SUIVIMARY OF PROPOSAL AND DECISION Proposal: Zone reclassification from the Urban Residential-3.5 (UR-3.5) zone to the Urban Residential-22 (iJR-22) zone for a professional office building. Decision: Approved, subject to conditions. II. FINDINGS OF FACT AND CONCLUSIONS The Hearing Examiner has reviewed the zone reclassification application and the evidence of record and adopts the following findings of fact and conclusions: A. GENERAL INFORMATION: Applicant: Kim Impecoven Spokane Structures 100 North Mullan Road, Suite 202 Spokane, WA 99206 Address: 521 North Argonne Road Location: Generally located south of and adjacent to Alki Avenue and approximately 165 feet west of ,Argonne Road, in the NW '/4 of Section 18, Township 25 North, Range 44 EWM, Spokane County, Washington. Legal Description: The east half of Lot 3 and Lot 2 of Block 23, Hutchinson's Addition, EXCEPT the east 42.29 feet of said Lot 2 and also EXCEPT the south 180.00 feet of said lots. Zoning: Urban Residential-3.5 (LTR-3.5). Comprehensive Plan Category: The property is designated in the Urban category of the Spokane County Generalized Comprehensive Plan. The site is also within the Priority Sewer Service Area (PSSA). HE Findings, Conclusions and Decision ZE-16-96 Page 1 . a Environmental Review: A Deternunation of Nonsignificance was issued by the Division of Building and Planning on April 19, 1996. Site Description: The site is approximately 40,300 square feet in size, with 145 feet of frontage on Alki Avenue and 130 feet of depth. The site is flat and improved with a single-family residence on the eastern portion of the site. The site also contains several accessory structures associated with the residence, all of which structures will be removed. I Surrounding Conditions: The site is located one lot west of Argonne/Mullan Roads, a major north/south traffic corridor in the Spokane Valley that is accessed from the site via Alki Avenue. Broadway Avenue, a busy eastJwest arterial, is located one block north of Alki. The neighborhood appears to be in transition from single-family uses towards more intensive development, including oflices and commercial uses. Single-family residences are found south and west of the site. A single-family residence is found between the site and Argonne Road, and a bank is located across Argonne Road from such residence. Offices and a single-family residences are found to the north. Project Description: The site plan shows the subject property in conjunction with the property to the east, which is adjacent to Argonne Road and is an existing Community Business (B-2) zone. The applicant proposes to develop both parcels with professional office buildings. The site plan does not show compliance with all landscaping requirements, but the applicant intends to seek administrative relief pursuant to Spokane County Zoning Code 14.806.080. The proposal also deviates slightly from the required parking and rear setback requirement of the Zoning Code. The site plan is general in nature, with detailed review to determine compliance with all the development standards of the Zoning Code recommended to be administrative and to occur prior to the issuance of a building permit or change of use pernvt. application, Waslungton case law generally provides that (1) there is no presumption tn favor of the rezone, (2) the applicant for the rezone must prove that condrtions have substantially changed in the area since the last zomng of the property and (3) the rezone proposal must bear a substantial relationship to the public health safety or welfare Parkridee v Seattle, 98 Wn 2d 4542 462 (1978), Biarnson v Kitsap Countv, 78 Wn App 840 (1995) Spokane County Zorung Code Section 14 402 (1)(2) indicates that consistency with the Comprehensive Plan, detnment to the public welfare and changed circumstances are relevant cntena to consider when a srte-specific rezone is sought The proposed rezone must also be consistent vvith the Spokane County Zorung Code, the State Envu-onmental Policy Act the County's Local Environmental Ordinance and other applicable land use regulations Conditions may be imposed to assure the consistency of the proposal vvith applicable regulations The following malang a rezone decision Belcher v Kitsav Countv 60 Wn App 949, 953 (1991) Deviation from a comprehensive plan does not necessanly render a rezone illegal, only general conformance is required Bassaru v Countv Comrrussioners, 70 Wn App 389, 396 (1993) The site is located in the Urban category of the Comprehensive Plan The Urban category is intended to provide the opportunity for development of a"city-like' environment which includes vanous land uses intensive residential development served by a fugh level of public facilities and HE Findings, Conclusions and Decision ZE-16-96 Page 3 w urban services (e g water sarutary and storm sewer lines police and fire protection and other features) The Urban category is pnmanly a residential category of single-family, duplex, multifamily and condomuuum buildings along with neighborhood commercial, light industnal, and public and recreational facihties The Urban Residential-22 (UR-22) zone is an implementation tool for the Urban category Offices are perntitted in the UR-22 zone to provide some of the service needs generated by high-intensity uses See SCZC 14 622 100 The Urban category indicates that the more intensive uses should be located near the more heavily traveled streets Buffenng, landscaping screerung or performance standards may be used to rrutigate the differences between uses recommended in the Urban category that he adjacent to each other The proposal generally complies with