plan of record submitted on November 26, 2001 indicates a maximum building height of 35 feet. At the public hearing, the applicant's representative testified that the buildings would all be single-story and could be constructed at a maximum height of 25 feet. Effective January 1,1991, the zoning of the site was reclassified from the A'cultural ~ Suburban zone of the now expired County Zoning Ordinance to the Urban Residential-3.5 (UR-3.5) zone, under the Program to Implement the Spokane County Zoning Code. The site is also located in the Aquifer Sensitive Overlay zone and the Public Transit Benefit Area designated by the Zoning Code. 17. The current rezone application, environmental checklist, site plan of record and application fees were submitted on November 26, 2001. The application is subj ect to the land use processing requirements in County Resolution No. l-0700. The County Division of Planning issued a determination of completeness for the rezone application on November 30, 2001. The completeness date for the application ~is November 26, 2001. 18. On November 5, 2001, pursuant to the State Growth Management Act (GMA), the County adopted a new Comprehensive Plan ("GMA Comprehensive Plan"}, Urban Growth Area (UGA) boundaries and a Capital Facilities Plan. See County Resolution No.1-1059. On January 15, 2002, the County implemented the GMA Comprehensive Plan, UGA and Capital Facilities Plan; and adopted Phase I development regulations ("Phase I regulations") to implement such plans. T'he County also repealed ~the interim development regulations and interim urban growth area ~ (IUGA) boundaries previously adopted by the County under the State Growth Management Act. See County Resolution No. 2-0037. 19. The site and surrounding land are designated in the County's UGA boundaries. Prior to . January 15, 2002, the site and such surrounding land were designated inside the County's IUGA boundaries. ~ ~ 20. The Phase I regulations allow rezone applications that were complete before the adoption of such regulations on January 15, 2002, pertain to land located within the UGA and are "inconsistent" with the GMA Comprehensive Plan to be processed under the comprehensive plan and land use regulations in effect when the application became complete. If the rezone application is approved, the new zoning is effective for a period of one (1) year, and development of the property may proceed under the conditio~s of the rezone provided a building permit is submitted within the 1-year period. After the 1-year period, the zoning of the property would "cross over" to the zone designated in the crossover ma~rix of the Phase I regulations, If a building permit is applied for during the 1-year period, the conditions of the ~rior rezone continue to apply; provided, if there is a conflict between the conditions and the development standards of the crossover zone, the more restrictive standard applies. 21. The GMA. Comprehensive Plan designates the site, and the land ~ying north, south and east of the site, in the Low Density Residential category. Under the Phase I regulations, the crossover zone for all land in the Low Density Residential category that was zoned UR-3.5 prior to January 15, 2002 is the UR-3.5 zone, Accordingly, if the cur~rent rezone application had not been submitted, or if the Examiner denies the applicat~on, the site would be zoned UR-3.5 pursuant to the Phase I regulations. 22. The proposed zoning for the site, UR-22, is incons~stent with the crossover zone (UR-3.5} for the site under the Phase I regulations. Accordingly, if the current rezone app~ication is approved, development of the site would be subj ect to the development standards of the UR-22 zone and the conditions of approval for the rezone, as long as a building permit is submitted HE Findings, Conclusions and Decision ZE-23-01 Page 3 t ~ within one (1) year. After the 1-year period expires, whether or not a building permit is timely applied for, the zoning of the site would "crossover" to the UR-3.5 zone. If a building permit is applied for within the 1-year period, any conditions of approval imposed under the current rezone to the UR-22 zone would continue to apply to the site upon its crossover to the UR-3.5 zone. See Resolution No. 2-0037, Phase I regulations. 23. The Phase I regulations require any rezone applications submitted under the GMA Comprehensive Plan and Phase I regulations to be consistent with the GMA Comprehensive Plan category for the property, and with the implementing zone set forth in the Phase I regulations for such category. The implementing zone for the Low Density Residential category of the GMA Comprehensive Plan is either the UR-3.5 zone or the Urban Residential-7 (UR-7) zone; provided, if the UR-7 zone is used the density of new development may not exceed a residential (net) density of six (b) dwelling units per acre. Accordingly, any future rezone applications submitted for the site under the Phase I regulations would be limited to a rezone to either the UR-3.5 zone or the UR-7 zone. ~ 24. The GMA Comprehensive Plan designates the land lying along the west side of Evergreen Road in the area