Existing zones along Pines Road are generally related to retail and
office uses. Agricuitural Suburban and iNultiple Family Suburban
zones are found 300 ft. beyond Pines Road in both directions.
Approximately 500 ft. northeast of tf~is proposal the Valley Generai
Hospital property was upgraded to Residential Office for hospital
expansion, medical offices and apartment uses.
At the end of the 5 year Zoning Code c rossover period, the
predominate new zones in the immediate area ►rill be Neighborhood
Business ~B-1), Urban Residential 22 (UR-22) and Urban residential
3.5 ~UR-3,5). The remainder of this ownership, west f rom this
proposal to Pines Road, will c rossover from the existing Cammercial
zone to Regional Business (B-3) Zone.
Uariances from building setback standards of the Spokane County
Zoning Ordinance have been approved over the past few years in the
immediate area~as follows:

Existing on SITE: Duplex, office, sign company, parking and storage.
To the NORTH: Apartments and auto repair.

Pines Road frontages contain a variety of retail uses togetl~er with
several office buildings. Land use patterns removed from Pines Road
consist of some apartments and generaliy low density single family,
The predominate single land use in the area is the Modern Electric
Water Company's approximate 8 acre complex adjacent to this proposal
on the south. Guidelines along that company's north property line
~and this proposal`s south property line~ are setback only 5 f t. per
the approved Variance VE-30-6b.

Pines Road easterly of the site is a State rignt
of way improved with five paved lanes, curbs and
sidewalks.
The subject lies within the boundaries of the

Proposed Buffering Techniques: The building and majority of parking
has been oriented away from the east and north property lines to
mi nimi ze acti vi ty adj acent to exi sti ng or potenti al resi denti al areas. Only 16 employee parking stalls and a service area are
proposed east of the bui 1 di ng. Addi ti onal ly, a 10 foot wi de Type 1
landscape screen is proposed along the east property line and expands
to fi 11 i n the southeast corner of the si te. The propos~d 10 foot
setback along the south property line would be used for '208'
drainage.

Other Site Plan Considerations: Landscaping along Desmet Avenue and
within the parking areas would be installed as required by the Zoning
Code. Access to the site would be from Desmet Avenue as well as from
Pines Road through the existing retail center. Additional parking
area deveioped for this proposal would adjoin and connect to existing retail center and be available~to serve the entire complex.

Examiner Committee is general in nature. Detailed review to
determine compliance with all Code regulations and conditions of
approval is recommended to be administrative and to occur at the Building Permit stage,
III. SITE DEVELOPP~ENT RECOMMENDATIONS
Desi~n; The Industrial Park (I-1~ zone contains specific design standards
to mitigate the project's impacts on adjoining urban uses. The minimum
one acre lot soze allows an adequate area for buffering, landscaping and
parking. i~inimum 50 foot setbacks to all property lines, when coupled with dense 20 to 25 foot landscape screens, provide adequate buffers to
nearly any type of adjoi ni ng use. Standards for archi tectural treatment
such as building style, color and height, further serve as compatibility
measures. Screening of parking, finished product storage, refuse and
mechanicai equipment minimize the visual impacts of an industrial use.
The proposed Neighborhood Business (6-1~ zone, just like the I-1 zone, is intended to be wit~in urban settings. Tjerefore. it also contains
deveiopment standards to mitigate impacts on all adjoin~ng uses. Howeve r,
those standards are not as extensive as those found in the I-1 zone. The
proposed site plan generally demonstrates compliance with the B-1 zone.
Bufferin~/Landscapin~: The Zoning Code allows for administrative
deviation from landscape standards when those regulations put more than
15~ of the site into landscaping. Due to the site's minimal area, the required landscaping would consume nearly 26~ af t~e property. The excess
will be trimmed from along the south and east property lines. Given the
setback of Modern Electric's buildings along the south property line,
landscape buffering would serve no useful purpose. Along the east
property line, 10 feet of dense Type 1 landscaping will be provided ~
instead of the required 20 feet. With limited employee parking in this
area and ori entati on of acti vi ty away from the east property 1 i ne, the 10 foot buffer could adequately protect adjacent properti~s.

Si~na~e: The I-1 standards are very restrictive and, again, are intended
to protect adjacent uses. General ly, only a 12 sq. ft. detached si gn 6 ft.
tall and in a lawn area is allowed. An attached sign of 36 sq.ft. is also
~ permitted. Signage standards for the B-1 zone are less restrictive than
I-1 but still contain adequate controls to protect adequate uses.

IV. SEPA ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The review considered
the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions
of Approval, the Generaiized Comprehensive Plan, and other County
policies and guidelines. The Zoning Administrator has determined
that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Determination of
Non-Si~nificance ~"DNS"~.
The "DNS" was circulated to 9 other agencies of jurisdiction and other agencies/departments affected by the future developrnent for
review and comment. The "DNS" comment period ends MARCH 5, 1986 and
was adverti sed 15 cal endar days before sai d date i n the newspaper, by
letter to adjacent property owners wi~thin 400 feet of the proposal,
and by notice on a sign posted on the proposal site. The Hearing
Examiner Committee may consider additional environmental related
testimony and the "DNS"/"P~DNS" at the public hearing,
V. PLANNING SUMMARY
The proposed rezones to I-1 and B-1 are supported by both the Urban and
Major Commercial categories of the Comprehensive Plan. The development
would be functionaliy tied to the~existing retail center and t~e entire
complex would share common facilities such as access and parking.
Abundant landscaping, along road frontages and in the parlcing lot, will be added to a site that has only minimal treatments now. Proposed buffering ~
to the east and south, while not exactly as per Code standards, appears to
be adequate given the circumstances.

~ Justification for t~e requested Variances can be found in previous
approvals in the area, existing uses and structures on adjacent property
owned by Modern Electric and the need to use existing structures by continuing established buiiding lines. Additional pubiic testimony by the
applicant and others may provide more justification.
VI. CONDITIONS OF APPROVAL

Mro Kennedy aske3 that the Policy Commtttee be continued. He stated
that it should be checked whether or not the member of the Commission
has the capability of voting on an issue and who ~etermines whether a
