of the site is currently bemg developed for a 2-story, 8-tenant, leasable office building The
remauider of the srte is undeveloped
Surroundwg Condihons Argonne Road is designated as a Prulcipal Artenal by the County
Artenal Road Plan, and is part of a one-way couplet with Mullan Road The couplet compnses a
major traffic and commercial comdor in the Spokane Va11ey area of the county Most of the land
frontuig the couplet has been developed for medicaUprofessional offices, banks and specialized
retail uses, along with some interspersed apartments and single-fanuly homes Broadway Avenue
to the north is designated as a Pnncipal Artenal, while Valleyway Avenue to the south is
designated as a Muior Artenal Surrounding land uses and zorung aze well-descnbed on page 9-
10 of the Staff Report
Project Description The apphcant requests a rezone of the westerly porhon of the site to
allow the enhre site to be developed under the B-2 zone The srte plan of record shows the office
builchng and associated pazking lot under construchon on the easterly half of the site, with the
westerly portion reserved for speculafiive commercial development. Twenty (20) feet of Type I

In considenng a rezone applicanon, Waslungton case law generally provYdes that 1) there is
no presumption in favor of the rezone, 2) the apphcant for the rezone must prove that con(htions
have substanhally changed m the area since the last zomng of the property, and 3) the rezone
proposal must bear a substanhal relationslup to the pubhc health, safety or welfare Parkndge v
Seattle, 98 Wn 2d 454, 462, 573 P 2d 359 (1978), and Bjarnson v Kitsap County, 78 Wn. App

A comprehensive plan is considered as a general bluepruit for land use regulation by local

Report The report finds that the proposed zone reclassifiication generally forms with the
Comprehensive Plan, based on apphcation of the transihon poucy and the general consistency of
the project with the Major Commercial category of the Comprehensive Plan The Hearmg

The project appears to extend about the same distance west into the Urban category as other
commercial zonuzg and uses in the vicuuty along the west side of Argonne Road No objechons
to the project were received from neighboruig property owners
The project is condihoned for comphance wrth the B-2 zone, wnth detailed review for
comphance mnth such zone and other appucable regulahons to occur pnor to issuance of a
building pernut The B-2 zone does provide some buffering protections for adjacent UR 3 5
zone uses, incluchng enhanced penmeter landscaping
No pubhc agencies requested that the Deternunation of Nonsigruficance (DNS) for the
project be withdrawn or modxfied, or alleged that the project would have sigruficant, probable
adverse unpacts on the environment As condzrioned, the proposal will not have more than a
moderate effect on the quality of the envYronment, and issuance of the DNS was appropnate
The procedural reqturements of chapter 43 21 C RCW (SEPA) and chapter 11 10 of the Spokane
County Code have been met

In appiying the changed cucumstances test, courts have looked at a vanety of factors,
includuig changed pubhc opuuon, changes in land use patterns in the area of the rezone proposal,

Recent cases hold that changed circumstances are not reqtured for a rezone if the proposed
rezone unplements pohcies of a comprehensive plan See Bjarnson v Kitsap County, 78 Wn.
App 840, 846 (1995), and Save Our Rural Eninronment v Snohomuh County, 99 Wn 2d 363,
370-371 (1983), and Tugwell v Kithtas County, 90 Wn App 1, 8, footnote 6(1997) As
dsscussed above, the project generally conforms to the Comprehensive Plan
Changed conchtions wluch support the rezone include recent commercial rezones in the
area along Argonne Road, and increased traffic and commercial development along the Argonne-
Mullan couplet

and Urban categones of the Comprehensive Plan, inside the Pnonty
Sewer Service Area (PSSA), mside the Aquifer Sensitive Area (ASA)
overlay zone, and uiside the Interun Urban Growth Area (IUGA)
boundary
The portion of the srte presently zoned Commumty Business (B-2) is
located vvithin the Major Commercial category of the Comprehensive
Plan The Ma,Jor Commercial category is intended to provide the
opportuiuty for development of commercial uses, includuig commurvty
and regional shopping centers duectly related to major throughways
Uses in major commercial areas vvill vary from supermazkets, drug
stores and laundromats to full-line department stores, lughly specialized
shops and professional offices Major commercial azeas also require a
full line of services and utilities These include service by, or
commrtment to sanitary and storm sewers, public water systems and
underground utilrties
The Comprehensive Plan emphasizes the need to ensure compahbility of
commercial development with adjacent non-commercial uses through
pleasing aesthetic and architectural treatment of new development which
elimuiates or is generally not charactenzed by signage clutter, provides
maintained landscaping, screens extenor storage, provides sufficient
setbacks and screens parking areas The Major Commercial category is
intended to be unplemented by the Commumty Business (B-2) aad
Regional Business (B-3) zones The existing Commututy Business (B-
2) zone is consistent rnnih, and unplements the Goals, Objectives and
Decision Guidelines of the Major Commercial category of the
Comprehensive Plan
The portion of the site that is presently zoned Urban Residential-3 5
(UR-3 5) is located vvithin the Urban category of the Comprehensive
Plan The Urban category is intended to provide the opportumty for
development of a"city-lilce" envuonment which includes vanous land
uses, intensive residential development, and public faclhhes and services