east of the site, to a depth of 300 feet, in the Mixed Use category of the GMA ~ Comprehensive Plan. The Mixed Use category continues to the north and south along the west side of Evergreen Road at varying distances. The crossover zone for such category under the Phase I regulations is the zoning of the land prior to adoption of the Phase I regulations on January 15, 2002. The implementing zones for the Mixed Use category are the Urban Residential-12 (UR-12}, UR-22, Neighborhood Business (B-1), Community Business (B-2) zone, and Industrial Park (I-1 } zone. 25. Within the UGA, the Phase I regulations authorize existing commercial and industrial zones to be utilized for development until January 15, 2003, notwithstanding the other transitional provisions in the Phase I regulations. ~ 26. The Examiner must consider the current rezone application under the comprehensive plan and development regulations in effect on November 26, 2001, the date when the application became complete. This includes the old Comprehensive Plan ("Comprehensive Plan"), County Zoning Code, County Road Standards, Critical Areas Ordinance, interim development regulations for land located inside the County's IUGA boundaries, and other development regulations in effect on November 26, 2001. 27. The County Zoning Code was amended in 1998 to increase the maximum residential densit~ (net) allowed in the UR-3.5 zone from 3.5 dwelling units per acre to 4.35 dwelling units per acre. See County Resolution No. 98-0482. 28. The land lying north, south and east of the site is zoned UR-3.5 and is primarily developed with single-family homes at urban densities. In 1996, a final short plat was recorded to divide approximately one (1) acre of land ~ying directly north of the easterly third (1/3) of the site into two {2} lots for single-family homes. See Short Plat No. SP-1034-95, recorded on 2-6-96. Single-family homes have been constructed on such land. In August of 2000, a preliminary short plat was approved to divide approximately 2.5 acres of land lying directly north of the westerly two-thirds {2/3) of the site into four (4) lots for an existing residence and three (3 additional } home sites. See decision dated 8-1-2000 in File No. SP-1243-00. HE Findings, Conclusions and Decision ZE-23-01 Page 4 29. The land lying westerly of the site across Evergreen Road, is across is zoned UR-3.5 and primarily developed with single-family homes, but includes some duplexes, a church and a new business office for a water district adja~cent to the west side of Evergreen Road. Some UR-7 zoning is found further to the southwest. 30. Some existing residences along Evergreen Road in the area have recently been removed or vacated due to the recent widening of Evergreen Road andlor in contemplation of redevelopment. 31. On September 26, 2000, two (2) acres of land located along the west side of Evergreen Road, approximately .3 miles north of the site, was rezoned from the UR-3.5 zone to the UR.-22 zone for the development of 32,000 square feet of professional offices. The office building was limited to two stories and a building height of 35 feet, and has been fully developed. See Hearing Examiner decision in File No. ZE-10-99. The applicant for such project (Mike Silvey) represented the applicant at the public hearing on the current proj ect. 32. The land lying along the south side of Sprague Avenue in the vicinity, to a depth of approximately 200 feet, is designated in the Regional Commercial category of the GMA Comprehensive Plan and zoned Regional Business (B-3) or Community Business (B-2). The crossover zoning for the Regional Commercial category is the zoning of the land prior to January 15, 2002, and the implementing zone for such category is the Regional Business (B-3) zone. 33. On September 8, 2000, two (2) acres of land located approximately 900 feet south of the site, along the east side of Evergreen Road, was rezoned from the UR-22 zone to the B-3 zone. This was to allow development of a building with 8,100 square feet of retail space and 9,000 square feet of inedical office use, at a maximum building height of 35 feet. See Hearing Examiner decision in File No. ZE• 12-00. 34. The County Arterial Road Plan, in both the Comprehensive Plan and the GMA. Comprehensive Plan, designate Evergreen Road, Sprague Avenue and Broadway Avenue in the area as Principal Arterials. The Arterial Road Plan in the Comprehensive Plan and the GMA Comprehensive Plan, respectively designate Valley Way Avenue as a Collector Arterial and an Urban Collector Arterial. Valley V~ay Avenue, west of Evergreen Road, is located approximately 80 feet south of Valley Way Avenue, east of Evergreen Road. 35. Sprague Avenue comprises a major traffic and commercial corridor through the Spokane Valley area of Spokane County, The County recently improved Evergreen Road, north of Sprague Avenue, from a 2-lane road without curb or sidewalk to a S-lane Principal Arterial Road Sect~on, with curb and sidewalk along both sides of the street. A new freeway interchange was also constructed at Interstate 90 and Evergreen Road, located approximately 1.3 miles north of the subj