the goals, obJectives and decision guidelines of the Urban category The site is served by a high level of urban sernces, including pubhc sewer The proposal is located near and has converuent access to the Argonne/Mullan comdor to the east and Broadway Avenue to the north No testimony was presented at the public heanng in opposition to the proposal The applicant testified at the public heanng that the residence to the east is owned by the applicant is currently vacant and will be removed in the near future Such adjacent lot is zoned Community Business (B-2) The testunony also indicated that the adjacent lots to the west and south are vacant for 200 feet before encountenng a lot improved with a single-fanuly residence North across Alki Avenue is a parcel with frontage on Argonne Road and extendmg west about half the westward extension of the site, wlvch parcel is zoned UR-22 and is improved with offices A single-family residence is also located across Alla Avenue from the srte to the northwest The proposal vvill provide transrtion from the commercial uses along Argonne Road to the east and the lower intensrty residential uses to the west There is sufficient buffering to the existing single-family dwellings near the srte, and comphance with the development standards of the zone will also facilitate such buffering There are additional UR-22 zones along Argonne road both north and south of the site, with westward extensions beyond those of the proposal 2 Conditions in the area in which the orovertv is located have chanized substantiallv since the prooertv was last zoned In applying the changed circumstances test, courts have looked at a vanety of factors, including changed public opiruon, changes in land use patterns in the area of the rezone proposal, and changes on the property itself The Zonuig Code references changes ui "econonuc, technological or land use conditions' as factors that will support a rezone Spokane County Zoning Code Section 14 402 020 (2) Washington courts have not required a strong' shovving of change The rule is flexible, and each case is to be judged on its own facts Bassaru v Countv Comrmssioners, 70 Wn App 389, 394 (1993) Recent cases have held that changed cucumstances are not required for a rezone if the proposed rezone implements policies of a comprehensive plan Btarnson, at 846, Save Our Rural Environment v Snohorrush Countv, 99 Wn 2d 363 370-371 (1983) There is sufficient evidence of change in the area since the adoption of the Zorung Code in 1986, and the cross-over zorung of the site to the Urban Residential-3 5(UR-3 5) zone in 1991, to justify rezorung the site to the Urban Residential-22 (UR-22) zone As indicated in the staff report and the rezone application filled out by the applicant, the Argonne-Mullan comdor has developed pnmanly as a commercial area, with a transition from residential uses to business HE Findings Conclusions and Comprehensive Plan No oppositican was expressed to the proposal at the public heanng 4 The vroDosed zone change comnlies with the vrovislons of the State Environmental Policv Act and the Countv s Local Environmental Ordinance The procedural reqwrements of chapter 43 21 C RCW and chapter 11 10 of the Spokane County Code have been met The Heanng Exanuner concurs with the Determunation of Nonsigruficance issued by the Division of Building and Plantung 5 The oronosal, as conditioned. comvlies with the Urban Residential-22 (IJR-22) zone, the Sookane Countv Zonuniz Code lSCZCI. and awlicable land use reiaulations The srte ptan shows several deviations from apphcable development standards of the Zorung cade as summanzed in the Division of Building and Planning staff report The rear setback 2s shown at only 14 feet, wlule 15 feet is requvred See SCZC 14 622 325 (4) However, the apphcant indicated that it will apply for a one (1) foot administrative exception from such requirement, pursuant to SCZG 14 506 020 (1) The proposal provides only five (5) feet of Type III landscaping along Alki Avenue whereas SCZC 14 806 040 (2)(a) requires 20 feet Further, 20 feet of Type I landscaping 1s required along the west and south borders of the site, adjacent to the Urban-Residential-3 5 zones, whereas only five (5) feet and 14 feet are shown respectively SCZC 14 806 040 (1)(d) The applicant indicated that it wiU request modification from these landscaping requirements on the basis that more than 15 % of the srte u+ill be landscaped and considenng that the lots adjacent to the west and south borders of the site are currently vacant See SCZC 14 806 080 (a) The site plan also does not show the six (6)-foot-hugh wall, solid landscaping ar sight- obscunng fence required along the baundary of any UR-22 zone whuch hes across from an UR-22 zone, which in thls case would involve the svuth and west borders of the srte See SCZC 14 622 365 In this regard, the applicant indicated that cucumstances might change in the area due to a short plat involving the land located to the west and south vnctuding the extension vf an access road in this location The site plan also shows off-street parkzng for only 11 velucles wluie the Zoning Code reqwres a mirumum of 13 spaces SCZC 14 802 040 (17) The applicant testified that the size of the proposed building on the srte made it difficult to meet the required parlung This is a self- unposed hardsh.ip and would not appear to provide a basis for noncomphance with such requtrements HE Findings Conclusions and are met The proposal has been conditioned for compliance with such requirements ffi DECISION Based on the Findings of Fact and Conclusions above the above application for a zone reclassification is