Urban areas wnll be the most intensely developed of all the categones
The Urban category is pnmanly a residential category of single family,
two-fanuly, multifamily, and condomuuum bwldings along wnth
neighborhood commercial, hght industnal, and public and recreational
facilities The proposed Commumty Business (B-2) zone is intended to
implement the Major Commercial category of the Comprehensive Plan
wlule the Neighborhood Business (B-1) zone is the commercial zone
that is intended to implement the Urban category because of the low-
intensrty neighborhood uses that are allowed in the B-1 zone
The proposed zone reclassification from Urban Residential-3 5(UR-3 5)
to Commumty Busmess (B-2) is generally not consistent with the Urban
Comprehensive Plan category However, the subject property may be
considered a transihon area
A"transition area" is the area of land located along the boundary
befiween two applicable land use categones It is the intent that the
established boundanes between land use categones are accurate and
definable on the ground, but rt is also recognized that a specific proposal
may cross these boundaries, as is the case wnth this proposed zone
reclassificanon In these instances, depending on the impact to existing
land use categones and the distance a use intrudes into an adjacent
category, a Comprehensive Plan amendment may not be reqlured The
"transition area " can allow developments complyuig vrnth either of the
Land-Use map categones depending upon the Heanng Exa.miner's
approval of the specific proposed srte development

adjacent to Argonne Road The Spokane County Artenal Road Plan
identifies Argonne Road as a Principal Artenal The Spokane County
Divrsion of Engineenng and Roads has not requested any dedication or
future acquisition area (FAA) along Argonne Road at this tune
E Site Characterishcs The eastern portion of the srte wluch is currently zoned
Commumty Business (B-2) is presently under construchon The Spokane County
Division of Building and Planning issued a building pernut on the Commumty
Business (B-2) portion of the srte for an eight tenant leasable office building on
March 7, 1997 The remauider of the site is undeveloped, vacant land
F Neighborhood Characteristics The surrounduig area is chazactenzed by both
residenual and non-residential uses The Argonne/Mullan comdor has developed

wnth frontage on Argonne Road, are zoned for commercial uses Those properties
wluch are located east of land adjacent to Argonne Road are zoned for residential
uses

Recently, a zone reclassification from Urban Residential-3 5(UR-3 5) and
Commuruty Business (B-2) to Commuruty Business (B-2) was approved for retail
sales, a beauty salon, and general B-2 uses on approxunately 36,000 square feet
(ZE-6-94) The property is located at the northwest corner of Broadway Avenue
and Argonne Road, approximately 1,000 feet north of the proposal This rezone
was approved by the Heanng Examiner Committee on Apn121, 1994
A zone reclassification from Urban Residential-7 (UR-7) to Regional Business
(B-3) was also approved by the Heanng Examiner Committee on January 25,
1995, for a bingo facility and those uses allowed in the Regional Business (B-3)
zone Tlus rezone encompassed 15 acres located between Argonne and Mullan
Roads, approximately 330 feet south of Broadway Avenue

(5) feet of Type III landscaping along Argonne Road as required by the
Spokane County Zoning Code The site plan also illustrates five (5) feet of
Type III landscaping along the east-half of the south property line The west-
half of the site illustrates twenty (20) feet of Type I landscaping along the
north, south, and west property lines The twenty-foot vvide stnp of Type I
landscaping is reqwred by the Zorung Code when a business use is located
adjacent to land zoned for urban uses, including the Urban Residential-3 5
(UR-3 5) zone, which is the adjacent zoning along the west portion of the srte
Site Plan Compuance The proposed srte plan of record is generally
consistent with the development standazds of the Spokane County Zorung
Code A detailed review for the west-half of the property will occur at time of