ect property. The Spokane Valley mall and associated retail development is located along the south side of Interstate 90, between Ever~reen Road and Sullivan Road. 36. Valle~ Way Avenue, east of Evergreen Road, consists of a paved road without curb or sidewalk. The right of way for such road is 50 feet wide adjacent to the site, narrows to 40 feet east of the site at Bannen Road, then widens back further to the east. HE Findings, Conclusions and Decision ZE-23-O1 Page 5 ~ G 37. The project would be served by a high level of urban services and facilities; including public sewer and water, and modern utilities. This implements the policies of the Urban category, as well a~ the purpose and intent statement of the UR-22 zone, regarding urban development. Public sewer availability is required for new development located within the County's IUGA boundaries. County Resolution No. 97-08d4. 38. The site meets the definition of "fill-in" development in the Urban category, since it is located between and in close proximity to at least two developed geographic areas having densities and land uses conforming to the land use categories of the Comprehensive Plan designated for such areas, and also because the development will aid in the cost-effectiveness of utilities and public facilities and services. See Comprehensive Plan, glossary and Decision . uideline l,l.a. 39. The Urban category of the Comprehensive Plan recommends that neighborhood commercial uses be located along the heavily traveled streets. The purpose and intent statement for the UR-22 zone, in pertinent part, indicates that the UR-22 zone is usually located adj acent to "major or secondary arterials", and that offices are permitted to provide some of the service ~ needs generated by high-intensity uses. "Maj or" and "secondary" arterials correspond to "Prinncipal" arterials and "Minor" arterials, under the County Zoning Code, and do not include "Collector" arterials. See Zoning Code 14.300.100, definitions. 40. The proposed offices can provide some of the service needs generated by the high-intensity commercial uses located along Sprague Avenue to the south. Office uses tend to have lower ~ traffic impacts and more limited hours of operation than other commercial uses, or multi-family developments, of comparable size. 41. Neighboring residents objected to the proposal expressi~g concern over impacts relating to property values, exterior lighting, noise, increased traffic and traffic safety along Valley Way Avenue, increased crime, building heights, wildlife, incompatibility of commercial development in a residential neighborhood, and other concerns. 42. County Critical Areas maps do not designate any critical areas, such as priority wildlife habitat, on the site. No evidence was submitted that any threatened or endangered species inhabit or depend on the site for survival. 43. No evidence of a traffic engineering nature was submitted to indicate that traffic from the proposal would have any significant adverse impact on traffic capacity or safety along the roads serving the proposal. 44. "Buffering" is a technique of separating potentially incompatible land uses by distance, changing density, landscaping, screening andlor physical features or structures. See Comprehensive Plan, glossary and Decision Guidelines 1.5.1,1.5.2 and b.1.1. The Urban category recommends that height and architectural design be considered in evaluating the impact of n.ew structures on a neighborhood. 45. The maximum building height in the UR-3.5 zone is 35 feet, and is 50 feet in the UR-22 zone. HE Findings, Conclusions and Decision ZE-23-01 Page 6 1 1 46. The site has frontage along Evergreen Road of approximately 246 feet, and frontage along Valley Way Avenue of approximately 641 feet. This extension to the east is more than twice as far as the Mixed Use category extends along the west side of Evergreen Road under the GMA Comprehensive Plan, and penetrates deeper into residential neighborhoods than other UR-22 ~ zones and commercial zoning along Evergreen Road to the north and south. The easterly half of the site also has primary access along Valley Way Avenue, a Collector Arterial, at a point directly opposite single-family homes zoned UR-3.5. 47. The proposal would place commercial buildings and associated parking lots within 20 feet of the single-family residential lots lying directly north and east of the subject property, zoned UR-3.5. The landscaping and sight-obscuring screening required by the UR-22 zone along the east and north property line of the site, the reduced building heights and the aesthetically designed and landscaped buildings proposed by the applicant do not provide a sufficient buffer for adj acent and nea.rby single-family homes. 