said owner(s) and auccessor(s)further agree (1) that the improvements
or construction contemplated within the proposed RID are feasible and
(2) that the benefits to be derived from the formation of the RID by
the property included therein, together with the amount of any County
participation, exceeds the cost and expense of formation of the RID,
and (3) that the property within the proposed RID ia sufficiently
developed, provided, themselves, their heira, grantees, aseigns and
successor(s) shall retain the right, as authorized under RCW 36 88 090,
to object to any asaessment(s) on the property ae a result of the
improvementa called for in conjunction with the formation of a RID by
either the petition or resolution method under Chapter 36 88 RCW and to
appeal to the Superior Court the decision of the Board of County
Commissioners confirming the final aesessment roll, provided further,
it is recognized that actual assessments may vary from asseesment
estimate ao long as they do not exceed a figure equal to the increased
true and f air value improvement ( s) add ( s) to the property
It is further acknowledged and agreed that at such time as a RID is
created or any County Road Improvement project is authorized by Spokane

The RID waiver contained in this agreement shall expire after ten (10)

9 The County Engineer has designated a Local Access Roadway Section for
the improvement of Alki Avenue whieh is adjaCent to the propoaed
development This will require the addition of approximately 6-8 feet
of asphalt along the frontage of the development The conatruction of
curbing and sidewalk is also required
10 The proposed plat shall be improved to the standarda set forth in
Spokane County Board of Commissioners Resolution No 95-0498, as
amended, which eetabliahes regulationa for roads, approaches, drainage
and fees in new construction
11 The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County

That the individuals and parties named herein as having an interest in the above described property or project agree
to the following:
1. Reimburse Spokane County for project review and inspection fees as specified in Ciiapter 9.14 of
the Spokane County Code. The fees will be based on actual salary costs incurred by Spokane
County for project reviews and / or inspections plus a ten percent administrative charge, and will
be billed monthly as accrued. Any billing amounts due, including any expenses incurred in the
collection of an overdue account, must be paid prior to the County's acceptance of the project for
filing. If a project is approved and/or filed with a balance still owing, the unpaid balance sllall be
paid within 30 days of the invoice date.
2. The unclersigned agrees that these fees are due and payable tipon receipt of the billing as specified
above.
3. Any invoices not paid within 30 days of the invoice date will be consiciered delinqtient. if any
outstanding balance on the account for tliis project is not paid witliin 30 days of tiie invoice date,
no furtlier reviews of the project doctiments will be conducted until the entire account balance is
paid. Any balance on the account for this project not paid within 65 days of tlie invoice date may
result in legal action or the initiation of other collection procedures, including referral to a
collection agency. The Sponsor will be liable for any and all expenses incurred by the County for
the coltection of overdue accounts.

approximately 65 acres into four tracts for single family residential development
are generally consistent vath the Goals, Objechves and Decision Guidehnes of the
Urban category of the Comprehensive Plan. Further, the proposals can
demonstrate general comphance wrth the development standards for the Urban
Residential-12 (UR-12) zone with the srte plan/preliminary short plat map
modificarions mdicated in tlus staff report. Although the proposed density is not
consistent vvith the densities of existing residenhal development vvithin the