48. Enhanced buffering is necessary to mitigate the impact of the proposed office development on the single-family residential neighborhood located near or adj acent to the site. 49. The rezone should be denied for the east half of the subject property. Access should also be limited to Evergreen Road. 50. The rezone should be approved for the west half (Tract "A") of the site, which is 1.69 acres in size. A maximum building height of 35 feet and two (2) stories should be imposed on development of the west half of the site, whichever is less. The buildings should be setback from the south property line to lessen the height impact of the office building (s) constructed on the west half of the site. 51. The amount of professional office space proposed by the applicant, (26,700 square feet), divided by the acreage of Tract "A" (1.39 acres), is approximately 15,800 square feet per acre. This compares favorably to the 16,000 square feet of office space per acre authorized for the UR- 22 zone approved ~n Fi~e No. ZE-10-99. 52. The rezone approved for the west half of the site is subject to the landscaping and screening requirements of the UR-22 zone, adj acent to UR-3.5 zoning, as set forth above. 53, The County Zoning Code restricts exterior illumination from illuminating directly any building or structure on an adj acent lot containing a residence or building. 54, The project, as modified, has been conditioned for compliance with the development standards of the UR-22 zone and other applicable provisions of the County Zoning Code, and the recommendations of the commenting public agencies. As conditioned, the project will be reasonably compatible with, and not have a significant negative impact on, neighboring land uses. The proj ect, as conditioned, generally conforms to the Comprehensive Plan. 55. No public agencies objected to the Determination of Nonsignificance (DNS) issued for the proposal by the County Division of Planning. The proposal, as modified, will not have more than a moderate effect on the quality of the environment, and the Examiner concurs with HE Findings, Conclusions and Decision ZE-23-01 Page 7 i ► issuance of the DNS. The procedural requirements of chapter 43.21 C RCW and chapter 11.10 of the Spokane Coun~y Code have been met. 56. Changed conditions have occurred since the zoning of the site was re-designated to the UR-3.5 zone on January 1,1991, pursuant to the Program to Implement the Spokane County Zoning Code. This includes the availability of public sewer in the area, recent road improvements to Evergreen Road and its interchange with I-90, recent rezones to the UR-22 along Evergreen Road to the northwest, increased residential~ growth in the area, and increased traffic in the area. 57. The site plan does not illustrate required landscaping along the west and south boundaries of the site. The rezone will be required to provide landscaping and screening as required by the Zoning Code. Based on the above findings of fact, the Hearing Examiner enters the following: II. CONCLUSIONS OF LAW ~ 1. The proposed rezone, as modified and conditioned, generally conforms to the Comprehensive Plan. 2. The proposed rezone, as modified and conditioned, bears a substantial relationship, and will not be detrimental, to the public health, safety or welfare. 3. A change in economic, technological, or land use conditions has occurred to warrant the proposed rezone, as modified and conditioned. A substantial change of circumstances has occurred in the area since the site was last zoned. 4. The procedural requirements of the State Environmental Policy Act and the County's Local Environmental Ordinance have been met. The proposal, as conditioned and modified, will not have a significant, probable adverse impact on the environment. 5. The proposed rezone, as modified and conditioned, meets the criteria established by Washington case law for approving a rezone, and the criteria established in paxagraphs 14.402.020 (1 }(2) of the County Zoning Code for amending the County of~.cial zoning map. b. Approval of the land use application is appropriate under section 11 of the Count~ Hearing Examiner Qrdinance, adopted by County Resolution No. 96-0171. III. DECISION Based on the above Findings of Fact and Conclusions of Law, the application for a rezone to the Urban Residential-22 (UR-22) zone is hereby approved for Tract "A" of Short Plat No. SP-1215-00, subj ect to the conditions of approvai of the public agencies stated below, and is hereby denied for Tract "B" of Short Plat No. SP-1215-00. HE Findings, Conclusions and Decision ZE-23-01 Page 8 .Any conditions of such agencies that have been added or significantly revised by the Hearing Examiner are italicized. Failure to comply with the conditions of this approval may result in revocation of this approval by the Hearing Examiner, This approval does not waive the applicant's obligation to comply with all other requirements of other agencies with jurisdiction. SPOKANE COUNTY DIVISI01~ OF PLANNING 1. All conditions imposed by the Hearing Examiner shall be binding on the "Applicant," which term shall include the owner or owners of the property, heirs, assigns and successors. 2. The zone change applies to the following real property: Tract "A" of Short Plat No. SP- 1251-00, recorded on July 17, 2001, in Book 17, Page 66 of Short Plats, Spokane County Auditor. . 3. The proposal shall comply with the Urban Residential-22 (UR-22) zone, the Aquifer Sensitive Area (ASA) ~verlay zone and other applicable provisions of the Spokane County Zoning Code, as amended. 4. Any change of conditions application submitted for the site shall comply with Section 14.504.040 of the County Zoning Code, as amended. All variations must conform to regulations set forth in the Spokane County Zoning Code, and the original intent of the development plans shall be maintained. ~ 5. Development of the site is litnited to no more than 26, 700 square feet of professional offices, including but not limited to medical o~ces. 6. All buildings shall be set back at least 70 feet from the south p~operty line of the subject property. 7. Buildings shall be limited to a maxi~num height of 35 feet or two (2) stories, whichever standard pYovides a lesse~ building height. "Story" and "building height" shall be as def ned in Section 14.300.100 of the County Zoning Code, as amended. 8. Vehicular access shall be restricted to ~vergreen Road. 9. Approval is required from the Director of the Division of Planningldesignee of a specific lighting and signing plan for the described property prior to the release of any building permit. 10. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 11. A specific landscape plan, planting schedule and provisions for the maintenance acceptable to the Director of the Division of Planning/designee shall be submitted with a performance bond or other suitable guarantee for the proj ect prior to release of any building permits. Landscaping HE Findings, Conclusions and Decision ZE-23-O1 Page 9 < < shall be installed and maintained so that sight distance at access points is not obscured or impaired. 12. Pursuant to Section I of the Phase I Development Regulations adopted on January 15, 2002, (County Resolution No. 2-0077), the zone reclassification shall be effective for a period of one (1) year from February 15, 2002. Building Permits must be applied for during the one (1)-year period, in order to develop the subject property under the Urban Residential-22 (UR-22) zone, subject to the conditions of approval imposed herein. 13, At the end of the one (1) year-period stated above, the zoning of the site will be reclassified to the applicable crossover zone for the site under the Phase I Development Regulations, as amended. The conditions of approval imposed herein shall continue to apply to any development of the site conducted pursuant to a complete building peYmit application submitted within the one (1) year period. 14. The Division of Plar~ning shall prepare and record with the Spokane County Auditor a Title Notice, noting that the property in question is subject to, a variety of speciai conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Planning. The Title Notice shall generally provide as follows: "The parcel of property legally described as Tract "A" of Short Plat No. SP-1251-00, recorded on July 17, 2001, in Book 17, Page 66 of Short Plats, Spokane County Auditor is the subj ect of a land use action by the Spokane County Hearing Examiner on March 4, 2002, imposing a variety of special development conditions. File No. ZE-23-O1 is available for inspection and copying in the Spokane County Division of Planning." SP4KANE CUUNTY BUILDING AND CODE ENFORCEMENT 1. The applicant should contact the Division of Building and Code Enforcement at the earliest possible stage in order to be informed of code requirements administered/enforced as authorized by the state Building Code Act. Design/development concerns include addressing, fire apparatus access roads, fire hydrant flow, approved water systems, building accessibility, construction type, occupancy classification, existing exte~or wall protection and energy code requirements. SPOKANE DIVISIUN UF ENGINEERING AND ROADS Prior to release of a building permit or use of the property as proposed; l. Access perm~ts for approaches to the County Road System shall be obtained from the County Engineer. 2. A Professional Engineer (P.E.), licensed in the State of Washington, shall submit road and storm drainage construction plans and a drainage report that conform to the versions of the Spokane Count~ Standards for Road and Sewer Construction, the Guidelines for Stormwater HE Findings, Conclusions and Decision ZE-23-01 Page 10 a ~ . ~ Management, and all applicable federal, state, and local regulations and laws that are in effect at the time of the plan submittal or at the time of the development permit application(s). The final road and storm drainage plans and drainage report shall receive the Count~ Engineer's acceptance prior to release of any Grading, Building, or Right-of Way Permit. 3. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard engineering practices. Paving or surfacing as approved by the County Engineer will be required for any portion of the project which is to be occupied or traveled by vehicles. 4. The construction of the roadway improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 5. The County Engineer has designated a Collector Roadway Section for the irnprovement of Valley ~Vay Avenue, which is adjacent to the proposed development. This will require the addition of approximately 8.5-10.5 feet of asphalt along the frontage of the development. . Curbing and sidewalk must also be constructed. ~ ~ 6. ,All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge construction and other applicable county standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 7. Roadway standards, typical roadway sections and drainage plan requirements axe found in Spokane County Resolution No. l-0298 as amended and are applicable to this proposal. 8. No construction work is to be performed within the existing or proposed right of way until a permit has been issued by the County Engineer. All work within the public road right of way is subj ect to inspection and approval by the County Engineer. 9. All required construction within the existing or proposed public right of way is to be completed prior to the release of a building permit or a bond in an amount estimated by the County Engineer to cover the cost of construction or improvements shall be filed with the . County Engineer. 10. The applicant is advised that there may exist utilities either underground or overhead affecting the applicant's property, including property to be dedicated or set aside future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should contact the applicable utilities regarding responsibility for adjustment or relocation costs and to make arrangements for any necessary work. 11. The applicant shall grant applicable border easements adj acent to Spokane County Right of UVay per Spokane County Standards. 12. This proposed zone change has been reviewed according to the site plan of record, Any modifications in this site plan of record shall require additional review by the County Engineer. At such time a revised site plan is submitted for review, the applicant shall submit detailed traffic HE Findings, Conclusions and Decision ZE-23-O1 Page I 1 1 ~ information for review by the County Engineer to determine what traffic impacts, if any, that the development would have on surrounding infrastructure. The applicant is advised that mitigation maybe required for off site improvements. 13. Vehicular access to the site is restricted to Evergreen Road. SPUKANE REGIONAL HEALTH DISTRICT 1. The sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. ~ater service shall be by an existing public water supply when approved by the Regional Engineer (Spokane}, State Department of Health. 4. Dec~sion Guidelines 1.3.3 and 1.6.1 recommend the provision of sanitary and storm sewer for developments to protect water quali~y when the provision is consistent uuith Coun~y plans, policies and regulations. Public sewer is available to the site and stormwa~er facilities are required for site development. Decision Guideline 1.5.1 recommends the use of buffering andlor landscaping to mitigate the difference be~reen proposed developments and exesting uses. Section 14.806.040 of the Spokane Coun~y Zoning Code requires a strip of Type I landscaping, a minimum of 20 feet in wid~h, along all property lines adjacen~ to the existing Urban Residential-3.5 ~~JR-3.5) zone. The subject site is bordered on the north ar~d east by the Urban Residential~3.5 (UR-3.5) zone and Section 14.806.040 also requires a 20 foot wide strip of Type III landscaping along Evergreen Road and Valleyway Avenue. In addition, Section 14.622.365 of the Zoning Code requires a six (6~ foot high fence, wall or sofid landscaping to be constructed along the internal property boundaries. This requirement is intended to supplement the required landscaping. Decision Guideline 1.5.4 recommends that sidewalk ~acilities be required along arterials connecting residential areas with commercial areas. Evergreen Road is a 4-lane road with existing curbs and sideuualks, and Valleyr~ay Avenue is a 2-lane road with no curbing or sidewalks. The Spokane Coun~ Division o~ Engineering and Roads has recommended a condition of approval requiring the construction of 8.5 to 10.5 of additional asphalt along the Valley~ray frontage of the site, and curbing and sideuualk. Objective 1.5.e recommends that when a neighborhood experiences pressure for a change of character, such change shall be permitted~ upon appropriate review. The proposed use is located with direct access to arterials and vuithin close proximi~y to a larger transportation netv~ork. The proposed use is more intensive ~han what currently exists in the adjacent areas and the site as located adjacent to existing residential uses. Required landscaping, fencing, building setbacks and proposed building height may~help to reduce impacts to residential homes Iocated adjacent to the site. Zoni~~: The purpose and intent of the proposed Urban Residential-22 (UR-22) zone is to set standards for the orderly development of residential property in a manner that provides a desirable living environment that is compatible with surrounding land uses and assures the protection of property values. It is intended that this zone be used to add to the varie~y of housing types and densities, and as an implementation tool for the Urban category of the Comprehensive Plan. Professianal offices are permi~ed in the Urban Residential-22 (UR-22) zone in orde~ $o provide some of the service needs generated by high-intensity land uses.
